Full textO propósito foi determinar se as publicações psicológicas incluem o consentimento informado no procedimento de suas pesquisas. Analisaram-se 1924 artigos de pesquisas empíricas de oito países da Latino-América, publicados entre os anos 1994 e 2012 em revistas indexadas no catálogo de Latindex. A obtenção do consentimento informado esteve se incrementando muito irregularmente ao ano 2012; no entanto, existe uma alta porcentagem de publicações que não obtiveram consentimento. Os países que contemplam o consentimento informado em seus códigos de ética tendem a sua maior aplicação. Consequentemente, não só é necessário regular o consentimento informado mas também promover a reflexão crítica da dimensão científica da Psicologia em um marco deontológico e ético, desde a formação profissional.

Full textThis is a research work on journalism deontology, which was developed with a specific aim: producing a deontological code for journalists in Argentina. The need to create this work lies in the absence of self-regulatory, deontological tools for professional journalism in Argentina, currently struggling amidst a critical context. The most apparent consequences of this crisis are found in the journalists’ lack of credibility and in the poor working conditions in which professionals execute their daily tasks. The absence of institutions representing journalists, the lack of professional associations, the low level of academic standards and the effects of a political dispute which, during the last decade, has involved press workers in the country, have all undermined the prestige and identity of such profession. As proved in this thesis, Argentinean journalists identify the loss of work ethics as the main reason for professional decay. This is accounted for by the absence of a deontological code recognized by professionals: this doctoral thesis aims at fulfilling that need. Additionally, this research work also delivers a general analysis on deontological coding in Latin America, where obsolete tools failing at responding to current needs or problems of professional journalism prevail. This work presents the current status of discussions around journalistic deontology while it develops a critical analysis on the nature and purpose of deontological codes for professional journalism. Adding to the debate, this work also revisits a set of topics related to digitalization processes and the journalistic approach to social issues not yet addressed by self-regulatory mechanisms in Latin America. Thus, the deontological code for journalistic activity in Argentina presented at the end of this thesis is the result of a conceptual, analytical and empirical approach contributing to the Argentinean case, as well as to the theoretical universe applied to journalistic deontology.

Full textCompilación y comparación de los códigos deontològics de cadenas y corporaciones televisivas de diferentes países: Estados Unidos (ABC, CBS y NBC), Canadá (SRC/CBC), Gran Bretaña (BBC e ITC), Italia (RAI), Brasil (ABERT) y Japón (NAB). El estudio se inscribe en una línea de investigación que parte del postulado que los códigos deontològics contienen una parte sustancial de los valores y de las normas éticas vigentes para la profesión periodística. La metodología seguida es la propia del Derecho Comparado: se ha elaborado un "tesauro" que comprende, con ánimo de exhaustividad, los diferentes ítems que constituyen el bagaje de problemas éticos que se plantean en el ejercicio del periodismo en general y, más particularmente, en los medios audiovisuales. Para cada ítem se presenta una exposición del estado de la cuestión sobre la materia y, a continuación, se hace la relación y la comparación de las normas que hay establecidas en los diferentes códigos que constituyen el corpus de la investigación. Esta tarea analítica está flanqueada por una reflexión teórica sobre las bases de la ética periodística y se alimenta también de la experiencia personal del autor de la tesis en el campo de la información televisiva.
Compilation and comparison of the deontological codes of television broadcasting corporations and channels in different countries: United States (ABC, CBS and NBC), Canada (SRC/CBC), Great Britain (BBC and ITC), Italy (RAI), Brazil (ABERT) and Japan (NAB). The study is part of an investigative approach based on the hypothesis that deontological codes contain a substantial part of the ethical values and standards which apply to the journalism profession. The methodology used consisted of a Comparative Study: an exhaustive "thesaurus" was prepared of the different items constituting the baggage of ethical problems which arise in the exercise of journalism in general and more particularly in the audio-visual media. For each item is presented an explanation of the status of the question on the subject and afterwards a list is prepared and a comparison of the standards make up the different codes constituting the body of the research. This analytical task is surrounded by a theoretical reflection on the bases of journalistic ethics and is supplemented by the author's personal experience in the field of television reporting.

Full textSe trata de una tesis por compilación de artículos que giran alrededor de la temática de los valores y la ética aplicada en la educación social. Se presenta con más profundidad el sentido de la ética aplicada en el mundo de las profesiones, así como la conveniencia de profundizar en las razones que hacen necesario hablar de ética aplicada en la educación social. A continuación se analiza los pasos que ha hecho esta profesión en la construcción de un sistema orientador para el tratamiento de las cuestiones morales que se dan en la práctica profesonal, vinculado al proceso de construcción de la propia identidad y los elementos que dificultan el desarrollo de este sistema de carácter ético. Finalmente, se proponen algunas vías para impulsar el desarrollo de este sitema a partir de las aportaciones de la hermenéutica crítica.
This thesis is presented as a compilation of articles that deal with the themes values and applied ethics in social education. The sense of applied ethics in the world of professions is hereby studied in depth and so is the convenience of studying the reasons that create a need to talk about applied ethics in social education. Next, we present an analysis of the steps that this profession has taken in the construction of an orientation system for the treatment of moral issues arisen out of the professional practice, connected to the process of self-identity construction and to the elements that show difficulties to the development of this ethics-based system. Finally, several options based on the hermeneutic critics are hereby proposed in order to foster this ethics-based system.

Full text[ES] El Diseño es, por naturaleza, una actividad útil a la sociedad y su práctica debería tener como objetivo indisociable la mejora de la calidad de vida de esa misma sociedad. Todas las otras actividades profesionales que influyen directamente en esa mejora de la calidad de vida, el bienestar, la seguridad física o psíquica y la vida de los seres humanos en general, se consideran "profesiones de elevado riesgo social" y, por esa razón, se encuentran en la actualidad sujetas a normativas que regulan el acceso y su ejercicio. Por las mismas razones, el diseño también debe acceder a ese estatuto de profesión reglamentada para posibilitar ejercer la actividad en cualquiera de los países de la Unión Europea sin necesidad de otros reconocimientos. El diseño se encuentra todavía en un proceso de formación y maduración. También se encuentra en vías de establecer conexiones con otras áreas de conocimiento entre las cuales, obviamente, se incluye el universo de la ética. En él se discuten principios, valores y responsabilidades que complementan los conocimientos y prácticas de naturaleza técnica. La ética se encuentra siempre implícita en cualquier acción del ser humano y la humanidad no sobrevive ni evoluciona sin ella. Todos nosotros somos portadores de una dignidad originaria que es consubstancial al principio de igualdad fundamental de derecho de todos los hombres.Por lo tanto, también parece indispensable adquirir una base ética en las concepciones y actuaciones del diseño, que sea la que imprima el valor trascendente de esta actividad. La adopción de patrones reconocibles y comunes permiten una actuación justa y consistente y los modelos de conducta profesional aseguran derechos y deberes de las partes, estableciendo, sin lugar a dudas, los compromisos con la calidad y la construcción de relaciones duraderas. En este contexto, parece necesario investigar la posible carencia, en la actividad del Diseño, de una filosofía propia para que sus profesionales puedan ejercer. En caso afirmativo, será necesario formular y proponer el marco teórico en que basar el ejercicio de la actividad. En nuestra opinión, también parece necesario aclarar si el Diseño, en su proceso actual de adaptación de conceptos y de creación de metodologías útiles a la sociedad, puede contribuir a la recuperación del protagonismo del pensamiento humanístico, principalmente a través de una praxis respaldada por valores perceptibles en el enaltecimiento y respeto por la condición humana, por el medio ambiente que soporta la vida y por la explotación sostenible de los recursos naturales. Teniendo en cuenta este objetivo, hemos considerado pertinente seguir el camino que cubre los siguientes aspectos: se han estudiado comparativamente las normativas de profesiones afines; se ha investigado y analizado la posible necesidad de una normativa para la actividad de diseño; se estructuró la aplicabilidad de una normativa; se ha definido una propuesta legislativa; se analizaron las posibles implicaciones para los diseñadores de la implementación de una normativa y, delante la existencia de una normativa, se han identificado los aspectos más relevantes para los beneficiarios de los servicios de diseño y se han evaluado las implicaciones en las relaciones del diseño con la sociedad. Con este trabajo de investigación, se ha pretendido, principalmente: - Definir una base filosófica que fundamente el ejercicio de la actividad; - Identificar las preocupaciones éticas y deontológicas que deben ser observadas por los diseñadores, en sus relaciones con los clientes, con los beneficiarios de los servicios de diseño, con sus compañeros, con el medio ambiente y con el uso sostenible de los recursos naturales; - Contribuir al prestigio de la profesión y al reconocimiento de la importancia del diseño y de los diseñadores para la construcción de un mundo mejor y de un futuro con futuro.
[CAT] El Disseny és, per naturalesa, una activitat útil a la societat i la seua pràctica hauria de tenir com a objectiu indissociable la millora de la qualitat de vida d'aqueixa mateixa societat. Totes les altres activitats professionals que influeixen directament en aqueixa millora de la qualitat de vida, el benestar, la seguretat física o psíquica i la vida dels éssers humans en general, es consideren "professions d'elevat risc social" i, per aqueixa raó, es troben en l'actualitat subjectes a normatives que regulen l'accés i el seu exercici. Per les mateixes raons, el disseny també ha d'accedir a aqueix estatut de professió reglamentada per a possibilitar exercir l'activitat en qualsevol dels països de la Unió Europea sense necessitat d'altres reconeixements. El disseny es troba encara en un procés de formació i maduració. També es troba en vies d'establir connexions amb altres àrees de coneixement entre les quals, òbviament, s'inclou l'univers de l'ètica. En ell es discuteixen principis, valors i responsabilitats que complementen els coneixements i pràctiques de naturalesa tècnica. L'ètica es troba sempre implícita en qualsevol acció de l'ésser humà i la humanitat no sobreviu ni evoluciona sense ella. Tots nosaltres som portadors d'una dignitat originària que és consubstancial al principi d'igualtat fonamental de dret de tots els homes. Per tant, també sembla indispensable adquirir una base ètica en les concepcions i actuacions del disseny, que siga la que imprimisca el valor transcendent d'aquesta activitat. L'adopció de patrons recognoscibles i comuns permeten una actuació justa i consistent i els models de conducta professional asseguren drets i deures de les parts, establint, sense cap dubte, els compromisos amb la qualitat i la construcció de relacions duradores. En aquest context, sembla necessari investigar la possible manca, en l'activitat del Disseny, d'una filosofia pròpia perquè els seus professionals puguen exercir. En cas afirmatiu, serà necessari formular i proposar el marc teòric en què basar l'exercici de l'activitat. En la nostra opinió, també sembla necessari aclarir si el Disseny, en el seu procés actual d'adaptació de conceptes i de creació de metodologies útils a la societat, pot contribuir a la recuperació del protagonisme del pensament humanístic, principalment a través d'una praxi recolzada per valors perceptibles en l'enaltiment i respecte per la condició humana, pel medi ambient que suporta la vida i per l'explotació sostenible dels recursos naturals. Tenint en compte aquest objectiu, hem considerat pertinent seguir el camí que cobreix els següents aspectes: s'han estudiat comparativament les normatives de professions afins; s'ha investigat i analitzat la possible necessitat d'una normativa per a l'activitat de disseny; es va estructurar l'aplicabilitat d'una normativa; s'ha definit una proposta legislativa; es van analitzar les possibles implicacions per als dissenyadors de la implementació d'una normativa i, davant l'existència d'una normativa, s'han identificat els aspectes més rellevants per als beneficiaris dels serveis de disseny i s'han avaluat les implicacions en les relacions del disseny amb la societat. Full textA importância de um comportamento ético dos contabilistas é um pilar na sustentabilidade das empresas. Tal importância da ética e da deontologia nesta profissão justifica o presente trabalho, cujo objetivo passa por avaliar o comportamento ético dos Contabilistas Certificados(CC), a partir do quadro legal da Ordem profissional. Para o efeito, o estudo desenvolvido foi suportado numa metodologia de cariz qualitativa e quantitativa com recurso a um questionário dirigidos aos contabilistas certificados. Após a análise dos resultados, conclui-se que a maioria dos CC inquiridos são profissionais com um comportamento ético e deontológico adequados. Denota-se, que os profissionais, em geral têm um conhecimento do código deontológico na sua formação académica, bem como a sua relevância e agem de acordo com os princípios e valores morais e que alguns mostraram não valorizarem e não respeitam os princípios éticos e deontológicos, sendo os mais velhos e com menos habilitações literárias são aqueles que “não cumprem” o código.
The performance of companies and their businesses is a pillar in the sustainability of companies. For this purpose, the design was supported in a qualitative and quantitative qualification methodology using a questionnaire addressed to certified accountants. After an analysis of the results, it is concluded that the respondents are professionals with an ethical and deontological behavior appropriate. It is also pointed out that professionals do not have a high degree of knowledge about their academic education, as well as their relevance and act according to their principles and values. On the other hand, there were also respondents who were not valued and did not respect the ethical and deontological principles, and the older and less literate are those who "do not comply" the code.

Tanmateix, en els darrers anys hem assistit a una proliferació de fonts d’informació organitzades que han incrementat la seva capacitat per accedir a l’agenda temàtica dels mitjans. Full textThe object of dissertation is bioethical theories based on deontology and utilitarianism. The purpose of dissertation is to examine if ethical principles proposed in bioethical theories are normatively justified. In this work comparative analysis of bioethical theories is made and theoretical assumptions of bioethical conceptions are analyzed. It is stated that according to the construction manner of the analyzed bioethical theories it is possible to group these theories to homogenic and heterogenic ones. Homogenic theories are proceeding along particular ethical tradition (deontological or utilitarian) and propose to deal with bioethical controversies such as abortion, euthanasia, assisted suicide applying particular value-system. Heterogenic theories are trying to combine deontology with utilitarianism in one conception and in this way to propose method suitable for pluralistic society for dealing with bioethical controversies. In this work it is stated that bioethical theories based on deontology and utilitarianism do not introduce any clear and acceptable principles and methods needed for solving bioethical issues.

Full textMokslinio darbo objektas - bioetikos teorijos, paremtos deontologija ir utilitarizmu. Darbo tikslas – įvertinti bioetikos teorijose siūlomų etinių principų normatyvinį pagrįstumą. Moksliniame darbe yra atlikta lyginamoji bioetikos teorijų analizė, išanalizuotas teorinių bioetikos koncepcijų prielaidų pagrįstumas. Yra teigiama, kad analizuojamas bioetikos teorijas galima skirstyti pagal jų konstravimo podūdį į homogeniškas ir heterogeniškas. Homogeniškos teorijos tesia konkrečią etinę tradiciją (deontologijos ar utilitarizmo) ir siūlo spręsti bioetines kontroversijas, tokias kaip abortai, eunazija, pagelbstimoji savižudybė taikant konkrečias vertybines nuostatas, būdingas astovaujamai šakai. Heterogeniškos teorijos bando derinti deontologiją su utilitarizmu vienoje koncepcijoje, siekdamos pasiūlyti bioetinių kontroversijų sprendimo būdus priimtinus pliuralistinėje visuomenėje. Disertacijoje teigiama, kad deontologija ir utilitarizmu pagrįstos bioetinės teorijos nepasiūlo aiškių ir priimtinų principų, reikalingų sprendžiant bioetines kontroversijas.

Full textEstablece la relación existente entre la deontología profesional y la formación de la identidad cultural de los estudiantes de la Carrera Profesional de Turismo de la Universidad Nacional de San Antonio Abad Del Cusco – 2013. Para este efecto se ha encuestado a 204 estudiantes de la carrera profesional de Turismo, con un muestreo de tipo probabilístico, los datos han sido procesados y analizados con el programa SPSS. Las conclusiones permiten corroborar que existe relación entre la práctica profesional y la formación del sentido de autorreconocimiento en los estudiantes de la carrera profesional de turismo de la Universidad Nacional de San Antonio Abad del Cusco. (p<0,05). Se evidencia que existe relación entre el comportamiento ético y la formación del sentido de pertenencia cultural en los estudiantes de la carrera profesional de turismo de la Universidad Nacional de San Antonio Abad del Cusco. (p<0,05). Se evidencia que existe relación entre la responsabilidad social y la formación del nivel de compromiso en los estudiantes de la carrera profesional de turismo de la Universidad Nacional de San Antonio Abad del Cusco. (p<0,05). Finalmente se evidencia que existe relación entre deontología profesional y la formación de la identidad cultural de los estudiantes de la Carrera Profesional de Turismo de La Universidad Nacional de San Antonio Abad Del Cusco (p<0,05).

Full textEn este trabajo se describe el estado de la enseñanza de la asignatura de Ética y Deontología periodísticas, se explica la percepción de los periodistas sobre diversas cuestiones éticas y se comparan las respuestas de profesores e informadores sobre algunos aspectos concretos en 2012 en España. Como en ese momento la universidad española se hallaba en plena transición al Espacio Europeo de Educación Superior (EEES), se analiza también una muestra de programas impartidos en licenciatura y grado por un mismo profesor, a fin de determinar si se estaba produciendo o no una mejora en la calidad de la enseñanza. Todo ello se acompaña, además, con una perspectiva histórica que permite conocer mejor la evolución de la enseñanza de la materia y de los dilemas morales, la ética, deontología y autorregulación de los profesionales. Dicha información se ha obtenido a partir de dos encuestas en línea, una a docentes y otra a periodistas, así como de un análisis de contenido y bibliográfico, respectivamente. En la parte académica, el lector podrá conocer quiénes impartían dicha materia en la carrera de Periodismo en las facultades de Comunicación españolas, qué enseñaban y cómo lo hacían durante el curso 2011-2012. Y averiguará, por ejemplo, que los profesores se plantean metas educativas muy prácticas y ambiciosas, pero que después no son coherentes con los sistemas de evaluación empleados, más propios de clases magistrales y teóricas. También podrá comprobar que la implantación del sistema de Bolonia todavía no se hallaba plenamente asentada, con más cambios superficiales que significativos. En el bloque dedicado a la profesión, se aprecia con claridad que los periodistas se hallan tan preocupados por la falta de libertad y autonomía dentro de su propia empresa que son incapaces de pensar en las repercusiones de su trabajo de cara a la ciudadanía y la consiguiente pérdida de identidad y sentido de su trabajo. El capítulo histórico ayuda a comprender cómo las dictaduras, sobre todo la franquista, impidieron un desarrollo adecuado de la libertad y, por tanto, de la responsabilidad. Esto se aprecia tanto en la docencia, donde se confundió y se sigue confundiendo la moral con la ética, la ética con la deontología y la deontología con la autorregulación; pero también en la profesión, donde los periodistas se muestran incapaces de buscar soluciones conjuntas por miedo a perder su frágil libertad. La tesis constituye una invitación al conocimiento mutuo, de tal manera que académicos y profesionales puedan comprenderse y tender puentes de colaboración que beneficien a ambas partes e, indirectamente, a toda la sociedad.
This paper describes the status of the teaching of the subject of Journalistic Ethics and Deontology, the perception of journalists on various ethical issues and the responses of teachers and reporters about some specific aspects are compared in 2012 in Spain. As at that time Spanish university was in full transition to the European Higher Education Area (EHEA), is also analysed a sample of programs taught in “licenciatura” and “grado” by the same teacher, to determine if it was occurring or not improvement in the quality of teaching. Besides, all of this is accompanied by a historical perspective to gain understanding into the development of ethics teaching and moral, ethical, deontological and professional self-regulation. Such information has been obtained from two online surveys, one from teachers and other from journalists, as well as a content analysis and literature respectively. On the academic side, readers will know who taught one particular subject in the career of Journalism at Communication schools in Spain, what taught and how they did during 2011-2012. And you'll find out, for example, that teachers arise very practical and ambitious educational goals, but are not consistent with employee evaluation systems, more typical of conference and lectures. You can also verify that the implementation of the Bologna system was not yet fully established, with more superficial than significant changes. In the section dedicated to the profession, we see clearly that journalists are so concerned about the lack of freedom and autonomy within their own company that are unable to think about the impact of their work on citizenship and the consequent loss of identity and sense of their work. The historical chapter helps to understand how dictatorships, particularly Franco’s, prevented adequate development of freedom and therefore responsibility. This is reflected both in teaching, where became confused and continues to confuse morality with ethics, ethics and deontology and deontology and self-regulation; but also in the profession, where journalists are incapable of finding joint solutions for fear of losing his fragile freedom. The thesis is an invitation to mutual knowledge, so that academics and professionals can understand and build bridges of cooperation to benefit both and indirectly the whole society.

Full textThe investigation has examined to what extent the main Mexican television chain, Televisa, observed the journalistic ethical principles —responsibility, truth, and justice— regarding the case of the 43 escuela normal rural de Ayotzinapa students, which forcibly disappeared on September 26th, 2014. The content analysis of more than 405 informative pieces, their correlation with the main deontological codes, the identification of journalistic frames, along with carrying out ten interviews to families of the victims revealed that, during the study time, the Mexican television overlooked important ethical matters. Among the remarkable transgressions there is the absence of informative accuracy, the imbalance of sources choice and the lack of context. The end results allowed to conclude that Televisa was more engaged on following the agenda provided by the administration than contrasting and validating the facts “historic truth” official version that intended to give closure to the case and out of which several international human rights organizations still unveil numerous irregularities. Therefore, the investigation shows the media did not comply with the journalistic duty of putting together truthful, rigorous, and ethically responsible information.

Full textThe present dissertation aims to reconstruct and to discuss Paul Ricoeur s argumentation about the notion of justice, presented at several books that had been published in the beginning and mid 90 , among them, Oneself as another, and the two collections of articles The just 1 and Readings 1: around the political. According to this, it takes as director axis the dialectic between teleology and deontology, with their respective predicates good and legal , seen by Ricoeur as a preparation for the real challenge of morality taken as a whole: the moral singular judgment, executed at uncertainty situations, under the sign of the practical wisdom. Under the teleological vision, the justice, with the providential intermediation of the Aristotelian s notion of friendship, is connected to the desire of a realized life, the ethic s aim. Further, yet with Aristotle, Ricoeur sees in the institution, grasped as a structure of desire to live together characterized by common wonts, the appropriated mediation to the distributive relations which it occurs under the aegis of justice. On the deontological plane, the discussion promoted with the Rawls s great work doesn t aim, properly, to refute it. In a diverse way, according to the thesis of the teleology s primacy over the deontology, what it intent is, at one hand, to extract a presupposed ethical sense, that the formalization of the rule of justice doesn t admit explicitly, and, at the other hand, to describe the tension provoked by the formalism, which conducts to necessity of a final recourse to the ethics itself. In the end, the phronesis s expedient, in your Aristotelian roots, aims the moral judgment s fundamental structure. Here, the paradigmatic example is offered by the judicial institution, which, in the judge s figure, judges the different demands and pronounces the justice, applying the law in a complex and not mechanical way, respecting their own rituals and obeying to public and recognized argumentation modes. The final point of this extensive trajectory is accomplished only when the act of judge is, finally, executed, distributing to each litigious part what is theirs by law, their fair share, contributing, in long term, to keep the social peace.
A presente dissertação tem como objetivo geral propor uma reconstrução e uma discussão da argumentação de Paul Ricoeur em torno à noção de justiça, apresentada em diversos livros do início e meados dos anos 90, dentre eles, O si-mesmo como um outro, e as duas coletâneas de artigos O justo 1 e Leituras 1: em torno ao político. Em função disto, ela toma como eixo diretor a dialética entre teleologia e deontologia, com seus respectivos predicados bom e legal , vista por Ricoeur como uma preparação para o verdadeiro desafio da moralidade tomada como um todo: o juízo moral singular, tomado em situações de incerteza, sob o signo da sabedoria prática. Sob a ótica teleológica, a justiça, com a intermediação providencial da noção aristotélica de amizade, é vinculada ao desejo de uma vida realizada, o objeto próprio da ética. Adiante, ainda com Aristóteles, Ricoeur percebe na instituição, compreendida como uma estrutura do querer viver junto caracterizada por costumes comuns, a mediação adequada às relações distributivas que se dão sob o signo da justiça. No plano deontológico, a discussão promovida com a obra magna de Rawls não pretende, propriamente, refutá-la. De maneira diferente, em acordo com a tese da primazia da teleologia sobre a deontologia, o que se tem em mente é, de um lado, extrair um sentido ético pressuposto, embora não admitido explicitamente, pela formalização da regra da justiça e, de outro lado, descrever a tensão provocada pelo formalismo que conduz à necessidade de um recurso final à ética. Por fim, o expediente da phronesis, em suas raízes aristotélicas, mira a estrutura fundamental do juízo moral em situação. Aqui, o exemplo paradigmático é fornecido pela instituição judiciária, que, na figura do juiz, julga as diferentes demandas e pronuncia a justiça, aplicando a lei de modo complexo e não mecânico, respeitando os seus ritos específicos e obedecendo a modos publicamente reconhecidos de argumentação. Full textThe dissertation investigates the changes between two periods of John Rawlss philosophy. In A theory of justice and until the late 1970s, he defined his philosophical project as part of a moral theory, that would establish a moral conception inspired by Kantian deontology. One argues that Rawls identified an internal problem in this project and, during the 1980s and 90s, he detached his conception of justice from moral theory and reoriented his efforts by an idea of the roles of political philosophy. This reorientation also meant that Rawls changed the relationship between his philosophy and Kants ethics. Therefore, the dissertation investigates the main characteristics of the two orientations of Rawlss philosophy (moral theory and roles of political philosophy), the reasons that lead him to abandon the project of a moral theory and the relationship between Rawlsian and Kantian philosophies. By doing this, one intends to understand why Rawls used the contractualist tradition as inspiration for his own philosophy, the meaning attributed to the concept of deontology, and the role of public political culture in justifying Rawlss conception of justice during the second phase of his philosophy.

Full textThe main purpose of this study is to investigate the architect and urban planner\'s professional behavior, their values and intentions, confronting them with the existing standards of the current codes of professional conduct in Brazil, as well as to compare these codes with those from other countries. Initial focus is given to the history of professional development, the rise of professional institutions, the current organization of the profession and the codes of conduct that rules the profession at present and their disciplinary procedures in countries of Anglo-Saxon culture, specifically the United Kingdom and the United States. Subsequently, the study considers the reality of the architect and the urban planner in Brazil, through the history of their professional development, the rise of the institutions and organizations that govern the profession in the country and the codes of conduct in force. To carry out this research, a theoretical and documentary survey was undertaken, supported by field research regarding the institutions located in the city of São Paulo. The study concludes with a comparative analysis of the three countries, refering to the history of the professional development, the rise of their institutions and the current organization of the profession in each country. The analysis also compares the codes and disciplinary procedures that govern the behavior and the professional practice of the architect and the urban planner.

Full textThis thesis examines the relationship between justice and good in the late works of John Rawls and, especially, in the book Political Liberalism (1991). It is argued that the changes in Rawls\' late work can be understood as as a result of a reorientation in his thinking. Rawls has redesigned some aspects of his philosophy so that it fulfills a specific set of roles in the public political culture of democratic societies. Despite the changes, late work carries with it a structure of the relationship between justice and well which has important implications for the way in which citizens, in accepting liberal political principles, conceive of their religious, philosophical and moral doctrines of good. The thesis examines, therefore, how these changes can be explained as a result of a reorientation that carries with it relevant consequences for the relationship between justice and good.

Full textIn Spain, although the legal profession devotes much energy to negotiation, the academic curriculums do not, for the most part, feature training in the skills necessary to carry out this legal function. Furthermore, there has been little research in the area and the question of ethics has not been addressed. In contrast, the situation in the United States is different: negotiation has become increasingly important in academic curriculums and in training for lawyers. There is a wealth of important research and their codes of ethics incorporate provisions relating to negotiation. Based on this analysis, a doctrinal review has been carried out, serving as a guideline for the presentation of different approaches, different styles of negotiation, their respective benefits and consideration of the factors to be taken into account. Once established the State of the art, the second part of this paper compares legal negotiation with litigation the growth of legal negotiation and other alternative conflict resolution mechanisms and its influenced on the way the legal profession operates has been evaluated. An analysis of the supposed benefits of these new procedures is carried out and the contribution of the traditional justice system is examined. At the same time, this work highlights concerns about the fairness and quality of solutions to conflicts arising from mechanisms other than litigation. Legal negotiation is, in general, undertreated by ethical standards. Having analyzed ethical issues in the United States and Spain, a longer and more thorough treatment is observed in the first of them and less regulation in the second. Ethical issues on legal negotiation have been particularly addressed. Finally, the desirability of the legal profession adopting a proactive approach by proposing its own alternative dispute resolutions is examined. This work concludes with two proposals: a rule of professional conduct and a supervised negotiation mechanism.

Esta investigação será também essencial para reunir as opiniões dos professores entrevistados no que diz respeito à eventual existência e necessidade de um código deontológico para a docência e quais as suas sugestões para a construção deste documento.
Nowadays teachers face different challenges than weren't present in the 90s. This study is meant to identify these challenges and compare them with those in the beginning of their career. It is also meant to identify what dilemmas they face and how they solve them. This investigation will also be essential to gather the interviewed teachers' opinions about the eventual existence and need of a deontological code for teachers and also what would be their suggestions for the writing of this document.

Full textDOCTORAL DISSERTATION "Knowledge and application of ethical principles by forensic psychologists expert in family procedures". SUMMARY: There is an increasing requirement for forensic psychologists to act in family proceedings and the existence of numerous complaints to the ethics commissions arising from such interventions is recognized (Del Rio, 2000; Cayuela, Jarne and Molina, 2005). However, research of ethical professional practice by forensic psychologists expert in family procedures is limited. The main objective of the presented work is to study the knowledge of ethics and professional standards by forensic psychologists expert in family procedures. The secondary objectives are the analysis of the relationship between the frequency of forensic psychologists in these situations and their ethical posture, and assessment of the different types of resources that can be used in the ethical dilemmas of practice. The sample of expert forensic psychologists in family procedures is composed of 81 Spanish professionals, who have completed a questionnaire developed from the one used by Pope, Tabachnick and Keith-Spiegel (1987), a Spanish version by Del Rio, Bordas and Torres (2003), and complemented by the Spanish code of ethics for psychologists (COP, 1987), the guidelines for child custody evaluations (APA, 1994, 2009) and the study by Urra (2007). The results obtained in the empirical investigation show that all these situations have been experienced by the participants in their professional practice and their ethical posture does not fit unanimously with the ethical standards. Only one third of the participants show an ethical posture in line with the code of practice (COP, 1987). The ethical values that are held more consistently with the ethical standard are basically related to objectivity, reporting obligations and informed consent, while those related to issues of practice, legal, fees, confidentiality and dual roles disagree with the ethical standards. Ten of the fourteen information sources are assessed as "positive" about their effectiveness in promoting ethical practice for more than 70% of the sample, and American and European resources are top rated. The Practice Committee of the College, state laws, court decisions and the degree program, are rated as "more negative" for a minimum of 40% of the participants. The evaluation of the ethics held by forensic psychologists expert in family procedures shows the need for a deeper understanding of the current code of ethics and an insufficient level of legal knowledge.

No entanto, a lógica mercantil a que os media estão constrangidos actualmente tem levado a processos de construção noticiosos que confluem na formatação da imagem dos menores de forma sensacionalista, indo contra as principais normas deontológicas e jurídicas adstritas ao jornalismo. Entender como os menores são indicados nos media permite conhecer como se degaldiam, na realidade de três jornais diário portugueses – Público, Correio da Manhã e Jornal de Notícias -, o dever de informar, de denunciar e de expor e de que forma é desenhado os ténues limites éticos entre o dever de informação e o dever de protecção face aos menores mediatizados. A análise dos conteúdos permite reconhecer quais os elementos mais utilizados na identificação directa e indirecta dos menores presentes nos relatos noticiosos, perceber que a construção mediática da criança é feita sobretudo em torno de temáticas que ampliam a imagem de fragilidade das crianças e, consequentemente, imprimem representações da realidade infantil em Portugal baseadas numa retórica sensacionalista. O confronto dos resultados obtidos permitem testar a viabilidade dos mecanismos de protecção da imagem infantil face aos media e o impacto que a veiculação mediática desta imagem terá, quer no diaa- dia da criança, quer ao longo de toda a sua vida. Esta dissertação é um despertador para os perigos da exposição mediática, um alerta para as marcas dessa exposição e dos condicionalismos que imprimem na vida das crianças expostas, uma denúncia da necessidade de protecção dos menores e as suas susceptibilidades infantis face ao um meio por vezes tão feroz como a comunicação social.
News about children are grandly perceived as a mechanism for reporting cases of abuses of minors. However the marketable logic that has currently enslaved the media has led to the adoption of newsmaking processes which converge into constructing media images where minors appear in a sensationalist fragilized way, going against journalism legal and deontological standards. Understanding how children are listed in the media nowadays allows us to know, in three Portuguese daily newspapers - Público, Correio da Manhã and Jornal de Notícias – in which grounds struggle the duty to inform, denounce and expose an abusive case and where is the line draw between the informational tasks an the ethical responsibility of protecting the image of mediated minors. The content analysis leads to recognizing what elements are generally used to identify direct and indirectly the children stated in the news and realizing that construction of a child image is mainly based on themes that enhance their vulnerability and consequently printing a stereotyped sensationalist representation of the infant in the Portuguese society. The obtained results examination also allow us to understand how child protecting mechanisms against media are working and what is the impact that the broadcasting a child’s image on his life, today and in the future. This dissertation is actually an alarm on media exposure dangers, a warning sign for the scars and the constraints that such exposure imprints on children’s lives, an plea for the needed protection of minors and their susceptibilities to face an environment as ferocious as the mass media.

Full textThe purpose of this doctoral thesis is to understand the conceptions and practices in ethical formation of teacher educators of the Escuela Normal Superior de Manizales (Colombia). The research investigates in the familiar, formative and labor trajectories of the participants; identifies conceptions of ethical formation; describes teaching practices and discusses how conceptions are reflected in the practices of teacher educators. It is a qualitative, ethnographic, descriptive-interpretive study focused on classroom practices. The participants are ten teacher educators. The data gathering techniques used are observation, interview, informal conversations, documentary analysis and the field diary. The analysis of the information is developed by deductive and inductive way and uses analytical techniques of open and axial codification and its corresponding categorization. Fieldwork was carried out between January and June 2015 with an intensity of five days per week. 45 teaching practices (53 hours) and 9 in-depth interviews were carried out with an average duration of one hour. Research results show that family, religion, and compulsory basic education of teacher educators have a strong impact on what they think about ethical issues. On the contrary, higher education and its training as teacher educators has had no influence on its ethical knowledge. The participants relate the concept of ethics and ethical formation with inculcation of values, norms and transmission of desirable behaviors. The processes of ethical formation in teacher education are assumed as something implicit that is developed through example. There is no evidence of ethical training processes in the teacher education program because institutional and classroom practices correspond to a technical, traditional and conservative perspective, which conflicts with the reflexive, critical, autonomous and responsible thinking inherent in the ethics.

Full textThis thesis inquires about the term “epistemic agency”, exploring different conceptions and assessing perspectives about its use and meaning. It is divided in three chapters. In the first chapter, it brings considerations about the term “agency”, its origin and multiplicity of uses. It also exposes the term’s emergence on epistemology, and a brief historical characterization. Additionally, it sets epistemic deontologism on the ethics of belief discussion, constructing the emergence of doxastic epistemic agency, and it shows the problem of doxastic involuntarism and some responses to the problem. At the end, presents our proposal, with a skeptical conclusion. In the second chapter, it examines reflective agency, as well as presents virtue epistemology and performance metaphysics. It also defines epistemic agency throughout reflective performances and shows three critics and a proposal considering the critics, again concluding skeptically. In the third chapter, leaves normativity behind and approaches ameliorative epistemology. It makes an argumentative reconstruction of empirical research considerations diagnosing human actual cognitive capacities, and inquires possibilities of improving their systematic failures or cognitive biases. It concludes skeptically about the possibility of improvement relying on individuals and indicates the possibility of collective restrictions on individuals called epistemic paternalism. In addition, it presents social epistemology and epistemic paternalism, and finally, concludes indicating skepticism about individual epistemic agency, on one side, and the possibility of collective epistemic agency, on the other.
Esta dissertação trata do termo “agência epistêmica”, explorando diferentes concepções e avaliando perspectivas sobre seu uso e sentido, e divide-se em três capítulos. No primeiro capítulo, ela traz considerações acerca do termo “agência”, sua origem e multiplicidade de usos, bem como expõe seu surgimento na epistemologia e uma breve caracterização histórica. Para além, ela contextualiza o deontologismo epistêmico na discussão da ética da crença, caracterizando o surgimento da agência epistêmica doxástica e apresenta o problema do involuntarismo doxástico e respostas a ele. Ao final do capítulo, ela apresenta nossa avaliação dessa proposta, concluindo-se ceticamente. No segundo capítulo, ela traz nosso exame da proposta de agência epistêmica reflexiva, bem como apresenta a epistemologia da virtude e a metafísica de desempenhos. Ainda, ela abrange a definição de agência epistêmica através de desempenhos reflexivos e traz três críticas e uma avaliação da proposta que as segue, também conluindo ceticamente. No terceiro capítulo, ela abandona a normatividade e aborda a epistemologia melhorativa. Assim, faz uma reconstrução argumentativa de considerações de estudos empíricos, diagnosticando as capacidades cognitivas humanas atuais, e examina possibilidades de melhorar suas falhas sistemáticas, ou vieses cognitivos. Ela conclui ceticamente sobre a possibilidade de aprimoramento a partir dos próprios indivíduos e indica a possibilidade de restrições coletivas aos indivíduos, chamada de paternalismo epistêmico. Por fim, apresenta brevemente a epistemologia social e o paternalismo epistêmico, e conclui indicando ceticismo quanto à agência epistêmica individual, por um lado, e a possibilidade de agência epistêmica coletiva, por outro.

Full textThe thesis aims at analysing, from a comparative perspective, the role of medical ethics in Italy, France and Germany. The survey focuses on both the formal and substantive aspects of the relationships between law and medical ethics. As to the first issue, the thesis analyses the codification of medical ethics, the normative function of the medical councils, the binding value of the codes of medical ethics and their position in the hierarchy of norms. With regard to the second aspect, the role of medical ethics is studied from a more substantial perspective, analysing the concrete interrelations between law and medical ethics in the field of biolaw. The survey is then extended to the disciplinary procedure and to the European level. In the first part, the relationships between law and medical ethics are analysed from a linguistic perspective, aiming at underlining some specific features of the concepts referred to as “déontologie”, “deontologia” or “Standesrecht” and “Berufsordnung” in France, Italy and Germany. This part also deals with some “open questions” characterising the relationships between medical ethics and the law. The second part concerns the codification of medical ethics, while its role in the field of biolaw is analysed in the third part. The fourth part deals with deontological liability and disciplinary procedures. Lastly, the fifth part aims at elaborating a theoretical reconstruction of the results of the comparative analysis, at highlighting the main roles of medical ethics at the European level and at suggesting a different model for the relationships between law and medical ethics in the Italian system
L’obiettivo della tesi è un’analisi comparata del ruolo della deontologia medica nel sistema delle fonti del diritto in Italia, Francia e Germania. Per tenere conto della complessità del rapporto tra diritto e deontologia, sono stati analizzati sia gli aspetti formali di tale rapporto, sia i profili sostanziali del ruolo della deontologia medica nel biodiritto. Nella prima parte alcune considerazioni preliminari e l’analisi linguistica hanno permesso di definire l’ambito di indagine e i profili di maggiore complessità del rapporto tra dimensione deontologica e dimensione giuridica sui quali nelle parti successive si è concentrata l’indagine. La seconda parte, dedicata alla codificazione dell’etica medica, ha messo in luce la varietà di soluzioni e di modalità di ingresso della norma deontologica nell’ordinamento giuridico. Nella terza parte sono stati analizzati il ruolo della deontologia medica nell’ambito del biodiritto e l’influenza di alcuni fattori particolarmente rilevanti sull’evoluzione dei contenuti concreti dei codici deontologici e sulla loro portata pratica. La quarta parte è dedicata alla violazione della deontologia e ai procedimenti disciplinari. Infine la parte conclusiva contiene una ricostruzione teorica dei risultati emersi dall’analisi comparata, lo studio di alcuni profili legati alla dimensione europea della deontologia e la proposta di alcune ipotesi di riforma per un modello italiano più coerente, flessibile ed efficace dei rapporti tra diritto e deontologia

O propósito deste estudo prospectivo descritivo foi desenvolver um sistema para o apoio à aprendizagem da disciplina Medicina Legal e Deontologia Médica na Universidade de Brasília e avaliar o padrão de utilização do mesmo pela resolução dos testes on-line, facultativos e assíncronos. Os sujeitos foram 38 alunos que cursaram a disciplina no segundo período de 2005. O sistema oferecia conteúdos textuais e imagens que podiam ser acessados anonimamente. Para a resolução dos testes do tipo “Verdadeiro” ou “Falso”, alguns com imagens, era necessário que os alunos se identificassem por senha, o que permitiu o monitoramento. Os resultados mostraram que 32 alunos (84%) realizaram testes on-line, com uma média de 183 respostas por aluno, dentre os que aderiram; 52% dos testes foram resolvidos nas últimas 24 horas antes da prova; 62,3% dos testes foram resolvidos entre 19h e 01h. Conclui-se que os alunos, em um sistema facultativo, concentram seus esforços na véspera da prova, o que diminui a eficiência do sistema, sugerindo que técnicas de motivação para o uso regular desse tipo de sistema devem ser implementadas. _____________________________________________________________________________________ ABSTRACT
The purpose of this descriptive prospective study was to develop a system to support learning of the discipline Legal Medicine and Medical Professional Ethics at the University of Brasilia and evaluate the pattern of use of the system of on-line optional asynchronous exercises. The subjects were 38 students of the discipline in the second term of 2005. The system offered textual content and images that could be accessed anonymously. To solve the tests, of the type "True" or "False", some with images, the students had to identify themselves by means of a password, which allowed tracking. The results showed that 32 students (84%) performed exercises online, with an average of 183 responses per pupil among those who joined, 52% of the exercises were resolved in the last 24 hours before the test; 62.3% of the exercises were resolved between 7p.m. and 1a.m. The conclusion was that the students in a voluntary system, concentrated their efforts just before the evaluation, which reduces the efficiency of the system, suggesting that techniques of motivation for the regular use of systems such as this one must be implemented.
