Full textThe reflection starts from the conviction that the traditional discourse on dolo – observed as sanction prerequisite in a mostly evidence-devoted analysis – represents, insofar as necessary in its discerning efficacy, only a facet of the mens rea role in criminal law. Some points of emergence of the content richness of dolo, scattered over normative time and space, capture its centrality with respect to prevention, assessment and re-education (or, even better, to restoration of the relational freedom that the will establishes and the crime betrayed). It’s firmly stated that, for the full unfolding of its function, it’s impossible to disregard a genuine scrutiny of the will, in the triple dimension of the action wilfulness, the mental perspective intentionality and the event volition. Evidentiary difficulties and common-sense reasoning risks constitute supporting arguments for the research about non-retaliation responses to the crime, aimed towards the shared reaffirmation of the offended values. Finally, the anchoring of criminal intent to the naturalistic datum of will is assessed as communicative linchpin in contexts of cultural plurality and systematic asset for criminal law as appeal to human freedom.
Salvarezza, Francesca. "Tempo, responsabilità e decisione : Friedrich Nietzsche e Emmanuel Lévinas." Paris 10, 2014. http://www.theses.fr/2014PA100006.
Full textIn this work we have attempted to illustrate, on one hand, Nietzsche’s trajectory in navigating the theme of responsibility, leading to its widespread diffusion within the concept of eternal return, toward the critical theme of decision. This latter theme indicates a formidable venture in thought reaching beyond and through philosophy itself, even as much as the will to power’s very framework or radical line of inquiry, once a similarly constitutive role is adopted and incorporated, appertaining to suffering rather than to action. Such an enterprise sees the confrontation of several elements: an original and vulnerable new openness toward the world, met with astonishment and dismay of the gaze, the hospitality of the absolute Other, and a weakening and renunciation of Ego in favour of Alter. This astonishment and dismay form the principle basis of a new critique, usually defined as “genealogical” as it arises in the imperialistic extreme of logos to break its existence and meaning. On the other hand, using these themes as a foundation, we have examined the possible axis of convergence, primarily temporal, between Nietzsche’s notion of eternity and Levinas’s notion of immemorial past. From Levinas’s opus, we made particular examination of the cardinal theme of responsibility par e pour Autrui and how the environment in which passivity of exposure corresponds initially to a dynamis – an activity – or better yet, the energy of a verb, a “cutting speech,” embodying a profound revision and even an overturning of key principles round which an entire tradition revolves. Even here, one assists in a certain “deconstruction” which attacks all of our “old-world” values. At the time of God’s eternal rest, the question arises of whether a path will be cleared for us in the entropic curve of nihilism – a transitional period aimed at a deeper understanding of our present, no longer merely centred on the levelled, egological primacy of time, but serving above all as an opening to the future. Such a “movement” toward the approaching world would entail a revision of responsibility, radical in its extra-moral basis, thereby not requiring the complete abolition of law. Responsibility thus interpreted hurls Kantian formalism into an irreparable chasmic split: an ipso facto way outside of itself in absolute responsibility, placed beyond rudimentary demands of political-judicial ethics and religious-theological morality. Responsibility would no longer be a passage from present to present, but a passage within the present, acting as time’s very catalyst and provoking the thought of another beginning. There in a fragmented time, our awareness as entities, temporary yet in control of ourselves and of our responsibilities, is definitively put into play. So, first and foremost, is a possible confrontation between Nietzsche and Levinas. Both arrive at the same conclusion, albeit in different ways: if the ethos of responsibility can no longer be rooted in the norm of the dominant language, it must place itself fundamentally under the symbol of promise and of the future, causing an upheaval played out in the violent relationship between all of Western civilisation and its Other. That is to say, it must be deepened in a pathos of “affection” and the realisation of the human being through the “otherness” of the Other

Full textThe subject of the present thesis is an articulated consideration on the various models of Court judgment, concretely identifiable in the juridical experience of Western Europe and of which the following types of sentence models are given: (a) the model of Court judgment where the grounds for the ruling are partially disclosed, specific to the Roman experience; (b) the model of Court judgment where the grounds for the ruling are not disclosed, specific to the pre-modern experience; (c) the model of Court judgment where the grounds for the ruling are disclosed, which points out the transition from pre-modern age to the modern age; (d) and its linked development, represented by the model of Court judgment where the grounds for the ruling are necessarily disclosed. The thesis focuses, in particular, on the analysis of two opposite models of Court judgment: (b) where the grounds for the ruling are not disclosed, specific to the pre-modern experience and (c) where the grounds for the ruling are disclosed. Within this scope, the corresponding reasons will be investigated to answer respectively these questions: “Why the grounds for the ruling should not be disclosed?” and “Why the grounds for the ruling should be disclosed?”. The purpose of the thesis is to introduce that the “reasons to give the grounds for the ruling” are opposite and specular to the “reasons not to give the grounds for the ruling”. In fact, the “reasons to give the grounds for the ruling” are identifiable in: (A) the principle of judge’s “technical” legitimacy; (B) the principle of the questionable (or controllable) nature of the Court judgment; (C) the principle of separation of powers. On the contrary, the “reasons not to give the grounds for the ruling” are identifiable in: (A) the principle of authority; (B) the principle of non-questionable (or non-controllable) nature of the Court judgment; (C) the principle of concentration of powers.

Full textTrauma is defined as tissue injury caused by violence or accident that occurs suddenly and is a common cause of morbidity and death in dogs and cats. There are much factors that may impact outcome in injured dogs and cats, such as severity of injury, age and coexisting disease. In human medicine a large number of complex injury severity scoring schemes are available and they can be used to determine need for referral to advanced trauma centers and identify people who are at hig risk for complications and death. Similar information may be useful for the vetetinary trauma patients. Furthermore trauma patients may need surgery and the damage control surgery is the most recent evolution of human trauma managment. Despite a relatively large amount of licterature available regarding veterinary patients suffering trauma, no guidelines exist to define the optimal timing of definitive surgical intervention. The objectives of the study reported were to describe a population of polytraumatized dog and cats and to determine the variables that may influence the outcome. We also investigated the influence of surgical timing on the outcome of polytraumatized dogs and the incidence of orthopedic surgery complications in politraumatized cats. Cause of injury was most commonly blunt trauma in dogs and cats; the seric albumine concentration, blood lactate concentration and body temperature at the time of hospital admission were predictive of outcome. The surgical timing was not associated with outcome for dogs but dogs with low blood pressure at the time of hospital admission were significantly more likely to die. The complication rate of orthopedic surgery in polytraumatized cats was high; the anemia, surgical wound infections and neurological deficits were the most common complications.

Full textThis dissertation investigates the relationships between decision making (DM), risk taking (RT), and creativity, focusing on divergent thinking (DT). Since risk is an integral part of decision making and often this construct is related to creativity, it was chosen to investigate the relationship between these three variables. Most research focused on age-related changes in DM across the lifespan, has found that decision-making skills tend to decline with age, but the results are controversial. In addition, some authors suggest that there are differences in decision-making styles and risk taking due to cultural background. Finding a relationship between how people make decisions and the role of creative thinking (specifically divergent thinking) in this process could open up the possibility of designing interventions to help people maintain autonomy and independence in their daily DM and risk management behaviors. The firsts two chapters of this dissertation explain the theories and definition of decision making, risk taking and creativity. In addition to a systematic review of the literature presented in chapter three, which investigates how the relationship between creativity and risk has been studied, three studies were conducted in collaboration with the Champlain College in Burlington (Vermont, U.S.A.) and the Catholic University of Milan. From the literature review, some methodological and theoretical implications emerged, particularly the need to have tools that allow a straightforward, adequate, comparable assessment of the constructs. The first two studies have investigated the relationship between decision styles, risk taking and divergent thinking with self-report questionnaires. The first study presented a sample of 140 healthy young (age 18-30) American and Italian subjects. In the second study, the sample included 174 healthy Italian subjects (age 18-75). In contrast, the third study (76 healthy Italian subjects, age 20-75) has investigated the relationship between decision making, risk, and divergent thinking using performance tasks. From the studies, it can be concluded that there is a relationship between creativity (divergent thinking) and the decision-making process. Specifically, divergent thinking skills are related to functional DM strategies and risk-taking profiles defined in the literature as more functional. This may suggest that strengthening divergent thinking may improve risk management and decision-making skills, especially metacognitive ones.

Full textThe theme dealt with in the thesis is that of the extent to which it is possible to speak of concern about the quality of the results, the correctness of the decision (or the truth) within the right process clause. In other words, the main issue guiding the work is to examine whether the justice of the decision is present and therefore protected by the constitutional clause of due process. The present study calls into question the importance of the correct reconstruction of the historical theme within the criminal process, moving from the question of whether the guarantee of due process also involves the concern for the veracity of the historical statement formulated in the decision, as an indispensable requirement for a fair result, and, consequently, as a condition sine qua non for a trial justice. Although the aforementioned court of justice of the trial is usually referred to the protection of the rights and procedural guarantees of the defendants, which leads many authors to believe that the right process is limited to understanding the rights of defense, we start from the hypothesis it is a precept with broader content, so as to include the protection of the quality of jurisdiction and the outcome issued at the end of the process of ascertaining criminal responsibility.

Full textTo write the thesis have read the works of authors who have written on this subject; we then studied all the Court's most important Italian and European. Thesis, however, is an original work for the proposed solutions. The first part of the paper examines the traditional concept of res judicata, we then move on to the study of matter in the Criminal Procedure Code in force in Italy. The second part of the thesis analyzes the concept of ne bis in idem, and all the consequences of the passage in res judicata of the trial story. The third part of the thesis looks at the tools for removal of the res judicata under the Italian Criminal Procedure Code, we study the art. 630 c.p.p., art. 625bis c.p.p. and art. 670 c.p.p. The fourth part of the final paper addresses the relationship between the European Convention, decisions of the European Court and the Italian law. We then move to the analysis of two case studies (affaire Dorigo and affaire Drassich). The final section opens the elaborate scenarios on possible considerations, in light of legislative ideas, to resign, finally, short and original conclusions.

Full textThe aim of this thesis is to explore the possible connection between Theory of Mind (ToM) and two dimensions implicated in the decisional process: the ability to resist to the biases that occur during the evaluation of a decision and the ability to decide when a temporal dimension is involved, both considered in a developmental perspective. The first chapter presents an overview on ToM; the second one provides a wide description of the most investigated decision evaluation biases: hindsight bias and outcome bias; whereas the third one focuses on the choices based on the temporal dimension. The fourth and the fifth chapters show two empirical contributes on how these themes develop and how they are connected. The focus is on primary school-age children, an age range that only recently has been explored. Specifically, in the first study the attention has been directed towards ToM and its possible link with hindsight and outcome biases. In the second study, the mindreading ability is analyzed when children have to take decisions that require the ability to manage the temporal dimension of the present and of the future. The results of both researches highlight the crucial role of mentalizing in the decision-making process.

Full textThe digitalisation of information on the built environment is a complex theme, which requires a multi-disciplinary approach to suit the needs of different users while each class could make use of specific models to reach their targets. In this context, with the aim of providing coherent and non-redundant representations, we need to think to new solutions for storing and sharing technical information. These should be able to capitalize existing knowledge and to integrate new data during the whole lifecycle of buildings. In this direction, representation methods have progressively evolved toward digital technologies, among those the opportunity of making joint use of GIS (Geographic Information System) and BIM (Building Information Modeling) through multi-scalar spatial database is emerging. The adoption of those tools allows defining digital archives that organize knowledge by taking advantage of the potential of IT (Information Technology) for realizing applications aimed at visualizing, querying and analysing building information. The research proposes a workflow for the creation of an information system based on GIS and BIM, able to collect and harmonize heterogeneous data on the built environment within a single platform. The structure is founded on a central core consisting of a standard spatial database, which can be enriched by linking thematic modules and decision support tools, realizing a modular and extensible configuration. In the present case, the theme of energy behaviour and refurbishment of existing buildings is examined in detail. In the European context, the energy efficiency of the built environment is a field of investigation of great interest given the building typologies that are involved. In fact, they often include constructions that are obsolete from a technical perspective, but crucial in the definition of the identity of the communities. For those buildings, interests addressed to the conservation of value and the upgrading of performance could coexist, determining a complex framework. The methodology was applied to the historical centre of Pavia, with a focus on the property asset of its University, which is extremely interesting due to its exceptional value, other than its vastness and variety. Concerning the case study, some applications for displaying energy information and assessing refurbishment scenarios were developed. The experiments show the operability of the workflow and allow to highlight the advantages deriving from the organization of a platform for collecting and sharing data on the built environment, designed to support investigation at different scales and to be inclusive with regard to all users.

Full textPresupposti.

Full textThe dominance of the left cerebral hemisphere (LH) over the right one (RH) for reading is widely recognized in the domain of cognitive neuroscience. However, it is still not clear whether such dominance is underlaid by a complete word blindness of the RH (absolute LH dominance) or by poorer/weaker lexical representations in the RH than in the LH (relative dominance). According to the first account, reading should be impossible when the visual word form system of the LH is lesioned and both afferent and efferent connections with the rest of the LH are interrupted by the lesion. Also, according to this account, hemispheric differences in lateralized reading in healthy subjects are explained by greater sensitivity of the RH than the LH to pre-lexical orthographic processing factors. According to the framework advocating a relative LH dominance for reading and suggesting poorer lexical orthographic abilities of the RH than the LH, reading should be possible even in case of lesion and disconnection of the LH reading system, although limited to frequent and/or concrete words. Accordingly, hemispheric differences in lateralized reading in healthy subjects should be explained by lexical-semantic factors. The predictions of these models were tested by means of a behavioral and structural disconnectome study on a patient with Pure Alexia, and two divided visual field reading studies (conducted on healthy right-handed and left-and right-handed subjects, respectively) in which pre-lexical and lexical factors were manipulated. Evidence of residual reading abilities in case of a LH visual word form system lesioned with both afferent and efferent connections with the rest of the LH being interrupted, together with evidence of a lexical effect accounting for visual field/hemisphere differences in lateralized reading supported the view of a relative LH dominance, according to the idea of the existence of a poorer/weaker orthographic lexicon in the RH. A computational modelling study conducted to simulate the development of orthographic representations in the two hemispheres suggested that weaker orthographic representations in the RH than in the LH -giving rise to such relative LH advantage for reading- could be due to inefficient consolidation of orthographic knowledge in the RH.

Full textA large part of political communication consists in attack and defence messages targeting politicians and their work. The aim of the present research is to analyse the effects of this kind of messages on citizens’ judgments and perception of political candidates. In a series of experimental studies, the effects of messages varying for function (attack vs. defence), style (direct vs. indirect) and content (focus on politicians’ leadership vs. morality dimension). Results showed that attack messages are more effective in influencing the perception of attacked politicians’ integrity when delivered in an indirect way (using counterfactual statements). Politicians’ defences are similarly more effective when using this kind of argumentation, as they influence receivers’ responsibility attributions for past events. Finally, results showed that also the level of political sophistication of receivers can influence the effectiveness of this kind of messages.
