Full textThe object of my work is about the public funds in Senegal. Senegal is a state of African continental. It has a long time undergone from many strangers influences as Frensh which whom it was its colony. In our introduction, we have studied the history of that country and specificities that draw attention to it. Colonization involved the exporting of frensh's law in general and financial law in particular to Senegal. The interest of this subject consist in looking at how the public funds got used to that country? That country in fact kept its cultural and cultual specificities. We so studied the notion of public funds in its meaning, but in the manner which it is legally managed in that country to. That permit us to see that the management is double. There's in fact a national management which make intervene executive and parliamentary powers. But, there's an supranational management to. Some actors of the international society have an influence on that management. They are Bretton Woods institutions, and some states by the co-operation of west African monetary economic union. This study permit us to see controls of the public funds in Senegal. It is the administrative, parliamentary and jurisdictional control. And then, we have seen the diversity of those controls and difficulties they cope with. We concluded by noting that there is a gap between the Senegalese financial law and financial practicies. And yet, public funds are an economic development tool and any state can prevail a good economic development if it doesn't master its funds. Lot of efforts are made in order to guarantee a good management, but some ways and customs must necessary been banished. There is always hope to see that country get over of it

Full textIn the spirit and the letter of articles 14 and 15 of the Declaration of the Rights of Man and of the Citizen of 26 August 1789, the Constitutional Bylaw n°2001-692 of 1 August 2001 on Budget Acts (hereafter Lolf) dramatically modified the State's new budgetary and accounting structure. However, the scope of the Lolf cannot only be restricted to the vote of budget acts. Indeed, in only a few years, the Lolf enabled modernization of the French administrative setup. Traditional values of public services are henceforth supplemented by emergent values : quality and performance. Searching for the general interest and meeting the expectations of the « citizen-user- taxpayer » triptych are now closely linked. Each budget act is indeed supplemented by an annual performance plan, which determines the purposes of public services, expressed through socio-economic goals of quality, but also, efficiencyTherefore, public funds management must be subjected to first Euro justification and focus on the required results. The Lolf supported decompartmentalisation of all public management actors. A new public financial governance, sometimes qualified as a new social contract, is gradually taking shape, involving together local authorities, State operators, all public services management, but also public benefits recipients. Faced with the new challenges of the 21st century, the French public service has demonstrated its ability to be modernized, as well as creating wealth for the Nation, while preserving its values. Faced with European and international public governance which remains to be built, hasn't the French public service become reference model ?

Full textTax expenditures in favor of the ultramarine real estate investments of natural persons, established for some thirty years now, may well be erased from the French tax landscape: on the one hand, the expected end of these expenditures is fast approaching and on the other hand, these expenses are the subject of much criticism and part of the doctrine militates for their abolition, mainly on the grounds that such expenditure would violate the principle of equality and that they would be too costly and thus detrimental to the Public finances, knowing that the level of public debt is a matter of concern and that control of public funds is required both at national and at European level. At least, a thorough review of these tax expenditures and the law governing them can be used to refute certain stereotypes and to offer a new approach to these expenditures. This examination reveals, against all odds, that these expenses contribute to the restoration of public finances and thus meet the requirement of control of public funds. Moreover, it shows that these expenditures enjoy great legitimacy and must be maintained and extended; they are not contrary to the principle of equality and even allow this principle to flourish; moreover, they make it possible to give concrete expression to the principle of solidarity (notably because they help to guarantee the right to housing and the right to health) and thus constitute "imperious" expenditure, the urgency of expenditures being a new concept emitted - intended to be used for all tax expenditures - making it possible to differentiate between expenditures that must necessarily be made and which could be converted into budgetary expenditures, and those that could not, given the principle of necessity of the tax. However, for such imperious expenses, the question of the justification of their fiscal nature is crucial, that is why a method has been developed to determine whether the tax nature of such expenditures is justified. This method has shown that the fiscal nature of the said expenses favoring the ultramarine investments is appropriate. As legitimate as these expenditures are, however, they are not without criticism and deserve to be reformed. These include better protecting taxpayers who are investing for the purpose of obtaining a tax advantage (among other things by combating questionable legal insecurity) and reducing certain inequalities caused by such expenditures. In this regard, and in order to better respect the principle of solidarity, a number of proposals have been made (some of which could benefit all tax expenditures), among which is the idea of offering taxpayers the opportunity to make their tax-advantaged investments through the tax department, which would transfer the funds belonging to taxpayers to a publicly run company, a proposal with many advantages

Full textConcluding on the subject of freedom of contract in French administrative law is not easy. It depends essentially on how to raise the issue. So if the question is whether public persons have, as individuals, contractual freedom, the answer, in the best case is that this is a special character to freedom. Indeed, in practice, this freedom is very limited, its manifestations are marginal, which prevents us from truly speaking of a "happy freedom." But if the question is whether the French administrative law, from its peculiarities, its originality and its normative rules can recognize such freedom in favor of public entities, then the answer is negative. The public interest, the prerogatives of public power, competence, sovereignty, efficiency of public procurement, proper use of public money and the fundamental principles of public procurement, etc., are fundamental obstacles not only to the recognition of freedom of contract to public persons but also to the effective exercise by them. Some authors have concluded on the contractual freedom of public persons that "in theory it exists but in practice, nobody really ever met it"

Full textThis PHD deals with a public place located in a Parisian suburb named Les Quatre-Chemins. The neighborhood is divided into two areas. The main one is part of Aubervilliers and the second one of Pantin, two cities of la Seine Saint-Denis (93). Quatre- Chemins is very poor and a lot of migrants from different waves of recent migrations live here. As it is full of food shops, drugstores and coffee shops, and as it hosts a subway station, urban life is very intense there. Secondly, the PHD deals with a second public sphere composed by the residents who apply to different social and cultural local policies dedicated to migrants in the city of Aubervilliers. The goal of the PHD is to reveal how sub-Saharan African migrants take place in these two public places and talk about themselves and their private life. How they define what is public and what is private and how they present the private part of their lives. The PHD reveals that in both public spaces, the cultural background of these migrants is neutralized in first place. This means that a few unconscious tricks work so that it seems impossible for the audience to interpret the acts of migrants as something which would be completely determined by their supposed belonging to an assigned migrant community. They can then act as individuals. In the urban public place of Les Quatre-Chemins, the neutralizing operator is composed by different interactional situations. Quatre-Chemins is then close to what Elijah Anderson calls a “cosmopolitan canopy”. In the political and local public space, the neutralizing effect is due to a political and ideological position of the municipality itself. Then, the PHD aims to understand how distinct groups of African migrants from different big cities of Senegal, Ivory Coast and Mali, take place in the streets and coffee shops of Les Quatre- Chemins. How they interact with different people who don’t come from the same regions and how they present themselves, their ethnical background, their working conditions and their private lives

Full textInternet access points are a place where users can access and use digital equipment and connect to internet. Various terms are used to indicate these places : « espaces publics numériques (EPN) », « Netpublics », «cyberbases », « cybercases », « espaces culturels multimédias (ECM) », « Points-cyb », « cybercommunes », « points d’accès public internet (PAPI) » and « cybercafés ». In France, internet access points help people without computer and internet access to use these technologies, to learn and to be assisted in their uses. In Madagascar, internet access points provide access to computer and internet networks but services are fee-based. The objective of this dissertation is to examine the roles of internet access points in ICTs appropriation process by public who visit these places. This research work analyses the theoretical concept of appropriation by using three approaches: the diffusion, the translation and the appropriation. This is followed by a comparative analysis of the uses of computer and internet in internet access points situated in Brest, Reunion Island and Antananarivo. The analysis shows the important role played by societal, economic and geographic contexts on ICTs appropriation. Beyond the uses of ICT in these places, this research attempts to identify users and discuss the reasons of their visits. The results are based on observations, questionnaire surveys and interviews with users in 18 internet access points in Brest, Reunion Island and Antananarivo

Full textWhat is the purpose of the philosopher in politics? We examine the way in which this question has been posed and the way in which it was answered in France in the years from the mid-18th century to about 1780. For a context characterized both by the omnipresence of philosophical discourse and its lack of autonomy, we put forward our understanding of the way the possible effects of the political writings of philosophers are identified. Two problems then arise. On the one hand, there is the question of determining under what condition philosophical discourse on politics is deemed useful, and what type of hold it must have on its object to be evaluated as such. On the other hand, the question of the effects produced by the text should invite us to consider how the relationship between the philosopher and his readers is established through the text: how are the ideas communicated, and what are the direct consequences? What is the relationship between knowledge and action?Our investigation has taken two subsequent approaches. First, we sought to identify the terms in which the question of the effects of political works written by philosophers was raised in the second half of the eighteenth century. This has enabled us to highlight the fact that the usefulness of writing is envisaged in two dimensions: insofar as it is likely to affect the world but also insofar as it is likely to contribute to the progress of knowledge and to fuel an intellectual debate. In either case, the form and style of the work are considered central to ensure its effect on the reader and encourage him to think. In a second phase, we sought out examples of a particular genre: Rousseau and Diderot's writing on Corsica, Poland and Russia allowed us to analyze how the counseling philosopher defines his role in relation to the legislator but also attempts to elaborate a language which at the same time allows him to grasp his object in its singularity and to make himself heard by his reader. These two approaches have shown us a distinct sphere of the philosopher's word in politics. While keeping his distance from action, the philosopher is the man of truth; the gradual contestation of the reference to the philosopher as legislator leaves room for a critical use of knowledge. The political fecundity of the philosophical word then appears not in its capacity to institute but rather to facilitate imagining other possible institutions

Full textSaint-Denis, a working class city in the suburb of Paris, is particularly impacted by run-down housing. How does a communist city that promotes an inclusive politics, addresses the question of degraded housing and what are the geopolitical stakes behind the resorption of this type of habitat? Saint-Denis’ elected officials have become outspoken on the question of slums at the national level and lead several projects for inserting their inhabitants in the territory. Those are however more akin to patch-up jobs considering the absence of a national policy and they face the lack of funding, the problem of rehousing, and sometimes negative reactions from other residents. With regards to apartment buildings’ insalubrity, it remains a problem despite thirty years of public policies. This is due to the low efficiency of incentivizing policies, city pauperization, and market-based solutions that attract landlords more interested in economic returns than good maintenance. Since 2008, city hall concentrates its efforts on the downtown area through a major program of urban renewal (PNRQAD), as part of a strategy to revalorize it to attract owners that would maintain housing’s upkeep. The implementation of the PNRQAD raises questions on issues of settlement, image, and sociological evolution of the downtown area, all the more so now that communists are faced with a rising socialist party. Communist elected officials therefore now face an internal contradiction: changing Saint-Denis’ image with the purpose of increasing the quality of housing conditions favors a settlement pattern that will be electorally detrimental to them

Full textThis thesis analyzes the process of politicization and de-politicization of documentary films that focus on stigmatized urban areas. It is based on 42 films made between 2000 and 2010 in the neighborhoods of Centre-ville Basilique in Saint-Denis and La Joliette in Marseille. This research draws from open-focused interviews with directors and content analysis of the studied films, as well as of other promotional or theoretical productions by the same directors. This thesis aims at understanding the structure and logics of a “documentary world” which is gaining structural autonomy towards other social fields. At the intersection of the sociologies of art, cinema, journalism and politically involved professionals, this study analyses the ambiguous positioning of the filmmakers when it comes to taking a political stand in the light of their social and professional backgrounds, of the professional collaborations that develop around the making and distribution of the films, and of the structural divisions organizing the documentary world. This approach allows us to question several dimensions of documentary film making that are often taken for granted: from the creative power of the director and his/her place in the creative process, to the opposition between cinema and journalism, and the relationship between documentary and politics generally speaking. By placing professionalization mechanisms and the relationships that directors develop with filmed participants and the public at the center of the study, this work sheds new light on the process of political commitment by and through cinematographic productions

Full textWithin the context of procurement contracts french authorities have carried some measures to hire young people without professional qualification in building sector. This policy is used to "socialise young people" who have social and professional difficulties. There are many actors who participate to follow actions of this social integration policy: organisation of reception for young job researchers, organisation of vocational training, decision-makers, orders givers, building firms. These actions are the result of local dynamic forces and labour. Institutional models are elaborated to in order to organise round of the young people's social integration. Nevertheless, variety of area divisions creates a superposition of unions and organisations. Hence, the existence of co-ordination problems between different actors of this social integration policy. Thank to this policy french authorities try to share responsibility of social advancement between state's decentralised services, local communities and building firms. Thus the building firm is the main actor of social and professional integration. The stake of this integration is based on the building site. In this context we can ask whether there is any coherence between this integration measures, system of building industry and manpower organisation of this sector too. This research is organised about the social policy applied to a regional suburban area, which is called: "la plaine saint-denis". The object of this research is to analyse young people's social and professional integration process, and to study impact of procurement contracts of building sector on local employment

Full textIn Seine-Saint-Denis and Val-de-Marne (France) several cities are exposed to pluvial flooding. This situation could worsen with climate change. This research develops a social and political perspective of pluvial flooding and climate change risks, in order to define the specificities of local systems which manage pluvial flooding and the contents of the adaptation policy. From the analysis of different policy instruments used to organize pluvial flooding management and climate change adaptation, as well as interviews with urban water management professionals, local officials elected, and citizens who are living in floodable areas, this study describes the local practices and their evolutions. The current evolutions in local practices correspond only partially to those promoted by the climate change policy. The evolutions of risks management practices also depend on resources and political strategies of local stake holders. This work highlights the political program of climate change adaptation and the evolutions in risk management at the local scale. It emphasizes the concepts of policy statements and strategic interactions as keys to analyse risks policies

Full textThe aim of this thesis is to describe and to understand the experience that theatre offers to the bodies gathered there. In order to do so, it relies on the idea of the copresence that permits us to think about the relationship that unites the stage and the audience. But it also reexamines this idea which, having appeared in the field of philosophy in the 1950s, has rapidly been adopted by performance studies where it came finally to designate an individual and hand-to-hand relationship. The first, historical part of the thesis permits thus to show why and how theatre tightens around the effective presence of the bodies, whereas the second, more anthropological part, studying precisely four contemporary performances, both from a stage and audience point of view, recontextualizes the copresence by putting it back into the structured frame which the theatrical space stands for and back into the ensemble composition which the performance forms

Due to the impact of social vicissitudes and low fertility rate in Taiwan, the issues of teachers' dismissed, suspended and denied renewed employment have become spotlight recently. Through the methods of doctrinal studies of law, content analysis and the case studies, the research objects are the teachers of public elementary and secondary school, the main conclusions in this thesis are as follows: 1. The Teachers’ Act, which protect teachers’ rights and obligations, was made very late in 1995. The Article 14 about teacher’s dismissed, suspended, or denied renewed employment has revised many times for insufficiency itself and it still has some conflicts with orther related laws, such like the Act of Governing the Appointment of Educators, and should be overall review. 2. The legal nature of the appointment system for teachers is still controversial. For example, the system of appointment between the school and teacher is considered as an administrative contract but the teacher dismissed by school was determined as the administrative sanction by the supreme administrative court. It is obviously against the “prohibition principle of behavioral forms” of administrative law and results in the expansion of administrative power. In addition, however the teacher’s dismissal the schools’ Teacher Review Committee has judged, it still must be approved by the education authority of superior administrative. Although such circumstance could be explained by the concept of “multi-leveled administrative procedure” and “modified two-phase theory”, it should be reasonable that teachers who are not satisfied with verdict may prosecute a lawsuit to not only school administration but also the education authority. 3. Including appeal and petition, the legal remedies for teacher dismissal are too multiplex to work efficiently at present. For instance, there are two major committees, Teacher Plead Review Committee and Teacher Petition Committee, which were set up to deal with the teachers' grievances. The two committees are also different in many ways, such like members composed, function operated and quorum, so the same case may bring different outcome after running these two systems. 4. Premeditating and dismissing the incompetent teacher is handled by the schools’ Teacher Review Committee. Because there are indefinite legal concept in defining incompetent teacher and the procedural defects in committee works, the functions of the committee are often challenged. 5. By reason of the “authorized discretion” respecting, the dismissed teachers seldom win in the administrative lawsuit and then lost their job forever. Recently according to the judicial yuan interpretation no.702, the law deprived of the right to work eternally is unconstitutional and should be corrected. The revised Teachers’ Act erased the controversial regulation, the Article 14 paragraph 6 about the misconduct and blemished Teacher image, and after dismissing the teacher, the Teachers’ Review Committee may determine a period of between one to four years for renew the teacher’s employment. In the end, the suggestions of solving problems are: Adopting the “temporary administrative act” to interpret the procedure of teacher dismissal; simplified and build the first instance as the final instance for teacher’s administrative relief system. Additionally, considering that apply or integrate the “Three Taiwanese Labor Laws” in the remedial system for teachers' rights and interests.
