Abstract:
O presente artigo analisa quais as consequências advindas da sentença condenatória internacional proferida em desfavor do Brasil pela Corte Interamericana de Direitos Humanos no caso Damião Ximenes Lopes tais como, condenação pecuniária, elaboração de estrutura de apoio para pessoas com adoecimento mental e capacitação dos profissionais da área da saúde mental. O primeiro capítulo traz uma análise dos Direitos Humanos no pós II Guerra Mundial e trata do sistema interamericano de Direitos Humanos, dando ênfase ao Pacto de San José da Costa Rica (1969). O segundo capítulo versa sobre a posição adotada pelo Brasil enquanto signatário da Corte Interamericana de Direitos Humanos. O terceiro capítulo trata das particularidades do caso Damião Ximenes Lopes versus Brasil na Corte Interamericana de Direitos Humanos. Finalmente, o último capítulo discorre sobre as consequências advindas da condenação do Estado brasileiro no caso Damião Ximenes Lopes. Assim, o presente artigo objetiva descrever o papel da Corte Interamericana de Direitos Humanos na proteção dos Direitos Humanos, bem como apontar seu funcionamento, especificar as características do caso Damião Ximenes Lopes, descrevendo e analisando quais as consequências advindas da condenação do Brasil, nesse caso, no que diz respeito ao enfrentamento das questões relativas aos doentes mentais. Assim, por meio do método dialético e de revisão bibliográfica, o artigo busca responder ao seguinte questionamento: Quais os efeitos advindos da condenação do Brasil na Corte Interamericana de Direitos Humanos por violação a vários direitos do Pacto de San José da Costa Rica no caso Damião Ximenes Lopes?

Abstract:
O doce de Cosme e Damião é distribuído entre o dia 27 de setembro (Dia de Cosme e Damião) e 12 de outubro (dia das crianças). Cosme e Damião foram nas religiões afro-brasileiras sincretizados com os erês (espíritos de crianças). Esses doces são ofertados como promessas, no catolicismo popular, ou foram oferenda aos Orixás (entidades dos cultos afro). Nosso trabalho discute, a partir do conceito de fato social total e de magia de Marcel Mauss, a prática de dar o doce e suas origens e a atitude dos evangélicos, principalmente pentecostais, de recusá-lo, como também, a re-configuração dessa prática que faz a Igreja Universal do Reino de Deus ao distribuir doces consagrados, temendo que as crianças fiquem endemoninhadas ao comer os doces oferecidos nessa época.

Abstract:
Pedro Damião (1007-1072) normalmente é descrito no interior da história da filosofia como uma espécie de inimigo da dialética, o exemplo mais acabado do anti-intelectual medieval. Boa parte de sua fama é resultado de um excerto de sua obra De divina omnipotentia em que ele parece defender que Deus poderia ferir o princípio de não-contradição. Com este trabalho, pretendemos mostrar que Damião não ataca a validade do princípio de não-contradição, assim como não chega a elaborar uma crítica geral aos princípios dialéticos, mas também não parece um entusiasta da mesma, sobretudo em questões de fé. De modo que ainda que não seja justo caracterizá-lo como um ferrenho anti-intelectual, é preciso considerar seu pouco entusiasmo em relação à aplicação da dialética em teologia.

Para este trabalho ser cumprido utilizei o romance de Josué Montello, Os Tambores de São Luís, como base fundamental. Levando em consideração o apreço do escritor por São Luís, trouxe o personagem Damião para cá, com a expectativa de representar seus sentimentos, experiências e memórias, como forma de representação simbólicas da categoria acima citada. Este trabalho só pode ser realizado muito em função dos teóricos da Geografia Humanista, que deram uma luz nas interpretações de categorias geográficas.Palavras-chave: Paisagem; Literatura; Geografia Humanista; Josué Montello.ABSTRACTThe following article aims to investigate the Landscape category, more especially bringing to the fore the relations between Art and Science, that is, Literature and Geography. For this work to be fulfilled I used the novel by Josué Montello, Os Tambores de São Luís, as a fundamental basis. Taking into account the writer's appreciation for São Luís, he brought the character Damião here with the expectation of representing his feelings, experiences and memories, as a symbolic representation of the category mentioned above. É necessário analisar o percurso de Damião de Góis pela Europa e a sua produção literária no período 1528-1540, de modo a compreender-se o contexto que levou o humanista português a interessar-se pela Lapónia e pelos Lapões e a escrever sobre isso. Descrevemos, de forma breve, a história do texto da Lappiae descriptio e as duas teses acerca da veracidade da sua alegada viagem à Lapónia. No fim, apresentamos a nossa tradução da Lappiae descriptio.

<p>Analisa as consequências de ratificação de um tratado pelo Estado Brasileiro, em especial do tratado que criou a Corte Interamericana de Direitos Humanos, em face do princípio <em>Pacta Sunt Servanda,</em> analisando a decisão, que recebeu o nº 12.237, datado de 1º de outubro de 2004, proferida no Caso Damião Ximenes contra o Estado Brasileiro, e que determinou a sua condenação. Esta é uma pesquisa sócio-histórica que tem como objetivo identificar, descrever e analisar a trajetóriaprofissional de Pio Damião. No estudo foram empregados documentos cartoriais, livro-ata de reuniões daSanta Casa, testamento público, artigos de revistas e jornais da época e, documentos do Arquivo PúblicoMineiro. Como fontes indiretas, foram utilizados capítulos de livros que retratam a história da cidade e quetambém citaram Pio Damião. Os documentos foram submetidos a leituras repetidas para busca dasinformações e do estabelecimento das relações entre elas. O personagem em foco foi o primeiro“enfermeiro” a trabalhar na Santa Casa de Guaxupé, Minas Gerais. Iniciou suas atividades em 1913, sededicando à enfermagem, cozinha e lavanderia da instituição. Fundou a Frente Negra Brasileira emGuaxupé. Foi desligado da Santa Casa provavelmente por motivos religiosos, por não ser católico, epermaneceu prestando cuidados à população da cidade em seu próprio domicílio até seu adoecimento emorte, em 1953.Descritores: História da enfermagem; Prática profissional; Biografia

Abstract:
Nota-se, a partir do período carolíngio, um paulatino aumento da presença da dialética no cenário filosófico latino. A questão que se coloca a esses pensadores, sobretudo nos séculos X e XI, diz respeito à articulação entre o estudo das Sagradas Escrituras e a dialética. Anselmo de Cantuária representa um momento importante na dissolução dessa tensão, chegando a escrever uma obra exclusivamente dialética, o De grammatico. A originalidade de seu pensamento ganha contorno quando comparada à solução hierárquica de seu contemporâneo Pedro Damião, ou quando voltamo-nos à disputa sobre a eucaristia, na qual Lanfranco é visto pela tradição como defensor da proeminência da fé, e Berengário, apregoado como defensor da dialética. Este trabalho investiga os deslocamentos teóricos que permitem a Anselmo propor uma solução diferente para o problema da dialética em teologia.
From the carolingean period, one may note the gradually increasing presence of dialectic in the latin philosophical scenario. The question that arises to those thinkers, specially on the 10th and 11th centuries, concerns the relation between the study of the Sacred Scriptures and dialectic. Anselm of Canterbury represents an important moment on the dissolution of this tension, even writing an entirely dialectic work, De grammatico. The \"originality\" of his thinking gains proportions when compared to the hierarchical solution of his contemporary, Peter Damian, or when we turn attention to the dispute on the eucharist, in which Lanfrac is seen by the tradition as a defensor of the prominence of faith, and Berengar proclaimed as defensor of dialectic. This thesis investigates the theoretical shifts that allow Anselm to propose a different solution to the problem of dialectic in theology.

As construções históricas no contexto do humanismo português são várias e significativas. A história constituiu um elemento essencial do humanismo, pois o alargamento do conhecimento da Antigüidade e o crescente interesse dos quinhentistas por retomar os relatos do passado, mas introduzindo novos temas ligados à expansão levaram a uma freqüente explicitação das concepções que conduziram as práticas historiográficas do século XVI. Nesse panorama, vemos Damião de Góis, guarda-mor do Tombo, dar continuidade à cronística do reino lusitano. Por ter sido uma das figuras de destaque na consolidação de certos valores europeus acerca da expansão ultramarina, sua obra, ao longo dos séculos, transformou-se numa referência entre os historiadores que descreveram os feitos portugueses do além-mar, num período em que se nota uma laicização do discurso histórico e, ao mesmo tempo, uma sobrecarga épica na descrição e fixação dos feitos lusitanos. São justamente essas tendências na escrita da história do século XVI o alvo desta pesquisa. Tomaremos como objeto de análise as duas crônicas escritas por Damião de Góis: A Crônica do Felicíssimo rei D. Emanuel I e a Crônica do rei D. João, Rei que foi destes regnos segundo do nome, a partir das quais procuraremos refletir sobre o seu fazer histórico, analisando a sua concepção de história em relação à dos cronistas que o antecederam, bem como o seu critério de verdade histórica
The historical constructions in the Portuguese Humanism context are several and very significant. The History constituted an essential element for the Humanism because the enlargement of the Ancient Times knowledge and the rising interest in the writers of the 16th century of retaking the reports from the past but introducing new issues related to the expansion took it to a frequent exploitation of the conceptions that conducted to the historiographic practice from the XVI century. This way we can notice Damião de Góis, highguardian of the Tombo, to continue the chronicles from the Lusitanian kingdom. For it has been one of the main characters in the consolidation of some European values about the oversea expansion, his work over the centuries became a reference among the historians that described the Portuguese deeds in overseas, in a period that we notice the laicity of the historical speech and at the same time an epic overload about the description and the fixation of the Lusitanian deeds. The focus of this research are these tendencies in writing the History from the XVI century. We will have as aim the analysis of two chronicles written by Damião de Góis: The chronicle of the most happy King Dom Emanuel I and the Chronicle of the King Dom João, whose name was the second in this kingdom, from this chronicles we will reflect about its historical work, analyzing its conception of History relating to the predecessor chroniclers conceptions, as well as their decisive factor about the historical truth

A história constituiu um elemento essencial do humanismo, pois o alargamento do conhecimento da Antigüidade e o crescente interesse dos quinhentistas por retomar os relatos do passado, mas introduzindo novos temas ligados à expansão levaram a uma freqüente explicitação das concepções que conduziram as práticas historiográficas do século XVI. Nesse panorama, vemos Damião de Góis, guarda-mor do Tombo, dar continuidade à cronística do reino lusitano. Por ter sido uma das figuras de destaque na consolidação de certos valores europeus acerca da expansão ultramarina, sua obra, ao longo dos séculos, transformou-se numa referência entre os historiadores que descreveram os feitos portugueses do além-mar, num período em que se nota uma laicização do discurso histórico e, ao mesmo tempo, uma sobrecarga épica na descrição e fixação dos feitos lusitanos. Abstract:
A presente dissertação tem por objetivo compreender as perspectivas de progresso que o processo de beatificação e canonização de Frei Damião pode trazer para o crescimento do turismo religioso em Pernambuco tendo-se por foco as romarias e festas que existem em sua homenagem. Nela, inicialmente é feita uma abordagem geral acerca das peregrinações e do turismo religioso com foco nas imbricações existentes entre os mesmos, além de apontarem-se suas raízes históricas para adentrar-se na questão do turismo religioso no Brasil. Depois, voltamos nossa atenção para a figura de Frei Damião de Bozzano, onde passeamos brevemente pela história da formação da Ordem dos Frades Menores Capuchinhos no Brasil e adentramos na trajetória de vida de Frei Damião no Nordeste brasileiro, por meio de suas missões, doença e morte e o processo de beatificação e canonização. Finalizada essa etapa, passamos a tratar de suas romarias e festas realizadas em homenagem a Frei Damião pelo nordeste brasileiro, com vistas ao turismo religioso e oportunidades mercadológicas e, por fim, tratamos dos desafios existentes para o crescimento do turismo religioso em Pernambuco, tendo-se por foco as informações recebidas durante as entrevistas realizadas junto ao Guardião do Convento de São Felix de Cantalice e o Gestor da Unidade de Destinos e Produtos Turísticos da EMPETUR. Para isso, a metodologia utilizada foi a pesquisa bibliográfica e documental, para a composição de nosso referencial teórico e a pesquisa de campo, realizada por meio de entrevista, diante das quais se pode concluir que a figura de Frei Damião tem uma grande representatividade para o povo nordestino, que o considera um santo, símbolo de fé e devoção e cujos deslocamentos que acontecem em decorrência de suas romarias e festas podem ser apontados como importante atrativo para o crescimento do turismo religioso no Nordeste.
This dissertation aims to understand the prospects of progress that the process of beatification and canonization of Frei Damião can bring to the growth of religious tourism in Pernambuco, having been the focus for pilgrimages and festivals that exist in his honor. It initially is made on a general approach of pilgrimages and religious tourism with focus on overlapping between them, and also point to its historical roots to enter on the question of religious tourism in Brazil. Then we turn our attention to the figure of Frei Damião of Bozzano where strolled briefly through the history of the formation of the Order of Friars Minor Capuchin in Brazil and we enter the life path of Frei Damião in northeastern Brazil , through its missions, and disease death and the process of beatification and canonization. After this step, we proceed to address their pilgrimages and festivals held in honor of Fr Damian to the Brazilian Northeast, with a view to religious tourism and marketing opportunities, and finally, treat existing challenges for the growth of religious tourism in Pernambuco, having focus is on the information received during the interviews conducted by the Guardian of the Convent of St. Felix of Cantalice and Unit Manager of destinations and tourism products of EMPETUR. For this, the methodology used was the literature and documents, for the composition of our theoretical and field research, conducted through interviews, on which one can conclude that the figure of Frei Damião has a great representative for the people northeastern, which considers it a holy symbol of faith and devotion and whose displacements that occur as a result of their festivals and celebrations can be pointed out as an important asset for the growth of religious tourism in the Northeast.

Esta pesquisa na linha de processos criativos, trata da criação artística como proposta de diálogo entre arte contemporânea, cotidiano e cultura local,desenvolvendo cruzamentos conceituais, estéticos, históricos e poéticos, a partir da proposição de uma experiência artística em colaboração com a comunidade. A vivência estabelecida no exercício da pesquisa de campo,baseada na observação participante nas práticas devocionais do caruru de Cosme e Damião em Salvador,resultou na realização de um ciclo de obrasevento que promoveu a socialização do processo criativo e configurou um campo experimental, resultando em um pensamento plástico construído na investigação da instauração da obra plástica neste percurso. Para tal articulação foram fundamentais as formulações teóricas de Michel Maffesoli,Luigi Pareyson, Gaston Bachelard, Gilles Deleuze e Félix Guatarri. O cruzamento entre tradição, contemporaneidade e cotidiano se revelou fecundo para a produção artística contextualizada dentro um campo do conhecimento transdisciplinar.

O objeto de nosso estudo é a investigação histórica da devoção a Frei Damião de Bozzano, tomando como lugar privilegiado de pesquisa o santuário de Frei Damião, em Recife, Pernambuco. A crença dos fiéis no poder deste frade em operar milagres fez com que ele ganhasse fama de santidade a partir da década de 1930 no nordeste brasileiro. Procuramos, então, compreender esta devoção em sua historicidade observando as tensões que circundaram sua atividade e esta crença, bem como o processo de disciplinamento empreendido pela instituição religiosa no alvorecer do século XXI. Para tanto, analisamos a prática missionária de Frei Damião na sua relação com o campo religioso católico entre as décadas de 1930 e 1990 tomando, além disso, as construções elaboradas pelos seus devotos e que se manifestam no santuário. Constatamos que as representações elaboradas pelos devotos na construção da santidade deste frade capuchinho emergem em meio às crenças produzidas sobre os poderes de taumaturgo que lhe são atribuídos. Por outro lado, existem os sentidos elaborados pelos agentes religiosos do santuário na atribuição de santidade do frade. Procuramos na confluência de estudos da História, da Sociologia, e da Antropologia, elaborar nossas reflexões sobre as práticas devocionais no santuário e sobre as estratégias produzidas pelos diversos agentes. Contribuíram, sobretudo, os referenciais teóricos produzidos por Pierre Bourdieu, a partir da noção de campo e habitus, e o conceito de plausibilidade de Peter Berger, ambos ancorados nas análises de Durkheim e Weber sobre religiosidades. Nossas fontes primárias estão classificadas como documentos institucionais e a documentação não institucional. No primeiro grupo estão os relatórios missionários da OFMCap, as encíclicas e cartas pastorais, os escritos de Frei Damião e publicações da revista D. Vital, além dos documentos do processo de canonização. Como documentação não institucional tivemos os jornais, revistas, cartas de devotos, ex-votos, depoimentos orais, os rituais e os bilhetes ao santo. Verificamos em nossa pesquisa que o santuário é espaço de uma hibridação ritual no qual as práticas dos devotos e dos agentes religiosos convergem para uma consolidação desta devoção. Constatamos ainda que embora os devotos sejam produtores desta crença, eles procuram junto aos agentes religiosos outros bens de salvação, posto que estão envolvidos numa estrutura de plausibilidade que confere sentido à vida e a suas práticas

This work takes as field Frei Damião district, in Juazeiro do Norte city, Ceará, to reflect on the images of outskirts that has been built about this place, the social practices of its inhabitants and its urban space. The area of Frei Damião neighborhood is defined by the municipality as a wide area that makes boundary with others counties. However, residents and other inhabitants of the city restrict the neighborhood to a region of rectangular geometric shape, densely populated. Taking this last representation of the territory as research locus, it was realized that this region is divided into three different areas, either by neighborhood residents and other inhabitants of Juazeiro do Norte. These areas, called by us as “territorialities” are: “Vila Real”, “Frei Damião” and “Baixa da Raposa”. In addition to this segmentation, the social networks of relationships around the four religious chapels that are in the neighborhood and the soccer games played by young male men in improvised fields, the "rachas", operate new cartographies of the space. To understand these areas is necessary to know the specific characteristics of each one, the relations between them, the understanding of the neighborhood as a whole and the relations between the district and the city. These territorialities are marked by symbolic boundaries and socio-spatial hierarchical stratifications constituted by: images and self-images, nomination systems, historical origins, the regulation of social life intensity, distribution of public and private facilities and patterns. These territorial and social dynamics lead us to question the very notion of district and think about the friction between different mappings and social practices of the residents. of housing. In addition, the historical origin of the district Frei Damiao also helps us clarify this urban dynamics and its presentations in the city and by the city, assigning the district as a “slum” or periphery. The structuring of the neighborhood, after the urban settlement that originated it, was planned keeping in view his arrest as peripherals / slum. It turns out forms of trading of its representation and its implications on the local urban space.
Adotando como campo de pesquisa o bairro Frei Damião, em Juazeiro do Norte-CE, esta dissertação reflete sobre a imagem de periferia, construída sobre o local, as práticas sociais dos seus moradores e seu espaço urbano. O bairro, o terceiro maior em número de habitantes da cidade, é definido pela Prefeitura Municipal como ocupando uma vasta área limítrofe com alguns municípios. Porém, os moradores e demais habitantes da cidade restringem o bairro a uma região de forma geométrica retangular, densamente habitada. Tomando essa última representação do território como locus da pesquisa, percebeu-se que essa região é dividia em três áreas diversas, seja pelos moradores do bairro e demais juazeirenses. Essas áreas constituem o que chamamos aqui de territorialidades, que são: Vila Real, Frei Damião e Baixa da Raposa. Além dessa segmentação, as redes sociais de relações que existem em torno das quatro capelas religiosas que há no bairro e dos jogos de futebol em campos de areia, os rachas, operam novas cartografias ao se espacializarem. A compreensão dessas áreas passa pelas características específicas de cada uma, pelas relações que existem entre elas, pelo entendimento do bairro como um todo e da relação deste com a cidade. Essas territorialidades são marcadas por fronteiras simbólicas e estratificações socioespaciais hierarquizadas, sendo constituídas por imagens e autoimagens diferenciadas, distinções de nomes, de origem histórica, de regime da intensidade da vida social, de distribuição de equipamentos públicos e privados e do padrão das habitações. Com isso, essas dinâmicas territoriais e sociais nos levam a problematizar a própria noção de bairro e pensar sobre as fricções entre diferentes cartografias e as práticas sociais dos moradores. Além disso, a origem histórica do bairro Frei Damião também nos ajuda a esclarecer essa dinâmica urbana e sua apreensão na e pela cidade, por constituir inicialmente a atribuição de periferia/favela de que ainda hoje é objeto. A estruturação do bairro, depois da ocupação urbana que o originou, foi planejada tendo-se em vista sua apreensão como periferia/favela. Isso acaba revelando formas de negociação da sua representação e suas implicações no espaço urbano local.

A morte de um interno, por violÃncia, em um hospital psiquiÃtrico em Sobral-Ce, em outubro de 1999, e as implicaÃÃes jurÃdicas e na Ãrea da saÃde ocasionadas por esse acontecimento que ficou conhecido como o caso DamiÃo Ximenes Lopes à o objeto desta tese. A morte de DamiÃo na Casa de Repouso Guararapes desencadeou a primeira condenaÃÃo do Brasil na Corte Interamericana de Direitos Humanos e exigiu uma mudanÃa na forma de lidar com a saÃde mental no MunicÃpio. A mudanÃa foi impulsionada pela repercussÃo internacional da sua morte, atà como uma aÃÃo politica, mas teve como alicerce os ideais do movimento da Reforma PsiquiÃtrica Brasileira. Esta tese volta-se para a histÃria de DamiÃo e como a sua famÃlia tornou-a pÃblica em busca do que considera justiÃa levando o caso à Corte Interamericana de Direitos Humanos e tambÃm como o MunicÃpio de Sobral respondeu Ãs acusaÃÃes Ãs quais foi imputado. Em nove meses, a estrutura hospitalocÃntrica da cidade foi desmontada e em seu lugar emergiu uma sÃrie de equipamentos de saÃde que, funcionando em rede, reorganizou a proposta de atendimento aos pacientes em sofrimento psÃquico. à relevante discutir os avanÃos ocorridos na saÃde do MunicÃpio com essa mudanÃa, mas tambÃm nÃo deixar de analisar as limitaÃÃes que perpassam a implementaÃÃo de uma polÃtica pÃblica complexa e inovadora.
The death of an internal from violence in a psychiatric hospital in Sobral-Ce, in October 1999, and the legal and health implications caused by this event that was known as the case Ximenes Lopes is the object of this thesis. The death of DamiÃo in Guararapes Rest Home triggered the first brazilian conviction in the Inter-American Court of Human Rights and demanded a change in dealing with mental health in the municipality. The change was driven by the international repercussions of his death, even as a political action, but had as foundation the ideals of the movement of the Brazilian Psychiatric Reform. This thesis aims to the story of DamiÃo and how his family publicized his death in pursuit of what they considered justice taking the case to the Inter-American Court of Human Rights as well as how the municipality of Sobral responded to the accusations that have been imputed. In nine months, the hospital-centered structure of the city was dismantled and in its place emerged a series of health equipment, which, through networks, reorganized the proposal of patient care in psychological distress. It is relevant to discuss the progress made in the health of the Municipality with this change, but also not fail to analyze the limitations that go through the implementation of a complex and innovative public policy.

Este estudo tem como tema a “fábrica” da cidade de Lisboa em dois aspectos complementares, representados pela cidade material e pela cidade narrada em duas obras quinhentistas: Descrição da Cidade de Lisboa (1554), de Damião de Góis, e Da Fábrica que falece à cidade de Lisboa (1571), de Francisco de Holanda. Baseado nas referidas obras e considerando as transformações ocorridas na cidade neste período, o trabalho demonstra a importância da Expansão Marítima Portuguesa na configuração do espaço urbano, bem como a influência dos acontecimentos dos séculos XV e XVI, como as reformas religiosas e o Renascimento, na forma como a cidade nos é apresentada pelos autores. Assim, por sua posição como “cabeça” do Império, Lisboa constitui um rico exemplo de como os diversos agentes podem interferir e moldar o espaço urbano, de modo a atender a interesses diversos. Da mesma forma, a análise das referidas obras permite perceber a cidade enquanto intenção, como discurso panegírico e ideário renascentista, a refletir os principais aspectos que regiam a sociedade quinhentista. Assim, é importante que a cidade seja entendida como uma valiosa fonte documental, cujo estudo nos permite o reconhecimento das características de uma sociedade em diversos momentos históricos.
This study has as theme the “factory” from Lisboa city in two complementary aspects. One is the physical city and another is the represented city in two sixteenth-century literary works: Descrição da Cidade de Lisboa (1554), from Damião de Góis, and Da Fábrica que falece à cidade de Lisboa (1571), from Francisco de Holanda. The present study show the influence from Portuguese maritime expansion, as described in the above-mentioned literary works as well as the changes occurred at that time, which established the urban space and the shape how these authors disclosed the city for us. Other events occurred in the Europe during 15th and 16th centuries, such as Renaissance and Catholic Reformation, also has had an influence on the city description. Lisboa, while head of this empire, represented a very rich example of how a number of actors can affect and mold the urban space to take account different interests. Likewise, the analysis from these literary works enables to notice the city like an intention, a panegyric speech and a Renascence demand, while component that reflects the key aspects, which conducted the sixteenth-century society. It is thus important that city must be understood as a valuable documental source, whose study enable us the recognition of the characteristics from society at different historical moments.

Prosumptionsmodelle im Bereich Ernährung und Bekleidung bieten Potential für eine Nachhaltige Entwicklung. Dabei lässt sich das klassische Verhältnis zwischen Anbietern und Konsumierenden verändern. Statt – eher passiver – Nachfrage, geht es um aktive Beiträge der Konsumenten, die sich damit auf den Weg hin zu „Prosumern“ machen. Aus öffentlich-rechtlicher Sicht geht damit eine Rollenverschiebung einher, die sich auch in der daran geknüpften „Verantwortungs-Konstellation“ niederschlägt: Wer aktiv in das Austausch-Verhältnis eintritt, den treffen auch die damit verbundenen Pflichten. Dies gilt grundsätzlich für alle Rollenverschiebungen im vorgenannten Sinne, also etwa auch für den Bereich der Bekleidung. Allerdings sind die damit einhergehenden Risiken für die Kunden (im Sinne einer Gefährdung von Leben und Gesundheit) in der Regel deutlich geringer als bei der Vermarktung von Lebensmitteln. Verunreinigungen, seien sie herstellungsbedingt oder durch nachträgliche Kontamination mit Mikro-Organismen (Bakterien, Pilze etc.) hervorgerufen, können zu Gesundheitsgefährdungen führen. Diese Risiko-Konstellation hat den Staat veranlasst, ein vergleichsweise dichtes Geflecht an öffentlich-rechtlichen Vorgaben zu etablieren, die relevant sind sowohl für (Food-) Sharing-Ansätze als auch für Modelle der solidarischen Landwirtschaft (SoLaWi). Aus öffentlich-rechtlicher Perspektive stellen sich im Bereich der beiden vorgenannten Fallbeispiele aus dem Bereich der Lebensmittelwirtschaft vor allem Fragen im Zusammenhang mit den einzuhaltenden Hygiene-Anforderungen. In der Praxis gab es hier auch bereits Auseinandersetzungen mit den zuständigen Behörden. Diese Stellungnahme konzentriert sich daher auf die damit zusammenhängenden Fragen.

Angesichts des gegenwärtigen Trends eines zunehmenden Diskurses über einen nachhaltigen Lebensstil, den politischen Debatten um die bestehende Ressourcenknappheit und der globalen anthropogenen Erderwärmung, verfügen diese drei Konstrukte über eine Konstante. Diese Thematiken vereint, dass der Mensch als Akteur die Verantwortung für diese Entwicklungen zu tragen hat. Der Dringlichkeit zu handeln bewusst, stellt sich die Frage, inwieweit die Intention nachhaltig zu Handeln mit der wirklichen Umsetzung übereinstimmt. In Form einer Online-Umfrage zum Thema nachhaltigen Konsum von Kleidung wurden Primärdaten generiert, die es im Rahmen dieser Bachelorarbeit zu analysieren gilt. Dieser Vorgang hat zum Ziel, die Forschungsfrage inwieweit sich Intention und Handlung, in Hinblick auf nachhaltigen Konsum von Kleidungsstücken entsprechen, eigenständig zu konzeptualisieren und zu beantworten. Die damit verbundenen Erkenntnisse offerieren neue Handlungschancen, um ein nachhaltigeres Konsumverhalten in Bezug auf Kleidung in einem gesellschaftlichen Kontext zu ermöglichen. Die Gliederung der Arbeit orientiert sich an einem thematischen Aufbau, der das Verständnis dieser Thematik uneingeschränkt zulässt. Zunächst wird im Rahmen des theoretischen Teils über den entsprechenden Forschungsstand der Wissenschaft informiert. Im Weiteren wird die zugrundeliegende Fragestellung skizziert und die damit einhergehenden Forschungshypothesen hergeleitet. Diese drei Forschungshypothesen ermöglichen im Weiteren analytischen Verlauf letztlich die Beantwortung der Forschungsfrage. Es folgt der empirische Teil, welcher die Forschungsmethode beschreibt und vertiefend die Durchführung und die Auswertungsmethoden veranschaulicht. Bezüglich dessen wird auch die Operationalisierung thematisiert, welche die Realität in Form von Items messbar macht. Um die erlangten Informationen in Verbindung mit der übergeordneten Fragestellung zu setzen, müssen bezüglich der Ergebnisanalyse, zunächst die Daten deskriptiv skizziert werden. Folgend werden im Rahmen linearer und einer multiplen Regression hypothesenprüfende Ergebnisse generiert. Auf Grundlage dieser, wird die Beantwortung der vorangestellten Forschungsfrage ermöglicht. Es gilt die Ergebnisse zunächst zusammen zu tragen, um die Interpretation in den aktuellen Forschungsstand einzuordnen. Anschließend wird die eigene Forschungsmethodik einer kritischen Reflexion unterzogen, um somit mögliche Optimierungsmöglichkeiten zu benennen und weiteren Handlungsbedarf kenntlich zu machen. Konzeptualisiert werden die empirischen Ergebnisse in Form des abschließenden Fazits, welches sich auch Bereichen widmet in denen potenzieller Handlungsbedarf benannt wird. Im besten Fall lädt diese Arbeit und die damit verbundenen neuen empirischen Erkenntnisse ein, Handlungsräume in Bezug auf Determinanten wie Moral, Information und Preis neu zu bewerten, um nachhaltigen Kleidungskonsum zu ermöglichen. Auf dieser Grundlage könnten sich geeignetere Strategien im Rahmen weitergehender Forschung entwickeln lassen, um nachhaltiges Verhalten tiefgreifender zu ermöglichen und damit einen gesellschaftlichen Beitrag leisten zu können.

Mit Blick auf Deutschland steht außer Frage, dass die im bestehenden föderativen System enthaltene Garantie der kommunalen Selbstverwaltung ein hin-reichendes Maß an dezentraler Finanzautonomie voraussetzt. Die Bewältigung der den Kommunen im Rahmen der föderalen Zuständigkeitsverteilung zugewiesenen Aufgaben und das Tätigen der damit verbundenen Ausgaben sind ohne eine entsprechende Ausstattung mit Einnahmen, d.h. der Verfügbarkeit über angemessene finanzielle Mittel zur Aufgabenerfüllung, nicht möglich. Diese grundlegende Einsicht spiegelt sich bereits in Art. 28 Abs. 2 Grundgesetz (GG), wonach den Gemeinden und Gemeindeverbänden das Recht gewährleistet sein muss, „alle Angelegenheiten der örtlichen Gemeinschaft im Rahmen der Gesetze in eigener Verantwortung zu regeln“. Und weiter heißt es dort: „Die Gewährleistung der Selbstverwaltung umfasst auch die Grundlagen der finanziellen Eigenverantwortung“. Dieser im Rahmen der Grundgesetzanpassung von 1994 hinzugefügte Satz stellt nicht allein eine verfassungs-rechtliche Grundlage für die Zuweisung eigener Steuerhoheiten an die kommunale Ebene durch den Bundesgesetzgeber dar. Er ist zugleich auch die grundgesetzliche Basis einer garantierten (vertikalen) Zuweisung von finanziellen Mitteln eines jeweiligen Landes an seine Kommunen und bildet damit den rechtlichen Bezugspunkt für den auf Landesebene bestehenden kommunalen Finanzausgleich, dessen Durchführung in den jeweiligen Landesverfassungen – so auch in Rheinland-Pfalz in Art. 49 der Landesverfassung (LV) – geregelt ist.

Das Forschungsprojekt „Responsive Steuerung von Innovationsverhalten für Nachhaltigkeit“ (ReSINa) untersucht, auf welche Weise das Recht fördernd bzw. hindernd auf Innovationen wirkt. Im Zentrum des Interesses liegen Innovationen, die einen Beitrag zur nachhaltigen Entwicklung leisten, die also u.a. dazu beitragen, negative Umwelt- und Gesundheitswirkungen von Produkten oder Verfahren zu verringern. Das Teilprojekt „Innovation und Recht bei Nanomaterialien“ geht dabei der Frage nach, wie Nanomaterialien zu regulieren sind, damit sich mit diesen Stoffen verknüpfte Innovationsprozesse am Leitbild Nachhaltigkeit orientieren. Eine solche Regulierung steht vor der Herausforderung, Innovationen und damit zusammenhängende Chancen für eine nachhaltige Entwicklung zu fördern bei gleichzeitiger Berücksichtigung potentieller stofflicher Risiken für die menschliche Gesundheit und die Umwelt. Das vorliegende Diskussionspapier beschränkt sich zunächst auf eine Analyse des Registrierungsverfahrens einschließlich der Bewertung (Evaluation) nach REACh sowie der innerhalb der Bundesrepublik durchgeführten behördlichen Überwachung. Dabei wird der Frage nachgegangen, inwieweit von den jeweiligen Vorschriften Impulse in Richtung auf nachhaltige mit Nanomaterialien verknüpfte Innovationen ausgehen. Ziel ist es, auf Grundlage einer Analyse der maßgeblichen Regelungen und Akteure Hypothesen zu entwickeln, die sich im weiteren Projektverlauf empirisch überprüfen lassen und schließlich gegebenenfalls die Basis für die Konzeption vorzugswürdiger Regelungsalternativen bilden.

Ausschreibung des Forschungsförderungsprogramms "Mobilität der Zukunft (MdZ)" gefördert wurden, auf die bisher erzielten Ergebnisse und Wirkungen untersucht. Einerseits auf der Ebene des einzelnen UML und andererseits auf der Ebene der UML-Initiative insgesamt. Ziel war es, das bisher Erreichte und die damit verbundenen Erfahrungen zu analysieren und auf dieser Grundlage Empfehlungen für die künftige Arbeit in diesem Rahmen (und möglicherweise darüber hinaus) zu entwickeln.

Die vorliegenden Materialien sollen Personen bei der Entwicklung, Durchführung und Bewertung von Projekten im Sinne des Konzepts Scholarship of Teaching and Learning (SoTL) unterstützen. Sie richten sich damit sowohl an Hochschullehrende, als auch an Hochschuldidaktiker*innen, denen das SoTL-Konzept bereits bekannt ist. Das vorliegende Dokument bestehen aus zwei Abschnitten: Einem Leitfragenkatalog und einem (Selbst-)Bewertungsraster zur systematischen Reflexion und Beforschung der eigenen Lehre.
