Abstract:
The problem faced by researchers and scholars, especially students, is finding the right reasons for choosing legal research methods. For this reason, this article was created to make it easier for scholars to choose the right legal research method. This article is described in descriptive form using secondary data or data obtained indirectly. This article re-explains the types of doctrinal/normative and non-doctrinal/empirical legal research methods. The characteristics of legal research are included in other social science research, however, what distinguishes it is the way of thinking. Legal research must rely on gap analysis or interest analysis between legal events (das Sein) and the rule of law (das Sollen). This article also emphasizes the reasons for choosing a research method based on the 'characteristics of the research objectives'.

Human beings possess instinct of inquisitiveness in cases of confronting with the unknown aspects of life which probe to attain greater understanding on such uncertainty. This inquisitiveness is the method which man employs for obtaining knowledge is termed as research. It is the art of scientific enquiry into new facts conducted in any branch of knowledge. Generally, Research is the movement from the known towards the unknown to be called as the voyage of discovery. It originally contributes to the existing stock of knowledge facilitating its advancement. Truth is pursued with the help of study, observation, comparison and experiment. Abstract:
The output of any research work depends, to a reasonable extent, on the adequacy of the sample from which data are obtained for the research. A sample is adequate when it is representative of the population or when it possesses the characteristics that are typical of the population from which it is drawn. The focus of this paper is on how researchers can select samples that are really representatives. Descriptive method was utilized in the writing of the paper. Attempts are made, in the paper, to describe the concepts of sample representativeness, sampling methods and sampling error. Some suggestions are then made on measures to take in carving out truly representative samples.

Abstract:
Articles published in International journals have rich potentials of learning sources since their publication has been scholarly processed through the hands of journal editors. Readers can get a lot of benefits from them. One lesson we might get is the way the writers conducted their researches. Thus, we can learn the research methods from the models found in journal articles. This paper will elaborate the research methods used in the teaching of English as a foreign language (TEFL). The elaboration is formulated from the research methods used by journal article writers around the world. A number of international journal articles in TEFL are taken as the corpus of the study. Using a grounded theory, varieties of research methods in TEFL are investigated. Among of them are case study, quasi experiment, qualitative experiment, meta analysis, descriptive research, activity theory, error analysis, R & D, action research, research and development (R&D), and survey method. Due to the limited space, however, the paper will only describe four popular methods: descriptive research, case study, error analysis, and R & D. The description of each method is supported with examples found in international journal articles published around the world.

Cibangu, Sylvain. "Mobile phones' contributions to socio-economic development according to Sen : corn growers' perceived impact in the Congo." Thesis, Loughborough University, 2016. https://dspace.lboro.ac.uk/2134/23013.

Full text
Abstract:
Research questions: This research was focused on exploring the impact of communication technologies on rural populations in the Congo. In particular, this research posed two questions: 1. Do mobile phones produce development in rural areas of the Congo? 2. Do mobile phones improve the living conditions of people? The questions helped examine ways in which mobile phones were or were not engendering development among these populations. Methods: The research was undertaken using four methods: 1. Phenomenology, 2. Sen's capability approach, 3. Participatory method, and 4. Ecological method. Phenomenology aimed to cater to the experiences and meanings of mobile phone uses. Sen's capability approach allowed the interviews to be focused on the basic needs of the poor. Participatory method provided a greater participation of respondents in discussion groups, and ecological method helped achieve a higher inclusion of key players in the targeted area. Major findings: The major findings of this study included: 1. Much of the literature on mobile phones and development was not representative or inclusive of key players and their day-to-day lives. 2. Studies have tended to present snapshots or single-focused accounts of mobile phone and development. 3. Authors of mobile phone research have tended to see rural populations with an urban-led bias, leaving aside the actual characteristics of rural areas. 4. Mobile phones were not limited to a person and her properties, but rather mobile phones were owned and shared by the community. 5. Participants expressed a need for technical skills and means to be available to the community and their members. 6. Households were not separated, but rather they were connected to allow people take care of one another. 7. People were connected through collective solidarities in order to come to the aid of those with special needs. 8. Literature and mobile phone sponsors or companies were disseminating mobile phones with an extractive and commercial tendency, focused principally on fees of batteries, chargers, and prepaid cards. Major contributions: The major contributions of this research revolved around the focus on: 1. technology to enhance the needed technical skills among concerned populations. 2. shared ownership of mobile phones to cater to both users and non-users of mobile phones among concerned populations. 3. connected households to capitalize on the dynamics of family among concerned populations. 4. collective solidarities to accommodate the processes of aiding one another among concerned populations. 5. capabilities, from a commercial or extractive aspect to capabilities to enhance the capabilities of people to afford mobile phones fees. 6. capabilities, from a corporate or business aspect to capabilities to enhance the capabilities of people who did not and could not own a business. 7. human basic needs to enhance the capabilities of mobile phone users with regard to human basic needs. 8. outliers or the marginalized to attend to those left out among concerned populations. 9. mobile phone-centric libraries to enhance the storage and retrieval of needed information among concerned populations.

Abstract:
The 2010 Fédération Internationale de Football Association’s (FIFA) World Cup (WC) would be the first time that a FIFA WC would be hosted on the African continent. This study was aimed at describing the South African City of Tshwane (COT) general volunteers’ experiences of volunteering at the 2010 FIFA WC. The FIFA Volunteer Programme consists of two groups of volunteers: Local Organising Committee (LOC) volunteers and each Host City (HC) volunteers. The COT volunteers are HC volunteers from the Tshwane Metropolitan Area (TMA). Volunteers are active in a variety of different contexts, namely in the community, volunteers at sport clubs or schools and also at mega sport events. Volunteers make it possible to host a mega sport event because they provide their time and effort without expecting remuneration or they receive a stipend amount. The existing literature of volunteers at mega sport events investigated what motivated volunteers to participate as well as how satisfied the volunteers were with the experience. The aim of this study was to describe COT general volunteers’ experiences of preparing (preparation phase) for the 2010 FIFA WC; COT general volunteers’ experiences during (participation phase) the 2010 FIFA WC, as well as the South African COT general volunteers’ experiences on their involvement (reflection phase) at the 2010 FIFA WC was described. The methodology employed in this study was Descriptive Phenomenology and the Duquesne Phenomenological Research Method was used to analyse the material. The differences between Descriptive Phenomenology and Interpretive Phenomenology were described. The material consisted of a written account as well as an interview, which was based on the essences that were portrayed in the written accounts. There were five participants — three spectator services volunteers and two rights protection volunteers. All of the participants were female. The findings of this study were divided into the preparation phase, participation phase and the reflection phase. In the preparation phase the COT general volunteers described two essences namely, the application process and training. In the participation phase the COT general volunteers experienced four essences namely, the working of shifts, interaction with volunteers, interaction with supervisors and lastly interaction with tourists. In the reflection phase the volunteers described two experiences, growth and value. This research project contributes to sport psychology because this study describes the experiences of volunteers at the 2010 FIFA WC.
Dissertation (MA)--University of Pretoria, 2012.
Psychology
unrestricted

Abstract:
This research focuses on the design process and more specifically on the way decision making can influence the design process’ outcomes in its strategic adequacy and overall quality. The study is centred on the conceptual phase of the design process and, in general, aims to describe the behaviour along the process of design students and professional Portuguese designers both at the educational and business level. It should result in a descriptive model to support the understanding of design process management in terms of its critical variables. This descriptive model is based on the identification of the key parameters of design processes concerning its strategic adequacy and overall quality. In methodological terms it is a mixed methods research with a clear dominance of qualitative methods integrating an active research where experiments either in simulated situations or in real context play a key role. Quantitative methods were also used and they served the purpose of triangulating data in order to have a more consistent and rigorous description of the design process and its main structural elements. Data gathering occurred in the education and business areas, partly separately and partly combined. Furthermore, in the field of education a comparison of the performance of both Portuguese and Dutch university students was made. That helped to validate some findings of previous studies but also to understand the role different Design curricula can have in the performance of students. The main conclusion of the study is that decision making togehter with information and knowledge management, and idea generation are the fundamental aspects to be addressed in design processes when both strategic adequacy and good quality of the design outcomes are pursued. Another important finding is that decision making is better understood through the use of a few central parameters. These parameters were used in the creation of a descriptive decision making model that equates xi Abstract decision making at three different levels that are highly dependent on information/knowledge management and Idea generation. At a macro level, which regards the mindset of the designer, we make a distinction into two elements: a) the design strategy with its three types – problem driven, solution driven and integration driven; and b) the creative cognitive processes that present two modes of action: the exploratory one that has to do with operations such as contextual shifting, functional inference and hypothesis testing; and the generative one that is related with analogical transfer, association, retrieval and synthesis. At an intermediate level we have decisions that can have a Framing, Key or Enabler nature. And finally, we have the micro level of the model, the operationalization of the mindset, where the decision strategy and the decision mode are chosen. The decision strategy presents three types of behavior: the compensatory rule based; the non compensatory rule based and the negotiated compensatory /non compensatory one and it is clearly linked with the way decisions are taken in processing information. The mode of decision is linked with group dynamics and focuses on the way teams organize themselves while working and deciding.

Abstract:
This thesis examines the trans-border circulation and production of feminist knowledge through translation. More specifically, my research focuses the translation of the U.S. women’s health book, Our Bodies, Ourselves, by a Chinese feminist NGO in 1998. My dissertation studies the social, cultural and political aspects of feminist translation, and examines the relation between translation and feminist praxis. Through the lens of gender and (feminist) health politics in 1990s China, I examine how the 1998 Chinese translation conveys the book’s message about how women should relate to their bodies. Set in the context of Chinese society opening up during the late 1970s, my research outlines the emergence of gender awareness in China with the influx of translated feminist texts, especially in the realm of women’s health research. Medical discourses were then assigned a privileged position in the studies of women’s sexual and reproductive health. However, with increased communications between Chinese and foreign feminists, Chinese women scholars developed new ideas around women’s sexual and reproductive health. The Chinese translation of OBOS addresses the lack of gender awareness in local discussions about women’s health. With a multi-method study, I emphasize the social and linguistic dimensions of translating a feminist health project into post-reform China. This study is based on both interview and comparative textual analysis data. Using feminist translation theories, I examine how the Chinese translators handled the book’s presentation of women’s sexuality and reproductive health. This thesis also highlights the constraints on translating feminism from the local context. This raises questions about the power of (feminist) translation, and emphasizes the need to examine the social-political context of translation practices.

Abstract:
Influencer marketing has become a central aspect within brand’s marketing activities (Kapitan & Silvera, 2016). The former marketing way of including celebrities within marketing purposes (Pringle & Binet, 2005) has in recent years been discussed as digital media influencers (Kapitan & Silvera, 2016). Digital media influencers resulted in social media influencers, where Instagram is one out of the social media which is worldwide used (Influencer Marketing Hub, 2018). Social media influencers are shown to have a significant role for brands in the process of reaching out to consumers (Lin, Bruning & Swarna, 2018) and within the fashion industry, the opinions of fashion influencers tend to weigh heavy within consumers decision making (Loureiro, Costa & Panchapakesan, 2017). However, besides the known influential characteristics of celebrity endorsement (Page Winterich, Gangwar & Grewal, 2018; Tzoumaka, Tsiotsou & Siomkos, 2014), the level of influence of Instagram influencers has mainly been discussed in terms of number of followers (De Veirman, Cauberghe & Hudders, 2017). The purpose of this study is to describe the influential characteristics of an Instagram fashion influencer and its influence on consumers purchase intention for fashion in Sweden. The research method applied for this research was primary data in the form of a survey research and was chosen as it allows to generate data which makes it possible to define correlations between the variables (Bryman & Bell, 2015). The study is based on the theory of consumer purchase intention, celebrity endorsement as well as influencer marketing, and through that, three hypotheses were created: 1) the trustworthiness of an Instagram fashion influencer has positive impact on consumers purchase intention, 2) the expertise of an Instagram fashion influencer has positive impact on consumers purchase intention, 3) the physical attraction of an Instagram fashion influencer has positive impact on consumers purchase intention. The conclusion drawn indicates that the trustworthiness of an Instagram fashion influencer is the only influential characteristic amongst the identified characteristics in this research which impacts consumer purchase intention for fashion in Sweden.

Abstract:
Organizations in the age of modern technology have a diverse workforce, who are spread around the globe, and the business leaders of the 21st century need to understand how best to manage, overcome new challenges, and know the various skills of team members to capitalize on their differences and unique skills. To allow those geographically dispersed workers to reach their full potential and facilitate team success. Global virtual teams (GVTs) operate in complex environments characterized by diverse cultural and organizational elements. The primary purpose of this correlational and nonexperimental quantitative research was to examine the impact of transformational leadership on GVTs, their productivity, and job satisfaction with leadership effectiveness. Using the Multifactor Leadership Questionnaire (MLQ) and the Job Satisfaction Survey (JSS), data analyzes were completed through SurveyMonkey.com and SPSS software. The study measured transformational leadership, the independent variable, by the leader's ability to motivate workers to be satisfied and productive, and by the leader's effectiveness in the organization. Data were assessed by frequency analysis, moderation analyzes, and multiple regression analysis on the dependent variables of job satisfaction, leadership effectiveness, and productivity. The findings from this study reinforced the positive relationships found between transformational leadership, employee productivity, and leadership effectiveness in GVTs. Results also showed that motivated employees increase productivity and help in the organization's growth. Implications for positive social change included improvements in GVT interactions to increase the exchange of diverse ideas that lead to increased productivity and job satisfaction.

Valverde, Sarah Hatheway. "THE MODERN SEX DOLL-OWNER: A DESCRIPTIVE ANALYSIS." DigitalCommons@CalPoly, 2012. https://digitalcommons.calpoly.edu/theses/849.

Full text
Abstract:
Over the last fifteen years, the sex doll industry has grown from producing inexpensive novelty items to creating a multimillion-dollar global industry featuring high- quality, realistic love dolls. These dolls are designed and advertised for sexual stimulation, companionship, artistic representations of human fantasy, and other creative pursuits, such as photography. Made of flesh-like silicone, modern sex dolls sell from $3,500-$10,000. The use of human simulacra for sexual stimulation is an enduring practice. However, the psychological community has said little on the subject. Early sexologists briefly reference Agalmatophilia or Statuphilia, a rare sexual attachment to statues. Today, the sex doll phenomenon appears increasingly prevalent across the globe. Media coverage of this phenomenon has been featured in online magazines, television programs, music, documentaries and major motion pictures. More often than not, sex doll-ownership is portrayed as pathological. Sex doll-owners are members of a marginalized population, and accessing the population is challenging as many members of the community wish to remain anonymous for fear of judgment, persecution, and psychiatric labeling. The purpose of this study was to increase psychology’s understanding of this interesting and growing population. Specifically, a 45-item online survey addressing demographics was constructed and assessed. Additionally, participants were asked to describe their relationship status, doll-ownership status, and satisfaction with human and sex doll partners, including sexual satisfaction and performance. Quality of life was also assessed via the Satisfaction with Life Scale (SWLS). Sixty-one participants were recruited from an online doll-owner community forum. It was hypothesized that most doll-owners sampled would be middle-aged, White, single, heterosexual males who are neither significantly better nor worse in terms of psycho-sexual functioning and life satisfaction than the general population. Descriptive data and statistical analysis partially supported the hypotheses. Implications and future direction are discussed, as are methodological considerations.

Abstract:
This paper presents one element of a larger project that probes for systematicand predictable patterns of variability/volatility in baseball's descriptivestatistics. The larger project standardizes many baseball indices along anevent metric and provides relative estimates of each index’s point of inflectiontoward an empirical asymptote. Specifically these estimates reflect deviationsin sensitivity to “sample size” (e.g., which descriptive statistics are more orless robust across events). The end purpose of this broader investigation is aqualifier to be associated with such statistics: sample size sensitivity (TripleS). Not because it's needed, but because, colloquially, discussions of baseballstatistics are commonly qualified by the cautionary statement, "well, it's asmall sample size". The current presentation highlights the process and resultsof estimating the logarithmic event function of one statistic, batting average, and we will provide real-time projections of accuracy (our estimated functionversus in-coming baseball data that occurs during the CARMA conference). Results have implications for the integration of BigData applications intodigestable summary statistics that appeal to a broad-reaching audience withpractical implications and meaning.

Abstract:
Labor accidents cause several misfortunes, such as inconvenience to the injured ones, loss of laborproductivity, and public spending on aid and accident compensation. This work aims to search and characterize groupsof labor accidents, granting interpretability to the obtained results, to extract information that can be relevant to publicmanagers. The method proposed in this work consists of the following steps: data pre-processing; the applicationof two hierarchical clustering algorithms, HDBSCAN * and COBWEB; the evaluation of results using the SimplifiedSilhouette. The research demonstrated the susceptibility of male workers, focused on ages between 18 and 34 years old, with labor accidents that caused injuries on the fingers, by handling machines and equipment or manual tools, followedby those activities such as fishing. Considering clusters majorly composed by female victims, those related to work incellulose, paper, and related products stand out. Moreover, fingers are the most affected part, featured for incidentscaused by the handling of chemical, biological, or hand tools.

Abstract:
the authors set the main aim to theoretically examine the nature of startups and identify the opinions of residents on startups in Latvia. The specific research tasks were defined as follows: 1) to conduct a theoretical review of literature on startups and the ecosystem thereof in Latvia; 2) to identify the knowledge and opinions of residents aged 18 to 75 about startups in Latvia. As part of the present research, the authors conducted a survey in Latvia to identify the population’s knowledge of startups, differences between startups and other kinds of enterprises as well as the role of startups in entrepreneurship. The research employed the monographic and descriptive methods, the descriptive statistics method and a sociological method – an Internet survey using quota sampling. The survey was conducted in January 2023 and involved 1005 respondents throughout Latvia. The survey found that most of the respondents (73%) generally knew or had heard about startups and, according to the respondents, the main features that distinguished startups from other kinds of enterprises were innovation (54%), use of modern technologies (48%) and fast growth (41%). 63% of the respondents who had heard about startups noted that the startups, compared with other kinds of enterprises, were generally important for further development of the business environment in Latvia.

Abstract:
This report describes a business intelligence (BI) model developed by the Cold Regions Research and Engineering Laboratory (CRREL) to evaluate multiple projects simultaneously and help researchers learn descriptive phrases found in alignment sources representative of their projects. The BI model combines the linear additive model with the analytical hierarchy process to take advantage of the qualitative and quantitative nature of both methods. The model has five variations, all built along the same objectives but with different criteria due to the specialized emphasis areas of each variation. The BI model operates around three central concepts for evaluating the projects: Alignment Variables, Timing, and Customer Relationship. A use-case scenario with ten projects shows the effectiveness of the model and compares it with another model from the United States Military Academy. This new BI model will assist researchers in developing and proposing research ideas that are more relevant and fundable.

Abstract:
Purpose. The goal of the present article is to analyze the original text of the tragedy “Romeo and Juliette” and its translations into the Russian and Ossetian languages to reveal Shakespeare’s metaphors for further analysis of the ways they are translated and possible problems translators might come across while translating. The main methods employed in the research are: the method of contextual analysis, the descriptive-analytical and the contrastive method. Results. The research was based on the theory of Shakespeare’s metaphor introduced by S.M. Mezenin. According to S.M. Mezenin the revealed metaphors were divided into several semantic groups the most numerous of which comprises metaphors with the semantic model “man - nature” that once again proved the idea of Caroline Spurgeon. The analysis of the translations into the Russian and Ossetian languages showed that translators do not always manage to preserve in the translated text unique Shakespeare’s metaphors. Practical implications. The received results can be used in teaching theory and practice of translation, cultural science, comparative lexicology of the Ossetian and Russian languages and the Ossetian and English languages.

Karki, Shanta. Applying the River of Life Method to Support Reflection and Learning in Terre des hommes Nepal. Institute of Development Studies, 2023. http://dx.doi.org/10.19088/clarissa.2023.005.

Full text
Abstract:
The RoL method is a visual narrative method that helps people tell stories of the past, present, and future. Individuals can use this method to introduce themselves in a fun and descriptive way. A group can use it to understand and reflect on the past and imagine the future of a project. Besides, it can also be used to build a shared view of a process over time while acknowledging different and perhaps contradictory perspectives. The method uses drawings rather than text, making it useful in groups that do not share a common language. Metaphors from a river are used to explore aspects of a story – such as whirlpools depicting challenges or lakes suggesting a sense of calm etc. When used in a group, it is an active method, engaging people in the process of storytelling and listening through visualising their experiences and using metaphors to explore in depth. In CLARISSA, we adapted the RoL method to document our collective understanding of the story of implementation of the programme as part of the programme’s monitoring, evaluation and learning component. The purpose was to surface the details of our process of the systemic Action Research that we are undertaking with children in the worst forms of child labour and business owners. We used the same river metaphors as is often applied when the method is used with individuals.
