Full textThis thesis is about the process of ethnogenesis of a Peruvian "peasant community" (comunidad campesina) in the area of Cusco. This community has the particularity of being officially "born" in 1982 after a long legal process, which started in 1969 by the agrarian reform. As a new territorial and social unit, it grouped populations that were previously parts of radically different productive structures : large farms (haciendas) and communities (ayllu). This "peasant community" could have existed only on paper, stayed as a legal shell emptied of significance. Nevertheless this is not the case ; the population structured itself in a very short time according to the social and territorial limits recognized by the law. Considering a combination of the sociological and symbolic dimensions, this study intends to investigate the nature of the social link, which was created. From a sociological and symbolic point of view, an essential value, the "respect" (respeto/ manchanakuy) , allowed the implementation of a hierarchy according to three essential criteria : taking part of the community works, attending to the municipal assemblies and assuming political or civil responsibilities within the community (sistema de cargos). From a symbolic point of view, the community seems strongly anthropomorphized and the application of the ethics of "respect" has to guarantee the integrity of the society. This representation takes a particularly elaborated meaning in the agriculture and the relation to the territory. The system of symbolic interpretation has strengthened the process of social structuralization and that is why the "peasant community" was able to take shape so quickly

Full textI was traveling on Nicaragua’s long roads, wandering, strolling with a camera in my hands, trying to capture the soul of rejected places and buildings. “I have visited historic places where pirates and conquistadores had passed, lands colonized by the English, Spanish and American empires. I have visited wonderful cities and isolated villages, virgin forests and crowded markets. I saw grand churches and modest chapels which had celebrated joyous births and had seen war heroes leaving. " I fully dived into this surprising culture. Sometimes as a tourist, a rambler, or a stranger, I wanted to immortalize the last visible tracks of some historic events that filled the history and the Nicaraguan culture. I produced a series of photographs which generated a large reflection about the construction of my own personal history, my own memory and my own identity. This essay is a testimony of these reflections from a human being as well as an artistic experience point of view.

Full textDesirous of clarifying a confused legal system and of resulting in human bliss, in L'Esprit des lois published in 1748, Montesquieu makes the distinction between political and civil laws. Identifying Civil law with Private law, he calls political law public and likens laws and law. To achieve his aim - the good of individuals and of society- the legal system must lean on public law since it comes from natural rights. Hence the primacy of political laws over civil laws. Given a rough handling by the critics, sometimes even disparaged, the distinction which was consolidated by the members of parliament, l'Ecole du droit naturel, and les Maximes du droit public français becomes the rule thanks to the philosophers of the Enlightenment. The notion of constitution, the politization of civil laws under the Revolution and the civil code reassert the primacy of political laws. Anticipating the relations between public law and private law which were established by the drafters of the civil code, the distinction between civil and political laws constitutes an intermediate stage in the setting of the important classifications of law. According to this hypothesis, hum an cognition is the product of the operations of computational systems which are relatively autonomous from a causal point of view and highly specialized in the management of a proprietary kind of information. My specific goal is to characterize the theoretical conflict between two modular conceptions of the cognitive architecture, and to evaluate the arguments implied in their defense. The first one is the "Fodorian" conception, according to which only peripheral cognition has a modular organization; the second one is the "massive modularity" thesis, endorsed by the evolutionary psychologists, according to which a larger part of the mind is strongly modular

First of them, thanks to an agreement, a lender concedes to a borrower a fair use of a copy on which there is a work. Because none of them enjoy any right on the work, the object of the agreement concerns only the copy. In the second relationship between author and lender, there is nevertheless a public communication of the work : from individual loans to individual loans which object is the copy, a public exploitation of work seems to appear. Is it possible for the authors to control the exploitation of their works even after there have been first put into circulation? does the authors enjoy a "public lending right" in france? this thesis tries to demonstrate that the french theory of "droit de destination" includes an exclusive rental right. An e. C. Directive of 1992, not translated in french legislation, but which must nevertheless have effects, will strengthen the french theory in order to develop the public lending right in france whatever the technology used to lend. In the third and last reltionship, between author and borrower, the question is to know if the author can forbid the borrower to use his work. The answer is no when the borrower has a domestical "fair use" of the work because the french legislation of copyright enforces to authors this kind of use

Indeed, his contemporaries criticize his preciosity, his exaggerated subtlety, his affected style : he was too witty, he was even accused of corrupting language. How could we define Marivaux's wit ? As a sparkling writing which is just about good enough for entertaining and tries to dazzle the audience ? Is it the result of a misuse of language ? Or have we to study it seriously to understand its meanings and its stakes ?In the first part, we try to define the notion of wit through different authors, dictionaries and Marivaux's written works. Then we choose the notion of witticism to analyse these comedies. In the second part, we study how wit functions : we give a typology and we show that it's both fragmentary and spectacular. The last part is devoted to explaining how wit influences the sentimental and moral sphere and the dramatic action

Full textIn this thesis, we make a contribution to the study of the properties of the generalized inverse Gaussian and Kummer distributions in the context of Stein's method. This is to contribute to establishing the mathematical tools necessary for the application of Stein's method to the case where the target law is one of the two aforementioned laws, on the one hand, and to applying Stein's method to give a bound of the rate of convergence in some limit theorems involving these two laws, on the other hand. We retrieve the Stein operator of each of these two laws, solve the corresponding differential equation and bound the solution obtained as well as its successive derivatives (for the derivatives, the bound is not always explicit but is established by an iterative technique). The techniques used to obtain the bounds of the solution and of its derivatives are essentially based on the fact that these two laws belong to the family of probability laws whose density g satisfies the differential equation (s(x)g(x))^'=τ(x)g(x) where s and τ are polynomial functions satisfying certain conditions. By Stein's method, we establish a bound for the rate of convergence of the generalized inverse Gaussian and Kummer distributions to the gamma distribution, of the generalized hyperbolic distribution to the generalized inverse Gaussian distribution and a sequence of random variables to the reciprocal inverse Gaussian distribution. Our approach in estimating these rate of convergence by Stein's method is essentially based on the fact that the law of the sequence of random variables considered and the limit law are involved in a convolution relation

Full textThe mind-body problem is one of the main centers of reflexion of contemporary philosophy. Generally coming from the supposed failure of the Cartesian interactionist dualism, most philosophers of the mind adopt a physicalist ontology. However this one seems to meet with insuperable difficulties : it can't give physicalist explanation of qualia, naturalyse intentionnality, suggest a satisfactory explanation of the implementation of logical standards. That is why materialistic theories of the mind turn into epiphenomenalism or eliminativism. Therefore the study of other conceptions is necessary. On this topic, classical philosophers have suggested some theories (interactionism, panpsychism, parallelism, occasionalism) about which philosophers of mind attach little value maybe because these theories often admet the spiritual reality of the mind, an idea which doesn't seem to match with the principles of science. However one should wonder on the one hand if scientific explanation is rightfully able to explain the whole reality and, on the other hand, if the conception of science supported by the majority of physicalists is true. The psychophysical reductionism doesn't take into account its incompletness and fail to explain emergent phenomena. All these criticisms of materialism allow to conceive the possibility of spiritual nature of the mind. This wiew doesn't necessary clash with science, and can't avoid the darwinian theory of evolution asking the question of emergence of mind. These considerations allow to defend a form of popperian dualism

Full textHuman beings have this surprising ability – coined Theory of Mind (ToM) – to reason about the mind of others and interpret their behaviour in terms of beliefs and desires. In this thesis, we focus on two critical aspects of ToM: (1) our ability to attribute recursive beliefs of the type “I think that you think that I think...” in the context of social interactions, (2) our ability to infer other people’s personal characteristics or preferences from observing their choices. This computational characterization of mechanisms at play in ToM provides new tools to address important questions such as: What is specific about learning in a context of social interactions? Are we optimal in our inference about others’ preferences or beliefs? Can we identify evolutionary constraints that may have shaped our current sophistication in ToM? Are these processes uniquely human? In which ways is ToM affected in disorders involving difficulties with social interactions? We investigated these questions combining computational modelling and behavioural experiments. The results of our studies offer significant advances in the description of the computational mechanisms underlying social cognition in humans and in non-human primates. Moreover, applying our paradigms to people from the autistic spectrum disorder allowed us to characterize what makes social cognition in autism so different

Full textThe Lancelot Graal is a collection of tales, pervaded by two spirits, courtly love and the marvellous. The aim of this research paper is to use the Lancelot Graal to test an interpretation suggested by historians, showing the construction of society in the Middle-Ages as orientated around the two opposing notions of the physical and the spiritual, linked by love, by caritas, and to examine to what extent this resolves the aporia arising from the confrontation between the courtly and the marvellous. The analysis of the novel attempts to show that the text uses a lexicon which reveals a dynamic organization from the bottom to the top and from the outside to the inside. This dynamic organisation highlights a hierarchy of values which also structure the narration, organised into two elements linked by the common theme of love : thus courtly love for a Lady would be physical, love for the Grail would be spiritual. Nevertheless, the sense of astonishment inspired by the Lady and the Grail enables us to show that there aren’t two spirits but only the desire to spiritualise love. Love also organises the network of relationships, which create strategies of spirituality. / The kinship networks are also organised around love. These kinship networks create strategiesof spirituality. Finally, the analysis of the novel shows how aristocrats lay claim to a secular model of heroism. The novel is structured around love which runs its course well or badly in the text

Several critical commentaries refer to the grotesque to describe the subject which are represented and to analyse the aesthetic of those art works. This thesis consists in showing that, from Buñuel to Almodovar, significant films of Spanish cinema comes within a grotesque spirit. It was particularly expressed from 1960 to 1965. It was at the beginning of this decade that were directed El cochecito (Marco Ferreri, 1960), Viridiana (Luis Buñuel, 1961), El verdugo (Luis G. Berlanga, 1963) and El extraño viaje (Fernando Fernan-Gomez, 1964).
