Full text
Abstract:
The chapter develops a conceptual framework within which to locate the principles determining the scope of State duties towards people at sea. Since scope is linked with the notion of jurisdiction, the chapter begins by providing a brief overview of what jurisdiction is often taken to mean in public international law and in human rights law, so as to dispense with some misconceptions and to provide a working understanding of the concept. It is then argued that jurisdiction under international law (de jure jurisdiction) in fact constitutes one facet of jurisdiction under human rights law, which also includes the de facto exercise of power by a State upon an individual (de facto jurisdiction). Applying these principles, the different hypotheses of State jurisdiction over a person at sea are discussed, taking into account the specificities of the marine environment. Cases of exclusive and priority jurisdiction are also presented.

Rodenhäuser, Tilman. A Three-Pronged Approach to Human Rights Obligations of Non-State Armed Groups. Oxford University Press, 2018. http://dx.doi.org/10.1093/oso/9780198821946.003.0008.

Full text
Abstract:
Chapter 6 proposes a three-pronged approach to possible human rights obligations of armed groups by distinguishing between (i) human rights obligations of groups exercising quasi-governmental authority in defined territory; (ii) human rights obligations of groups exercising de facto control over territory and population; and (iii) human rights obligations of groups not controlling territory or populations. This not only reflects contemporary international practice, but also the different capacities of armed groups and the varying circumstances in which they operate. This chapter examines each type of armed group separately. For each type, it shows to what extent human rights obligations for armed groups are needed; it provides international practice showing that a number of states and human rights experts consider the respective type of groups to have human rights obligations; it considers which sources of international law could bind the type of group in question; and suggests which scope of obligations should bind them.

Ebobrah, Solomon T. The ECOWAS Community Court of Justice. Oxford University Press, 2018. http://dx.doi.org/10.1093/oso/9780198795582.003.0004.

Full text
Abstract:
This chapter examines whether the ECOWAS Community Court of Justice (ECCJ or Court), as an international court operating in the West African region with its peculiar sociopolitical and economic context, enjoys any form or degree of actual authority in any of its main functions. The ECCJ’s two contrasting epochs represent a variation in the authority of the Court. Whereas under its 1991 Protocol, the Court enjoyed limited de jure authority with little potential for growing its de facto authority, the 2005 Supplementary Protocol introduced expansions that increased the potential for enhanced de facto authority. Ultimately, the Court’s authority varies significantly both in terms of areas of competence, as among different court-users and in relation to wider communities in its State Parties. Arguably, these variations indicate that different factors influence the responses that the Court attracts from different user-groups.

Abstract:
What does it mean to say that austerity has caused the burden for providing social welfare to shift from governments to international migrants? This chapter reports findings from fieldwork I conducted in Mexican communities with high rates of emigration to the United States. I explore how many agrarian communities used remittances to cope with economic shocks associated with Mexico’s transition to a market-oriented economy in the 1990s. I argue that austerity caused the welfare burden to shift increasingly from the state to transnational families, and that counting on emigrants to send money home became Mexico’s de facto social policy in the rural areas.

Full text
Abstract:
The facts, circumstances, and events which lie at the root of foreign affairs and their conduct by the Executive have conveniently been described as facts of State. These are facts which are peculiarly within the cognisance of the Executive. For this reason, at any rate in so far as they are within the scope of the United Kingdom's Executive, they can be proved only in a special manner, namely by a certificate issued by the Foreign and Commonwealth Office or by a statement made to the court by the Attorney-General rather than by other documentary or oral evidence. The idea underlying this practice is the familiar one: in matters relating to foreign affairs the judiciary and the Executive should speak with one voice. The scope of prerogative power is discussed, covering territory; state of war, belligerency, and neutrality; civil war or insurgency, immunity, abolition of a state, and government of a recognized state.

Fox, Jonathan. Political Secularism and Democracy in Theory and Practice. Edited by Phil Zuckerman and John R. Shook. Oxford University Press, 2017. http://dx.doi.org/10.1093/oxfordhb/9780199988457.013.7.

Full text
Abstract:
An overwhelming majority of democracies, no matter how the concept of democracy is defined, restrict the religious practices and institutions of minority religions, substantially support religion, and give de jure and de facto preferences to a single religion or a few religions. Since so few democracies meet any standard of political secularism, political secularism is either not essential to liberal democracy or these countries’ status as liberal democracies must be questionable. Political secularism as an ideology is not as influential in the practical politics of democratic states as many believe. An important question is whether political secularism is the best model for democracy or whether the best models are those that integrate state support for religion with checks and balances that protect religious freedom.

Full text
Abstract:
This chapter discusses the rise of the idea of Sweden as a particular model of welfare capitalism in the social sciences from the 1930s onwards. Drawing on a constructivist approach to political economy, it proposes that prevailing analytical concepts of the Swedish model as a politics-against-markets type of intervention into the capitalist economy are today falsified, as both the welfare state and social democracy have been thoroughly caught up in the process of marketization. The defining features of welfare capitalism in its original sense have undergone a transformation. Neoliberalism was introduced in Sweden, the chapter concludes, through the welfare state, functioning as a de facto series of quasi markets.
