On October 16, 1953, Fidel Castro delivered his now famous speech History Will Absolve Me, while on trial for having led 113 Cuban revolutionaries in an attack on the Moncada military barracks in Santiago de Cuba on July 26. The site served as the headquarters of the Cuban dictator Fulgencio Batista’s military in the southern region of Cuba and was therefore one of the most important military posts in the country. Castro and his men were fighting to overturn the rule of Batista, who had seized power on March 10, 1952, in a coup d’état. Castro’s plan failed, and he and many of his troops were captured by Batista’s army and put on trial. Although the Moncada Barracks attack failed, it signaled the beginning of the Cuban Revolution against Batista and brought Castro into the international spotlight. Castro had been educated as a lawyer and was acting as his own attorney when he delivered his History Will Absolve Me speech, which was later published in full. Over two hours long, his speech outlined the five laws that encompassed the socioeconomic agrarian reform that Castro’s movement wished to implement. History Will Absolve Me was less a legal defense than a denunciation of the Batista regime and a proposal for a new government

The centerpiece of the book defends the principle of remedy and the expanded asymmetry principle, and presents the resulting abolitionist argument. The principle of remedy states that legal institutions must correct their mistakes, and the asymmetry principle holds that underpunishment is preferable to overpunishment. The chapter begins with a brief for the necessity of remedying mistakes, discussing the contemporary legal practices that endorse this obligation and detailing its retributivist bona fides. After clarifying the nature of the imperative, it shows how it functions alongside irrevocability to ground abolitionism. The chapter also unpacks the retributivist challenge and the pro tanto reasons to punish implicit therein. To repel the challenge, an appeal is made to the expanded asymmetry principle, which states that legal institutions must err on the side of leniency even in the face of retributive reasons to punish. After reconstructing recent justifications of the principle, and illuminating their infelicities, a new defense is supplied.

This chapter studies why large social systems generate inequality. Half of it is bona fide returns to merit, while half of it is leverage of personal position into advantages for friends, families, and oneself. The organizations run by the elite take things from people and control their lives. People have lots of reason to resent people who exclude them from opportunities, take things from them, and regulate them. The trouble is that some of these exercises of authority are necessary for a society to function: governments cannot build schools or hospitals or provide defense against invaders unless they collect taxes; students will not learn anything in school if they do not obey the teachers; economic life will be in complete chaos if no one does what they are supposed to do on the job. Talcott Parsons argued that legitimation is what allows all these good things to happen. Without legitimation, society cannot exist. Legitimation is accepting the authority of someone over you as being legitimate. However, legitimation is fragile. We live in a world where powerful individuals and large organizations do not always do the right thing.

For Erasmus, the relationship between God and the human being is rationally and morally acceptable fair play in which both parties have their responsibilities. He follows the teaching of Nominalism: God has promised to grant his grace to anyone who does the minimum that he/she naturally can for receiving grace. “Free choice” means that the human being has the capability of applying him/herself to the things which lead to eternal salvation or turning away from them.Impenitence is a sin that can never be forgiven; moral deeds “attract” grace. For Luther, freedom in moral decisions plays a crucial role in the human community “in front of the world and people,” in relation to the “things below oneself.” But the human being is not free in his/her relation to the “things above oneself,” “in front of God,” or facing the power of unfaith, sin, and demonic evil. Should there be any change in the human’s relation to the realities “above oneself,” it is always a work of God’s prevenient grace effected by the Holy Spirit. Faith is a “new creation” infused into human hearts by God’s Spirit; sola fide is fully a Pneumatological reality for Luther—a fact overlooked in Luther research. The Spirit establishes an intimate union between the Triune God and the human being. Luther creates a massive defense of God’s sovereign grace, sola gratia. The doctrine of two “kingdoms” is the backbone of Luther’s thinking. Erasmus did not make such a distinction; consequently, law and gospel get mixed.
