Full textThe object of my work is about the public funds in Senegal. Senegal is a state of African continental. It has a long time undergone from many strangers influences as Frensh which whom it was its colony. In our introduction, we have studied the history of that country and specificities that draw attention to it. Colonization involved the exporting of frensh's law in general and financial law in particular to Senegal. The interest of this subject consist in looking at how the public funds got used to that country? That country in fact kept its cultural and cultual specificities. We so studied the notion of public funds in its meaning, but in the manner which it is legally managed in that country to. That permit us to see that the management is double. There's in fact a national management which make intervene executive and parliamentary powers. But, there's an supranational management to. Some actors of the international society have an influence on that management. They are Bretton Woods institutions, and some states by the co-operation of west African monetary economic union. This study permit us to see controls of the public funds in Senegal. It is the administrative, parliamentary and jurisdictional control. And then, we have seen the diversity of those controls and difficulties they cope with. We concluded by noting that there is a gap between the Senegalese financial law and financial practicies. And yet, public funds are an economic development tool and any state can prevail a good economic development if it doesn't master its funds. Lot of efforts are made in order to guarantee a good management, but some ways and customs must necessary been banished. There is always hope to see that country get over of it

Full textIn the spirit and the letter of articles 14 and 15 of the Declaration of the Rights of Man and of the Citizen of 26 August 1789, the Constitutional Bylaw n°2001-692 of 1 August 2001 on Budget Acts (hereafter Lolf) dramatically modified the State's new budgetary and accounting structure. However, the scope of the Lolf cannot only be restricted to the vote of budget acts. Indeed, in only a few years, the Lolf enabled modernization of the French administrative setup. Traditional values of public services are henceforth supplemented by emergent values : quality and performance. Searching for the general interest and meeting the expectations of the « citizen-user- taxpayer » triptych are now closely linked. Each budget act is indeed supplemented by an annual performance plan, which determines the purposes of public services, expressed through socio-economic goals of quality, but also, efficiencyTherefore, public funds management must be subjected to first Euro justification and focus on the required results. The Lolf supported decompartmentalisation of all public management actors. A new public financial governance, sometimes qualified as a new social contract, is gradually taking shape, involving together local authorities, State operators, all public services management, but also public benefits recipients. Faced with the new challenges of the 21st century, the French public service has demonstrated its ability to be modernized, as well as creating wealth for the Nation, while preserving its values. Faced with European and international public governance which remains to be built, hasn't the French public service become reference model ?

Full textTax expenditures in favor of the ultramarine real estate investments of natural persons, established for some thirty years now, may well be erased from the French tax landscape: on the one hand, the expected end of these expenditures is fast approaching and on the other hand, these expenses are the subject of much criticism and part of the doctrine militates for their abolition, mainly on the grounds that such expenditure would violate the principle of equality and that they would be too costly and thus detrimental to the Public finances, knowing that the level of public debt is a matter of concern and that control of public funds is required both at national and at European level. At least, a thorough review of these tax expenditures and the law governing them can be used to refute certain stereotypes and to offer a new approach to these expenditures. This examination reveals, against all odds, that these expenses contribute to the restoration of public finances and thus meet the requirement of control of public funds. Moreover, it shows that these expenditures enjoy great legitimacy and must be maintained and extended; they are not contrary to the principle of equality and even allow this principle to flourish; moreover, they make it possible to give concrete expression to the principle of solidarity (notably because they help to guarantee the right to housing and the right to health) and thus constitute "imperious" expenditure, the urgency of expenditures being a new concept emitted - intended to be used for all tax expenditures - making it possible to differentiate between expenditures that must necessarily be made and which could be converted into budgetary expenditures, and those that could not, given the principle of necessity of the tax. However, for such imperious expenses, the question of the justification of their fiscal nature is crucial, that is why a method has been developed to determine whether the tax nature of such expenditures is justified. This method has shown that the fiscal nature of the said expenses favoring the ultramarine investments is appropriate. As legitimate as these expenditures are, however, they are not without criticism and deserve to be reformed. These include better protecting taxpayers who are investing for the purpose of obtaining a tax advantage (among other things by combating questionable legal insecurity) and reducing certain inequalities caused by such expenditures. In this regard, and in order to better respect the principle of solidarity, a number of proposals have been made (some of which could benefit all tax expenditures), among which is the idea of offering taxpayers the opportunity to make their tax-advantaged investments through the tax department, which would transfer the funds belonging to taxpayers to a publicly run company, a proposal with many advantages

Full textConcluding on the subject of freedom of contract in French administrative law is not easy. It depends essentially on how to raise the issue. So if the question is whether public persons have, as individuals, contractual freedom, the answer, in the best case is that this is a special character to freedom. Indeed, in practice, this freedom is very limited, its manifestations are marginal, which prevents us from truly speaking of a "happy freedom." But if the question is whether the French administrative law, from its peculiarities, its originality and its normative rules can recognize such freedom in favor of public entities, then the answer is negative. The public interest, the prerogatives of public power, competence, sovereignty, efficiency of public procurement, proper use of public money and the fundamental principles of public procurement, etc., are fundamental obstacles not only to the recognition of freedom of contract to public persons but also to the effective exercise by them. Some authors have concluded on the contractual freedom of public persons that "in theory it exists but in practice, nobody really ever met it"

Full textThis PHD deals with a public place located in a Parisian suburb named Les Quatre-Chemins. The neighborhood is divided into two areas. The main one is part of Aubervilliers and the second one of Pantin, two cities of la Seine Saint-Denis (93). Quatre- Chemins is very poor and a lot of migrants from different waves of recent migrations live here. As it is full of food shops, drugstores and coffee shops, and as it hosts a subway station, urban life is very intense there. Secondly, the PHD deals with a second public sphere composed by the residents who apply to different social and cultural local policies dedicated to migrants in the city of Aubervilliers. The goal of the PHD is to reveal how sub-Saharan African migrants take place in these two public places and talk about themselves and their private life. How they define what is public and what is private and how they present the private part of their lives. The PHD reveals that in both public spaces, the cultural background of these migrants is neutralized in first place. This means that a few unconscious tricks work so that it seems impossible for the audience to interpret the acts of migrants as something which would be completely determined by their supposed belonging to an assigned migrant community. They can then act as individuals. In the urban public place of Les Quatre-Chemins, the neutralizing operator is composed by different interactional situations. Quatre-Chemins is then close to what Elijah Anderson calls a “cosmopolitan canopy”. In the political and local public space, the neutralizing effect is due to a political and ideological position of the municipality itself. Then, the PHD aims to understand how distinct groups of African migrants from different big cities of Senegal, Ivory Coast and Mali, take place in the streets and coffee shops of Les Quatre- Chemins. How they interact with different people who don’t come from the same regions and how they present themselves, their ethnical background, their working conditions and their private lives

Full textInternet access points are a place where users can access and use digital equipment and connect to internet. Various terms are used to indicate these places : « espaces publics numériques (EPN) », « Netpublics », «cyberbases », « cybercases », « espaces culturels multimédias (ECM) », « Points-cyb », « cybercommunes », « points d’accès public internet (PAPI) » and « cybercafés ». In France, internet access points help people without computer and internet access to use these technologies, to learn and to be assisted in their uses. In Madagascar, internet access points provide access to computer and internet networks but services are fee-based. The objective of this dissertation is to examine the roles of internet access points in ICTs appropriation process by public who visit these places. This research work analyses the theoretical concept of appropriation by using three approaches: the diffusion, the translation and the appropriation. This is followed by a comparative analysis of the uses of computer and internet in internet access points situated in Brest, Reunion Island and Antananarivo. The analysis shows the important role played by societal, economic and geographic contexts on ICTs appropriation. Beyond the uses of ICT in these places, this research attempts to identify users and discuss the reasons of their visits. The results are based on observations, questionnaire surveys and interviews with users in 18 internet access points in Brest, Reunion Island and Antananarivo
