Abstract:
This thesis examines the process of approximating EC law that the Czech Republic has undertaken both under the Europe Agreement and in order to fulfill one of the conditions for membership in the European Union. The thesis aims to determine whether the transposition of EC legislation has been undertaken with a view to effective implementation of the acquis communautaire and to assess what implications this process will have for the Czech Republic. To this end, three areas of law which are subject to approximation are examined, namely competition law, environmental law and company law. Accordingly, Chapter I provides a general overview of the process of approximation and the challenges it poses for the Czech Republic. The process of approximation in the field of competition law is examined in Chapter II, followed by environmental law in Chapter III. The area of company law is addressed in Chapter IV. Finally, Chapter V concludes with an analysis of the findings of the previous chapters with a discussion of the implications of approximation for the legal order of the Czech Republic.

Abstract:
The thesis examines the expressions and origins of negative attitudes to gender equality in the Czech Republic, which have been noticeable especially in the process of implementation of the EU sex equality acquis. It asks whether and how they can be explained with reference to socio-legal developments that started during Czechoslovakia’s State Socialist past, but are still relevant today. In order to answer these research questions, the thesis examines how gender equality has been regulated through law and how it has been understood by law-makers, judges and legal scholars in Czechoslovakia and the Czech Republic during State Socialism (1948-1989) and Transition (1989-today). The thesis examines legal developments in gender-relevant areas, most importantly in antidiscrimination law. It also excavates the underlying, sometimes hidden, but crucial understandings of key concepts such as ‘women’, ‘gender’, ‘equality’, ‘discrimination’ and ‘rights’. The thesis argues that while formal legal guarantees for women have largely been satisfactory in the Czech Republic by international standards, the way these formal legal guarantees are understood, interpreted and applied has not been gender-progressive. It argues that the reasons for this are: (i) entrenched patriarchal ideas about women’s appropriate role both in private and public life; (ii) a failure to understand gender as a social construct and to recognize gender order as a pervasive social structure; (iii) an inadequate conceptualization of equality and a refusal to combat sex discrimination; and (iv) a limited understanding of the role of law and of rights in the shaping of social relations. It argues that these understandings have been considerably path-dependent on State Socialism, be it through a rejection of anything perceived as State Socialist (which has harmed redistributive policies), as well as through the mostly unconscious retention of ideas or their absence (which has led to a blindness to the cultural aspects of patriarchy).

The submission of manuscripts by Authors to Law Reviews is presently an inefficient process for both parties. The integration of technology allows for improvements to this process as can be seen in ExpressOTM and the Stanford Law Review's Electronic Submission System. The Automated Law Review Submission System (ALRSS) was developed to make the submission process even more efficient and effective than present systems allow. This is a software design thesis with emphasis on the System Requirements developed for the ALRSS. The method of developing System Requirements started with discussing the present process with Authors and Law Reviews and determining current needs of the users. Afterwards, a comparison among competitors was discussed to generate limitations of these systems and determine features to emulate for the development of ALRSS. Thirdly, a workflow model was created to examine internal issues of submission tracking and management within the Law Review to further automate the review process and make management of the process more effective. As a result, a more efficient and effective submission process is feasible for both the Author and Law Review by allowing processes to occur electronically from the Author submitting a manuscript to a Law Review Editor assigning or viewing a manuscript. In addition, with electronic tracking, time consuming communication regarding the submission status between the parties can be minimized. This submission system can be further customized for improved features or broader purposes in the future.

Abstract:
The Computer On-Line Police System (COPS) is a vehicle registration and ticket management system used at the Naval Postgraduate School (NPS) security Department, which was designed by the Naval Computer and Telecommunications Station, San Diego, in 1991. COPS is an inadequate information system (IS) possessing the following weaknesses: severely limited query capabilities, outdated system hardware, software design errors, fimetionality gaps, antiquated graphical user interfaces (GUI), and no computerized data archiving capability. This thesis will try to alleviate these deficiencies. Using the System Development Methodology (SDM), the authors hope to provide NPS, and potentially other Department of Defense (DoD) security forces, with a significantly improved vehicle registration database system. A baseline Assessment of COPS verified that a new IS was necessary. A new IS, called the Law Enforcement and Vehicle Registration Administration System (LEVRAS), was designed, programmed, and developed. The fully operational LEVRAS met all of the requirement specifications, and replaced COPS after a parallel conversion was conducted. Users were trained, and the NPS Security Department accepted the new database system for its daily operations. Fully supporting the LEVRAS lifecycle, maintenance will be performed by the NPS Management Information System (MIS) Department.

Abstract:
This thesis examines the Indian system of personal laws (‘the PLS’), under which the state applies a version of religious doctrine to the family matters of citizens whom it identifies as belonging to different religious groups. There has been a lengthy and persistent debate over the PLS, particularly in relation to its discriminatory effects upon women. However, another problem with the PLS has been little commented-upon. Supporters of the PLS emphasise its positive impact on religious freedom to such an extent that there is a pervasive assumption that the PLS is, indeed, good for religious freedom. But there has been surprisingly little critical assessment of the truth of this claim in either academic or political debates. This thesis, a work of applied normative legal theory, attempts to fill this important gap in the literature on the PLS. The thesis addresses the question of how the PLS affects one conception of religious freedom, namely religious autonomy. Its principal findings are that the PLS interferes with the religious autonomy of those subject to it by affecting their religious options (by interfering with their freedom from religion and their freedom to practice religion) and by harming their self-respect (by discriminating on the grounds of sex and religion, and by misrecognising their religious identities). Furthermore, the thesis finds that the PLS cannot be defended in the name of religious autonomy based on the possibility of exit from the system, the advantage of having the ‘option of personal law’, the power it gives people to bind their future selves, the expressive potential of the personal laws, the contribution it makes to membership in a religious community, the contribution it makes to religious group autonomy, or the recognition or validation it provides for religious identities. These conclusions imply that concerns relating to religious autonomy constitute an important set of objections to the PLS. The thesis then considers several reform proposals, including certain modifications of the PLS, a move towards a millet system, ‘internal’ reform of individual personal laws and the introduction of a Uniform Civil Code. It particularly focusses on one reform possibility – religious alternative dispute resolution – which has not been considered closely in the Indian context.

Abstract:
Constitutional approaches have been frequently employed in recent international legal literature. This unavoidably triggers the question of the quality of international law as a constitutionalized legal system. This thesis attempts to answer such a question by determining the necessary and sufficient conditions for a constitutionalized international legal system and whether or not, at present, such minimum requirements have been fulfilled. The main difficulty in the articulation of these conditions is the semantic problem regarding the contours and content of constitutionalism caused by the transfer of this highly contested concept to the international context. In order to understand the destination context, a cosmopolitan paradigm will be consulted to provide explanations for the state-centred character of international law as part of the world’s multi-level governance. The thesis argues that the conditions for a constitutionalized international legal system must be articulated based on the viability of the proposed legal structure and its capacity to fulfil the underlying aims of international constitutionalism. The viability criterion demands compatibility with the pluralist structure of international society. The capacity criterion requires that the proposed legal structure can fulfil the underlying aim of international constitutionalism, which is, due to its complementary relationship with domestic constitutional sites, to create international self-governance with a limited mandate for peace and fundamental human rights. Thus, it is proposed that, in order to qualify as a constitutional legal system, international law must first be sufficiently equipped with secondary rules which will provide efficacy for international law to exist as a legal system. Secondly, there must also exist a hierarchy conferring a constitutional status on certain international primary rules protecting peace and fundamental human rights. Finally, international constitutionalization requires the institutionalization of international constituted power. The examination of whether or not each condition has been met in the current international legal structure is undertaken in order to determine the constitutional quality of international law, paying particular attention to the role of jus cogens rules and the United Nations in the process of international constitutionalization. It is argued that with the existence of the three elements, international law has already been constitutionalized to a large extent. However, there remain some deficiencies especially with regard to the legitimacy of the exercise of power on matters of peace and security by the Security Council, which require further constitutionalization.

Abstract:
In this study I try to explain the characteristics of the legal system, as it is understood in the framework of the Communicational Theory of Law (TCD). The legal system constitutes a textual totality that reflects another textual totality: the legal order. It is not a positivist reflex, by virtue of which the system would be a mere description of the order, but of a hermeneutic reflex, which supposes that the system constructs the order, and presents its better and more finished version, a more intelligent version. The relationship between order and system is not unidirectional, but between them there is a hermeneutic spiral relationship sustained over time, since they are textual totalities in perpetual change. The ordering / system duality represents the basic axis within a juridical realm, a reality that encompasses all the communicational processes and the texts produced by them: first, the communicational processes generated by the ordination and the ordinary texts; second, the communication processes of legal dogmatic, which generates the various proposals of the exhibition system; third, from the conjunction of dogmatic texts and from the jurisprudence of the courts arise the systemic texts or texts of the legal system; fourth, the communicational processes and the texts that are generated within the scope that, however, do not belong to the order or the system; and fifth, the acts (and omissions) whose legal meaning can only be understood from the frame of reference constituted by the hermeneutic axis of order / system. In all this analysis, it is necessary to differentiate - as has been pointed out - between the didactic-expository system and the legal system itself (or legal system in the strict sense). In order to carry out the proposed task, before entering into the distinction between legal order and legal system, it is convenient to deal with the differentiation between set and order.
En este estudio me propongo explicar los caracteres del sistema jurídico, tal como es entendido en el marco de la Teoría Comunicacional del Derecho (en adelante: TCD). El sistema jurídico constituye una totalidad textual que refleja otra totalidad textual: el ordenamiento jurídico. No se trata de un reflejo positivista, en virtud del cual el sistema sería una mera descripción del ordenamiento, sino de un reflejo hermenéutico, lo que supone que el sistema construye el ordenamiento, y presenta de él su versión mejor y más acabada, su versión más inteligente. La relación entre ordenamiento y sistema no es unidireccional, sino que entre ellos se produce una relación en espiral hermenéutica sostenida a lo largo del tiempo, ya que son totalidades textuales en perpetuo cambio. La dualidad ordenamiento/sistema representa el eje básico dentro de un ámbito jurídico, realidad ésta que engloba todos los procesos comunicacionales y los textos producidos por ellos: primero, los procesos comunicacionales que genera el ordenamiento y los textos ordinamentales; segundo, los procesos de comunicación de la dogmática jurídica, generadora de las diversas propuestas de sistema expositivo; tercero, de la conjunción de los textos dogmáticos y los de la jurisprudencia de los tribunales surgen los textos sistémicos o textos del sistema jurídico; cuarto, los procesos comunicacionales y los textos que se generan dentro del ámbito que, sin embargo, no pertenecen al ordenamiento ni al sistema; y quinto, los actos (y omisiones) cuyo significado jurídico sólo es comprensible desde el marco de referencia constituido por el eje hermenéutico ordenamiento / sistema. En todo este análisis, es preciso diferenciar -como ha quedado apuntado- entre el sistema didáctico-expositivo y el sistema jurídico propiamente dicho (o sistema jurídico en sentido estricto). Para llevar a cabo la tarea propuesta, antes de entrar en la distinción entre ordenamiento jurídico y sistema jurídico, es conveniente tratar de la diferenciación entre conjunto y orden.

Abstract:
This research attempts to measure the relationship between time and region on appeals with both criminal and civil cases in Nigeria during the period 1956 to 1965. The four regions studied include Lagos, Midwest, East and West by A.B. Kasunmu. Methodologically, this study employed the Univariate Box Jenkins Model, better known as the Auto-Regressive Integrated Moving Average, which is primarily a Univariate Time Series Analysis and the Analysis of Variance, which is the final statistical analysis used in this study. The major findings of this study were that: (a) the number of civil appeals permitted during the military regimes was significantly lower than those permitted during the civilian regimes; (b) the number of criminal appeals permitted during the military regimes was significantly lower than those permitted during the civilian regimes; (c) there were significant regional differences in the number of civil appeals permitted by the Supreme Court during the civilian and military regimes; and (d) there were significant regional differences in the number of criminal appeals permitted by the Supreme Court during the civilian and military regimes.

Abstract:
The purpose of this thesis is to examine the educational disadvantage currently being suffered by Roma children in the Czech Republic, Hungary, Romania and Slovakia, and to identify the most appropriate human rights mechanism with which to remedy the situation. Education is vitally important for oppressed minorities such as the Roma since, without it, individuals will be unable to fully access the complete range of their fundamental rights and so will be unable to challenge the disadvantage and discrimination that they suffer. This thesis first submits, therefore, that the traditional liberal democratic model of governance as featured in contemporary Europe is insufficient to adequately address the needs of minorities. To address this insufficiency, states must recognise a version of multiculturalism that both embraces critical pluralism and is compatible with liberal theory. Secondly, this thesis suggests that the individualistic focus of rights protection should be enhanced through an increased recognition of children’s rights so that the individual child is firmly entrenched as an autonomous rights holder. The type of education system that would exist in such a rights environment should serve to develop the autonomy and competence of individual children but also to facilitate their security within their own culture. This type of multicultural education can only be achieved if the various international instruments concerning the right to education can be required to place a more onerous burden on states parties when it comes to minority accommodation. At a domestic level, this thesis suggests that the most appropriate means by which to accommodate the Roma within the national education systems of the four countries would be through a culturally sensitive mainstreaming approach adapted from that used in England.

The thesis defines consumer protection law in the Czech Republic and compares it with italian law. The subject of this comparison is the substance of the law clauses but also the overall level of legal protection, consistency, system and comprehensibility of the laws and quality of european directives implementation. The thesis is divided into chapters - definitions, information, advertising, consumer contracts, safety and quality of products and consumer associations. In the conclusion some potential changes that could be made to czech system, based on good experience in Italy, are suggested.

El presente artículo intenta abordar la problemática, desde el punto de vista del derecho laboral, que se presenta en torno a la interpretación de normas laborales partiendo de un análisis de fuentes, ya sea tanto fuente interna como internacional. Con lo cual, el autor aboga por mantener la esencia del principio protector del derecho laboral lo cual llevará a conjugar normas de las diferentes fuentes para proteger tanto al trabajador como a la estructura institucional y legal del derecho interno de cada país.

ENGLISH ABSTRACT: This dissertation considers the question whether there are viable alternatives to the conceptual framework within which the South African administrative-law system operates, given that the administration now functions under new constitutional demands and new approaches to administrative engagement. The intention is not to proffer concrete recommendations for such a system, but only to propose an approach by means of which questions concerning the legal regulation of the administration and administrative function may be addressed. The dissertation introduces the concept of the contextualised administrative-law system. This concept emphasises the legal relationship between the public administration and the judiciary, but is not limited to this relationship. The administrative-law system does not operate in a vacuum, though, and is informed by the conceptual framework within which the system operates. The system is also a function of its geo-political and socio-economic context. The historical development of the doctrine of separation of powers, as one aspect of the conceptual framework, is traced. Thereby the normative, dynamic and flexible nature of the doctrine is established. On this basis, the potential and value of a fourth branch, the administration, within the separation-of-powers doctrine is assessed. By implication, the administrative function would constitute a fourth, distinct function in addition to the legislative, executive and judicial functions. The concept of the administrative-law system is consequently applied to the South African context. Firstly, the development of the South African system is outlined and, secondly, the administrative-law relationship is analysed. This discussion establishes that the system is characterised by an embryonic administrative law, the equating of administrative law and judicial review, an emphasis on the rule-of-law or “red-light” approach to administrative regulation, a rhetoric of deference, and the supremacy of the Constitution of the Republic of South Africa, 1996. Therefore, the system must be informed by the Constitution and, arguably, by Karl Klare’s project of transformative constitutionalism and Etienne Mureinik’s “culture of justification”. The content of the separation of powers is also investigated by means of an historical analysis of the considerations that rationalise the existence of an independent administrative jurisdiction in France. This entails an exposition of the Conseil d’État’s structure, organisation and dual function. Principles that describe the French system, other than the pure separation of powers, are discussed, namely, the duality of jurisdiction, the separation of administrative and judicial authorities, the separation of the administrative jurisdiction and active administration, the maxim “to judge the administration is still administering”, and the hybrid nature of administrative litigation. The legal regulation of public contracts can be regarded as a doctrinal perspective of the administrative-law system. The public contract is discussed as one form of administration, due to its conceptual ambiguity as a legal instrument on the boundary between public and private law and due to the administration’s increasing contractual activity. To an extent the contrat administratif of French law indicates that particular legal rules are an extension of the broader principles, considerations and institutional structures discussed in the preceding sections. This dissertation introduces an approach that emphasises the relationship between the administration and the judiciary as well as the conceptual framework within which the administrative-law system operates. Through the application of this approach to the South African context and to public contracting the key concepts and debates underlying an appropriate administrative-law system in South Africa are identified and investigated. This constitutes a platform for the development of a particular administrative-law system and an exposition of viable alternatives to the conceptual framework within which the system operates.
AFRIKAANSE OPSOMMING: Hierdie proefskrif ondersoek die vraag of daar lewensvatbare alternatiewe tot die konseptuele raamwerk van die huidige Suid-Afrikaanse administratiefreg-stelsel moontlik is. Dié vraag word gestel teen die agtergrond van die nuwe grondwetlike vereistes en benaderings waaraan administratiewe interaksie moet voldoen. Die bedoeling is nie om aanbevelings vir die bestaande stelsel te maak nie, maar eerder om ‘n benadering voor te stel waarin vrae oor die regulering van die administrasie en die administratiewe funksie geakkommodeer kan word. In die proses skep die proefskrif ‘n nuwe konsep: die administratiefreg-stelsel in konteks, wat die regsverhouding tussen die administrasie en die regbank beklemtoon, terwyl dit nie beperk is tot die verhouding nie. Uiteraard word die administratiefregstelsel beïnvloed deur die konseptuele raamwerk waarin dit funksioneer, terwyl dit verder ook ‘n funksie is van sy geopolitiese en sosio-ekonomiese konteks. Die historiese ontwikkeling van die skeiding van magte, een aspek van die konseptuele raamwerk, word bespreek en daardeur word die normatiewe, dinamiese en buigsame aard van die leerstuk bevestig. Hiermee word die potensiaal en waarde van ‘n vierde been, naamlik die administrasie, binne die skeiding-van-magte leerstuk oorweeg, met die implikasie dat die administratiewe funksie ‘n onafhanklike, vierde funksie vestig, benewens die wetgewende, uitvoerende en regsprekende funksies. Die konsep van die administratiefreg-stelsel word gevolglik toegepas op die Suid- Afrikaanse konteks. Eerstens word die ontwikkeling van die Suid-Afrikaanse stelsel uiteengesit en dan tweedens word die administratiefreg-verhouding ontleed. Hierdie bespreking bevestig dat die stelsel gekenmerk word deur ‘n onderontwikkelde administratiefreg, die gelykstelling van die administratiefreg en geregtelike hersiening, die beklemtoning van die regstaat en ‘n sogenaamde rooilig-benadering tot administratiewe regulasie, ‘n retoriek van geregtike agting, en die oppergesag van die Grondwet van die Republiek van Suid-Afrika, 1996. Juis as gevolg hiervan moet die stelsel op die Grondwet gegrond word. Daar word ook geargumenteer dat Karl Klare se transformerende konstitusionalisme sowel as Etienne Mureinik se kultuur van regverdiging die stelsel vorm behoort te gee. Die skeiding van magte se inhoud word ook aan ‘n historiese ontleding van Franse reg onderwerp om sodoende die rasionaal agter die onafhanklike administratiewe jurisdiksie in Frankryk te verduidelik. Dit behels ‘n uiteensetting van die Conseil d’État se struktuur, interne organisering en tweeledige funksie. Die beginsels wat die Franse stelsel beskryf, bo-en-behalwe die suiwer skeiding van magte, word bespreek en dit is by name die dualiteit van jurisdiksie, die skeiding van administratiewe en regsprekende owerhede, die skeiding van die administratiewe jurisdiksie en aktiewe administrasie, die leuse wanneer die administrasie beoordeel word, word daar steeds administreer, en die gemengde aard van administratiewe regsgedinge. Die openbare kontrak word bespreek as ‘n instrument van administrasie gegewe die konseptuele dubbelsinnigheid van daardie regskonsep, wat op die grens tussen publiek- en privaatreg lê, en as gevolg van die administrasie se toenemende kontraktuele aktiwiteit. In ‘n mate dui die Franse contrat administratif daarop dat bepaalde regsreëls ‘n uitbreiding van die breër beginsels, oorwegings en institusionele strukture is, soos in die voorafgaande afdelings bespreek word. Dus stel hierdie proefskrif ‘n benadering voor wat die verhouding tussen die administrasie en die regbank, sowel as die konseptuele raamwerk waarbinne die administratiefreg-stelsel funksioneer, beklemtoon. Deur hierdie benadering toe te pas op die Suid-Afrikaanse konteks, en op openbare kontraktering, word die konsepte en debatte geïdentifiseer en ondersoek wat ‘n gepaste administratiefreg-stelsel onderskryf. Dit vorm ‘n basis vir die ontwikkeling van ‘n bepaalde administratiefregstelsel en die uiteensetting van lewensvatbare alternatiewe tot die konseptuele raamwerk waarbinne die stelsel funksioneer.

Member Countries of the Andean Community (ANCOM) have established a supranational legal regime applicable to intra and extra-subregional air transport activities: the Andean Subregional Air Transport Integration system. This regime was established by Decisions 297 and 320 and was based on the Colombia-Venezuela Bilateral Air Transport Agreement. It revolutionizes the status quo regarding air transport. The new regime adopts the principles of multiple designation of air carriers, free determination of frequencies and capacities for scheduled air services performed with the Subregion, and complete liberalization for non-scheduled air services. It creates an "Andean subregional market" and promotes the establishment of a "common" position for negotiating intra and extra-regional fifth freedom.
Member Countries have been unresponsive in updating their bilateral agreements vis-a-vis the regime set by Decisions 297 and 320. This situation makes the application and healthy development of the Andean Subregional Air Transport Integration process difficult.
In order to avoid these difficulties, Member Countries shall apply the supranational principles contained in Decisions 297 and 320 and update their bilateral agreements. (Abstract shortened by UMI.)

"The enjoyment of all human rights by all persons is the ultimate horizon of democracy. It is generally admitted that democratic societies are less likely to violate human rights. The good human rights records of these societies can be justified, among others, by the promotion of a strong legal culture, which provides procedural avenues for allocating responsibility for human rights violations. Thus, the protection of human rights follows from the functions of law in society, and the nature of human rights claims. At the national level, human rights are protected by both domestic and international mechanisms. Therefore, the human rights claims should be based on violations of either domestic law or relevant provisions of operational international human rights instruments. However, most of the time this is not the case, especially in Africa. Many African states have ratified several international human rights instruments, but the record of the way the latter are applied in their respective judicial systems remains very poor. This study aims to analyse the case of Burundi, one of these state whose judicial system only rarely applies international human rights instruments in spite of the importance devoted to them by the Constitution. It must be understood that international human rights as a source of law will be referred to, in this study, both as a source of rights and as a source of interpretation of domestic human righs instruments such as the Bill of Rights. ... Chapter one will set out the content of the research, identify the problem and outline the methodology. Chapter two will focus on the status of international law in domestic legal systems. This master's thesis analyzes the possibilities of implementation of Toyota Production System within Japanese subsidiaries in Czech Republic. It explores the fit between the cultural values of Czech and Japanese management and the values incorporated in the Toyota Production System. In order to conduct the study, 79 companies were contacted, and survey responses from a total of 108 Czech and Japanese employees were collected. Data from the survey show that both Czech and Japanese employees have similar values related to work and neither job satisfaction nor number of conflicts is connected with TPS training. In the conclusion, areas for further research and more detailed elaboration are identified and presented.

Islamic banking is an investment and financing system which expands globally. The Islamic banks have only been established for some 30 years but the banking system is based on long-going traditions within Islamic finance. The system is founded on ethical values and emphasises the well-being of society as a whole.

Islamic banking is different from conventional banking in most aspects, since its close tie to religion is very important. The system is not based on interest, as it is prohibited in Islam. Instead Islamic banks offer various kinds of accounts and a range of financing alternatives all complying with the Islamic Law – Shari’a. To work according to Shari’a is crucial for the banks and their activities are controlled by a special Religious Supervisory Board working within the bank.

The implementation of the Islamic banking system varies to some extent between Islamic countries. It has been influenced by its connections to politics of and the history in the countries where the system operates. As a result to the variations between the states’ implementation, the need for harmonisation increases as the expansion of Islamic banks continues. Several organisations work to achieve international standardisation and harmony to make the banking activities more transparent and attractive. The achievement of harmonisation as well as the performance of the banks is crucial for the future of Islamic banking.

The dissertation is based on extensive literature review and a personal interview with a professional within an Islamic bank in Lebanon.

Accounting change occurred in the Czech Republic as a result of the political revolution in 1989 which heralded the resurrection of democracy and the re-establishment of a market economy. The Czech Republic is gradually rebuilding the framework within which companies are able to compete efficiently. These events present an ideal opportunity to examine the process of development of an accounting system using theories of international accounting. The aim of this study is threefold: (1) to assess whether international accounting literature is able to predict the accounting system of the Czech Republic using theories of environmental influence, (2) to operationalise Gray's (1988) theory of cultural influence in the development of the Czech Republic's accounting system, and (3) to critically review the present accounting system in the Czech Republic in order to establish if the accounting system has developed independently of the environment in which it exists. The research design combines qualitative (interviews) and quantitative (questionnaire survey) methodologies within a case study of the current financial accounting system in the Czech Republic. The findings indicate that theories of cultural and environmental influence are capable of predicting the broad structures of the Czech Republic's financial accounting system based on an historical knowledge of the country's political economy. Further, the surveyed position of the Czech Republic on Hofstede's (1980) four dimensional model of cultural values and the transposition of these into accounting values (Gray, 1988) have supported the theory of cultural influence.

Insolvency law is a progressive and dynamic legal discipline closely interrelated with economics and business. A quality legal framework of insolvency is indispensable for modern market economies: it helps to identify companies or individuals in financial distress and to restructure their debts, or liquidate their assets in an efficient and transparent way. The main purpose of the insolvency law is to provide creditors and debtors with a ground for negotiations and to help them reach qualified decisions based on the available information. In the Czech Republic, the insolvency law had long been criticized for its insufficient protection of creditors and for the loopholes that made extensive property frauds possible without having the wrongdoers punished. The current Czech Insolvency Act which took effect in 2008 was broadly inspired by the U.S. Bankruptcy Code Chapter 11 and eliminated most of the weaknesses of the earlier law. This thesis shows that valuable inspiration can be found not only in texts of statutes but also in the real life. On the example of reorganizations of Kordárna and GM described here, main principles of insolvency law are being discussed.

In order to receive full compensation for damage caused during air transportation, plaintiffs try to get around the liability limitations of the Warsaw regime, inter alia, by alleging willful misconduct on the part of the carrier or its agents and servants under Article 25 of the Warsaw and Hague Conventions. On their part, carriers have an interest in limiting their potential liability under the said regime, and in avoiding any possibility of breaking the stipulated monetary limitation. Consequently, the said provisions are litigated frequently without, however, bringing uniform results in different jurisdictions of the world.
This thesis makes a study of the application and interpretation of the willful misconduct exception (Article 25) of the original Warsaw Convention as well as its subsequent amendments. The study reviews the treatment accorded to the relevant provisions in different common and civil law jurisdictions. Further, the problem is examined from the point of view of Muhammadan Islamic jurisprudence. This paper also traces the legislative history of the relevant provisions of the original treaty and its subsequent amendments.
The final chapter of the thesis assesses the possibility of a "new" consolidated regime for international air carriage and concludes that at present Montreal Protocols Nos. 3 and 4 may be allowed to work.

In this thesis different control methods are applied to the beam and ball system. Test setup for the previous thesis is handled, circuit assemblies and hardware redesigned. As the system is controlled by the control law partitioning method by a computer, discrete time system model is created. The controllability and the observability of the system are analyzed and a nonlinear controller by using control law partitioning in other words computed torque is designed. State feedback control algorithm previously designed is repeated. In case of calculating the non measurable state variables two different reduced order observers are designed for these two different controllers, one for control law partitioning controller and the other for state-feedback controller. Two controller methods designed for the thesis study are tested in the computer environment using modeling and simulation tools (Also a different controller by using sliding mode controller is designed and tested in the computer environment using simulation tools). A controller software program is written for the designed controller algorithms and this software is tested on the test setup. It is observed that the system is stable when we apply either of the control algorithms.

Organizing article data and information as well as streamlining communications are the most important goals of any submission system. The submission process used by law professors and law review journals severely fails to meet those goals. The Automated Law Review Submission System (ALRSS) has been developed in order to meet those goals. Many potential ALRSS users were interviewed and a rigorous set of requirements was developed. ALRSS successfully provides an easily accessible, central document and information repository, and also would nearly eliminate the use of phone, fax, mail or personal email. Furthermore, the system enables editors of law reviews l;o control the workflow of the review process. With further development, ALRSS will compete commercially with ExpressOTM in the law article community and strive to operate as effectively as MonsterTrakTM and LSDASTM do in their respective communities. The long term goal of ALRSS is to function as a general submission system that can be customized for a specific submission processes.

The judicial system in what is now the European Union has been subject to only a few structural changes since the Court of Justice assumed jurisdiction over the European Economic Community and the European Atomic Energy Community. In a more significant development, the Court of Justice has shaped its own role and its relationship with the courts of the Member States. Today, the functioning of the resultant system is put at risk by an increasing case-load and duration of proceedings, but also by the impact of certain developments in the Community legal order and the intended enlargement of the European Union. Various mechanisms of reform, including those now framed by the Treaty of Nice, may remedy individual problems. But only the re-organisation of the courts according to their different essential tasks will lead to a principled structure for the future.

The liability regime of the air carrier is regulated by the Warsaw Convention of 1929. The latter establishes a certain uniform set of regulations in the field of international carriage by air. This universally accepted Convention was gradually amended and supplemented by later instruments in order to adjust and adapt this uniform set of rules to the changing and rapid growth of the aviation industry.
Thailand, however, is one of the few countries who have not yet become a party to this beneficial system. This results in conflicts of laws and jurisdictions.
The purpose of this dissertation is to explain and analyze the necessity and significance of Thailand's adherence to the Warsaw System, and to propose a strategy for Thailand to become a party to this system.

The thesis provides an analysis of multilateral trade lawmaking in the GATT and the WTO from the late 1940s to the current Doha Round negotiations. It investigates the discourses, practices, techniques, and legal concepts that have come to define what it means to make trade law. These elements are essential to multilateral trade lawmaking insofar as they provide trade negotiators with a way to frame their arguments and to go about negotiating, and with the tools to construct trade policy disciplines and to record them in legal form. On the other hand, they are also limiting, in that they endorse certain ways of going about trade lawmaking as normal, and delimit what negotiators and their audiences perceive as reasonable, legitimate, and realistic arguments in the lawmaking process. The aim of the thesis is to destabilise these elements of trade lawmaking by revealing their contingent and often contested origins, and by showing how they foreclose alternative conceptions of the objectives, means, and possibilities of trade lawmaking. While the dissertation does not provide a full-fledged normative critique of the elements of lawmaking, it attempts to elucidate the discursive, practical, technical, and legal underpinnings of trade lawmaking that any such reform effort will, of necessity, confront.

Abstract:
The public works included in this submission span a number of years. The publications themselves track the journey from the more traditional command and control type of regulation towards a more innovative market based system, note the developments with some success, but also identify the perceived failures and mark the changes along the way. This is a particularly fast moving area of law and regulation and the jury is still out on how successful any new regulatory system will be. Will it develop further to include more sectors or will the vagaries of the 'market' prove too difficult to provide the policy objective of protecting the atmosphere from anthropocentric activities? The main question is 'how has the international community addressed the issue of anthropogenic pollution of the atmosphere through international legal instruments?', and more specifically, the objective is to provide an understanding and critique of the development of regulatory practice and the influence of economic theory on the design of new regulatory legal instruments. The specific contribution to knowledge of each publication was confirmed by the editors and referees of the articles at the time of publication, although over time this becomes accepted wisdom. The commissioned chapters, monographs and articles demonstrate standing within the European academic community specialising in the energy and environmental field. The overall contribution of this collection is an ongoing critique of the development of this specialised area of law. The group of publications submitted form part of a theme which mainly considers the more flexible mechanisms, which could be considered a rather narrow approach. However, within the context statement as a whole I have tried to place the publications in a broader framework and in my conclusions have moved the discussion on further.

Abstract:
This paper deals with the legal situation surrounding the legal statutory portion. The purpose of this paper is to investigate the statutory portions function in our society, does the rule fit into today’s society? To carry out this study, the authors analyzed the legal situation accordingly to the legal dogmatic method. Emphasis has been placed especially on laws but also non-government bills and doctrine.The statutory portion was introduced in the Swedish system, as early as in the 17th century. Its primary purpose then was to ensure a heritage to the descendants’ heirs. At this time most people died at a young age and their children were often young and incapable of supporting themselves. Today, it is more unusual to leave minor children, and it its more common to die of old age with already adult chil-dren. The statutory portion, which has as a purpose to ensure that parts of the de-scendants inheritance shall rightly fall to its heirs, is found today in 7 chapter 1§ ÄB .In recent years, a large number of non-government bills and government bills has been presented with proposals for the abolition of the statutory portion. Different writers express their view on the statutory portion as outdated and that the system does not fit into our society. Those who find the statutory portion outdated also express the meaning that statutory portion stands in conflict against both property law and the descendants last will.The authors consider the need for an investigation on the matter to determine whether the legal portion is outdated and no longer fulfills its purpose, or if it still is adapted to our modern society.
Denna uppsats behandlar den rättsliga situationen kring laglottsskyddet. Syftet med uppsatsen är att utreda laglottens funktion i dagens samhälle, är regeln anpas-sad efter dagens rättsliga behov? För att genomföra denna undersökning har för-fattarna analyserat det rättsliga läget i enlighet med den rättsdogmatiska metoden. Tyngd har lagts särskilt på lagtext men även motioner och doktrin har spelat en viktig roll.Laglotten infördes i det svenska systemet redan på 1800-talet. Dess främsta syfte var då att säkerställa ett efterarv för den avlidnes bröstarvingar. På den här tiden dog de flesta i ung ålder och de barn som efterlämnades var ofta unga och oför-mögna att själva försörja sig. Idag är det mer ovanligt att den som avlider efter-lämnar omyndiga barn, oftast dör vi idag i en hög ålder och våra barn är då själva redan vuxna. Laglottsskyddet, vilkets innebörd är att viss del av en avlidens arv skall tillfalla dess bröstarvingar, hittas idag i 7 kap 1§ ÄB.Under de senare åren har ett stort antal motioner och propositioner lagts fram med förslag om ett avskaffande av laglotten. Olika skribenter utrycker en åsikt om att laglotten är föråldrad och att systemet inte passar in i vårt samhälle. Det menas också att laglotten strider emot både egendomsrätten och den avlidnes sista vilja.Författarna anser att det behövs en utredning på området, för att fastställa huruvida laglotten är föråldrad och ej längre uppfyller sitt syfte, eller om den än idag är anpassad till vårt samhälle. Efter en utredning finner författarna att en re-form av laglotten kan finnas nödvändig.

This thesis examines the principles of tariff classification in Canadian customs law. Tariff appeals prior to implementation of the Harmonized System in January 1988 are analyzed. The General Rules for Interpretation of the Harmonized System are then discussed. The thesis throughout is that interpretation should not be limited to physical characteristics such as material composition. The naming of goods requires a contextual approach to interpretation which also takes into account their use in application.

In recent decades, the nature of international commercial arbitration has been transformed from a method of dispute resolution to an autonomous legal system. Globalization and a shift of power from states to private actors have resulted in the emergence of an international arbitration community that eventually produced this kind of transition. This movement has generated a dynamic discussion over the legality and systematicity of the arbitral legal system. By applying various legal theories, scholars of different legal systems have analyzed the legality of the arbitral legal system. A few scholars have advocated the concept of this system based on a transnational legal positivism theory. In contrast, others, because of a lack of essential qualities of law and structural deficiencies in international arbitration, refuse to recognize it as an autonomous legal system. The main objective of the present work is to study the major legal theories about the legality and systematicity of international commercial arbitration, and then to take an overview of the adverse and advantageous consequences of applying the concept of the arbitral legal system.
Au cours des dernières décennies, l'arbitrage commercial international a subi de grandes transformations : longtemps utilisé comme simple méthode de résolution des différends internationaux, il est en voie de devenir un système de droit autonome. Avec la globalisation des échanges et des activités humaines et la décentralisation du pouvoir des États vers des acteurs privés, une nouvelle catégorie d'arbitres internationaux a fait son apparition, de nouveaux arbitres qui deviennent à leur tour des agents de changement. La pluralité de leurs opinions a poussé ces nouveaux acteurs à se questionner sur la viabilité à long terme de la mise en place d'un nouvel ordre juridique arbitral. Diverses théories juridiques mises de l'avant par des experts issus de différents domaines du droit ont permis d'en étudier la légalité et la systématicité. Ce nouvel ordre juridique a ses défenseurs et ses détracteurs. Certains le défendent en invoquant la théorie positiviste du droit basée sur les règles de droit transnationales. D'autres refusent de le considérer comme un système autonome parce certaines règles de droit essentielles n'y sont pas définies et qu'il existe des lacunes structurelles flagrantes en arbitrage international. Ce sont là quelques-unes des grandes questions qui seront débattues dans le présent ouvrage. L'auteur y fera d'abord l'analyse des principaux courants théoriques traitant de la légitimité et de la systématicité de l'arbitrage commercial international et de la mise en place d'un régime juridique dans ce domaine, pour se concentrer ensuite sur les avantages et les désavantages que sa reconnaissance en tant que système de droit autonome pourrait représenter.
