Abstract:
THE PERPETUAL Curate of Allendale, an active participant in the Jacobite rebellion of 1715 who later turned king's evidence, said of William, fourth Lord Widdrington, a leading rebel, ‘it had been happy for him, and so we thought would have been better for us, if he had stayed at home’.’ The comment referred both to Widdrington's military incompetence and to the ruin of his house consequent upon his attainder. For Widdrington was one of the wealthiest Northumbrian Catholics, with estates in Lincolnshire, Northumberland and Durham, none of which was heavily mortgaged or encumbered with major debt, as so many northern Catholic estates were. Moreover, his estates at Stella and Winlaton (in the north-west Durham parish of Ryton) incorporated coal-bearing lands which were ripe for development. The shallow coal seams in Whickham and Gateshead, east of Ryton, were virtually worked out and, in order to satisfy the increasingly demanding London market, northern coal-owners were about to extend operations. Widdrington's estate in north-west Durham lay in the middle of the expanding coalfield and would undoubtedly yield substantial profits. As a result of his involvement in the, ‘Fifteen, however, Widdrington forfeited what was described by an acquisitive coal-owning competitor as this ‘very improvable estate’, and, of course, any future profits its coal-mines might earn. Widdrington was fortunate, even so, in having agents in Durham who were prepared to do all in their power to ensure that he did not lose everything. Albert Silvertop and Joseph Dunn, fellow-Catholics and experienced colliery managers (or ‘viewers’), rightly supposed that whoever took over the Stella estate would work quickly to exhaust its coal reserves before the property could be restored, for the entailed estate would revert to Widdrington's heir at his death. Silvertop and Dunn therefore embarked on a remarkable campaign to deprive the new ownership of the benefits the estate promised. The struggle that ensued was long, and often bloody; it became a trial of strength between the powerful coal magnates and independent entrepreneurs, but it also developed into a contest between Protestants and Catholics in which the Catholics were conspicuous for their aggression in defence of their property and reckless in their defiance of possible repercussions under the penal laws.

Four interrelated reforms in the private law of Ghana were promulgated by the ruling Provisional National Defence Council (P.N.D.C.) on 14 June, 1985: the Intestate Succession Law, 1985 (P.N.D.C.L. Ill); the Customary Marriage and Divorce (Registration) Law, 1985 (P.N.D.C.L. 112); the Administration of Estates (Amendment) Law, 1985 (P.N.D.C.L. 113); and the Head of Family (Accountability) Law, 1985 (P.N.D.C.L. 114). The Intestate Succession Law radically changes the law of inheritance, and constitutes the most extensive legislative reform ever made in the private law of Ghana. The Administration of Estates (Amendment) Law is a minor consequential enactment. The other two Laws are directed primarily to other issues, but bear on the Intestate Succession Law in minor aspects which will be mentioned later.This comment does not seek to provide a detailed textual analysis of the Law, but merely to consider its provenance and general significance in the development of Ghanaian property law.

Abstract:
The defence factor which largely determined the location and shape of historic settlements remains a major determinant of the structure of contemporary global cities. Separated enclaves of guarded housing estates are becoming an extreme sign of their inhabitants’ concern for their own safety. Since they first appeared in Poland, gated communities have enjoyed enormous popularity. The success of this housing model rests above all on the feeling of exclusiveness, achieved through the idea of fencing off. Fear of intruders from the outside appears to be a secondary factor. However, the steadily increasing level of fear effectively fuelled by the sellers of security systems results in more and more sophisticated means of protection of Polish “gated communities”.

Abstract:
Ever since it was discovered in the Topkap? Palace in Istanbul (1889), the Chrysobull of St Stephen has not ceased to attract researchers? attention. It is one of the most representative Serbian medieval charters, and the first known example of a charter in the form of a book. The Chrysobull is a rich resource for linguistic, historical, cultural and ethnic studies of the Serbian medieval state in a wide area covered by the estates of the Banjska monastery. A palaeographic and philological analysis has shown that the same scribe who wrote out this stupendous monument of Serbian medieval law also wrote King Milutin?s founding charter granted to the tower of Hrusija on the sea coast, intended for the defence of the Hilandar monastery (Archbishop Nikodim?s note of confirmation was added by the same hand at the bottom of the scroll). Although rather extensive, this document is more than half as extensive as the Chrysobull of St Stephen. Taking this into account and keeping in mind the fact that it presents a lower degree of original content (the tower was granted a rather small estate in Serbia for its own needs, whereas the estate of the monastery to which it belonged was merely enlarged), this document is, on the whole, a less abundant source of information for research. Nevertheless, it additionally illuminates the activity of a very prominent scribe from the beginning of the golden period of Serbian medieval culture who tried himself in writing original documents and original manuscript copies for the king. The Chrysobull reveals his scribal diversity and contributes to a better understanding of the activities of the royal chancery. The document may be used as a reliable comparative material in linguistic research, as well as a control corpus to check the previous knowledge, but also to make new conclusions. The exceptional significance of the Chrysobull of St Stephen also increases the significance of this Hilandar scroll.

El presente artículo realiza un análisis y estudio de las múltiples torres localizadas en las costas de la Región de Murcia utilizadas para la defensa y vigilancia de las poblaciones costeras ante posibles amenazas. Se tienen en cuenta tanto las fortificaciones construidas por los concejos municipales como aquellas de uso y propiedad privada. Para este fin, dentro del contexto histórico que dio origen a su construcción se realiza una exhaustiva descripción de las características que debían presentar para maximizar su utilidad ante los peligros marítimos, así como las continuas reparaciones y obras que sufrieron a lo largo del tiempo hasta que las desapariciones de las amenazas provenientes del mar sumieron en el abandono y destrucción a la mayoría de ellas. Finalmente, se presenta el análisis de los estados actuales de conservación y preservación de las fortificaciones que aún se conservan en la Región de Murcia. Con el objetivo de proteger y dar a conocer a las torres como bienes patrimoniales que deben de ser conservados y custodiados. Estas torres son tratadas como un vestigio de fenómenos pasados que no sólo afectaron a la zona litoral de Murcia, sino también a toda la costa del Mar Mediterráneo. In this article, both the fortifications built by the local councils that governed the territory of the old Murcia and those of private use and property are analyses. Beside, these towers are located on the coastline of the Region of Murcia where they were used for the defense and surveillance of the coast in case of any threat. For this reason, the historical context that caused the building of these defense systems, among other architectonical elements, are explained as well as the characteristics that such towers should have had in order to maximize their usefulness in case of maritime hazard. Moreover the continuous repairs and constructions that they suffered over time until the disappearance of sea threats are illustrated. Finally, it is important to consider the current estate of conservation and preservation of the fortifications that still survive in the Region of Murcia. In order to protect the public buildings as a cultural and heritage asset that must be preserved and protected. The towers are treated as a remnant of past event that not only affected the littoral zone of Murcia, but also all the coast of the Mediterranean sea. A partir de este estudio se observa cómo la inversión en estos factores influye en la industria de la defensa en Ecuador, y se consideran países como Brasil, Estados Unidos y China como referentes para contextualizar los resultados. Se evidencia así que Ecuador está en proceso de construcción de un sistema de investigación, desarrollo e innovación, articulando políticas enfocadas en el impulso de la industria de la defensa.

This article examines the formation of land defense in relation to changing legal and economic conditions in the occupied Palestinian territories. It argues that as a result of settler capital and law, Palestinian land defense should be understood as emerging through, rather than apart from, private property. Specifically, it explores how private property and market forces shaped agrarian land defense (1970s–1980s) and real estate land defense (post-2007). In the 1970s and the 1980s, land defense sought to protect agriculture against market forces that drew Palestinians off the land and into wage labor in Israel. Beginning in the 1990s, the exclusion of Palestinians from Israeli wage labor and new forms of West Bank governance created the conditions for real estate land defense to appear. Taking the real estate project TABO as a case study, this article details its political logic, unexpected market effects, and its social and economic limits.

Em seu livro, "Perception as a Capacity for Knowledge" (2011), John McDowell defende que a garantia fornecida pela percepção é infalível. Para tanto, é preciso entender o papel que a razão tem na constituição de estados perceptivos genuínos. Por meio dela, posicionamos estes estados no espaço lógico das razões. Assim, não só fazemos do estado perceptivo um episódio de conhecimento, mas também obtemos conhecimento de como chegamos a este conhecimento. McDowell sustenta que esta condição para o conhecimento, a posse da capacidade de posicionar um estado perceptivo no espaço lógico das razões, não o compromete com o intelectualismo. Neste artigo, defendo que o internismo de McDowell não está totalmente livre do intelectualismo e que o internismo é mais plausível não só sem intelectualismo, mas também sem reflexividade.

[full article is in English]EnglishAt the beginning of the 1980s a new Global Space for the expansion of transnational capital emerged in the US–Mexico Border States. The militarization and securitization of that border were justified by government policies aimed at stopping irregular immigration, drug traffic, and terrorism. In 1991 the US Congress approved the creation of a new Defense Industrial and Technology Base (DITB), which would benefit the Gun Belt linked to the Military-Industrial Complex; and in 1992 the Department of Defense (DoD) proposed to establish a Defense Reserve Industrial Base Program (DRIB), the location for which would be within the existing production-sharing centers along the US–Mexico Border. Both, the DITB and the DRIB, would take advantage of the North American Free Trade Agreement (NAFTA), and transnational arms corporations established or expanded their facilities in the Global Space that has been created along the Mexico–US Border. This article examines this process. SpanishA principios de los años ochenta surgió un nuevo Espacio Global para la expansión del capital transnacional en los estados fronterizos de Estados Unidos y México. La militarización y la securitización de esta frontera ha sido justifi cada por estrategias para detener la inmigración irregular, el narcotráfi co y el terrorismo. <p>La Política Común de Seguridad y Defensa (PCSD) de la Unión no ha supuesto un cambio fundamental en la defensa europea que sus artífices esperaban. No podría ser de otra manera, dada la naturaleza de la Unión y las diferentes prioridades estratégicas de sus miembros. Tiene una finalidad, sin embargo, como instrumento de gestión de crisis para tareas de seguridad limitadas y puede actuar como plataforma de solidaridad en apoyo de operaciones dirigidas por Estados Miembros, como en Sahel. Europa se enfrenta a un momento estratégico, ante el pivot de Estados Unidos a Asia y el consiguiente replanteamiento de políticas por Estados Miembros clave. El viejo objetivo de una Defensa Europea independiente no se va a realizar a corto plazo, dada la crisis de defensa en Europa, que podría hacer inalcanzables incluso objetivos de autonomía estratégica limitada. En primer lugar estudiamos el nacimiento de un nuevo espacio delictivo el “ciberespacio” y todas sus amenazas, en una segunda parte vemos la reacción que este fenómeno ha provocado en las naciones y organizaciones internacionales en dirección a determinar y estudiar todos estos delitos, sus causas, métodos y reacciones, para poder combatirlos desde el aspecto legal (legislación española, europea e internacional) y a partir de aquí finalizar mostrando la visión estratégica de defensa de los estados, estudiando como ejemplos las líneas de actuación que utiliza España y Europa para contrarrestar su efecto destructivo en la sociedad actual.ABSTRACTThis article aims to analyze the view of different authors about emergence of cybercrime in the terrorism area (cyberterrorism) and the nations cyber-defense response. Analysis of U.S. immigration, border defense, and national security policies and their impact on individuals, families, and communities from Mexico and Central America who have migrated or fled to the United States as refugees since the mid-1980s suggests that through immigration programs such as Prevention through Deterrence, the United States has crafted a set of policies that creates “preemptive suspects”—categories of people from Central America and Mexico that may be systematically excluded as dangerous, criminal, undeserving, and less valuable than U.S. citizens. Un análisis de las políticas de inmigración, defensa fronteriza y seguridad nacional y su impacto en individuos, familias y comunidades de México y Centroamérica que residen en los Estados Unidos como inmigrantes o refugiados desde mediados de la década de 1980 sugiere que los Estados Unidos ha creado, a través de programas migratorios como la Prevención por Disuasión, un conjunto de políticas que generan “sospechosos preventivos,” es decir, categorías de personas de América Central y México que pueden ser sistemáticamente excluidas como peligrosas, criminales, indignas y de menos valor que los ciudadanos estadunidenses.

Com isso, defende-se a tese de que existe, na matéria, um bloco de constitucionalidade que está alinhado às previsões convencionais que obrigam tais Estados, como a Declaração Universal dos Direitos do Homem e a Convenção Americana de Direitos do Homem. As sequelas das lesões traumáticas da espinal medula representam um elevado prejuízo pessoal, familiar e social. Desde 1984, foi investigado e proposto o tratamento com succinato sódico metilprednisolona em altas doses, como forma de reverter ou prevenir o agravamento dessas lesões. Apresentamos uma revisão da literatura sobre essa temática. Sabe-se que essa terapêutica tem uma elevada taxa de complicações, mas, acerca das suas vantagens e real eficácia, não existe concordância entre autores de trabalhos. Enquanto uns a defendem, outros chegam a considerar provada a sua total contraindicação nessa patologia. Já existem, em nível mundial, alguns centros que não fazem a sua administração. Em Portugal é prática generalizada a sua utilização. Não o fazer poderia mesmo ser difícil de defender em situação de litígio. Mas será que estamos mesmo a ajudar os nossos doentes?

O presente trabalho pretende pensar a realidade cotidiana como uma dimensão em multiplicidade que se abre ao diverso e à diferença. Para desenvolver esta questão, são problematizadas duas concepções sobre a realidade: uma que defende que esta pode ser compreendida como uma unidade totalizável em sua imobilidade, e outra que considera por realidade uma dinâmica em movimento sempre em vias de novas transformações. Na proposta de seguir esses dois modelos de realidade, este trabalho se utiliza, como um cordão de Ariadne, da ação de acompanhar alguns usos que foram feitos, nos últimos dois milênios, da imagem do Diabo. Desdobrando esses diferentes usos no conversar com as teorias de Platão, Hegel, Nietzsche, Deleuze e Guattari, este trabalho defende que as realidades cotidianas são forjadas em encontros incertos a agenciarem misturas que, devindo em multiplicidade, não se filiam a um projeto universal.

One of the most litigated and adjusted areas in taxation has been the determination of the minority interest discount in estate and gift taxation. Valuation disputes arise because the valuation processes for estate and gift taxation are “inherently imprecise,” and the goals of the taxpayer and Internal Revenue Service (IRS) are diametrically opposed. The IRS's vigorous defense of the estate and gift tax base and the taxpayersa' attempts to pay no more tax than is their legal duty have resulted in a history of situations where the taxpayer and the IRS turn to the courts for adjudication. This paper addresses the basis for a minority interest discount, the determination whether ownership interests are in fact minority interests, and the importance of facts and law in the determination of the minority interest discount. A comprehensive analysis of estate and gift tax cases that determined minority interest discounts is used as a basis for planning ideas to maximize these discounts.

Nesse contexto discuto a relação dos "especialistas" com as práticas corporais. Minhas considerações apontam para a dificuldade em se limitar, sem grandes prejuízos, o campo as práticas corporais para os "profissionais de Educação Física". Defendo, por fim, a necessidade de um diálogo mais aberto e menos entrincheirado sobre o tema. The aim of this paper is to present some exploratory reflections on the "Regulation of the Profession of Physical Education". I try to show up some difficulties, implications and consequences, desires, motivations and indispositions that link to the thesis and the application of the regulation of the profession. In that context I discuss the specialists' relationship with the corporal practices. My considerations point for the difficulty in limiting, without great damages, the corporal practices for the "professionals of Physical Education". I defend, however, the need of more free dialogue on the subject.

No Brasil, esta questão surgiu na Estratégia Nacional de Defesa de 2008 e permanece inconclusa no Ministério da Defesa, para o que este relato pretende contribuir. Inicialmente, são visitados conceitos da Gestão Estratégica, adotados como referenciais teóricos. Após, são descritos e analisados os macroprocessos adotados e os documentos que orientam a gestão estratégica de defesa no Brasil, para neles identificar conceitos, funções e efeitos das hipóteses de emprego e das capacidades, bem como sua aderência ao referencial teórico. Em seguida, os principais aspectos do planejamento baseado em capacidades são resumidos visando esclarecer o conceito de capacidades e sua efetividade. Na sequência, o artigo discute as possibilidades de substituição dos conceitos em questão nos processos brasileiros, de forma aderente à teoria da gestão estratégica. With an exploratory intent, this study addresses procedural issues related to the passage of hypotheses of employment key concept adopted in the strategic defense management model in Brazil to the capabilities key concept, as adopted by the United States of America, the North Atlantic Treaty Organization and Australia. In Brazil, this issue emerged in the 2008 National Defense Strategy and remains unfinished in the Ministry of Defense to which this report intends to contribute. Initially, concepts of strategic management adopted as theoretical references are reviewed. Afterwards, Brazilian macroprocesses and documents are described and analyzed in order to identify concepts, functions and effects of the hypotheses of employment and the capabilities as well as their adherence to the theoretical framework. Additionally, the main aspects of capabilities-based planning are summarized with focus on clarifying the concept of capabilities and its effectiveness. Furthermore, the article discusses the possibilities of replacing these concepts within the Brazilian processes so as it may adhere to the strategic management theory. Finally, the study presents favorable and advantageous arguments for the change under analysis, despite the need of procedural adjustments and some integration of both purposes. Con el propósito exploratorio, este estudio se dirige a las cuestiones procedimentales relativas al paso del concepto clave Hipótesis de Empleo, adoptado en el modelo de gestión estratégica de defensa en Brasil, para el concepto clave Capacidades, según lo adoptado por los Estados Unidos de América, países de la Organización del Tratado del Atlántico Norte y Australia. En Brasil, esta cuestión surgió en la Estrategia Nacional de Defensa de 2008 y permanece inconclusa en el Ministerio de Defensa, para lo que este relato pretende contribuir. The thesis about a possibility of violations of the right of the foreclosure of the mortgaged real estate by a third party is grounded.

This article offers the first empirical study of the origins, nature and effects of Australian Defence Force (ADF) opinions about the Australian media's coverage of Defence issues and ADF operations. It summarises the history of fractious military–media relations in Australia, and looks at the principal contributors to the current antipathy between the parties. It argues that while the media routinely denounce the military's motivations in its dealings with the fourth estate, they have no means of understanding its rationale, as until now there has been no empirical analysis of what the military thinks of the media's treatment of it and how these opinions have been shaped. The article then presents and examines the results of its survey of the 2011 intake at the Australian Command and Staff College. From an analysis of these results, it proposes why the ADF has such a low opinion of Australian media coverage of the armed forces, and examines the consequences of these opinions for current and future military–media relations.

En el presente trabajo se analiza la controversia existente en el marco de la sistemática biológica en torno al estatus de la cladística. La utilización del método de parsimonia para la reconstrucción filogenética ha sido defendida apelando a un principio metodológico de simplicidad, así como a principios fácticos externos a la propia sistemática. Se propone aquí un nuevo tipo de enfoque, que consiste en considerarla una teoría fáctica, siendo su aplicación justificada por su éxito empírico. Para defender este punto se brindará una reconstrucción formal estructuralista de la cladística, que ayudará a clarificar cuáles son sus afirmaciones fácticas centrales. A su vez, se muestra cómo estos principios fácticos han sido utilizados para contrastar a tal teoría utilizando filogenias experimentales.

Abstract:
The article analyzes the topography, planning and defense systems of late medieval castles of the Horyn River basin. Literary sources mention 43 castles which is about half of the total number of Volhynian castles of the sixteenth century. Most of them concentrate in the upper reaches of the Horyn River, within the limits of the North Podillia Upland (18) and in the middle reaches of the Horyn in the Volhynian Highland (23). Most of the castles (10) were in the estates of Ostrozki princes. The remains of 16 fortifications were excavated. All of them were the parts of privately owned cities. According to the topographic conditions of the site most of them had the fortifications built on the capes. As for the planning scheme the castles are classified into two groups: the simple (having one fortified site) and multiple (with two fortified sites). Archeological excavations took place in the territory of 5 castles with two fortified sites (Ostroh, Taikury, Dorohobuzh, Rivne, Korets). The fact of the construction of castles in Slavic settlements were studied at 10 sites. The examples of the use of early settlements for the construction of late medieval castles allow conclude that their complex planning (fortified center and suburb) derived from the practice of the period of Kyiv Rus. Concerning the size of the fortified sites, the castles of Pohorynnia (Horyn River basin) are quite diverse. The smallest ones had an area of 0.1—0.2 ha (Krupa, Verkhiv, Marenyn), the largest — 3.2 ha (Ostroh). There is certain dependence between the area of the castles and their administrative and economic importance, primarily the size of subordinated land holdings, estates or parishes. The centers of large land holdings of princely families were Ostroh, Zaslav, Olyka, Korets. Rivne, Klevan and Stepan also were the centers of large territories while Zhukov and Dorohobuzh were the centers of smaller estates. The number of castles in the region significantly increased in the sixteenth century, during the time when the military threat from the Crimean Khanate and the Ottoman Empire increased. Most of the castles had wooden and earth fortifications and only some, in the sixteenth century, were reinforced with stone and brick defense objects — towers, gates, walls.

Freight factoring companies provide much-needed cash flow and additional services to trucking companies. The trucking company sells its accounts receivable, or invoices, at a discount to the freight factoring company and receives an advance of funds in exchange. The freight factoring company will then begin collecting on these invoices from the trucking company’s customers, or debtors. When a debtor sends funds to a freight factoring company, it is paying for the services rendered by the trucking company. As such, the freight factoring company is obligated to apply the funds it receives to its client’s invoices in accordance with remittance attached to the debtor’s payment. When a debtor files bankruptcy, the bankruptcy trustee seeks to recover as much property as possible for the bankruptcy estate. Thus, it is not uncommon for freight factoring companies to find that funds it received from a debtor may be subject to a preferential claim under Bankruptcy Code section 547 for recovery by the bankruptcy estate. However, there is a judicially created exception from recovery called the mere conduit defense. This Comment explores the origins of that defense, its application in cases involving banks as financial intermediaries and as payees on loans, and advocates that freight factoring companies should be viewed as mere conduits in bankruptcy preference claims.

Abstract:
The present research featured the legal nature of the negatory action as one of the common ways to protect the rights of a real estate owner. The article focuses on the ground of this action and the fact in proof in property rights protection cases not related to dispossession. The authors drew a parallel between the negatory action and the prohibitory action which prohibits offensive activities or hazards of injury infliction. In spite of the fact that the prohibitory action used to be associated with the nugatory one, they demand different kinds of actual statutory regulation and law enforcement. The authors agree that the lawsuit on the prohibition of activities, as provided for by Article 1065 of the Civil Code of the Russian Federation, stems from a tort, and is not a proprietary method of defense of rights. In the Russian civil law, the law of neighboring tenements remains underdeveloped, as does the defense of rights of the real estate owner from their neighbors. The authors believe that it is wrong to justify the negatory action by administrative law as this violates the rules for overcoming conflicts of legal regulation, shifting the burden of proof, and deviating from the standards of adversarial and equal rights of the parties in the civil process.

Este artigo defende a tese de que, para superamos o cinismo frente ao sofrimento dos pobres, é preciso ir além: é preciso uma crítica teológica que se liberte do cinismo e trabalhe com a noção de classes sociais, associada ao lugar nas relações sociais de produção, de idolatria e de pecado estrutural.Abstract: The economic crisis affecting the United States and Europe and the worldwide visibility of the movement “Occupy” in the United States brought the issue of social inequality once more to the fore. Generally, in the Churches and in theology, this matter is the target of ethical criticism where the concept of social classes - in terms of income, the rich and the poor - is used. El período de un mundo bipolar Capitalismo vs. Comunismo dejó como resultado un concepto restrictivo de la seguridad, encaminado a la vigilancia y cuidado de un expansionismo ideológico comunista. En este contexto, los Estados suramericanos adoptaron como propias las políticas norteamericanas y lucharon internamente con los brotes comunistas que se manifestaban por medio de partidos políticos y grupos alzados en armas. Actualmente el giro a la izquierda de América Latina está avivado por discursos populistas que han creado nuevas dinámicas en la reconfiguración de la seguridad. La transición de una seguridad hemisférica que se limitaba a las políticas adoptadas por Washington pasó a proyectos para la articulación de ejércitos y fuerzas militares de la región. El ambiente de seguridad mundial en la actualidad está viviendo un momento de discontinuidad o transición, de un modelo de cooperación y convergencia a uno de competencia y divergencia. La Estrategia de Seguridad Nacional de Estados Unidos identifica a ciertos Estados como poderes revisionistas, entre los cuales China y Rusia se destacan por estar orientados a dar forma a un mundo consistente con su modelo autoritario de gobierno. La política de defensa de la administración del Presidente Donald Trump tiene su punto de partida en el mensaje de “América primero”, la cual en general favorece el empleo del poder duro para abordar los desafíos que afecten expresamente los intereses de la nación, mediante la modernización militar con fuerza letal de gran tecnología. Se limita el involucramiento del país en conflictos externos donde no estén en juego los intereses de la nación y adicionalmente, manifiesta la voluntad política para revisar tratados y lograr nuevas condiciones con mayores ventajas y beneficios para el país.

The immediate responsibility for the spiritual well-being of the parish in the early sixteenth century lay with the priest who had the living. Patrons of church livings were able, however, to influence parochial care by extending their patronage to priests who would be certain to maintain their cures satisfactorily. While the patron had no legal obligation to ensure the proper execution of parochial duties by his appointee, a certain degree of responsibility would be expected of men like Sir Thomas More, who allied themselves with the defence of the clerical estate while denouncing the personal or professional shortcomings of many of its members.

The problem of the high social gap in Papua, which is the cause of marginalization and discrimination against the Papuan people, and the different perceptions of some Indonesians at home and abroad towards armed separatist conflicts are push factors to corner the Indonesian government. In addition, the issue of internationalization of the 1969 referendum mechanism, violations of human rights, and the management of natural resources by multinational companies that do not have an impact on improving the welfare of the Papuan people also complement the opinion of the government's failure. Against the background of these problems, this study uses a quasi-qualitative research method. We collected research data through focus group discussions (FGD), in-depth interviews, and direct discussions with various informants (academics, practitioners, bureaucracy, and community leaders), completed with literature review as secondary data. The results of this study recommend the development of an Integrated Food Estate (IFE) in stages according to customary areas in Papua, which will indirectly support the realization of territorial resilience and the Universal Defense System (Sishta). In conclusion, with all implementation of recommendations, it is hoped the completion of peaceful and prosperous Papuan people will come true.

The article focuses on the main legal aspects of the land registry system in Ukraine. Research allowed to identify theshortcomings of the existent, inefficient land registry system, which significantly increase the conflict potential of land matters.The article also covers the preconditions needed for the establishment of an ef ficient land registry system based on the lessonslearned from land surveying activities of the Ministry of Defense. Moreover, it provides a comprehensive description of thecurrent state of the national land registry system of Ukraine. The paper highlights factors enabling the development of a cohesivesystem of measures, that would allow to significantly improve management of the land registry system of Ukraine. A list ofreasons has been provided, justifying a lack of an all-encompassing registration of the military land parcels of the Ministry ofDefense of Ukraine. Besides, many other topical issues related to the military land were identified, including systematicshortcomings that intervene with the comprehensive and legal usage of real estate assets of the Armed Forces of Ukraine. Inorder to ensure that the real estate and land parcel management system conforms to the law, preconditions for the establishmentof a computerized military land and real estate registration system were identified. Research findings included suggestionsrelated to the establishment of land management, registry and land registration center in the structure of MOD, which would dealwith issues related land management, registry and land registration. To ensure direct control and timely response such centerwould have subordinated detachments. The article provides a list of suggestions for the establishment of an efficient controlover the land fund of the Armed Forces of Ukraine, which will not only simplify the process of stock taking, but also will speed upthe process of land parcel transfer to the Ministry of Defense of Ukraine.

La Monarquía Hispánica, en previsión a un desembarco Aliado en Cataluña, se vio obligada a desviar recursos al frente mediterráneo. Felipe V necesitaba tropas, y convocó Cortes en Navarra. Navarra era un territorio leal, pero que mantenía sus propias instituciones políticas –las Cortes y la Diputación–, y su propio sistema fiscal y jurídico –el Fuero General–. Estas particularidades habían mantenido a Navarra al margen de la costosa política exterior de los Habsburgo. Ahora, sin embargo, la situación había cambiado, y la Monarquía tenía que negociar con las Cortes un servicio, en forma de regimientos. AbstractIn the summer of 1705, Spain was about to face civil war. In the eventuality of an Allied landing in Catalonia, the Crown was forced to divert resources to the Mediterranean front. Philip V needed troops, and he called the three estates of Navarre for Cortes. Navarre was a loyal territory, but it had its own political institutions –the Cortes and its permanent commission, the Diputación– and its own tax and juridical system –the Fuero General–. These particularities kept Navarre out of the gruelling Habsburg foreign policy. A Medida Provisória (MP) brasileira é um dos instrumentos legislativos mais poderosos nas mãos do Presidente da República para alterar unilateralmente o status quo. Apesar de o judiciário ter reconhecido a competência dos governadores para instituir e adotar a MP, esta existe apenas em seis estados. O artigo procura explicar a não adoção deste instrumento legislativo pela maioria dos estados. Enfatiza-se a escassa ou marginal relevância que é dada à MP pelo governador nos seis casos que a adotaram. Defende-se, aqui, que os governadores, diferentemente dos presidentes, não necessitam de mais um instrumento legislativo ou da ampliação da delegação de prerrogativas legislativas para garantir sua agenda frente a seus respectivos legislativos, já que com ou sem poder de decreto estadual os governadores controlariam a já limitada agenda decisória nos estados.

Dentro de las posturas que consideran que los animales tienen estatus moral, hay dos tipos de posturas: las que consideran que los animales tienen el mismo estatus moral que los humanos, y las que consideran que los animales tienen menos estatus moral que los humanos. En este artículo argumento que ambos tipos de posturas son práctica y teóricamente equivalentes. En primer lugar, argumentaré que dichas posturas no hacen ninguna diferencia práctica, en tanto desde ellas pueden justificarse los mismos juicios morales. En segundo lugar, argumentaré que, aunque superficialmente pareciera que los mismos juicios morales se justifican de distinta manera desde cada tipo de postura, haciendo un análisis más profundo puede verse que esto no es el caso. De este modo, tampoco hay una diferencia teórica sustancial entre los dos tipos de posturas. Por lo tanto, estos dos tipos de posturas no constituyen diferentes opciones en la defensa de los derechos de los animales.
