Full textIn 2002, the French legislator introduced the “juridictions de proximité” in order to approach justice and citizens. These courts are exclusively composed of lay judges who decide about specific issues in first and in last resort. The French legislator defined these new institutions as local access to justice or as a citizen-oriented justice. In due consideration of this aim, the doctoral thesis gives a definition of the expressions “local access to justice” and “citizen-oriented justice”. These definitions allow to highlight the different elements of local access to justice and citizen-oriented justice which serve as a basis for the comparison between German and French procedural law. In the first part of the doctoral thesis, the author analyzes the measures taken in France and in Germany to guarantee local access to justice or citizen-oriented justice. In the second part of the thesis, the author compares these measures with the “juridictions de proximité “. This admits to evaluate the new institution “juridiction de proximité” from an external point of view and to show the necessities of a general model for local access to justice or of a citizen-oriented justice

Full textThe Rule of law concept is a real domestic law dogma and has established itself as a norm in the international judicial order. It is beneft of a clearly defined signification. Different concepts are accepted and depend on the agreements of the state, on a hic et nunc warranty of some rights as well as the rulers political will. This study aims to consider the administrative law, and more specifically the administrative judge’s role, as a means of control over the authority of the state so as to promote the rights and fundamental freedoms of the constituents in France. Even if nothing could portend such an evolution on the account of the state, the Conseil d’État, through a (neo)liberal political influence, became major judicial institution which builds the concept of domestic rule. The administrative juridiction legitimizes the public action of the governments while ensuring the legal security of the constituents through a formal and substantive interpretation of the principle of legality. This relation on between the state and the administrative law state of litigation which can be analyzed as a kaleidoscope of social facts. This stems from a power policy, of a positive conflict between men, the institutions, the normes or the instituted powers. Therefore, by accommodating authority and freedom, the administrative jurisdiction exposes the extent to which the administration is subjected to the administrative law. The objective construction of the administrative Rule of law allows the setting up of an administrative justice, which guarantees the republican values of the State thanks to legal Justice and Legal State. The upgrading of the administrative Rule of law by the democracy provide some freedom to the people vis-à-vis the state. The lack of liberalism fades away in favour of a litigious society, juridification and normatism to the detriment of the state

Full textConstitutional interpretation has become a recurrent issue in modern world. Since the law is subject to interpretation by anyone (judges, doctrine. ordinary citizens), so that "jurists and ordinary citizens accept and affirm (or doubt and refuse) proposals on what the 'law says' of their nation or their state" (Ronald Dworkin), the question is who, among these various actors, is the most legitimate to affirm a finalist interpretation of the law imposing itself on everyone. At the center of this question is the constitutional judge, the empowered interpreter, his judgments and the criticisms raised by the latter. But the judge's interpretation is sometimes. even often, poorly accepte1 which contributes to the weakening of his authority in a competitive legal system marked by pluralism, bath at the stage of the production procedure and al that of the application of the law. Thus, if the judge has the privilege to judge, he also has the necessary vocation to b in turn judged. This necessity is explained by the fact that "Ali power is wicked as long as it can, [but becomes] wise when it feels judged (Alain). In such a context, the question of methods and tools used by the interpreting judge also becomes central because the latter are scrutinized by everyone, often at the expense of the complex interpretative work of the judge. Among these tools and methods c interpretation used by the judge is the use of preparatory work (Hansard). As the basis of a legal interpretation method, the latter become problematic. Beyond the question of the definition of the concept of preparatory work, it should be raised the questions of the role, fore and value of the latter in constitutional interpretation. Thus, this paper aims to try to give an initial answer to these questions, through general reflection on this interpretation method that has been debated, at least, from the Middle Ages

Full textThe spiral bevel gears have various applications. They are widely used in different technical fields, to provide high power transmission between perpendicular axes, mostly in the gearboxes of transport, vehicles, trains or helicopters. Nowadays, industrial development enhances the redefinition of the key points in the spiral bevel gear research and development. Introduction of the CNC manufacturing and CMM measuring systems, the increasing capacity of Finite Elements Modelling lead to complex spiral bevel gear research and development. This research work was concentrated on spiral bevel gears of the Klingelnberg Cyclo-Palloïd system. From fundamental point of view an imaginary crown gear, whose tooth trace is an epicycloids curve, generates the tooth geometry. Tooth height is constant. Different corrections can influence the tooth surface geometry, thus unloaded and loaded contact characteristics. A study on previous research works and theory of gearing had been realized to have an enlarged view and a fine definition of our tasks during the period of this doctoral work. The tooth surface geometry issued from the different machine setting is discussed. Numerical computer programme was developed to model the geometry and the contact characteristics variation in function of corrections or misalignments. Three contact facts like contact pattern, kinematics error and velocity slip are considered. After the unloaded contact analysis, loaded cases were proposed. Hertz contact theory and a finite elements model are applied to define the loaded contact. The real tooth surface was measured and the contact pattern is determined under light load by a testing rig to validate the simulation results. This work has allowed understanding the machine-setting influences on spiral bevel gears of the Klingelnberg Cyclo-Palloïd system to optimize the tooth geometry and the contact

Full textThe aim of this thesis is to improve the definition of vibrations ("seismic motion") on "hard" sites (hard soils or rocks) related to scenarios (earthquakes of magnitude between 5 and 6.5, distances less than 50 km) representative of the French metropolitan context.In order to constrain the seismic motions on "hard" sites, an accelerometric database was built, from the K-NET and KiK-net Japanese recordings which have the benefit of being public, numerous and high quality. A ground motion prediction equation for the acceleration response spectra was developed from this new database. The comparison between theoretical models and observations shows the dependence of vibration on rock sites in both the velocity characteristics of the site (classical parameter describing the S-wave velocity in the last 30 meters) and the high frequency attenuation mechanisms (a phenomenon little studied up to now). These results confirm a correlation between these two mechanisms (the high frequency seismic motion is more attenuated in the case of softer rock sites) and we propose a ground motion prediction equation taking into account all the properties of the site (attenuation and velocity).New methods of nonlinear dynamic analysis (both geotechnical and structural) are not satisfied with the response spectra but require time histories. To generate such time histories, the non-stationary stochastic method previously developed by Pousse et al. (2006) has been revisited. This semi-empirical method requires first to define the distributions of key indicators of seismic motion. We have developed empirical models for predicting the duration, the Arias intensity and the central frequency, parameter describing the frequency content variation over time. New developments of the stochastic method allow to reproduce time histories over a wide frequency band (0.1-50 Hz), to reproduce the non-stationarity in time and frequency and to reproduce the natural variability of seismic vibrations. This method has the advantage of being simple, fast and taking into account basic concepts of seismology (Brune's source, a realistic envelope function, non-stationarity and variability of seismic motion). In earthquake engineering studies, a small number of time histories is selected, and we analyze in the last part the impact of this selection on the conservation of the ground motion natural variability

Full textPersonal Development is largely called upon in the Management Sciences, naming the man-agement practices, coaching and corporate training. Even so, scholarly works aiming at defin-ing Personal Development in an explicit an integrated way remain scarce if any at all. This endeavor seeks to fill into that void by offering a qualitative conceptualization and a quantita-tive operationalization of Personal Development. An in-depth review of literature about the concepts indirectly associated to Personal Development allows us to suggest a conceptualiza-tion that accounts for three main perspectives on Personal Development: Psychological, Soci-ological and Philosophical. This result is largely confirmed by a qualitative study undertaken with a sample of about thirty organizational actors. This same study also offers us instructive insights about the use of Personal Development at work. The overall data collected until then paves the way for a specific quantitative study on the psychological operationalization of Personal Development. It means, conceptualizing Personal Development as a second order multidimensional construct. After selecting several scales measuring different concepts generally connected to Personal Development, we created a questionnaire under the assumption that it would measure Personal Development as a second order factor. The data collected from the survey confirms the existence of a second order fac-tor, with 4 dimensions and a dozen items, after scale discrimination. From that perspective, we can define the second order factor as Personal Development, the dimensions of which are professional flourishing, private flourishing, positive emotions and the mastery sub dimension of Flow. This integrated psychological conceptualization of Personal Development accounts altogether for the professional as well as the private, the hedonic as much as the eudaimonic, the active as well as the more passive side of Personal Development. All this research brings about a whole set of tools usable for a qualitative as much as for a quantitative assessment of Personal Development, in the service of the betterment of Man in the organization, be it in management, for 360 evaluations, career counseling, training, coaching, preventing psychoso-cial risks

remarquable de l'algèbre de Hecke (ce qui donne une représentation non triviale
de cette algèbre), leur valeur au point 1 intervient dans la décomposition de certains
modules de Verma, et leur coefficients peuvent être interprétés comme des dimensions

Full textCan Catalonia be called a nation, or should it still be considered as a region ? Catalonia's geographical, economic, and above all historical features, together with age-old institutions, would rather confirm the first assumption. Catalonia can be characterized as a nation essentially because of its existing distinctive claim for home rule and the defense of its language. Catalonia has struggled to survive : thanks to its supportive civilian society, the real foundation of catalanism, thanks to the rallying power of its political bodies, in spite of vicissitudes under dictatorial regimes that were bent on destroying its identity, and thanks to what it cares for most: the catalan language. From the decret de Nova Planta to the return of the Generalitat with the transition, through the various statutes it adopted, it managed to mobilize its power to claim and to be heard, even in the darkest ages of decadence or the sombre franco days. This voice often took the form of poetry songs, from the Catalan troubadours to the cantautors of the nova canco. The language survived interdiction, oblivion, contempt thanks to learned creators whenever it could benefit by their talent; when this was not possible, thanks to the people who kept it alive by continuously handing it over orally, mostly by singing, a strong point of popular culture. Until a new revival dawned with other poets breathing new inspiration. Catalan has become the official language again. But it must still fight and resist in front of the threat of domination by worldwide languages. Will this struggle ever end to enable catalan to become, as it longs to be, the language of the six million people living in catalonia ? Will it survive into the second millenium ? That is the question for languages that have no state

Full textFor a definition of a fixed asset in Taxation Law we must be guided by those criteria that in the first instance enable the identification of an underlying asset and the calculation of the acquisition cost for that asset. The difficulty resides in the fact that the General Taxation Code contains only one provision, article 38 quinquies (fifth section) of Appendix III which stipulates that: “Fixed assets shall be recorded on the balance sheet at their original value”. Although the Code deals with measurability it falls silent on identification. In the absence of a purely fiscal definition, we need to turn to accountancy law. In this regard, it emerges from article 38 quater (fourth section) of Appendix III of the General Taxation Code that "businesses shall comply with the definitions set out by the General Accountancy Plan subject to these not being incompatible with the applicable regulations for the calculation of tax brackets". In this regard, the General Accountancy Plan defines an asset as “an identifiable component of property having a positive value for the entity, i.e. a component generating a resource that the entity controls owing to previous events and from which it anticipates future financial advantage”. This definition is the result of a profound reform of our accountancy practices. In fact, accountancy has been in a state of upheaval since 1st January 2005, when all listed companies within the European Union were required to publish their consolidated accounts in accordance with international accountancy regulations. What is more, and also under the influence of international accountancy regulations, internal accountancy now tends to favour a financial approach to the detriment of a traditionally asset-based approach. The definition of intangible fixed assets fully confirms this trend and for some it heralds the ultimate disappearance of any specifically French accounting and taxation law

This PhD dissertation is a contribution to the control of integer order systems using a fractional order PID controller.The classical PID, well known for its applications to industrial plants, has been adapted to the fractional case as a PInDf controller, thanks to a fractional order reference model, characterized by its robustness to static gain variations.This new controller has been generalized to time delay systems as a fractional SMITH Predictor. In standard case, these controllers are adapted to first and second order systems, with or without a time delay. For more complex systems, two design methodologies have been proposed, based on the method of moments and on output feedback approach.For systems whose model is obtained by an identification procedure, the closed loop has to be robust to estimation errors. So, a worst-case model, derived from the covariance matrix of the estimator and the frequency uncertainty domains, has been proposed for the design of the controller.The different numerical simulations demonstrate that this methodology is able to provide robustness to static gain variations and to identification uncertainties

Full textThe goal of this dissertation is to study the ways economics terms are defined in economics school readers for the baccdalaureat b (economics). The first chapter deals with the choice of economics school readers, with the selection of a limited corpus, taking into account the instructions on methodology, the reference tools conceming economics and human sciences put at the disposal of grammar school students, as well as the specific methodology at work throughout the dissertation. The second chapter deals with the lay out and the contents of the readers, develops etymological roots and presents the historical backgrounds of economics and the origins of its particular terms. The third chapter attemps to clarify the different aspects of the dictionnary definition relating to the chosen corpus. Denominations are classed grammatically and morphologically and one particular study deals with signs and acronyms. The study of etymologies, foreign roots, official recommandations, relating to the words of the corpus are presented. Then a theoretical distinction is made between "word definition" and" object definition". Common groups are limited on the basis of statistics and their recurrence. The typology of dictionnary definitions reveals two primay categories (lexical ones and didactic ones) and five kinds of dictionnary definitions in the corpus. Finally, the metalanguage at work, classed according to the subject matter and their sub headings is defined before preceeding to the statistical data which will clarify the various levels of understanding of terms which are needed in order to fully comprehend a definition. The last section draws conclusions and attempts to prove the effenciency of the glossaries which are to be found in economics and human sciences school readers

Full textThe French (Cour de Cassation) Supreme Court's decisions wording encompass a significant increase of genuine definitions of labour law concepts. This process raises question insofar it does not fall within the judge's jurisdiction in the (French) legal tradition. This trend makes the " Chambre sociale de la Cour de cassation " (Social senate of the Court of Cassation) the first labour law definitions producer. When defining, is the Social Senate aim at the creation of (new) classifications or does it restrain its action to the framing of the classification operation? Beyond the questioning of this issue, which allows to outline the art of definition, what is at stake is the place definition itself gets within the case law. Full textMany problems exist in PIS (Performance Indicators Systems) design and implementation. So, a lot of methods have been developed by different practitioners and researchers, but none of them has a sufficient covering to solve all these problems. The objective of this research task is to start from all the existing methods to bring out from them , at the one hand, the strengths and the weaknesses and then, to develop a Generalized Framework of Development Methods for Performance Indicators Systems (GFDMPIS). Initially, this framework defines all the modules which should contain any method dedicated to the definition and the implementation of a PIS. In the second time, from this framework, improvements were introduced to the ECOGRAI method. This improved method ECOGRAI* was then applied to an industrial case focused on Management of Maintenance

Full textDespite the problem's currency, contemporary philosophy continues to neglect the need normatively to ground social and economic rights. Classical natural law theory offers reflections that can form the basis for an attempt to do so. Since Cicero, natural law has been thought to establish rules of acquisition without referring to community-based justice. Still, it attributes certain rights to non-owners, such as the defense of necessity or the right of adversarial possession and later, with Leibniz, the obligation in equity to cooperate. The young Kant of 1764 radically rejected both serfdom and wage-labor. Natural justice also demanded the creation of poorhouses. Nonetheless, though natural law distributes ownership without reference to any criteria of justice, the dominum terrae confers the innate right of each man to use the earth. Taken out of context, this seems self-contradictory, since this right cannot be enjoyed at once by all. But Kantian and Fichtean property rights rest on a permissive law which structures ownership to allow for the same freedoms to coexist for all, mutually restricted as necessary but in the same way for all. The Fichtean system recognizes the right to own the productive means to work for his personal subsistence, pleasure and leisure. But Fichte avoids the pitfalls that so often accompany the economic planning he advocates. His social and economic model leaves a genuine place for individual initiative and enterprise, as well as freedom to choose one's own life style. More, it allows for the consideration of how economic progress - which demands investment, a growing division of labor, the adaptation of production and work to the market, and so on - can take place within this same framework of justice
