Full textIn a world where local governments play today a preponderant role, the town-planning comes as a marked domain of the seal of their interventions. The Ivory Coast State is not remained in the margin of this reality, it has officially decentralized the abilities concerning this matter. But the most important problems appear today at the level of the accomplishment and the effectiveness of these transferred abilities. Dysfunctions exist in this regard and parasitize continually the initiatives undertaken by local governments on the town-planning scene. Thenceforth, reforms must be undertaken by public powers, for clarifying or specifying more abilities assigned notably to townships, for adapting rules to the sociological context of the Ivory Coast, for associating different social actors to the work of local urban planning. Full textIn Ivory Coast, the questioning of the hegemony of the central government, because of the ineffectiveness of its too much centralized management, aroused a strong craze for the decentralization. The action for a decentralizing reform appears as an answer to the crisis of the State and as a condition to promote the development recommended by the financial international backer organizations. Under the pressure of these and because of internal structural and financial constraints requiring an appeal to the action of the local institutions, the State undertook in a reform of its juridical and institutional apparatus by adopting the French model of territorial decentralization. The relevance of the reception of this model is not questioned, but the Ivory Coast political, social and economic context imposed that it is adapted in order to favour the economic interventionism of the decentralized authorities. The aim in view being to promote a territorial development which fulfills both conditionalities of aid for development and the emergence of effective participation of these institutions in the context of self-government. The Ivory Coast decentralization reveals a financial dependence of the local organs towards the central power and a pressing control on the exercise of their skills, limiting their capacities of economic initiative. Nevertheless, the recognition of more asserted economic liberties with a capacity to create additional resources as well as a national representative body which can protect them from encroachments of the central government would promote effective decentralization contributing to the territorial development

Full textAfrica, because of its weakness, its failures at many levels, and all the difficulties it faces in meeting the global standards of democracy, has over the years become the ideal receptacle for all kinds of experimentation on the issue of development.And it was only from a public finance crisis, the most emblematic manifestation of which was that of public debt, which had already begun a decade earlier, that Africans referred to structural adjustment policies. Strongly encouraged by international organizations, these countries have adopted decentralization as an effective means of good governance.Despite its adaptation in the various constitutions, decentralization really began only about fifteen years ago in many African countries such as Côte d’Ivoire, Senegal and Cameroon. Decentralization thus appears to be one of the best means of modernizing the centralized state, promoting citizen participation and good governance. It could, together with good governance, shed light on how the incumbent authorities manage state’s resources.Seen as a means of economic growth and development, decentralization and good governance, according to the observations of recent years, do not seem to have the same effects in the developing countries, still tribal and especially very poor and plagued by many problems. This model of territorial organization has just become a condition for receiving international assistance.What are the causes of the failure of decentralization in West Africa, and what are the means these countries possess in order to succeed in changing the democratic ideals still locked in ancestral rites and Customs?

Full textGenerally speaking, the contentious administrative function can be arrested as all the jurisdictions asked to know disputes resulting from the activity of the authorities. She represente the jurisdictional activity in administrative subject. Consequently, the contentious administrative functio has to dread as long under the angle of a jurisdiction, that under that of his judge. The institution of a contentious administrative function (office) in Ivory Coast goes back up to the colonial time. However, following the example of most of the French ex-colonies, it is that after the independence in 1960, that the Ivory Coast contentious administrative function asserted itself as autonomous jurisdictional office towards the French system. The not contentious administrative procedure, as the contentious administrative procedure question of which it is in the study knew big progress both in France and in the French-speaking countries of Africa for which the system of jurisdiction administrative as the right at which it aims at checking constituted for a long time, according to the Jean RIVERO's beautiful formula, a voucher " produced by export " French. Full textThis research is on a new model of procedural code concerning the civil rights trade and administration in the ivory-coast. The study was based on two fondamental principles: swiftness in the dispensation of justice and defence rights. Decreed on 1972, this code is a large extent a product of the country's history. Although modified, or adapted to suit the local environment, signs of colonial rule are still present. In fact the study tried to show the evolution in time and space of world event of which this code is the product. An effort has been made to show the originality of this code, and the differences between it and french procedure. The originality comes from the fact that there is a common judicial procedure to all branches of law as against french's which has a specific procedure for each branch of law. However, there is still a lot to do in the technicalities of the code as many procedural rule are either not covend at all or are shallowly treated. Furthermore, inspite of the sound structure for swiftness (unified tribunals and procedures, thereby reducing the nomber of steps and time required to complete a case) adopted by the authors of the code, many juges apparently and paradoxically make it difficult for suitors, maybe as a result of their training which was not originally geared to handle the new situation. Besides, the authors of the code completely ignored the theme "defence rights" apparenteltly because they were much more preoccuped with the dispensation of justice. And that is all the more reason why (the topic of) this study was chosen -knowing fully well that swiftness can make defence rights to suffer even more. Finally, one thing that can be said is that a code exists; but to have a code is one thing, and (to know) the reality is another

Full textIn ivory coast, what characterised administrative law is its access to common man. Nevertheless the administration keeps some particularity : in fact though both administrative and civil cases are firsthy tried by the same court in the supreme court, they are handled to differents houses. However, that effort to wite the legislation doesn't wake things ease weither to the citizen, nor to the administrative law itself. In fact, the lawer, through his judicial pratice fails to find a solution to that gap. This, not only because of his status and the ivoirien institutionnal environnement, but also due to his carefuluess before innovation, soft application and creation of rules. There fore, modification are needed in administrative and judicial organisation in term of structure, procedure and management in order to meet the administrative partners'will. Furthermore, one can thik of a "non contentious administrative procedure" two solutions can be suggested : a para-jurisdictional stop for option and extra-jurisdictional one for conflicts. All these reforms will associate a decentralised administration, take accounts the creative feeling of the magistrate as well as the critical observation of the doctrine for creation and application of adequate rules

Full textAn effective and efficient public-sector reform enhances government capability to raise domestic revenue for prioritized spending. It also contributes to strengthening the government capacity to manage public resources more effectively and deliver public services. In pursuing these objectives, fiscal decentralization, the devolution of taxing and spending powers to lower levels of government, has become a key public-sector reform in many countries. Given such high stakes, a growing economic literature is focusing on how to better understand the challenges developing countries face in implementing fiscal decentralization reforms. The present thesis adds to this effort through four contributions shedding light on specific issues related to fiscal decentralization.Chapter 1 analyses whether and how municipal revenue mobilization could enhance citizens’ access to public services and reduce poverty. The results indicate that increasing municipal-raised revenues improve access to public services and reduce poverty. This effect works mainly through enhancing access to education than on access to health, especially in less ethnically diverse localities and in urban zones. Chapter 2 investigates the effect of municipal revenue autonomy on inequalities within sub-national governments. We conclude that higher local revenue autonomy reduces income inequalities within localities, which effect differs between the type of revenue and jurisdiction considered. Chapter 3 analyzes the impact of the transfers from central government to municipalities on the revenue mobilization by municipalities. Our results show that increasing central transfers to subnational government boost revenue mobilization by municipalities for both tax revenue and non-tax revenue. The effect of transfers is found to be higher for tax revenue than for non-tax revenue. Finally, we examine whether the effect of government responsiveness on property tax compliance differs between central government and municipalities in chapter 4. The results conclude that responsiveness by municipalities is found to have a greater effect on property tax compliance than those by central governments. The results of our analysis bear important policy implications to strengthen public sector, especially in sub-Saharan Africa

Full textDecentralization is the major institutional innovation that African countries since the 1990s. If it is irreversible, the fact remains that the ability of local authorities to provide local public services to local people and to boost development economic and social development is constrained by the narrow legal means, financial, human and material. This thesis public law concerns the financing of local authorities in Côte d'Ivoire. The overall objective of this study is to demonstrate one band, the different local public policies financed by local institutions, and secondly, the means used to finance them. After an investigation that has used many types of data (documents, interviews, direct observations, etc.) it appears that the local authorities financing assets in Côte d'Ivoire have proven and can point to a success material for making local investment. However, the existing legislative tools and devices on sustainable local development raise difficulties raise questions about the very effectiveness of the financial system in these decentralized entities. This means that malfunctions exist on this subject and impede the initiatives of local elected officials. Based on a series of African case studies and numerous examples in other parts of the world, this thesis proposes concrete ways to modernize the Ivorian local government finance system. Full textThe decentralized co-operation which is based on a new type of partnership takes root in research of the durable development of which one of the solutions resides in the restoration of dies of management of the development aid. It is thus the means of diversification and decentralization of the decision-making centre as regards management of the policy of international co-operation especially relative to this help. Also, in margin of the purely official international relations and exclusively policies build it e new give incarnated by the decentralized co-operation of the local authorities still called co-operation “of community to community” to this end, these people take note which are not classified easily in a precise category or a single legal order because pf existence sometimes of several elements of extraneity. From the point of view of the construction of a harmonized Community space, the local authorities and in particular the areas become the instrument of implementation of the European policy. Thus, reforms is structural funds and the creation of national commission of decentralized co-operation take part of the achievement of this objective. Consequently, an important and coordinated engagement is started in favour of the interest of this new exercise of local freedom. This step will become the point of support of a convergent orientation of the local policies for an official recognition of the international action of the local communities. So that the change of he NORTH-SOUTH relations remains especially characterized by the entry in scene of local authorities thus marking the end of the official monopoly and the beginning of emergence of the local authorities in the international relations of the development. In this moment, the decentralized co-operation becomes the new alternative of the economic and social development. In the analysis of this decentralized co-operation, the legal approach of the acts and actors of this new type of partnership are an important shutter. It contributes to the determination of the nature of concluded conventions. As for the aspects of its practical evolution, it seems like the development and the implementation of these conventions or of the projects which they contain. The partnership experiment of the local authorities of franche-comté and west-mountainous of Ivory Coast aims to elucidate all these remarks

Full textA survey of nearly a century of municipal involvement in the artistic and cultural domains reveals both periods of change and continuity. The chronological development of the cultural policies adopted by Dijon can be considered as representative of what happened in the other regional capitals of France. Following on traditions originating in the nineteenth century, the influence of the municipal authority is already perceptible in the early part of the twentieth century, but it was only in the 1960s that a "cultural policy" properly so called began to be formalised. The 1970s, and still more the 1980s, were marked by major qualitative and quantitative developments in the cultural policy. Although remaining a priority throughout the six years following the 1985 election, cultural policy was neglected when the next administration made social problems their main preoccupation. Dijon offers some distinctive features however. For example, the importance of the association bourguignonne culturelle which, for almost thirty years, played a monopolistic role while remaining relatively independent from municipal control

Full textThe object of this thesis is to question the mode of construction of a decentralized public action. More specifically, this work is interested in the methods of institutionalization of a voluntarist regional land policy in Provence-Alpes-Côte d'Azur beyond the block of skills transferred to the Region in 1983. In this perspective, it is a question of studying an original shape of regionalization outside of the hard core of the regional skills, playing however an important role in the construction of the Region and the structuring of a sphere of action. Adopting an approach of search crossing sociology of the public action and the political sociology, we arrest the rules of this regional public space of action by favoring the study of a radius of action established beyond the frame fixed by the law.We so make the hypothesis as the land policy, between multiple sectors and between already institutionalized levels of action, constitutes a space of interactions favored for the analysis of the processes of construction and institutionalization of the Region through a policy in which it participates. By adopting a diachronic and multilevel perspective, that is by favoring the analysis of the change in long lasting within the regional space, and by attaching a particular attention on the interdependent social games which interconnect various levels of public action, the thesis aspires to contribute to the sociological study of the processes of regionalization of the public action under dynamics of decentralization
