Full textA presente tese visa a afirmar o potencial da arte enquanto uma via de pesquisa acadêmica capaz de propiciar modos alargados de pensamento e ação, concebendo a criação e a experiência como elementos centrais do processo investigativo. Na perspectiva que elege, a tese entende a pesquisa com a arte não tanto como uma elaboração epistemológica, mas como um dispositivo de ações ontológicas: a composição de uma estética da existência, de um devir-pesquisa, de um devir-arte. No momento contemporâneo, em que a humanidade se confronta com a possibilidade de estar causando sua própria extinção, a tese apresenta a força do ato poético de perscrutar caminhos outros, desestabilizando o lugar comum do pensamento, propiciando um acreditar na possibilidade do mundo (Deleuze). A Tese sublinha a importância da arte na formação de pesquisadores e na efetivação de uma educação enquanto educere, permitindo uma humanidade por-vir. A pesquisa, de caráter ensaístico, é organizada como uma tese-parangolé (Oiticica), propondo operações discursivas bricoladoras e lúdicas, visando a produzir deslocamentos e intensificações da potência de vida, articulando, na educação, tanto saberes quanto não saberes. A tese revisita a obra de alguns autores da metodologia conhecida como Pesquisa Baseada em Arte, enfatizando a contribuição dos desafios colocados por Jan Jagodzinski e Jason Wallin. A tese propõe ainda navegações teórico-poéticas por diferentes águas: pelos gestos transgressores nietzscheanos, que situam a arte no centro da vida; pelos processos foucaultianos de subjetivação, que desdobram liberdades e práticas de si; pelo olhar noturno de Blanchot, que vislumbra a experiência-do-fora; pela in-fância ética agambeniana que favorece experiências; pelo pensamento desviante de Deleuze, que se espalha em multiplicidades produzindo inícios. E propõe, especialmente, encontros com você, leitor. E com quem mais chegar.
Abstract : The objective of this thesis is to affirm the potential of art as a means for academic research that is capable of propitiating broad modes of thinking and action, conceiving creation and experience as central elements of the investigative process. The thesis understands research with art not so much as an epistemological elaboration, but as a dispositif for ontological actions: the composition of an aesthetic of existence, of a become-research, of a become-art. At the contemporary moment, when humanity faces the possibility that it is causing its own extinction, the thesis affirms the strength of the poetic act for scrutinizing other paths, destabilizing the commonplace of thought, propitiating a believe in the possibility of the world (Deleuze). The thesis highlights the importance of art in the education of researchers and in the realization of an education as educere, which makes possible a humanity to come. This essay-like research is organized as a parangolé thesis (Oiticica), proposing ludic discursive operations and bricolages, aiming to produce displacements and an intensification of the potential for life, articulating, in education, forms of knowledge and non-knowledge. The thesis revisits the work of some authors of the methodology known as Arts- Based Research, emphasizing the contribution of the challenges raised by Jan Jagodzinski and Jason Wallin. The thesis also proposes theoretical-poetic navigations through different waters: through the transgressive Nietzchean gestures, which locate art at the center of life; by the Foucaultian processes of subjectivation, which unfurl liberties and practices of self; through the nocturnal look of Blanchot, which envisions the outside-experience; through the Agambenian ethical childhood that is propitious to experiences; and through the deviant thinking of Deleuze, which spreads out in multiplicities to produce beginnings. Full textIn spite of the transformations and many crises which family encounters, the family solidarity duty seems to be a constant element in time. Although relatives and family are aware of this duty, it was never truly identified juridically. Indeed, its legal apprehension reveals a multitude of legal or contractual obligations, which can go from the maintenance obligation, to life insurance precautions, as well as inheritance issues. Taking into consideration the diversity of family duties, this thesis highlights the existence of one and only solidarity family duty, which can be listed in a multitude of modalities. We are led to the juridical foundations of this duty by the need to create a unity between different solidarity demonstrations. Family bond is initially imposed indeed, but its restrictive law comprehension prevents us from accounting for the solidarity, which exists in some current family structures, such as second families and cohabitation. Thus, it is necessary to explore other bases such as concepts of piety and will of community life, which would enable to admit more openly the existence of a solidarity duty. Moreover, it seems necessary to lay down the essentiel conditions to a material implementation - resources and needs - as well as a moral implementation - protagonists' behavior A definition of these criteria is offered in order to enable its application to all demonstrations of solidarity. Lastly, unity can be found in gratuitousness, a family duty caracteristic which tends to be limited. This study enables indeed the demonstration of the existence of a family solidarity unity, but also highlights it imperfection

Full textThe duty of independence of the arbitrator has been nearly unanimously recognized. Rather than considering the duty of independence as a "dual" concept, it is necessary to perceve the duty of independence as a unitary and generic duty composed of three particular obligations: the obligations of neutrality, impartiality and objectivity. The renonciation of the "dual" vision of arbitration characterized by a reference to the jurisdictional and contractual components of the latter, would permit an analysis of the duty of independence of the arbitrator as a rule of moral conduct compelled by the very nature of the function of arbitration. The duty of independence of the arbitrator would constitute the fundation of arbitral justice. It would characterise the originality of the latter as opposed to state justice which, as gardian of a determined juridical order, should not be able to aspire to neutrality and therefore independence. The duty of independence of the arbitrator would be the basis of his autonomy. The fundamental scope of the duty of independence of the arbitrator would justify that the independence of the arbitrator be deemed of mandatory public order and therefore neither the parties no the arbitrators could derogate therefrom. A particular attention must be brought to the means whereby the independence of the arbitrator can be assured. The arbitrator should reveal any circumstance which may prejudice his independence. Este trabalho nasce da inquietação e do desejo de melhor compreender o movimento que envolve a busca de estratégias que permitem aos professores não sucumbir diante das situações paradoxais e adversas que caracterizam o cotidiano escolar. Trabalhar com história de vida pressupõe de certa maneira mergulhar no cotidiano do trabalho dos professores, perceber suas alternativas e possibilidades de escolha dentro das condições em que se estabelecem as relações neste contexto. A vida cotidiana não acontece do lado de fora da história, é, antes o momento histórico carregado de significados que, ao proporcionar sentidos individuais, estabelece conexões entre o "eu" e o "nós", entre tempo e espaço, que se fundem entre presente, passado e devir. Este mergulhar, ora no cotidiano dos professores, ora na história de uma vida constituída neste cotidiano permitem, por certo, compreender quais as brechas ou fendas em meio a tantas amarras inerentes ao sistema educacional, possibilitou a esta professora, constituir-se desta forma? Que relações travadas em meio a tantas adversidades, permitiram que a mesma não perdesse a esperança e o compromisso com uma educação pública de qualidade?

Essa dissertação estuda os significados dos auxiliares modais #deve. e #devia. do português brasileiro quando formam um par mínimo de sentenças. Para tanto, iniciamos com um panorama acerca da modalidade das línguas naturais e posteriormente, apresentamos uma breve caracterização dos auxiliares modais. O arcabouço teórico utilizado foi a teoria de Kratzer (1981, 1991, 2010), que se fundamenta na semântica de mundos possíveis. O objetivo é traçar as semelhanças, diferenças e especializações entre os auxiliares modais #deve. e #devia. quando orientados para o futuro. As fontes de ordenação analisadas para o objeto de estudo serão a epistêmica, deôntica e teleológica, com um especial enfoque na epistêmica. Para isso, partimos da hipótese de que os dois modais veiculam necessidade fraca, porém eles não dizem o mesmo e essa diferença poderá ser captada através do morfema de imperfeito presente em #devia., mas não em #deve.. Através das análises intuitivas, percebeu-se que #deve. é especializado, isto é, ele #prefere# se combinar com base modal epistêmica, mas também se encaixa em contextos deônticos e teleológicos, podendo ainda expressar ordem e conselho como ato de fala. Ao passo que #devia. prefere se combinar com fonte de ordenação teleológica, expressa conselho como ato de fala e não #gosta# de ser epistêmico e nem deôntico. A noção de necessidade fraca de Kratzer sozinha não consegue explicar a semântica de #deve. e #devia., já que podemos perceber que um é mais objetivo e o outro subjetivo, respectivamente.

A presente tese tem como temática a desinstitucionalização de jovens "egressas" de serviços de acolhimento institucional (abrigo e casa-lar), habitantes de Santa Catarina (Palhoça e Florianópolis) e Rio Grande do Sul (Porto Alegre). Para tanto, a desinstitucionalização é tomada como um processo amplo e complexo que implica mudanças, não só de lugar (desacolhimento), mas de estado, em especial em termos daquilo que as jovens podem vir a ser (devir), e também como contexto privilegiado para a emergência da dimensão vivencial dos sujeitos. Partindo dessa temática mais geral, a pesquisa buscou investigar as maneiras pelas quais estas jovens inventam/criam novas possibilidades de vida, a partir de condições que a princípio reforçariam sua vulnerabilidade e falta de potência, e também aquilo que elas podem vir a ser (devir) para além da institucionalização. A etnografia, realizada junto a oito jovens "egressas" de serviços de acolhimento (Isabelle, Nicole, Virgínia, Estella, Nina, Clarissa, Alice, Olívia), permitiu destacar fundamentalmente três modos pelos quais as jovens inventam/criam novas possibilidades de vida. Uma primeira via para a invenção estaria na prática de "circulação de crianças", a qual, ao invés de ser uma iniciativa da família ou mesmo do Estado, teve início pela ação das próprias jovens que, durante a infância, se desvencilharam, através da fuga, de diferentes situações de maus-tratos e exploração. A segunda está relacionada às maneiras pelas quais as jovens vivenciam a experiência da maternidade e de cuidado com os filhos, tendo em vista a relação que estabelecem com as políticas públicas assistenciais, com as novas tecnologias reprodutivas, com os seus companheiros e o trabalho, etc. E a terceira refere-se a uma espécie de "virada no jogo das relações de parentesco", em especial , quanto às relações que as jovens estabeleciam com os parentes (principalmente mãe, pai e irmãos) previamente ao acolhimento institucional. A análise dos modos de vida dessas jovens permitiu observar que estes têm como característica uma "espécie de improvisação contínua" que, ao contrário de revelar uma postura simplesmente reativa (marcada pela busca da sobrevivência) diante das adversidades, está relacionada àquilo que elas souberam criar, ou seja, à descoberta do que gostam e sabem fazer. Para contemplar essa diversidade de experiências, foi preciso conduzir a análise e a própria escrita etnográfica tendo em vista o desafio de compreender o sujeito de uma maneira que não estamos acostumados a ver. Ou seja, a improvisação contínua foi revelando não um sujeito acabado ou precário, mas sim configurações de sujeito que vão sendo constituídas contingencialmente e que apontam para novas possibilidades de devir.
Abstract : The present thesis dwells upon the deinstitutionalizat ion of young women from foster care services in the states, habitants of Santa Catarina (Palhoça and Florianopolis) and Rio Grande do Sul (Porto Alegre), Brazil. Deinstitutionalizat ion is understood as a broad and complex process which involves changes, not only from one place to another (since they leave the institution), but also as a change in their state of being, especially when we consider what these young women could become (becoming). Likewise, deinstitutionalizat ion is understood as a fruitful context for the emergence of the experiential dimension of the subjects. Taking this general theme as a starting point, the research seeks to investigate the ways through which these young women invent/create new life possibilit ies based on conditions which, at first could reinforce their vulnerability and lack of potency, and it also explores what they could become beyond the boundaries of their institutionalizat ion. The ethnography, which took place with eight young women (Isabelle, Nicole, Virgínia, Estella, Nina, Clarissa, Alice, Olívia) who had been through the foster care system, enabled me to highlight three ways where they invent/create new life possibilit ies. The first path to invent ion can be found in the "children circulation" practice, a practice that, instead of being an init iat ive of the family or even the state, was an init iat ive of the young women themselves, who, during their childhood, ran away leaving behind different situations of abuse and exploitat ion. The second, is related to the way they experience motherhood and caring for their children. Here the idea is to think about these experiences in relation to the relat ionships they establish with welfare policies, with the new reproductive technologies, with their partners, with work, etc. The third path to invention deals with what one could describe as a ?turning tables on kinship?, notably reggarding the relat ionships they had with their kin (mainly mother, father, brothers and sisters) before their institutionalizat ion. The analyses of the ways of life of these young women, allowed me to observe that these ways of life have, as a prime characteristic, something like a "continuous improvisat ion". However, contrary to common belief, this "continuous improvisat ion" does not only mean a reactive attitude (given by a survival drive when faced with hardship), but it is related to what they knew and wanted to create. In other words, it is linked to their process of finding out what they knew and wished to do. In order to be able to contemplate the diversity of experiences it was necessary to build the analyses, and even the ethnographic text, taking into consideration the challenge of understanding the subject in a way not familiar to us. Thus, the notion of continuous improvisation helped to unfold not a final or precarious subject, but configurations of subjects, which are being constituted contingently and that signal to new possibilit ies of becoming.

Full textThe XXthe century has given rise to the notion of objective good faith in contract law, and more generally, to a standard by which the behaviour of parties to an obligation is judged. The adoption of the concepts of contractual duty and incombance allows a technical approach without affecting the category of civil obligations.Contractual duty is a code of conduct that the contracting party has to observe throughout the performance of the contract ; otherwise it might be viewed as being in a breach of contract. For example, the requirements of good faith and security are duties in that they require the contracting party to adopt a certain conduct on an ongoing basis, in addition to the obligations the contracting party has to carry out under the terms of the contract.Contractual incombance is also a merely behavioural constraint, however it differs in that it weighs on the contracting party only if they wish to benefit from the advantages it determines. It is a prerequisite for the exercise of a right. A buyer who wishes to avail himself of a legal warranty against latent defects, for example, must point out any defect to the vendor, just as the insured who wishes to make a claim must report the covered incident to his insurance company.Distinct sanctions apply to these notions : in case of a breach of contractual duty, penalties can be awarded as a result of the party’s failure to perform its contractual obligations ; on the other hand, non-compliance with and incombance will entail the loss of the determined right

Há uma certa imagem de ciência que remonta a Galileu (sec. XVII). Ela corresponde à idéia de que a ciência poderia "descobrir" as leis impessoais que governam a natureza. Porquanto detentora de uma racionalidade "neutra" (a-histórica, a-moral e a-temporal), capaz de acesso privilegiado a essas leis impessoais, a ciência consistiria, consequentemente, em uma forma de investigação da realidade superior a qualquer outra. Segundo essa perspectiva, a ciência logrou desenvolver uma metodologia que exclui os valores dos momentos cruciais de suas práticas. Essa abordagem é bem conhecida e endossada e constitui, ainda hoje, em uma espécie de "senso comum" da tradição científica. Segundo alega a ortodoxia da filosofia da ciência, qualquer papel desempenhado por valores (morais, sociais) constituiria uma espécie de "intrusão" de subjetividade que ameaçaria a possibilidade de objetividade científica. Já que juízos de fatos (ou resultados dos conhecimentos científicos) não podem ser inferidos de valores, inversamente, não poderíamos esperar que a ciência pudesse nos ajudar a resolver nossos problemas éticos mais fundamentais. O filósofo Hugh Lacey, inserindo-se em uma longa tradição crítica, contesta a imagem de ciência como uma instância independente da subjetividade humana. Ele propõe um modelo, segundo o qual todo conhecimento científico é produzido mediante a subordinação a alguma estratégia de pesquisa, que carrega consigo a marca dos valores sociais mais prementes, e que impõe limites à parcela da realidade que será "tocada" pela investigação. Segundo sua abordagem, há (e deve haver) uma interação profunda entre ciência e valores, que é essencial para a metodologia científica. O objetivo desse trabalho é estender o modelo laceyano a um caso diverso daquele por ele já tratado (nas ciências naturais). Partindo de sua tese, argumentamos que a ortodoxia da ciência econômica moderna (teoria neoclássica), através da incorporação do paradigma mecanicista da física clássica, bem como de todo instrumental analítico das estratégias materialistas, representa não um tipo de compreensão "neutra" dos fenômenos econômicos # todos agora expressos ou refletidos no movimento dos preços. Ao invés disso, propomos que ela representa uma sutil, porém particularmente notável manifestação dos valores predominantes nessa sociedade (capitalista, tecnológica, industrial, liberal), da qual faz parte. Assim, procuramos mostrar que, também no âmbito social, a preeminência dos aspectos nomológicos e quantitativos da realidade na formulação das teorias econômicas de tradição neoclássica, os próprios valores cognitivos espelham valores sociais altamente estimados nas sociedades modernas. Como propostas alternativas, surgem, no nível teórico, a proposta da Economia sistêmica, na esfera pragmática, o paradigma do Ecodesenvolvimento aparece como um novo modelo, capaz de dar conta da complexa problemática sócio-ambiental. Ambos projetos compatíveis com a proposta de Lacey: de que, ao pluralismo dos sistemas de valores existentes em uma sociedade, diversas alternativas possíveis para a investigação científica, norteadas pelas estratégias de pesquisa correspondentes, devem ser fomentadas. A co-existência de várias ciências desse tipo # "não#neutras" #, nas mais diversas áreas de investigação, seria um pré-requisito necessário para a realização do antigo ideário Iluminista -- de construção de uma sociedade mais humana.

Full textThe duty of disobedience of the public official is envisaged as constituting a legal obligation, that is, as a "social technique" serving a number of policy choices. The thesis proposes to build analytical tools that can produce a general topography of the object in la and in the discourse on the law. It must identify and clarify a number of issues raised by the existence of this type of object in positive law sometimes obscured by the intuitive relationships that we imagine it has with fundamental moral questions. To do this, the research thesis specifically implements an analysis of the functions, structures, and criteria for implementing the obligation in domestic law, international criminal law and foreign national law. The study then shows the diversity of existing obligations, reveals certain dynamics of the doctrinal and contentious debate, and finally confirms the impossibility of "essentializing" the object. It makes it possible to envisage a proposal for modification of the existing systems in domestic law

Esta tese enseja a possibilidade de leitura das letras de música do rock brasileiro dos anos oitenta sob o viés de uma poética pessimista, entendendo esta segundo as prerrogativas estabelecidas por Arthur Schopenhauer em O mundo como vontade e representação. Para tal, letras de Cazuza, Renato Russo e Humberto Gessinger estão aqui circunscritas como corpus para, por meio desta proposição de interpretação, estabelecer sondagens que possibilitem visualizar em seus versos temas que seriam afins ao do pensamento pessimista do século XIX. Com este intuito, a tese usa como instrumento de análise a epistemologia que faz parte da proposta desconstrutivista de Mil Platôs, obra de Gilles Deleuze e Félix Guattari, dando ênfase ao emprego que estes autores fazem dos termos devir e agenciamento. É com o uso destes termos, então, que este trabalho enquadra as letras que estão aqui selecionadas, vendo-as como uma reterritorialização do pessimismo enquanto um devir no rock brasileiro da década de oitenta. Devir este possibilitado em função dos agenciamentos oriundos das rupturas políticas, econômicas e sociais que protagonizaram o contexto histórico do Brasil após o fim do regime militar. Imiscuídos por estes agenciamentos uma nova geração se aproximou de temas que em si engendram uma estética de desilusão, apatia e descrédito pelos sistemas ideológicos de outrora; e que seriam uma tangente pós-moderna da concepção pessimista de que a vida, malgrado os diferentes contextos históricos que a envolvem, não proporcionaria nada além de tédio e vãs expectativas
This thesis entails the readability of the Brazilian rock music lyrics from the eighties under the bias of a poetic pessimism, pursuant to the prerogatives established by Arthur Schopenhauer in The World as Will and Representation. To do so, through this proposition of interpretation, lyrics of Cazuza, Renato Russo and Humberto Gessinger are here circumscribed as corpus to establish soundings enabling the view through their verses, themes to be related to the pessimistic thought of the nineteenth century. To this end, the thesis uses as an analytical tool the epistemology that is part of the deconstructive proposal of Thousand Plateaus, the work of Gilles Deleuze and Felix Guattari, emphasizing the application of the terms becoming and agency that these authors make use of. It is with the use of these terms, then, that this paper frames the lyrics that are here selected, seeing them as a repossession of pessimism while a becoming in the Brazilian rock music of the eighties. Becoming, this being possible depending on the agencies originated from political, economic and social disruptions which have carried out the historical context of Brazil after the end of the military regime. Intruded by these agencies a new generation came up with issues that in itself engender an aesthetic of disillusionment, apathy and disbelief of the old ideological systems; and that would be a postmodern tangent of the pessimistic conception that life, despite the different historical contexts surrounding it, would provide nothing but boredom and vain expectations.

Full textThe first part presents a review of the duty of loyalty in company law, to establish an understanding of the origins of the concept and consider its extension. The duty of loyalty, which has developed from case law, places upon directors an obligation to provide information on current negotiations to partners and not to compete with the company. The root of these two expressions of duty lies in the director's power to act in the interests of the partner or the company; by violating one of these obligations in order to favour a conflicting personal interest the director breaches this duty of loyalty. This understanding of the duty of loyalty, similar to that of fiduciary duties in common law, makes it possible to envisage an extension to those bound by the duty whenever a relationship of power and a conflict of interests can be seen to exist. It also provides a basis for imposing new obligations such as the obligation to declare conflicts of interests and not to vote in case of conflict. The second part uses a prospective approach to consider the various applications of the obligation of loyalty imposed on the director and partner. Respect for these obligations is based on two types of control. Firstly, legal control which can be provided internally by advisers and the general meeting, and externally by auditors and various experts in order to prevent disloyal decisions and actions. Secondly, courts are called upon to exercise their power in case of an action to declare null and void or accountable against a director or leading partner who has failed in his or her duty of loyalty

Full textUsing an attitude survey, this essay studies the relationship between employed soldiers and their employer the Swedish Armed Forces in order to develop an understanding of therelationship between these parties. The research question is: What do soldiers' relationships totheir employer, the Swedish Armed Forces, look like?The theoretical basis of the study is build on the theories of relationship commitment, andmore specifically the part that can be linked to attitudinal commitment. The conceptualdefinition used is mainly based on Meyer and Allen's (1991) three components of relationshipcommitment, namely affective commitment (emotional), continuance commitment(calculating) and normative commitment (normative). The concept definition also includeseight influencing factors, each given a clear linkage to the respective component ofrelationship commitment. The influencing factors are personal competence, shared values, trust, experiences, relationship benefits, relationship termination costs, obligations andimperative environment.Unlike many previous studies done in this area, a clear link between the influencing factorsand their respective components is defined. In addition, the survey covers the relationshipbetween workers and employers in the public sector which is also relatively rare. Previously,mainly relationships between organizations in the private sector or in various forms ofnetwork have been studied.The results of the survey show that soldiers' relationship with the Swedish Armed Forces arebased in particular on an emotional basis, where feelings of personal competence, desire forexperiences and shared values are most important. In addition, trust has some but lesssignificance for the relationship. Within the caculating component an expectation of personaldevelopment play a certain role but otherwise the component has limited influence on the relationship. In principle, there is no normative basis in the soldiers' relationship with theSwedish Armed Forces.Keywords:

Full textABSTRACT - The infection with Human Papilloma Virus (HPV) is a sexually transmitted infection very frequent throughout the world. The discovery that this infection is responsible for cervical carcinoma spurred the development of vaccines against HPV. In Portugal, the quadrivalent vaccine against HPV is part of the National Vaccination Plan, and it is administered only to 13 years old girls as a prophylactic measure of cervical carcinoma. In the United States of America, in December 2010, the Food and Drug Administration (FDA) approved the use of the quadrivalent vaccine for the prevention of pre-cancerous and cancerous lesions of the anus in both boys and girls from 9 to 26 years. On October 25th 2011, the Advisory Committee on Immunization Practices (ACIP) recommended that all boys 11 and 12 years old should be vaccinated against HPV with the quadrivalent vaccine. Given this context, what is intended with this study is to compile enough evidence that allows further consideration of the implications of whether or not to vaccinate boys against HPV in Portugal. Firstly, one collected scientific evidence about the relationship between HPV infection and the development of carcinomas of different anatomical regions. Secondly, epidemiological data on incidence and survival associated with different types of malignant tumors potentially associated with HPV infection was compiled, with special emphasis on the Portuguese reality. Thirdly, the history of HPV vaccination in Portugal and existing vaccines to prevent this infection were framed up succinctly. In fourth place, economic evaluation studies of HPV vaccination both in women as in men were reviewed, following an introduction to the subject of economic evaluation of pharmaceuticals. In fifth place, one estimated the costs of vaccinating boys against HPV over the next 20 years. Finally, one tried to reflect upon the implications of extending or not the HPV vaccination to boys in Portugal.

Full textThis paper is produced from the difference’s philosophy’s perspective and it’s intersections with education. It aims to answer the question: What can the post-curriculum child-becoming do?, taking property of the meaning of post-curriculum, invented by Corazza, and trying to update and reivent it. It explains that the meaning of child-becoming is not referred to the child individual, neither any other individual, because a becoming is made of movement and transformation, it doesn’t fit in any kind of identity forms. It attributes to the post-curriculum child-becoming a minority character due to its molecular flows and escape lines constitution and to the multilinguism that crosses it. It also affirms the child-becoming’s nomadism, attributing to it the invention of a war machine made by laughter. Putting these concepts together, a post-curriculum moved by child-becoming is presented, which problemizes and destabilizes the thinking and school practices.

Full textThe failure with the duty of humanity, in the medical acts, is seldom defined as such by the judges although it is the object of repetitive complaints of patients who primarily feel it like an attack with human dignity. In first part, the various aspects of inhumanity in the medical acts are approached with principal reference to the medical code of ethics: reflection of medicine "to the service of the humanity" which regulates the respect for human dignity, the respect of its physical integrity, psychic, the freedom of the patient, its free choice and its assent. Real examples of lived of patients victims of these acts of inhumanity are presented. In second part, the legal consequences of the failure to the duty of humanity make it possible to inform the remarks on the medical responsibility, right of the patients, devoted by the law of March 4, 2002, concept of medical fault per defect of humanity and the repair of the medical accidents. In conclusion, the doctor, looking after must apply, the proverb "Science without conscience is only ruin of the heart"

Full textThe frequency and the numbers of international private trials have grown up during the last decades. With this development, dilatory proceedings tactics have multiplied. An answer must be opposed to those unfair behaviours. Between moral and law, the notion of “loyalty – fairness” commands to parties, lawyers and judges the requirements of transparency, harmonization, esteem and cooperation during the resolution of an international private trial. Some of our actual positive rules already command the respect of the loyalty-fairness: we can speak of the requirement of the fairness of the foreign proceedings during the exequatur. However, there are still too many possibilities for bad procedural behaviours during private international trials. The recognition of a principle of abuse of right, or of the estoppel can be two ways, among others, to protect the fairness of the judicial proceedings. If it is hard to question the utility of the requirement of loyalty-fairness, this notion has no still effective value in positive law. Among the tools that we know, especially the principle of law, the study of the loyalty-fairness in international private litigation asks the recognition of a new standard of loyalty-fairness. The standard can be immediately effective, reinforcing the quality of the judicial process, but the standard of loyalty-fairness also bears some of the next evolutions of the international private litigation rules

It is this last method which has been used for a work pertaining to the Editions de minuit elaborated from undisclosed archives (new sources discovered for the period of the German occupation ; complete access to the archives of the publishing house for the years 1944-1955). Integrating new information from undisclosed documents, this work tries to explore the importance of the notion of a catalogue in the study of a publishing house. A small structure publishing only about twenty texts a year since its foundation ; occupying a singular position in the publishing world due to its history and the nature of its literary and political production, the Editions de minuit are a privileged laboratory for the application of a new approach and an observatory allowing a better understanding of the recent history of the French publishing world
