Abstract:

Synopsis Deutsche Bahn AG (Deutsche Bahn hereafter) was the former German railroad monopolist until deregulation in 1996. It was a well-known company that operated in worldwide markets for transport and logistics at the time of the case (late 2013). The case “Deutsche Bahn AG: a former monopoly off track?” focuses on the opportunities and challenges faced by Deutsche Bahn with regard to its position in the German individual transportation market. On the one hand, Deutsche Bahn is facing external problems. Increasing competition in short- and long-distance traffic threatens its strong business position. The competition emerged from a growing long-distance bus market and the increase in private railway companies. During the last few years before 2013, Deutsche Bahn has lost several public tenders for individual passenger travel in Germany. On the other hand, Deutsche Bahn has internal problems that endanger its image as a service company. A lack of service quality and the technical condition of its trains has led to rising numbers of customer complaints. In addition, staffing and punctuality problems have exacerbated the situation. One of the main technical issues the company faces is that ordered trains have not been delivered on time. Given the focus on Deutsche Bahn’s domestic challenges, its international business activities are tackled only briefly. While regulatory and political events have an impact on Deutsche Bahn, these are not the main subjects of the case. Research methodology This case has been written from public sources. Consequently, no company release is provided. None of the information has been disguised in any way. Relevant courses and levels The case is intended for use in a 90-minute strategic management class attended by students at the end of their undergraduate studies or in postgraduate study. Although the case relates to issues in strategic management, the special regulatory environment and some of the issues covered could make the case a useful complement in other classes as well, such as classes in supply chain management (procurement) or the management of public companies. Therefore, students should have basic knowledge in developing strategies, management, marketing, human resource management, and finance. Abstract:

With Judgment No. 21995/2019 (the Judgment), the Italian Court of Cassation (Court of Cassation) once again tackled the limits of sovereign immunity with regard to crimes against humanity (para. 7). The Judgment is part of litigation originating in Greece with the Leivadia Tribunal's 1997 Distomo decision, confirmed in 2000 by the Areopago (Hellenic Supreme Court), which ordered Germany to pay compensation and legal costs of approximately 50 million euros to the relatives of 218 victims of the Distomo massacre committed by the German military in 1944. In this Judgment, the Court of Cassation addressed whether sovereign immunity blocked the seizure of German assets located in Italy as part of that compensation order. The Court of Cassation's decision is noteworthy because it takes the discussion on sovereign immunity from jurisdiction and crimes against humanity one step further by addressing, in particular, the question of compensation and attachment of claims and rights held by the debtor against third parties.

Ziel war es, eine einheitliche Dokumentation in den beteiligten stationären Einrichtungen zu erreichen, die zudem mit dem EBIS-Datensatz der ambulanten Erhebungen besser vergleichbar sein sollte. Das System wird vom Bundesministerium für Gesundheit gefördert und vom IFT Institut für Therapieforschung fachlich betreut. </P><P> Als Träger des Systems wurde die SEDOS-Arbeitsgemeinschaft (SEDOS-AG) gegründet, der heute der Bundesverband für stationäre Suchtkrankenhilfe (buss) e. V., der Deutsche Caritasverband e. V., die Deutsche Hauptstelle gegen die Suchtgefahren (DHS) e. V., der Deutsche Orden KdöR Suchthilfe, der Fachverband Sucht e. V., der Gesamtverband für Suchtkrankenhilfe im Diakonischen Werk der Evangelischen Kirche in Deutschland e. V.sowie das IFT Institut für Therapieforschung angehören. </P><P> Mit Stand Dezember 1999 nehmen 124 Einrichtungen aus dem gesamten Bundesgebiet am SEDOS-System teil. Von diesen haben für die Auswertung 1999 insgesamt 107 Einrichtungen verwertbare Datensätze geliefert. Die Unternehmen trennten sich flächenstark von Wohnungsbeständen. Abstract:

This work addresses crosswind stability exemplified for the German Railway Deutsche Bahn AG high-speed train ICE 2. The scope of the work is to describe the flow by means of computational fluid dynamics past the leading two cars of the train for yaw angles in the range 12.2–40.0°. Three track formations are utilized. The basic results are the set of independent aerodynamic coefficients for the lead and subsequent cars. The results are to some extent compared with experimental data for ICE 2 and also with data obtained for the Swedish high-speed train X2000. A numerical sensitivity study is undertaken to quantify differences in the above results dependent on the grid density and quality, turbulence model, numerical scheme, location of inlet and outlet boundaries, turbulence intensity and flow simulation software.

Forschungsdaten sind das primäre Produkt empirischer Studien und die zentrale Grundlage wissenschaftlicher Erkenntnis. Ihre langfristige Sicherung und Bereitstellung zur intersubjektiven Nachvollziehbarkeit und damit zur Qualitätssicherung sollte daher in allen wissenschaftlichen Disziplinen unterstützt werden. Entsprechend hat die Deutsche Forschungsgemeinschaft 2016 die sozialwissenschaftlichen Fachgesellschaften in Deutschland aufgefordert, sich mit dem Thema zu befassen und konkrete Leitlinien zum Umgang mit Forschungsdaten zu entwickeln. Die vorliegenden Leitlinien sind dabei aus einer Arbeitsgruppe der Deutschen Gesellschaft für Publizistik- und Kommunikationswissenschaft entstanden. Sie beziehen sich auf alle in der Kommunikationswissenschaft generierten Datentypen und reflektieren dabei die Bedeutung der Bereitstellung von Forschungsdaten, aber auch Herausforderungen und Einschränkungen. Daraus werden Empfehlungen für verschiedene Zielgruppen abgeleitet, um die Bereitstellung von Forschungsdaten in der Kommunikationswissenschaft stärker zu fördern.

Abstract:

Distributed acoustic sensing (DAS) over tens of kilometers of fiber optic cables is well-suited for monitoring extended railway infrastructures. As DAS produces large, noisy datasets, it is important to optimize algorithms for precise tracking of train position, speed, and the number of train cars. The purpose of this study is to compare different data analysis strategies and the resulting parameter uncertainties. We present data of an ICE 4 train of the Deutsche Bahn AG, which was recorded with a commercial DAS system. We localize the train signal in the data either along the temporal or spatial direction, and a similar velocity standard deviation of less than 5 km/h for a train moving at 160 km/h is found for both analysis methods. The data can be further enhanced by peak finding as well as faster and more flexible neural network algorithms. Then, individual noise peaks due to bogie clusters become visible and individual train cars can be counted. From the time between bogie signals, the velocity can also be determined with a lower standard deviation of 0.8 km/h. The analysis methods presented here will help to establish routines for near real-time train tracking and train integrity analysis.

Abstract Es gibt sie – langfristige russische Direktinvestitionen in Deutschland, wie die von Ilim Timber. Ursprünglich wollte das St. Petersburger Forstprodukteunternehmen nur deutsche Maschinen für eine neue Produktionsstätte in Russland kaufen und entschied sich dann dazu, zwei komplette Sägewerke in Wismar und Landsberg zu übernehmen (Tepavcevic, 2013) – oder die des Investors und Vorsitzenden der Sankt Petersburger Kirov-Werke Georgi Semenenko in Rostock (Mangler, 2017). Sie dienen nicht – wie oftmals bei russischen Investitionen in Deutschland unterstellt – der Kapital- oder Systemflucht, sondern werden aus strategischen Überlegungen heraus präzise geplant und erweisen sich als ökonomisch nachhaltig. Und umgekehrt gibt es auch die deutschen Erfolgsgeschichten in Russland, wie die von Pobeda Knauf, von Siemens Gas Turbine Technologies – einem Gemeinschaftsunternehmen der Siemens AG und der russischen Power Machines zur Produktion von Gasturbinen –, der Robert Bosch GmbH, von Mustang Neva im Bereich der Textilherstellung oder der Beteiligung von Henkel an der ERA AG in Tosno, die Wasch-, Reinigungs- und Scheuermittel sowie Kosmetika herstellt. Aber das wirtschaftspolitische Umfeld wird rauer. Ein Indikator dafür sind neben den kurzfristig reagierenden Import- und Exportzahlen vor allem die auf Langfristigkeit und Verlässlichkeit fußenden Investitionen russischer Unternehmen in Deutschland sowie deutscher Unternehmen in Russland. Der „Russian Investment Monitor“ der Hochschule Stralsund sowie der „German Investment Monitor“ der Polytechnischen Hochschule „Peter der Große“ in Sankt Petersburg ermöglichen eine fundierte Analyse und dienen als zuverlässiges Barometer der deutsch-russischen Wirtschaftsbeziehungen. When analyzing the long-term trade relations between two countries, import and export data are of limited help. Here the direct investment behavior is a much better indicator. However, direct investment figures entirely based on the stocks of investment are open to interpretation and might be even misleading. This is where the “Russian Investment Monitor” in Germany and the “German Investment Monitor” in Russia is of help. Analyzing investment behavior on the company level reveals the trust investors assign to their home country and the host country. Russian investments in Germany seem to be declining with China taking over the lead. Moreover, the Russian investments in Germany seem to a large part be motivated by capital flight rather than by traditional investment motives. However, exceptions to the rule exist. On the other hand, German investments in the Russian Federation seem to be more strategic and economically sustainable although the challenging political environment has reduced the German investment activity in Russia and opened the door to increasing Chinese direct investments. In summary, the German-Russian investment relations seem to be at the crossroads. Abstract:

AbstractIt has been a policy proposal since long to vertically separate transport and infrastructure in Germany’s railway sector. The proposal received new momentum, when selling the transport subsidiaries of Deutsche Bahn AG to the public was discussed in 2008 / 2009. While vertical separation is general ly understood to prevent foreclosure and discrimination by the incumbent network- operator, advocates of vertical integration claim separation to have adverse effects on access prices to the infrastructure. We examine the price setting incentives of an integrated and a separated network-operator and compare our results to rough empirical findings on the profitability of the Deutsche Bahn AG infrastructure branches. Theoretical analysis highlights that after separation exceptional mark-ups on access prices to the railwayinfrastructure are feasible only in segments of railway-transport with insufficient competition. We therefore conclude that an economic policy for the railway sector directed on efficient supply and promoting effective competition should unbind itself from alleged price synergies and should press ahead with vertical separation instead.

Für die etwa 4,7 Millionen in Deutschland lebenden Muslime hat am 23. April der religiöse Fastenmonat Ramadan begonnen. Obwohl Menschen mit chronischen Erkrankungen wie einem Diabetes mellitus von der Pflicht zu fasten befreit sind, machen trotzdem viele muslimische Diabetespatientinnen und -patienten von dieser Ausnahme keinen Gebrauch. Doch beispielsweise bei Schwangerschaftsdiabetes oder einem schlecht eingestellten Diabetes kann das tägliche Fasten erhebliche Gesundheitsrisiken bergen. Die Deutsche Diabetes Gesellschaft (DDG) rät Menschen mit Diabetes daher, nur unter ärztlicher Begleitung zu fasten – Risikopatienten sollten darauf besser ganz verzichten. Zudem geht während der Corona-Pandemie ein entgleister Diabetesstoffwechsel mit einem erhöhten Risiko für einen schweren Krankheitsverlauf einher. Wie medizinisches Personal im Ramadan kulturell sensibel begleiten kann und wie Patienten ihre Blutzuckerwerte stabil halten, erklären Dr. med. Mahmoud Sultan und Johanna Karapinar von der AG „Diabetes und Migranten“ der DDG.

ZusammenfassungDie Finanzkrise der Jahre 2007 ff., insbesondere die Insolvenz der US-Investmentbank Lehman Brothers Inc., hat das Finanzsystem weltweit an den Rand des Abgrunds geführt. Besonders betroffen waren Banken, welche in verbriefte US-Hypothekenmarktpapiere investiert hatten, die während der Krise massiv an Wert verloren. In Deutschland gerieten insbesondere öffentlich-rechtliche Landesbanken, die halbstaatliche IKB AG, aber auch einige Privatbanken und als Genossenschaftsbank die Deutsche Apotheker- und Ärztebank eG in große Schwierigkeiten. Dies führte zu einer Debatte, inwieweit die Verluste durch haftungsrelevantes individuelles Fehlverhalten von Bankvorständen verursacht wurden oder schicksalhaft eintraten. Während die einen forderten, Bankmanager für die Schäden zivil- und auch strafrechtlich zur Rechenschaft zu ziehen, halten andere die Haftungsrisiken für existenzvernichtend. Fragen der Vorstandshaftung wegen fehlgeschlagener Investitionen in US-„Subprime“-Papiere waren und sind noch Gegenstand einiger Zivilverfahren vor staatlichen Gerichten und Schiedsgerichten sowie von Strafverfahren. Dieser Beitrag behandelt zunächst in einem Überblick die Pflichten und die Haftung von Bankvorständen. Die weiteren Ausführungen gelten der Haftungsdurchsetzung. Abschließend wird die Frage beleuchtet, unter welchen Voraussetzungen Ansprüche aus Vorstandshaftung vor einem Schiedsgericht durchgesetzt werden können und welche Vor- und Nachteile damit verbunden sind.
