Abstract:
Hot air ballooning is a dangerous activity, and not only for the balloonist. In Guille v. Swan, 1 a balloonist crash-landed in a New York vegetable garden. When a crowd rushed to his assistance damage was caused to the vegetables. He was held to be strictly liable for the damage caused. Across the Atlantic balloonists were more glamorous although not more successful. In Scott's Trs. v. Moss, 2 the defender, an Edinburgh impresario, arranged a balloon flight by the “world-renowned scientific aeronaut”, Professor Baldwin. The advertisement promised that the Professor would descend by parachute, landing on ground rented by the defender. In the event, he missed and landed in a turnip field owned by the pursuers. Fences and a large number of turnips were trampled by the crowd rushing to the scene. The Court of Session decided that the defender could be liable only on the basis of fault. Foreseeability was of the essence: the pursuer was entitled to damages if and only if the crowd's actions were the “natural and probable consequence” of the defender's activities. Counsel's research had uncovered Guille v. Swan, but the Court of Session declined to follow it into strict liability.

Abstract:
It has become an embarrassment. The American Conservative crows, “Cesar Chávez, Minuteman,” and the accompanying article delivers the news that the United Farm Workers was not only anti-immigrant but that it set up its own border patrol between Arizona and Mexico. The magazine does not stand alone. Leaders of current right-wing vigilante groups claim Chávez's retroactive endorsement for their occasional attempts to close small sections of the border. In response, Chávez's defenders contend that the UFW opposed the undocumented only when they broke strikes; and besides, that was long ago, and now the union is a strong defender of immigrant rights. Thus, UFW policy toward the undocumented—controversial in its own time—once again has become a subject of public debate, threatening to tarnish the name given to so many California streets, parks, schools, community centers, and even university departments.

Abstract:
This article introduces five terracotta figurines acquired in Egypt by Vladimir S. Golenishchev and N. G. Ter-Mikaelyan and currently preserved at the Pushkin State Museum of Fine Arts. Three statuettes depict the child god Harpocrates with the attributes of royal power; two figurines demonstrate the identification of Harpocrates with the Greek god Eros. Most of the objects can be dated mainly to the Roman times, one is to be dated to the late Ptolemaic period. The places of finding or manufacturing of figurines are mostly unknown; however, according to a number of specific features, these could be towns of the Fayum Oasis, the Delta, and in one case — probably, Edfu. Terracotta figurines of Harpocrates with royal regalia are rare, especially in comparison with the wide-spread occurrence of terracottaе with Harpocrates holding a pot or cornucopia; all these data bring his functions as patron of fertility and defender of health to the fore. The presence of royal attributes seems to be a kind of secondary, partly decorative elements that only enhance the most popular aspects of terracotta images of Harpocrates. The type of figurines depicting Harpocrates sitting on a throne with the crown of the god Amun reproduces the iconography of small bronze sculpture. In other types of terracotta the royal attributes most frequently found are the double crown and — rarely — a nemes-headdress; the crown is usually surrounded by lotus buds, a favorite motive of Harpocrates’ iconography. The childish image of Harpocrates in the time of interaction between Eastern and Western cultures led to a natural synthesis of images of the child gods of Egyptian and Graeco-Roman worlds — Harpocrates and Eros. Apparently, such terracottaе, which had more Hellenistic than Egyptian features, were in demand by the population of different towns in Ptolemaic and Roman Egypt.

Abstract:
In the period of Nobles’ Democracy, the art of war of the Polish-Lithuanian Commonwealth attained the highest level, making a real phenomenon in the then Europe. It owed its development, among others, to outstanding Hetmans of the Crown and Lithuania, victors in many battles, leaders surrounded by fame and admiration, genuine patriots. In the hall of fame of Grand Hetmans, Field Hetmans and Lithuanian Hetmans, a most prominent place is taken by Stanisław Żółkiewski (1747-1620).On 13 June 2019, Members of Parliament passed an occasional resolution dedicating the year 2020 to Stanisław Żółkiewski. The resolution reads, among others, “Stanisław Żółkiewski always put the good of Poland above his own benefits, stood faithfully on the side of successive kings, also in internal conflicts, despite the critical opinion of Sigismund III’s politics. He advocated religious tolerance and easing conflicts. […] The Seym of the Republic of Poland, upon acknowledging the great contributions of Stanisław Żółkiewski, creator of the victory of Klushino and a conqueror of Moscow, tenacious defender of the Mother Country for which he sacrificed his life, establishes the year 2020, which marks the occasion of the 400th anniversary of his death, the Year of Hetman Stanisław Żółkiewski.”

Project by authorship and idealization of the paraense doctor Wirley Otávio Oliveira de Barros, which involves art, science, history and political reflection, developed in the city of Belém, capital of the State of Pará, in the middle of the Amazon region, registered in a notary through a Notarial Act. This grandiose work was developed with scientific support Museum of Geosciences of the Amazon (MUGEO) of the Institute of Geosciences (IG) of the Federal University of Pará (UFPA) through Prof. Dr. Marcondes Lima da Costa, with a PhD in Mineralogy and Geochemistry from Universität Erlangen-Nürnberg (Friedrich-Alexander), in Germany (1982) and with a post-doctorate in mineralogy-geochemistry from IG-USP (2001); chemist Dr. Suyanne Flávia Rodrigues, with a doctorate in Mineralogy and Geochemistry from the Graduate Program in Geology and Geochemistry (PPGG) at IG / UFPA and MsC. geologist Gisele Tavares Marques, also from PPGG. This project, which will soon be presented to the public, was duly informed to Her Majesty, Queen Elizabeth Alexandra Mary Windsor (Elizabeth II), of the United Kingdom of Great Britain and Northern Ireland, in addition to Head of Commonwealth Realms and Defender of Faith, as it presents as a prominent item the replica work of “Saint Edward's Crown” or “St. Stephen’s Crown ”, as mentioned in the Royal letter received on February 3, 2016, signed by Miss Jennie Vine (Deputy to the Senior Correspondence Officer for Buckingham Palace), who on this occasion conveys the monarch's personal message. This is the official coronation crown of British monarchs, consisting of 444 stones of distinct mineral gems, which inspired the title attributed to the project. Therefore, it is a replica of a symbol of POWER, whose heraldic meaning of CRUZ DE MALTA and FLOR-DE-LIS guide the conduct and political profile of the ruler. In this regard, the author also addresses a message to the "men of power", made through a personal text of his own.

Abstract:
Abstract Cato the Younger is often depicted as a principled senator and a vehement defender of republican values, but how did he relate to the people of Rome? The ancient sources present a multifaceted picture of this relation and central to these descriptions are Cato's oratorical qualities as a means to communicate with the urban populace. Cato was an effective orator and aware of the various influential tactics available when addressing the crowd, but he was never the people's hero. While he would, at times, promote people-friendly tactics and ingratiate himself with the crowd, this was only a means to his ultimate end: the advancement of his own interpretation of the res publica.

Abstract:
AbstractThis article examines the music criticism of Nora Douglas Holt, an African American woman who wrote a classical music column for the Chicago Defender (1917–1923) and published a monthly magazine, Music and Poetry (1921–1922). I make two claims regarding the force and impact of Holt's ideas. First, by writing about classical music in the black press, Holt advanced a model of embodied listening that rejected racist attempts to keep African Americans out of the concert hall and embraced a communal approach to knowledge production. Second, Holt was a black feminist intellectual who refuted dominant notions of classical music's putative race- and gender-transcending universalism; instead, she acknowledged the generative possibilities of racial difference in general and blackness in particular. I analyze Holt's intellectual commitments by situating her ideas within the context of early twentieth-century black feminist thought; analyzing the principal themes of her writing in the Chicago Defender and Music and Poetry; and assessing her engagement with a single musical work, Tchaikovsky's Symphony No. 4 in F Minor, op. 36. Ultimately, Holt's criticism offers new insight into how race, gender, and musical activity intersected in the Jim Crow era and invites a more nuanced and capacious understanding of black women's manifold contributions to US musical culture.

Laird, Jess. "Understanding Implicit Bias in Public Defender Social Workers." CSUSB ScholarWorks, 2019. https://scholarworks.lib.csusb.edu/etd/889.

Full text
Abstract:
Research has demonstrated that implicit bias is an inescapable part of the human experience that can have harmful repercussions. Its effects can be seen particularly in the criminal justice system where those of marginalized groups are disproportionately represented. Social workers in the public defender’s office representing indigent clients in the criminal justice system, implicit bias can negatively impact client outcomes or service access. This study sought to explore how these social workers understand implicit bias in their work and will be conducted using qualitative analysis through the use of interviews and document review. This research found that social workers in this setting identify in ways that are very different from their clients and view the resulting implicit bias as an important hurdle to overcome. Social workers reported that working with clients who are similar to them can increase rapport but also introduce issues of countertransference. When working with clients who are different from them, social workers found it most challenging to serve clients with worldviews they found personally offensive, such as homophobia or white supremacy. Social workers of more privileged identities found ways to leverage this advantage to best serve their clients. The participants in this study had mixed feelings on whether or not differences in identity between social workers and clients increase implicit bias or impact client outcomes. There are many larger factors that increase the risk of implicit bias, which participants feel can be mitigated with training and more diverse teams.

Abstract:

Our economic and social welfare depend on certain "critical" infrastructures and key resources. Protecting these infrastructures is a challenge because they are complex, and as systems they are difficult to understand, predict and control. In addition, they do not operate in isolation, but are interdependent with other infrastructures. This presents a challenge for their modeling and analysis. Due to the complexity of modeling the operation of just a single infrastructure, most research to date has analyzed infrastructures in isolation. This thesis introduces a taxonomy of dependence relationships and incorporates these relationships into an attacker-defender model of interdependent infrastructure operation. We formulate and solve a sequence of models to illustrate how dependence relationships between infrastructures create vulnerabilities that are not apparent in single-infrastructure models, and we use the results to assess the consequences of disruptions to a system of infrastructures. We provide complete documentation for how to apply these techniques to real infrastructure problems and include a discussion of the necessary assumptions, as well as the pros and cons of our methods. Finally, we present examples of how to provide relevant, understandable results to help decision makers, such as where to make limited investments to increase resilience.

Abstract:
Our criminal justice system works very hard to prevent criminals from harming other individuals; however, unfortunately mistakes happen. One wrongful conviction is one too many. There are multiple factors that can be assumed to be the cause of wrongful convictions. However, due to the lack of directly related research, the determents are not well established. The following research addresses wrongful convictions as a result of public defender representation. Through the process of theory construction, the research uses critical race theory and social disorganization theory to show the relationship between court appointed representation and wrongful convictions. A new theory is also established that is referred to as the partial load reduction theory. This theory establishes the relationship that exists between wrongful convictions and public defender representation and provides solutions as well as new avenues for future research.

Welch, Teresa Lynn. "The Sources and Extent of Public Defender Occupational Stress." Thesis, Nova Southeastern University, 2018. http://pqdtopen.proquest.com/#viewpdf?dispub=10824847.

Full text
Abstract:

Utah public defenders (n = 96) completed a survey tool that provided data on their sources and extent of occupational stress. The data also indicated any differences in job-stressors scores, perceived stress scores, and occupational burnout scores when comparing public defenders by their demographic factors. Having too many cases is the most stressful of 35 job stressors and is moderately more stressful for female public defenders than for male public defenders, t(94) = –2.98, p = .004, d = .67. The most stressful of six job-stressor categories is structural/systemic, followed closely by prosecutors.

The PSS-10 indicated that a total of 74% of the Utah public defenders perceive themselves as having moderate or high perceived stress. In addition, female public defenders perceive themselves as experiencing more stress than do the male public defenders, t(94) = –3.53, p = .001, d = .80. ANOVA and Games-Howell post hoc indicated that public defenders aged 60 years or older experience minimally less perceived stress than do public defenders ages 30–39 and 50–59 years old, F(4,18.64) = 4.748, p = .008, η 2p = .104. The MBI-HSS indicated that Utah public defenders are experiencing moderate (inching towards higher) levels of occupational burnout. ANOVA and Tukey post hoc indicated that public defenders age 60 years or older experience minimally less emotional exhaustion than are public defenders ages 30–39 and 50–59 years old, F(4, 91) = 2.833, p = .029, η2 p = .111.

Burguera, i. Puigserver Victòria Alba. "Els perills de la mar. Pirateria, captiveri i gestió del conflicte marítim a la Corona d’Aragó (1410-1458)." Doctoral thesis, Universitat de Barcelona, 2020. http://hdl.handle.net/10803/671849.

Full text
Abstract:
This PhD dissertation offers a diversified picture of the management of maritime threats and conflicts in the Crown of Aragon between 1410 and 1458. The chronology covers one of the periods of the Crown’s maximum expansion in the Mediterranean: from the end of the reign of Martin the Humane, the last king of the house of Barcelona, to the death of the second king of the house Trastámara, Alfonso the Magnanimous. My research undertakes the point of view of the three most important maritime cities of the Crown: Barcelona, Valencia and Majorca. The thesis is structured in four big chapters. The first one, by way of introduction, reconstructs the origins of the connections between different management authorities and the maritime war. It analyses the role of the king in controlling privateers and his own fleet, commanded by the admiral; the role of maritime cities, and, successively, that of the Diputació and merchant corporations. The second chapter analyzes the function and composition of the royal fleet and cities’ fleet. The third one deals with the privateering war and includes its objectives, its evolution through various political circumstances and its effects. Finally, the fourth part is dedicated to captivity as a consequence of piracy. This last chapter focuses on the ransoming means linked to the economic duality capture- rescue and on the double use and profitability of human captures between Christians and Muslims.

Fortification plans in Calabria Ultra between the sixteenth and seventeenth centuriesThe Crown of Spain acquired, as it is known, the kingdom of Naples in 1504, which as Viceregno it will be part of the Spanish empire for more than two centuries. The empire between the sixteenth and seventeenth centuries was faced with various challenges, both internal and boundary, particularly maritime, attacked by the Ottoman expansion. Urban and coastal fortification plans were prepared and put in place to defend the territory. Calabria was also a participant in this effort, which the Viceroys directed and followed from Naples, with the approval of Madrid. This study examines the projects and achievements implemented in the chronological period under consideration in Calabria Ultra, current provinces of Reggio Calabria, Vibo Valentia, Catanzaro and Crotone. Particular attention is paid to coastal defense plans with the design of new towers, which combined with city walls and/or castles in state-owned or feudal cities, complement the defensive projects of the coasts. It is important to highlight how the types adopted are consistent with coherent implementations implemented in the extended territory of the empire, thus declaring widespread knowledge and cultural identity in the Europe of the time.

Abstract:
The influence of Pedro Luis Escrivá in the American colonial defense systemThe architect and military engineer Pedro Luis Escrivá (1490 ca. - sixteenth century), at the service of Charles V of Habsburg and the Viceroyal Court of Naples, built two bastioned fortifications designed to considerably influence the subject of territorial defense structures: The quadrangular Spanish Fort of L'Aquila (1534-1567) and the reconstruction of the Sant’Elmo Castle in Naples (1537), with an elongated six-pointed stellar plan, served as a reference point for the European and American fortifications of the period. Due to its size and versatility, the model adopted in L’Aquila was widely used in the Latin American context between the sixteenth and eighteenth centuries. It is found in countries that were Hispanic colonies such as Cuba, Mexico, Venezuela, Chile, Argentina and Uruguay; as well as in the Hispanic domains of the United States and in some of the dependent territories of the Portuguese crown, in Brazil. Based on a historical-architectural and contextual analysis of these structures, the effects of the “cultural transfer” between Europe and America will be investigated with respect to the model devised by Escrivá to promote its cultural valorization.

Abstract:
Cagliari capital and frontier city in the Mediterranean of the modern age: the use of space and walls in archival sourcesIn a city already formed in its essential traits, with its historic districts of Castello, Stampace, Villanova and Llapola, the Hispanic Monarchy had a great influence on Cagliari urban structure adapting the defenses to the new war needs, exploiting to the most the internal walls space and encouraging the cultivation of extra moenia areas left in a state of abandonment. Cagliari was a composite city, were the inner integration between Catalans-Aragonese and Sardinians progressively settled and interacted with different ethnicities, as in other urban realities of the Mediterranean frontiers of that time. Through the archive sources (emphyteusis concessions of state property and notarial acts), it is possible to perceive a lively city and locate the sacred and profane places: palaces, streets, squares, fountains, churches and convents are cited as fundamental citizen reference points. The emphyteusis give us an important basic framework which allows us to know both the urban structure and the policy of the Crown at the same time, through the management of the state properties. Notary’s acts integrate these data bringing interesting information on private estates and on architectural characteristics of the realty.

Abstract:
Archaeology and documentary research: the first bastioned fortifications of Alacant (Spain)In the Courts of the Crown of Aragon held in Monzón (Huesca, 1528) it was raised the need to organise the coast defence of the Kingdom of Valencia through a series of fortification works and the creation and maintenance of militias in order to avoid the attacks and incursions of the Turks and the Berber corsairs. In Alacant (1533), under the auspice of the Duke of Calabria, viceroy of the Kingdom of Valencia, and the design of Joan de Cervelló, noble, military and engineer of King Carlos I and with great experience in artillery and fortification of cities, three bastions were built taking advantage of the medieval walls: Sant Francesc, Sant Bertomeu and Sant Sebastià. These improvement works on the walls continued with the rise of two more towers that protected the gate (Puerta del Mar or Montserrat). The bastions had a circular plan and an escarp elevation up to their half and vertical until the crowning, besides a low armed parapet. They were demolished because of the urban renovations that Alacant experienced during the nineteenth century. However, the historical planimetry, engraving images and photographs, as well as the archaeological excavations carried out in them allow to know their morphology and materials, which are explained in this paper.
