Abstract:
Private sector U.S. defense contractors failing to meet contract objectives experience lower profitability, pay costly penalties, and risk survivability. Using the theory of contracts, the purpose of this multiple case study was to the explore strategies that some leaders of U.S. defense contracting businesses use to meet all the contract terms with the U.S. Department of Defense. Data were collected from 5 leaders of private sector defense contracting companies in northwest Florida through face-to-face, semistructured interviews and through a review of operations manuals, quality assurance policy manuals, and archived U.S. Department of Defense contracts. During data analysis using Yin's 5-step process of compiling, disassembling, reassembling, interpreting, and concluding the data, 4 themes on strategies emerged: (a) communication strategy for successful completion of contracts, (b) technology strategy to monitor contract compliance, (c) training strategy for program managers, and (d) subcontractor selection strategy. The findings indicated that communication among all contract parties was an essential component of each of the 4 themes. Computerizing the contracting workflow to monitor compliance efforts, training program managers for effective oversight of contract compliance, and selecting subcontractors were vital elements of the strategies private sector defense contractors used to meet all the terms and conditions of U.S. Department of Defense contracts. The implications for positive social change include the potential for private sector defense contractors to improve the strength of the defense of the northwest Florida community, lower unemployment, and provide a safer environment for humanity.

In this article, the author highlights the benefits of incorporating the concepts “concession contract” and “long term contract” within the new Civil and Commercial Code of the Nation in Argentina. For the author, these contractual arrangements are fundamental in Administrative Law to understand the scope of the concession of public services, specifically in regard to the introduction of changes in the contract. This also means that foreign police concepts or theories as ius variandi, which only add authoritarian elements under the contract, are not longer required.
En el presente artículo, el autor resalta los beneficios de la incorporación de los conceptos “contrato de concesión” y “contrato de larga duración” dentro del nuevo Código Civil y Comercial de la Nación argentina. Así, para el autor, estas figuras contractuales son fundamentales en el Derecho Administrativo para poder comprender los alcances del contrato de concesión de servicios públicos, específicamente, en cuanto a la introducción de variaciones en la ejecución del contrato. Ello conlleva, además, que ya no se tenga que recurrir a conceptospoliciales extraños o a teorías como la del ius variandi que únicamente añaden elementos autoritarios en el marco del contrato.

Abstract:
The purpose of this study is to examine the determinants of the new entry of an HMO into a Medicare risk contract using a resource dependence—diversification model. This study is conducted through a non-experimental, panel design With one year time lag. An HMO’s market is defined as the service area. The primary sample for this study is composed of 440 HMOS that do not have a Medicare risk contract as of January 1994. Data for the variables are extracted from the 1994 and 1995 InterStudy and Group Health Association of America (GHAA) directories, the 1996 Area Resource File, the 1994 County and City Data Book, the 1993 County Business Patterns. Additional supplementary data on adjusted average per capita cost (AAPCC) and county-level Medicare beneficiaries are obtained from the Health Care Financing Administration. The dependent variable is discrete indicating an HMO’s market entry. Independent variables are grouped into four categories: market structure, resource munificence, market price, and organizational attributes. Twelve hypotheses are tested using multivariate logistic regression. This analysis reveals that HMO enrollment size is a predominant, positive factor in predicting a new market entry. HMOs are also sensitive to the level of AAPCC rates in making a market entry decision. Results from hypothesis testing suggest that competition encourages a new market entry. The importance of resource munificence is not statistically supported. This study demonstrates the appropriateness of a panel design to verify a cause-effect relationship and the applicability of the service area as an HMO’s market. This study also contributes to the theoretical understanding of an HMO’s market entry.

Abstract:

There are currently 4 different generations in the workplace, and the newest generation, Generation Y, has caused leaders within organizations to rethink their management and workplace cultural approach to leading this emerging generation. This qualitative phenomenological dissertation examines the work environment preferences of Generation Y contract managers who work in the Los Angeles area in the defense and aerospace industry by interviewing 11 participants from both the public and private sectors. The research indicates that this new generation, Generation Y or Millennials, prefer to have autonomy over their workload and schedule, but prefer to have their direct manager active in a mentoring and coaching role, rather than acting as a task-master. In addition, the participants in this study preferred a healthy amount of pressure, but not too much of a workload that would cause them to fail. Lastly, this dissertation found that Millennials have a high preference for innovation and using innovative technology in the workplace to increase efficiency.

Abstract:

The purpose of this dissertation was to explore the application of open innovation theory concepts and practices employed in private industry to the federal public sector, specifically the Department of Defense (DoD) Defense Acquisition Management System (DAMS). This study considered using open innovation to improve the DoD’s ability to move innovative products and services through the DAMS faster, at a lower cost, while continuing to meet performance requirements for the DoD’s end-users. The theoretical lens was focused around the core concept of open innovation: collaboration with external parties, principally customers, and the acquisition, integration, and application of knowledge from external parties to improve innovation performance. The study also considered improved performance from the perspective of what the DoD, as the primary customer in the ecosystem, could do to raise the capacity of its supporting industrial base. Furthermore, the study considered the importance, use, and alignment of several secondary enablers that are needed to improve the probability of successfully implementing open innovation, including leadership and governance, culture, intellectual property and legal issues, funding, and technology. The study examined four propositions identified in the literature review and used realist synthesis in combination with the context, intervention, mechanism, and outcomes model to determine their validity. In the synthesis, the study identified four major findings that served to validate each of the propositions, essentially supporting the overall proposition that, as the primary customer in the ecosystem, the DoD’s effective use of collaboration with industry throughout the process and its provision of the right type of information earlier in the process resulted in better innovation performance for everyone in the ecosystem.

La définition historique de l'équilibre économique dans les contrats de concession s'est manifestée principalement au travers de la théorie générale des contrats administratifs. C'est pourtant réduire sa définition à la seule résolution des situations de déséquilibre nées lors de l'exécution du contrat. L'équilibre économique dépasse cette seule fonction de rééquilibrage des relations contractuelles tout comme il relativise le principe qui lui est rattaché du droit financier détenu par le concessionnaire à son maintien. Aussi, la définition de l'équilibre économique des concessions de service public a pu autrement se manifester par la définition d'un mode de rémunération ou encore par la présence de risques et périls. Mais le constat est celui de l'incapacité de définir en réalité l'équilibre économique de la concession de service public par une notion particulière. Cette insuffisance soulève la problématique de l'hétérogénéité des composantes de l'équilibre économique de ce contrat et de la nécessité de le définir par la mécanique permanente existant entre elles. Pour résoudre cette équation à plusieurs inconnues, il convient de reconsidérer l'équilibre économique comme un objet économique et d'en saisir les multiples incidences. Cette occasion est donnée avec la refonte substantielle du régime juridique applicable à toutes les concessions en droit européen et par l'imprégnation des considérations liées au marché. La rénovation de l'équilibre économique des concessions de service public a alors deux objectifs. Elle suggère d'abord une actualisation de la définition de l'équilibre économique à l'aune de la référence faite au risque d'exploitation. L'avènement du risque d'exploitation doit conduire à une définition de l'équilibre économique non exclusive d'autres composantes, mais au contraire révélant la complexité de leur constante interconnexion. Puis, elle impose de réintroduire positivement des données économiques telles que la rentabilité et le profit pour que les personnes publiques puissent en maitriser l'existence et en rationaliser les effets
The economic equilibrium of concession contract’s historical French definition demonstrated through principals drawn from public contract theory. However, this definition reduced the influence of the equilibrium to the contract imbalances. The economic equilibrium definition goes beyond the co-contractor rights to exploit the public service. In addition, the economic equilibrium definition has related to a remuneration model or to co-contractor’s risk. Nevertheless, each time it occurs, it is an unsuccessful try to reveal a thorough definition of the economic equilibrium of concession contract. To resolve the complex equation, it is necessary to use the heterogeneous characteristics in concession contract and to notice the global mechanic among them. The recent concession contract reform in Europe is an opportunity to. First, the definition review should take into account the concept of operating risk and integrating so the interconnectedness of the many factors that characterize concession contract. Then, the definition review should require introducing the economics as aims to make profit and market conditions to streamline the use of the economic equilibrium of concession contract and its effects in contractual relationship

L’intérêt public imprime aux ports une organisation juridique et institutionnelle spéciale. Les installations portuaires doivent fonctionner sans désemparer et aucun usager ne doit en être privé au-delà des restrictions nécessaires à la satisfaction de tous. À ce titre, elles sont traditionnellement soumises au régime de la domanialité publique et les activités qui s’y déroulent à celui du service public. Les deux régimes étant, par leur essence même, exorbitants, leur application simultanée génère une surprotection préjudiciable à la compétitivité des ports.L’objet de cette étude est de démontrer l’inadaptation de la domanialité publique portuaire, tant du point de vue de sa cohérence générale, que de du point de vue de son impact sur le développement des sites portuaires. L’adoption du CGPPP et les réformes postérieures n’ont pas permis de résoudre le problème de l’hypertrophie du domaine public portuaire, pas plus qu’elles n’ont consacré un régime domanial véritablement adapté.L’émergence du régime des conventions de terminal constitue une évolution majeure, mais insuffisante. S’il favorise un certain partage des risques entre autorités portuaires et opérateurs privés, il n’a, malheureusement, pas résolu le problème de la précarité des occupations domaniales. L’insécurité juridique demeure ; ce qui n’encourage pas l’investissement privé.Face aux contraintes du droit de la concurrence et à la généralisation de la libre circulation des biens et des personnes au sein de l’UE, les modalités de gestion des installations portuaires doivent s’adapter aux enjeux modernes de l’économie de marché
Public interest gives harbours a specific legal and institutional framework. Harbour facilities must work continuously and stay available to every user, according to the limitations required to satisfy everybody. As such, they are traditionally subject to the state ownership system and their related activities are subject to the public service one. Both systems are exorbitant by nature. Applying them simultaneously triggers off an overprotection detrimental to harbours competitivity.This study aims at showing the harbour state ownership system is unsuitable, both in terms of overall consistency and its impact on the harbour site growth. Adoption of the general code ruling the public ownership and posterior reforms did not allow to resolve the harbour state ownership hypertrophy issue, nor did they establish an ownership system truly appropriate.Appearing harbour terminals contracts constitute a major but still insufficient evolution. If they do allow to share risks between harbour authorities and private operators to some extent, unfortunately they did not resolve the ownership activities precarity issue. Legal insecurity remains, which does not stimulate private investment.Against competition law obligations and the free movement of goods and people spreading within the EU, harbour facilities management terms need to adapt to today’s market economy challenges

Large scale purchase of armament always are complicated and time-consuming. And there are a lot of disorderly data belonged to the same contract. Those data may be collected from different source and not at the same time. For the reason , it is necessary for contract administrators to integrate and analyze all related data in order to enhance efficiency. The purpose of this study is to design a subsystem to manage purchase contracts which main functions include data processing, reminding and alerting. It will offer comprehensive reports about current situation periodically as well as alarm the administrators of abnormal conditions, analyze the reasons and offer suggestions for reference. It lets users control the whole process toward to contract completion and make decisions properly for the future. It is a bridge between contract administrators and the information used to supervise contract schedule. Beyond producing informations for consulting, check-list of work finished and efficient analysis, its most powerful function is to alert against existing and potential troubles by means of continued data collection and analysis.

abstract: With regard to business modules in Chinese delivery services companies, there has long been a heated debate on whether franchising or direct management is the better module for Chinese market. But most prior discussion was lightweight, unconvincing and without any theoretical framework. This research examines three major management problems in Chinese delivery services: 1. The reason for choosing franchising module, 2. The relationship between franchising module and implementation of the product, 3. The functions of IT in delivery services. By reviewing theories on enterprise boundary and summarizing the six features of franchising contracts in Chinese delivery business as well as the five properties of delivery products, two contract models are finally set up with five beneficial conclusions which are proved by a very solid empirical data analysis. The purpose of this research is to either support or weaken the current theories on enterprise boundary as well as to offer meaningful inspirations for the management of express delivery companies in China.

Abstract:
A survey was undertaken for a contract cleaning company in Durban. In order to preserve the confidentiality of the information contained in this dissertation, a fictitious name, Kleen Co, has been used. The aim of the survey was to find further similarities within the existing segments. At present, the traditional geographic and industry-type bases of segmentation (namely healthcare, hospitality, offices and shopping centres in various regions) are used. Recent literature suggests that similarities can be sought in three areas: 1. expectations of service; 2. perceptions of service; 3. unique benefits of the service. In the survey, clients were asked to rate their expectations and perceptions for six attributes (price of the cleaning service, customer service, quality of cleaning, innovativeness of cleaning methods, assessment of cleaning requirements, and consistency of the cleaning service) . They were also asked to rate the relevance of four reasons for outsourcing (cheaper to outsource, need for specialised cleaning, company policy to outsource, and labour problems). The results indicate that price and innovation can be used as further bases for segmentation for the following segments: • offices and healthcare have the same high expectation for price; healthcare and hospitality have the same high expectation for innovation; • shopping centres and hospitality have the same low expectation for price; • offices and shopping centres have the same low expectation for innovativeness; • healthcare and hospitality have the same high perceptions for price and innovation; • offices and shopping centres have the same low perceptions for price and innovation. For outsourcing are concerned, the following reasons were found: • offices: all reasons are relevant except for price of service. • healthcare: need for specialised cleaning and labour problems are relevant; price of service and company policy are irrelevant; • shopping centres: price of service and company policy are relevant; need for specialised cleaning and labour problems are irrelevant. • hospitals: all reasons are relevant except company policy to outsource. Although the main aim of the survey was to identify new segments, client satisfaction was also measured. Clients were asked whether they had raised a complaint with the company and, if so, how satisfied they were with the outcome. This was done in order to test the loyalty of clients, the hypothesis being that the longer the client had been with Kleen Co, the more satisfied they would be with the outcome of their complaints - and more loyal. However, the data reflect that clients who have been with the company for more than four years are no more satisfied in this regard than clients who have been with the company for shorter periods of time.

Abstract:
Performance Management and Development System (PMDS) is a process of harnessing human and material resources within an organisation to ensure maximum performance to achieve the desired results of improved quality of health service delivery. This study explored and described the ontological experiences of nurses of all categories with contracting and doing performance reviews in a public hospital in the Eastern Cape Province. Purposive sampling approach was used to recruit all categories of nurses Data was collected through unstructured, individual, in-depth interviews with professional nurses and focus group interviews with lower categories. Techs eight step data analysis method was employed to analyse data. Major findings were related to lack of supervisor cooperation, shortage of resources, difficulty in calculating the scores, lack of understanding the tool, time constraints and paperwork which results in the tool being viewed as time consuming. Positive findings were that experiences such as improved relations resulting from spending time with supervisors during performance review sessions. Guidelines were developed, based on the findings, to empower both nurse clinicians and the supervisors in the implementation of the PMDS. ,
