Nationalism has long been a subject of discussion in the literature on development. It has been discussed whether nationalism is indispensable or not on the way to modernity and development. Third World nationalism and revolution from above emerged as key concepts within these discussions. Nationalism was brought forth in many Third World countries as an understanding, which is thought to facilitate paving the way for development, as it imagines a nation based on integrity. "L'expression "devoir d'ingérence" est un terme qui a fait son apparition récemment parmi le vocabulaire du droit international public. Elle a été inventée par les organisations humanitaires non-gouvernementales pour attirer l'attention de l'opinion publique sur les conséquences graves qu'engendre l'absence d'une assistance humanitaire pour les victimes des catastrophes naturelles et autres situations d'urgence. Sur proposition française, l'assemblée générale de l'ONU a adopté deux résolutions: la 43 131 du 8 décembre 1988 et 45 100 du 14 décembre 1990 au sujet de la fourniture d'assistance humanitaire et l'établissement des couloirs d'urgence. Mais ce sont surtout les actions menées ou autorisées par le Conseil de sécurité de l'ONU, lors des catastrophes politiques survenues au Kurdistan d'Irak, en Somalie, en Bosnie - Herzégovine et au Rwanda, qui ont permis la consécration du droit à l'assistance humanitaire, la détermination des modalités de sa mise en œuvre et le précision de son étendue. Actuellement, le conseil de sécurité considère les atteintes portées au droit à l'assistance, comme des menaces à la paix et à la sécurité internationales justifiant le recours aux mesures coercitives armées prévues par le chapitre VII de la charte. The expression "duty to interfere" has recently appeared among international law vocabularies. Il est devenu frequent, dans le debat publique sur l'importance du passe et de l'histoire, de faire appel a un devoir de memoire. Cette notion suscite de nombreuses questions, concernant, entre autres, la portee d'un tel devoir, son origine et son fondement. L'analyse d'une forme particuliere du devoir de memoire, celle du souvenir des morts, permet de mettre en evidence les traits fondamentaux du devoir de memoire: il s'agit d'un devoir dont le sujet herite en vertu de son appartenance a un groupe donne et qui renvoie aux roles et aux fonctions que le sujet occupe dans une communaute. Un tel devoir semble difficilement compatible avec la conception d'un sujet autodetermine, qui definit le sens de son existence en opposition a toute appartenance a une tradition ou a une culture determinees, et qui s'efforce de mettre en question tout devoir herite. La possibilite d'amenager un devoir de memoire des morts dans l'horizon conceptuel du sujet autodetennine est examinee a travers la philosophie d'augustin, de heidegger, ainsi que dans la pensee liberale anglo-saxone contemporaine. Cette analyse permet de mettre en evidence le role que joue le devoir de souvenir des morts dans le processus narratif par lequel le sujet assume l'ensemble de son existence. Plus qu'un imperatif pedagogique visant a prevenir la repetition des crimes du passe, le devoir de memoire renvoie a une identite collective, aux liens d'appartenance qui unissent l'individu a son groupe.

A presente tese visa a afirmar o potencial da arte enquanto uma via de pesquisa acadêmica capaz de propiciar modos alargados de pensamento e ação, concebendo a criação e a experiência como elementos centrais do processo investigativo. Na perspectiva que elege, a tese entende a pesquisa com a arte não tanto como uma elaboração epistemológica, mas como um dispositivo de ações ontológicas: a composição de uma estética da existência, de um devir-pesquisa, de um devir-arte. No momento contemporâneo, em que a humanidade se confronta com a possibilidade de estar causando sua própria extinção, a tese apresenta a força do ato poético de perscrutar caminhos outros, desestabilizando o lugar comum do pensamento, propiciando um acreditar na possibilidade do mundo (Deleuze). A Tese sublinha a importância da arte na formação de pesquisadores e na efetivação de uma educação enquanto educere, permitindo uma humanidade por-vir. A pesquisa, de caráter ensaístico, é organizada como uma tese-parangolé (Oiticica), propondo operações discursivas bricoladoras e lúdicas, visando a produzir deslocamentos e intensificações da potência de vida, articulando, na educação, tanto saberes quanto não saberes. A tese revisita a obra de alguns autores da metodologia conhecida como Pesquisa Baseada em Arte, enfatizando a contribuição dos desafios colocados por Jan Jagodzinski e Jason Wallin. A tese propõe ainda navegações teórico-poéticas por diferentes águas: pelos gestos transgressores nietzscheanos, que situam a arte no centro da vida; pelos processos foucaultianos de subjetivação, que desdobram liberdades e práticas de si; pelo olhar noturno de Blanchot, que vislumbra a experiência-do-fora; pela in-fância ética agambeniana que favorece experiências; pelo pensamento desviante de Deleuze, que se espalha em multiplicidades produzindo inícios. E propõe, especialmente, encontros com você, leitor. E com quem mais chegar.
Abstract : The objective of this thesis is to affirm the potential of art as a means for academic research that is capable of propitiating broad modes of thinking and action, conceiving creation and experience as central elements of the investigative process. The thesis understands research with art not so much as an epistemological elaboration, but as a dispositif for ontological actions: the composition of an aesthetic of existence, of a become-research, of a become-art. At the contemporary moment, when humanity faces the possibility that it is causing its own extinction, the thesis affirms the strength of the poetic act for scrutinizing other paths, destabilizing the commonplace of thought, propitiating a believe in the possibility of the world (Deleuze). The thesis highlights the importance of art in the education of researchers and in the realization of an education as educere, which makes possible a humanity to come. This essay-like research is organized as a parangolé thesis (Oiticica), proposing ludic discursive operations and bricolages, aiming to produce displacements and an intensification of the potential for life, articulating, in education, forms of knowledge and non-knowledge. The thesis revisits the work of some authors of the methodology known as Arts- Based Research, emphasizing the contribution of the challenges raised by Jan Jagodzinski and Jason Wallin. The thesis also proposes theoretical-poetic navigations through different waters: through the transgressive Nietzchean gestures, which locate art at the center of life; by the Foucaultian processes of subjectivation, which unfurl liberties and practices of self; through the nocturnal look of Blanchot, which envisions the outside-experience; through the Agambenian ethical childhood that is propitious to experiences; and through the deviant thinking of Deleuze, which spreads out in multiplicities to produce beginnings. It especially proposes encounters with you, the reader. And with those to come.

Malgré les transformations et les nombreuses crises que connaît la famille, le devoir familial de solidarité apparaît comme une constante. Conscience qu'ont les proches parents de s'entraider, ce devoir n'a véritablement jamais été identifié juridiquement. Certes, son appréhension juridique révèle une multitude d'obligations légales ou contractuelles allant de l'obligation alimentaire à l'assurance-vie prévoyance en passant par la réserve héréditaire. Partant du constat de la diversité des devoirs de famille, la thèse met en évidence l'existence d'un seul et même devoir familial de solidarité qui se décline en une multitude de modalités. La recherche d'une unité entre les diverses manifestations de solidarité conduit aux fondements juridiques de ce devoir. Si le lien de famille s'impose en premier lieu, sa compréhension restrictive par notre droit empêche de rendre compte de la solidarité pourtant présente dans certaines structures familiales actuelles comme notamment les familles secondes et le concubinage. Ainsi, sont explorés d'autres fondements tels que les notions de piété et de communauté de vie qui permettent d'admettre plus largement l'existence d'un devoir de solidarité. En outre, l'unité des devoirs de famille est envisagée à travers les conditions indispensables à la mise en couvre tant matérielles - les ressources et les besoins - que morales - le comportement des protagonistes. Une définition de ces critères est proposée afin qu'ils puissent s'appliquer à toutes les manifestations de solidarité. Enfin, l'unité se retrouve dans la gratuité, caractéristique du devoir familial de solidarité qui tend à être limité. Si cette étude permet de démontrer l'existence d'une unité dans la solidarité familiale, elle souligne également son imperfection
In spite of the transformations and many crises which family encounters, the family solidarity duty seems to be a constant element in time. Although relatives and family are aware of this duty, it was never truly identified juridically. Indeed, its legal apprehension reveals a multitude of legal or contractual obligations, which can go from the maintenance obligation, to life insurance precautions, as well as inheritance issues. Taking into consideration the diversity of family duties, this thesis highlights the existence of one and only solidarity family duty, which can be listed in a multitude of modalities. We are led to the juridical foundations of this duty by the need to create a unity between different solidarity demonstrations. Family bond is initially imposed indeed, but its restrictive law comprehension prevents us from accounting for the solidarity, which exists in some current family structures, such as second families and cohabitation. Thus, it is necessary to explore other bases such as concepts of piety and will of community life, which would enable to admit more openly the existence of a solidarity duty. Moreover, it seems necessary to lay down the essentiel conditions to a material implementation - resources and needs - as well as a moral implementation - protagonists' behavior A definition of these criteria is offered in order to enable its application to all demonstrations of solidarity. Lastly, unity can be found in gratuitousness, a family duty caracteristic which tends to be limited. This study enables indeed the demonstration of the existence of a family solidarity unity, but also highlights it imperfection

Le devoir d'indépendance de l'arbitre a été consacré de manière quasi-universelle, tant au plan national qu'international ainsi que dans les règlements des institutions arbitrales. Plutôt que de considérer le devoir d'indépendance comme un concept de nature "dualiste" consistant tantôt en une obligation a contenu limite distinct des obligations parallèles d'impartialité et de neutralité, tantôt comme une obligation générique, il conviendrai de reconnaitre une nature unitaire et générique au devoir d'indépendance, ce dernier étant composé de trois obligations particulières: les obligations de neutralité, d'impartialité et d'objectivité. L'abandon de la vision dualiste de l'arbitrage se caractérisant par une référence de principe aux composantes juridictionnelle et contractuelle prêtées à ce dernier, permettrait d'analyser le devoir d'indépendance de l'arbitre comme une règle de conduite morale commandée par la nature même de la fonction d'arbitrer. Le devoir d'indépendance de l'arbitre constituerait le fondement même de la justice arbitrale. Il caractériserait l'originalité de cette dernière par opposition à la justice étatique laquelle, en tant que gardienne d'un ordre juridique déterminé, ne devrait pas pouvoir aspirer à la neutralité et donc à l'indépendance. Le devoir d'indépendance de l'arbitre fonderait l'autonomie de ce dernier. La portée fondamentale du devoir d'indépendance de l'arbitre justifierait que cet impératif soit inclus dans les définitions données à l'arbitrage. Cette portée justifierait également que l'indépendance de l'arbitre soit érigée en principe d'ordre public avec pour conséquence que ni les parties ni les arbitres ne pourraient y déroger. Une attention particulière devrait être accordée aux moyens de garantir l'indépendance de l'arbitre. L'arbitre devrait révéler toute circonstance de nature à préjudicier a son indépendance. Un système cohérent de sanctions du devoir d'indépendance devrait être adopte (responsabilité de l'arbitre, récusation de l'arbitre, annulation de la sentence). Les critères d'appréciation de l'indépendance de l'arbitre devraient refléter la portée fondamentale de cette exigence
The duty of independence of the arbitrator has been nearly unanimously recognized. Rather than considering the duty of independence as a "dual" concept, it is necessary to perceve the duty of independence as a unitary and generic duty composed of three particular obligations: the obligations of neutrality, impartiality and objectivity. The renonciation of the "dual" vision of arbitration characterized by a reference to the jurisdictional and contractual components of the latter, would permit an analysis of the duty of independence of the arbitrator as a rule of moral conduct compelled by the very nature of the function of arbitration. The duty of independence of the arbitrator would constitute the fundation of arbitral justice. It would characterise the originality of the latter as opposed to state justice which, as gardian of a determined juridical order, should not be able to aspire to neutrality and therefore independence. The duty of independence of the arbitrator would be the basis of his autonomy. The fundamental scope of the duty of independence of the arbitrator would justify that the independence of the arbitrator be deemed of mandatory public order and therefore neither the parties no the arbitrators could derogate therefrom. A particular attention must be brought to the means whereby the independence of the arbitrator can be assured. The arbitrator should reveal any circumstance which may prejudice his independence. A coherence system sanctions of the duty of independence should be adopted responsibility of the arbitrator, challenge of the arbitrator, cancellation of the arbitral award)

Este trabalho nasce da inquietação e do desejo de melhor compreender o movimento que envolve a busca de estratégias que permitem aos professores não sucumbir diante das situações paradoxais e adversas que caracterizam o cotidiano escolar. Trabalhar com história de vida pressupõe de certa maneira mergulhar no cotidiano do trabalho dos professores, perceber suas alternativas e possibilidades de escolha dentro das condições em que se estabelecem as relações neste contexto. A vida cotidiana não acontece do lado de fora da história, é, antes o momento histórico carregado de significados que, ao proporcionar sentidos individuais, estabelece conexões entre o "eu" e o "nós", entre tempo e espaço, que se fundem entre presente, passado e devir. Este mergulhar, ora no cotidiano dos professores, ora na história de uma vida constituída neste cotidiano permitem, por certo, compreender quais as brechas ou fendas em meio a tantas amarras inerentes ao sistema educacional, possibilitou a esta professora, constituir-se desta forma? Que relações travadas em meio a tantas adversidades, permitiram que a mesma não perdesse a esperança e o compromisso com uma educação pública de qualidade?

Essa dissertação estuda os significados dos auxiliares modais #deve. e #devia. do português brasileiro quando formam um par mínimo de sentenças. Para tanto, iniciamos com um panorama acerca da modalidade das línguas naturais e posteriormente, apresentamos uma breve caracterização dos auxiliares modais. O arcabouço teórico utilizado foi a teoria de Kratzer (1981, 1991, 2010), que se fundamenta na semântica de mundos possíveis. O objetivo é traçar as semelhanças, diferenças e especializações entre os auxiliares modais #deve. e #devia. quando orientados para o futuro. As fontes de ordenação analisadas para o objeto de estudo serão a epistêmica, deôntica e teleológica, com um especial enfoque na epistêmica. Para isso, partimos da hipótese de que os dois modais veiculam necessidade fraca, porém eles não dizem o mesmo e essa diferença poderá ser captada através do morfema de imperfeito presente em #devia., mas não em #deve.. Através das análises intuitivas, percebeu-se que #deve. é especializado, isto é, ele #prefere# se combinar com base modal epistêmica, mas também se encaixa em contextos deônticos e teleológicos, podendo ainda expressar ordem e conselho como ato de fala. Ao passo que #devia. prefere se combinar com fonte de ordenação teleológica, expressa conselho como ato de fala e não #gosta# de ser epistêmico e nem deôntico. A noção de necessidade fraca de Kratzer sozinha não consegue explicar a semântica de #deve. e #devia., já que podemos perceber que um é mais objetivo e o outro subjetivo, respectivamente.

A presente tese tem como temática a desinstitucionalização de jovens "egressas" de serviços de acolhimento institucional (abrigo e casa-lar), habitantes de Santa Catarina (Palhoça e Florianópolis) e Rio Grande do Sul (Porto Alegre). Para tanto, a desinstitucionalização é tomada como um processo amplo e complexo que implica mudanças, não só de lugar (desacolhimento), mas de estado, em especial em termos daquilo que as jovens podem vir a ser (devir), e também como contexto privilegiado para a emergência da dimensão vivencial dos sujeitos. Partindo dessa temática mais geral, a pesquisa buscou investigar as maneiras pelas quais estas jovens inventam/criam novas possibilidades de vida, a partir de condições que a princípio reforçariam sua vulnerabilidade e falta de potência, e também aquilo que elas podem vir a ser (devir) para além da institucionalização. A etnografia, realizada junto a oito jovens "egressas" de serviços de acolhimento (Isabelle, Nicole, Virgínia, Estella, Nina, Clarissa, Alice, Olívia), permitiu destacar fundamentalmente três modos pelos quais as jovens inventam/criam novas possibilidades de vida. Uma primeira via para a invenção estaria na prática de "circulação de crianças", a qual, ao invés de ser uma iniciativa da família ou mesmo do Estado, teve início pela ação das próprias jovens que, durante a infância, se desvencilharam, através da fuga, de diferentes situações de maus-tratos e exploração. A segunda está relacionada às maneiras pelas quais as jovens vivenciam a experiência da maternidade e de cuidado com os filhos, tendo em vista a relação que estabelecem com as políticas públicas assistenciais, com as novas tecnologias reprodutivas, com os seus companheiros e o trabalho, etc. E a terceira refere-se a uma espécie de "virada no jogo das relações de parentesco", em especial , quanto às relações que as jovens estabeleciam com os parentes (principalmente mãe, pai e irmãos) previamente ao acolhimento institucional. A análise dos modos de vida dessas jovens permitiu observar que estes têm como característica uma "espécie de improvisação contínua" que, ao contrário de revelar uma postura simplesmente reativa (marcada pela busca da sobrevivência) diante das adversidades, está relacionada àquilo que elas souberam criar, ou seja, à descoberta do que gostam e sabem fazer. Para contemplar essa diversidade de experiências, foi preciso conduzir a análise e a própria escrita etnográfica tendo em vista o desafio de compreender o sujeito de uma maneira que não estamos acostumados a ver. Ou seja, a improvisação contínua foi revelando não um sujeito acabado ou precário, mas sim configurações de sujeito que vão sendo constituídas contingencialmente e que apontam para novas possibilidades de devir.

Abstract : The present thesis dwells upon the deinstitutionalizat ion of young women from foster care services in the states, habitants of Santa Catarina (Palhoça and Florianopolis) and Rio Grande do Sul (Porto Alegre), Brazil. Deinstitutionalizat ion is understood as a broad and complex process which involves changes, not only from one place to another (since they leave the institution), but also as a change in their state of being, especially when we consider what these young women could become (becoming). Likewise, deinstitutionalizat ion is understood as a fruitful context for the emergence of the experiential dimension of the subjects. Taking this general theme as a starting point, the research seeks to investigate the ways through which these young women invent/create new life possibilit ies based on conditions which, at first could reinforce their vulnerability and lack of potency, and it also explores what they could become beyond the boundaries of their institutionalizat ion. The ethnography, which took place with eight young women (Isabelle, Nicole, Virgínia, Estella, Nina, Clarissa, Alice, Olívia) who had been through the foster care system, enabled me to highlight three ways where they invent/create new life possibilit ies. The first path to invent ion can be found in the "children circulation" practice, a practice that, instead of being an init iat ive of the family or even the state, was an init iat ive of the young women themselves, who, during their childhood, ran away leaving behind different situations of abuse and exploitat ion. The second, is related to the way they experience motherhood and caring for their children. Here the idea is to think about these experiences in relation to the relat ionships they establish with welfare policies, with the new reproductive technologies, with their partners, with work, etc. The third path to invention deals with what one could describe as a ?turning tables on kinship?, notably reggarding the relat ionships they had with their kin (mainly mother, father, brothers and sisters) before their institutionalizat ion. The analyses of the ways of life of these young women, allowed me to observe that these ways of life have, as a prime characteristic, something like a "continuous improvisat ion". However, contrary to common belief, this "continuous improvisat ion" does not only mean a reactive attitude (given by a survival drive when faced with hardship), but it is related to what they knew and wanted to create. In other words, it is linked to their process of finding out what they knew and wished to do. In order to be able to contemplate the diversity of experiences it was necessary to build the analyses, and even the ethnographic text, taking into consideration the challenge of understanding the subject in a way not familiar to us. Thus, the notion of continuous improvisation helped to unfold not a final or precarious subject, but configurations of subjects, which are being constituted contingently and that signal to new possibilit ies of becoming.

Le XXe siècle aura été celui de l’essor de la bonne foi objective en droit des contrats, et plus largement, de la prise en compte du comportement du contractant. La consécration des concepts de devoir et d’incombance contractuels permet d’appréhender techniquement cette donnée juridique sans altérer la catégorie des obligations civiles. Le devoir contractuel est une règle de comportement que le contractant doit observer tout au long de l’exécution du contrat, sous peine de commettre une faute contractuelle. Ainsi, par exemple, les exigences de bonne foi et de sécurité sont des devoirs en ce qu’ils imposent une certaine attitude au contractant, de manière continue, au-delà des obligations qu’il doit exécuter. L’incombance contractuelle est également une contrainte purement comportementale, mais sa particularité est qu’elle ne pèse sur le contractant que s’il désire obtenir l’avantage qu’elle conditionne. Il s’agit d’une exigence préalable et adventice à l’exercice d’un droit. Par exemple, l’acheteur qui désire obtenir la garantie du vice caché doit en dénoncer l’apparition au vendeur ; l’assuré qui veut bénéficier de la garantie du sinistre doit informer l’assureur de sa survenance. The XXthe century has given rise to the notion of objective good faith in contract law, and more generally, to a standard by which the behaviour of parties to an obligation is judged. The adoption of the concepts of contractual duty and incombance allows a technical approach without affecting the category of civil obligations.Contractual duty is a code of conduct that the contracting party has to observe throughout the performance of the contract ; otherwise it might be viewed as being in a breach of contract. For example, the requirements of good faith and security are duties in that they require the contracting party to adopt a certain conduct on an ongoing basis, in addition to the obligations the contracting party has to carry out under the terms of the contract.Contractual incombance is also a merely behavioural constraint, however it differs in that it weighs on the contracting party only if they wish to benefit from the advantages it determines. It is a prerequisite for the exercise of a right. A buyer who wishes to avail himself of a legal warranty against latent defects, for example, must point out any defect to the vendor, just as the insured who wishes to make a claim must report the covered incident to his insurance company.Distinct sanctions apply to these notions : in case of a breach of contractual duty, penalties can be awarded as a result of the party’s failure to perform its contractual obligations ; on the other hand, non-compliance with and incombance will entail the loss of the determined right

Há uma certa imagem de ciência que remonta a Galileu (sec. XVII). Ela corresponde à idéia de que a ciência poderia "descobrir" as leis impessoais que governam a natureza. Porquanto detentora de uma racionalidade "neutra" (a-histórica, a-moral e a-temporal), capaz de acesso privilegiado a essas leis impessoais, a ciência consistiria, consequentemente, em uma forma de investigação da realidade superior a qualquer outra. Segundo essa perspectiva, a ciência logrou desenvolver uma metodologia que exclui os valores dos momentos cruciais de suas práticas. Essa abordagem é bem conhecida e endossada e constitui, ainda hoje, em uma espécie de "senso comum" da tradição científica. Segundo alega a ortodoxia da filosofia da ciência, qualquer papel desempenhado por valores (morais, sociais) constituiria uma espécie de "intrusão" de subjetividade que ameaçaria a possibilidade de objetividade científica. Já que juízos de fatos (ou resultados dos conhecimentos científicos) não podem ser inferidos de valores, inversamente, não poderíamos esperar que a ciência pudesse nos ajudar a resolver nossos problemas éticos mais fundamentais. O filósofo Hugh Lacey, inserindo-se em uma longa tradição crítica, contesta a imagem de ciência como uma instância independente da subjetividade humana. Ele propõe um modelo, segundo o qual todo conhecimento científico é produzido mediante a subordinação a alguma estratégia de pesquisa, que carrega consigo a marca dos valores sociais mais prementes, e que impõe limites à parcela da realidade que será "tocada" pela investigação. Segundo sua abordagem, há (e deve haver) uma interação profunda entre ciência e valores, que é essencial para a metodologia científica. O objetivo desse trabalho é estender o modelo laceyano a um caso diverso daquele por ele já tratado (nas ciências naturais). Partindo de sua tese, argumentamos que a ortodoxia da ciência econômica moderna (teoria neoclássica), através da incorporação do paradigma mecanicista da física clássica, bem como de todo instrumental analítico das estratégias materialistas, representa não um tipo de compreensão "neutra" dos fenômenos econômicos # todos agora expressos ou refletidos no movimento dos preços. Ao invés disso, propomos que ela representa uma sutil, porém particularmente notável manifestação dos valores predominantes nessa sociedade (capitalista, tecnológica, industrial, liberal), da qual faz parte. Assim, procuramos mostrar que, também no âmbito social, a preeminência dos aspectos nomológicos e quantitativos da realidade na formulação das teorias econômicas de tradição neoclássica, os próprios valores cognitivos espelham valores sociais altamente estimados nas sociedades modernas. Como propostas alternativas, surgem, no nível teórico, a proposta da Economia sistêmica, na esfera pragmática, o paradigma do Ecodesenvolvimento aparece como um novo modelo, capaz de dar conta da complexa problemática sócio-ambiental. Ambos projetos compatíveis com a proposta de Lacey: de que, ao pluralismo dos sistemas de valores existentes em uma sociedade, diversas alternativas possíveis para a investigação científica, norteadas pelas estratégias de pesquisa correspondentes, devem ser fomentadas. A co-existência de várias ciências desse tipo # "não#neutras" #, nas mais diversas áreas de investigação, seria um pré-requisito necessário para a realização do antigo ideário Iluminista -- de construção de uma sociedade mais humana.

Le devoir de désobéissance de l'agent public est envisagé en tant qu'il constitue une obligation juridique, c'est-à-dire une «technique sociale» au service d'un certain nombre de choix politiques. La thèse propose de construire des instruments d'analyse susceptibles de produire une topographie générale de l'objet en droit et dans le discours sur le droit. Ils doivent permettre d'identifier et clarifier un certain nombre de questions soulevées par l'existence de ce type d'objet en droit positif, parfois obscurcies par les rapports souvent intuitifs qu'on l'imagine entretenir avec des questionnements moraux fondamentaux. Pour ce faire, le travail de recherche met précisément en œuvre une analyse des fonctions, des structures, et des critères de mise en œuvre de l'obligation en droit interne, en droit international pénal et dans les droits nationaux étrangers. L'étude fait alors apparaître la diversité des dispositifs existants, met au jour certaines dynamiques de la discussion doctrinale et contentieuse, et confirme en définitive l'impossibilité «d'essentialiser» l'objet. The duty of disobedience of the public official is envisaged as constituting a legal obligation, that is, as a "social technique" serving a number of policy choices. The thesis proposes to build analytical tools that can produce a general topography of the object in la and in the discourse on the law. It must identify and clarify a number of issues raised by the existence of this type of object in positive law sometimes obscured by the intuitive relationships that we imagine it has with fundamental moral questions. To do this, the research thesis specifically implements an analysis of the functions, structures, and criteria for implementing the obligation in domestic law, international criminal law and foreign national law. The study then shows the diversity of existing obligations, reveals certain dynamics of the doctrinal and contentious debate, and finally confirms the impossibility of "essentializing" the object. It makes it possible to envisage a proposal for modification of the existing systems in domestic law

Il resulte de ce rapprochement des parties et de leurs besoins une nouvelle conception du contrat dans laquelle l'exigence de la loyaute et de la solidarite, la recherche de l'entente entre les parties et de l'efficacite dans l'execution du contrat deviennent l'epine dorsale des rapports contractuels. Dans cette conception, en effet, tenir compte de l'interet de l'autre partie ou se mettre a sa place dans l'execution des obligations ou dans l'exercice des droits nes du contrat, transforment les contractants en veritables partenaires, consideres jusqu'a lors comme des protagonistes parce que l'on estime leurs interets en conflit. Le devoir de cooperation dont l'importance pour les parties comme pour le contrat est inestimable ne peut cependant pas etinceler de tout son eclat, faute de nature juridique precise, de base legale stable et solide et de regime propre. Abstract:
In this paper, I call into question the thesis known as judgment internalism about moral motivation. Broadly construed, this thesis holds that there is a non-contingent relation between moral judgment and moral motivation. The difficulty for judgment internalism arises because of amoral agents: when an agent both knows the right and yet fails to be motivated to act on this knowledge. Specifically, I cite John Milton's Satan from Paradise Lost. This is a problem because it calls into question the non-contingent relation between moral judgment and moral motivation. I argue that in order for judgment internalism to be viable in reconciling judgment internalism and amoralism, it must provide plausible accounts of both (a) the relationship between judging and motivation, and (b) the conditions for defeasibility. While crude versions of the thesis fail to do this, I provide a revised thesis which I call Narrative Internalism, which assumes a narrative theory of the self. This thesis has the dual strength that it can account for both why one would typically be motivated to Φ upon judging that it is right to Φ and also the conditions that might obtain such that one would fail to be motivated. This account of moral psychology explains both (a) the relationship between judging and motivation, and (b) the conditions for defeasibility by giving an account of plausible defeasibility conditions. I conclude that unless there are more plausible accounts of judgment internalism in the offing, which doesn't seem apparent to me, we should adopt Narrative Internalism.

Esta tese enseja a possibilidade de leitura das letras de música do rock brasileiro dos anos oitenta sob o viés de uma poética pessimista, entendendo esta segundo as prerrogativas estabelecidas por Arthur Schopenhauer em O mundo como vontade e representação. Para tal, letras de Cazuza, Renato Russo e Humberto Gessinger estão aqui circunscritas como corpus para, por meio desta proposição de interpretação, estabelecer sondagens que possibilitem visualizar em seus versos temas que seriam afins ao do pensamento pessimista do século XIX. Com este intuito, a tese usa como instrumento de análise a epistemologia que faz parte da proposta desconstrutivista de Mil Platôs, obra de Gilles Deleuze e Félix Guattari, dando ênfase ao emprego que estes autores fazem dos termos devir e agenciamento. É com o uso destes termos, então, que este trabalho enquadra as letras que estão aqui selecionadas, vendo-as como uma reterritorialização do pessimismo enquanto um devir no rock brasileiro da década de oitenta. Devir este possibilitado em função dos agenciamentos oriundos das rupturas políticas, econômicas e sociais que protagonizaram o contexto histórico do Brasil após o fim do regime militar. Imiscuídos por estes agenciamentos uma nova geração se aproximou de temas que em si engendram uma estética de desilusão, apatia e descrédito pelos sistemas ideológicos de outrora; e que seriam uma tangente pós-moderna da concepção pessimista de que a vida, malgrado os diferentes contextos históricos que a envolvem, não proporcionaria nada além de tédio e vãs expectativas
This thesis entails the readability of the Brazilian rock music lyrics from the eighties under the bias of a poetic pessimism, pursuant to the prerogatives established by Arthur Schopenhauer in The World as Will and Representation. To do so, through this proposition of interpretation, lyrics of Cazuza, Renato Russo and Humberto Gessinger are here circumscribed as corpus to establish soundings enabling the view through their verses, themes to be related to the pessimistic thought of the nineteenth century. To this end, the thesis uses as an analytical tool the epistemology that is part of the deconstructive proposal of Thousand Plateaus, the work of Gilles Deleuze and Felix Guattari, emphasizing the application of the terms becoming and agency that these authors make use of. It is with the use of these terms, then, that this paper frames the lyrics that are here selected, seeing them as a repossession of pessimism while a becoming in the Brazilian rock music of the eighties. Becoming, this being possible depending on the agencies originated from political, economic and social disruptions which have carried out the historical context of Brazil after the end of the military regime. Intruded by these agencies a new generation came up with issues that in itself engender an aesthetic of disillusionment, apathy and disbelief of the old ideological systems; and that would be a postmodern tangent of the pessimistic conception that life, despite the different historical contexts surrounding it, would provide nothing but boredom and vain expectations.

La première partie dresse une rétrospective du devoir de loyauté en droit des sociétés afin d’en dégager la conception et d’envisager son extension. De source jurisprudentielle, le devoir de loyauté impose au dirigeant une obligation d’information sur les négociations en cours envers l’associé et une obligation de non-concurrence envers l’entreprise. Ces deux expressions du devoir trouvent leur fondement dans le pouvoir du dirigeant d’agir dans l’intérêt de l’associé ou de l’entreprise ; le manquement au devoir de loyauté étant caractérisé lorsqu’il viole l’une de ces obligations afin de privilégier un intérêt personnel conflictuel. Cette conception du devoir de loyauté, similaire à celle des fiduciary duties de common law, permet d’envisager l’extension des sujets dès lors que l’on peut déterminer une relation de pouvoir et l’existence d’un conflit d’intérêts. Elle permet également d’imposer de nouvelles obligations telles que l’obligation de révéler le conflit d’intérêts et l’obligation de ne pas voter en cas de conflit. La seconde partie envisage, dans une approche prospective, les différentes applications des obligations de loyauté imposées au dirigeant et à l’associé. Le respect de ces obligations repose sur deux types de contrôle. En premier lieu, un contrôle juridique peut être opéré au niveau interne par les conseils et l’assemblée générale, et au niveau externe, par le commissaire aux comptes et différents experts afin de prévenir les décisions et actes déloyaux. En second lieu, les tribunaux sont appelés à exercer leur contrôle en cas de recours en nullité ou en responsabilité contre le dirigeant ou l’associé prépondérant ayant manqué à son devoir de loyauté
The first part presents a review of the duty of loyalty in company law, to establish an understanding of the origins of the concept and consider its extension. The duty of loyalty, which has developed from case law, places upon directors an obligation to provide information on current negotiations to partners and not to compete with the company. The root of these two expressions of duty lies in the director's power to act in the interests of the partner or the company; by violating one of these obligations in order to favour a conflicting personal interest the director breaches this duty of loyalty. This understanding of the duty of loyalty, similar to that of fiduciary duties in common law, makes it possible to envisage an extension to those bound by the duty whenever a relationship of power and a conflict of interests can be seen to exist. It also provides a basis for imposing new obligations such as the obligation to declare conflicts of interests and not to vote in case of conflict. The second part uses a prospective approach to consider the various applications of the obligation of loyalty imposed on the director and partner. Respect for these obligations is based on two types of control. Firstly, legal control which can be provided internally by advisers and the general meeting, and externally by auditors and various experts in order to prevent disloyal decisions and actions. Secondly, courts are called upon to exercise their power in case of an action to declare null and void or accountable against a director or leading partner who has failed in his or her duty of loyalty

Det här arbetet studerar med hjälp av en attitydundersökning förhållandet mellan anställdasoldater och Försvarsmakten i syfte att utveckla förståelsen för soldaters commitment till sinarbetsgivare. Frågeställningen lyder Hur ser soldaters relationer ut till arbetsgivarenFörsvarsmakten? Arbetets teoretiska grund hämtas i begreppet relationship commitment och närmare bestämtden del som benämns attitudinal commitment. Den begreppsdefinition som nyttjas bygger ihuvudsak på Meyer och Allens (1991) tre komponenter av relationship commitment, det villsäga affective commitment (känslomässig), continuance commitment (kalkylativ) ochnormative commitment (normativ). Begreppsdefinitionen inkluderar även åtta påverkansfaktorer som var och en ges en tydlig knytning till respektive komponent avrelationship commitment. Påverkansfaktorerna utgörs av personlig kompetens, deladevärderingar, förtroende, upplevelser, relationsfördelar, relationsavvecklingskostnader samtskyldigheter och tvingande miljö.Till skillnad från många tidigare studier görs här en tydlig koppling mellan påverkansfaktoreroch komponenter. Vidare studeras relationen mellan arbetstagare och arbetsgivare inomoffentlig sektor vilket även det är relativt ovanligt. Tidigare har framförallt relationer mellanorganisationer inom privat sektor eller olika former av nätverk studerats.Undersökningens resultat visar att soldaternas relation med Försvarsmakten framföralltbygger på en känslomässig grund där personlig kompetens och upplevelser samt deladevärderingar har störst betydelse. Därtill kan föras att även förtroende har viss betydelse förrelationen. Inom den kalkylativa komponenten spelar en förväntan om personlig utveckling enviss roll, men i övrigt har komponenten begränsat inflytande på relationen. I studienkonstateras också att det i princip inte finns någon normativ grund i soldaternas relation medFörsvarsmakten.
Using an attitude survey, this essay studies the relationship between employed soldiers and their employer the Swedish Armed Forces in order to develop an understanding of therelationship between these parties. The research question is: What do soldiers' relationships totheir employer, the Swedish Armed Forces, look like?The theoretical basis of the study is build on the theories of relationship commitment, andmore specifically the part that can be linked to attitudinal commitment. The conceptualdefinition used is mainly based on Meyer and Allen's (1991) three components of relationshipcommitment, namely affective commitment (emotional), continuance commitment(calculating) and normative commitment (normative). The concept definition also includeseight influencing factors, each given a clear linkage to the respective component ofrelationship commitment. The influencing factors are personal competence, shared values, trust, experiences, relationship benefits, relationship termination costs, obligations andimperative environment.Unlike many previous studies done in this area, a clear link between the influencing factorsand their respective components is defined. In addition, the survey covers the relationshipbetween workers and employers in the public sector which is also relatively rare. Previously,mainly relationships between organizations in the private sector or in various forms ofnetwork have been studied.The results of the survey show that soldiers' relationship with the Swedish Armed Forces arebased in particular on an emotional basis, where feelings of personal competence, desire forexperiences and shared values are most important. In addition, trust has some but lesssignificance for the relationship. Within the caculating component an expectation of personaldevelopment play a certain role but otherwise the component has limited influence on the relationship. In principle, there is no normative basis in the soldiers' relationship with theSwedish Armed Forces.Keywords:

RESUMO - A infecção por Vírus do Papiloma Humano (Human Papillomavirus - HPV) é uma das doenças de transmissão sexual mais frequentes em todo o mundo. A descoberta de que esta infecção é responsável pelo carcinoma do colo do útero impulsionou o desenvolvimento de vacinas contra o HPV. Em Portugal, a vacina tetravalente contra o HPV faz parte do Plano Nacional de Vacinação, sendo administrada apenas a raparigas aos 13 anos de idade como medida profiláctica do carcinoma do colo do útero. Nos Estados Unidos da América, em Dezembro de 2010, a Food and Drugs Administration (FDA) aprovou o uso da vacina tetravalente na prevenção de lesões pré-cancerígenas e cancerígenas do ânus, tanto em rapazes como em raparigas, dos 9 aos 26 anos. A 25 de Outubro de 2011, o Advisory Committee on Immunization Practices (ACIP) recomendou que todos os rapazes de 11 e 12 anos sejam vacinados contra o HPV com a vacina tetravalente. Partindo desta realidade, o que se pretende com o presente trabalho é compilar evidência científica suficiente que permita ponderar mais aprofundadamente acerca das implicações, a partir de dados epidemiológicos e económicos, de se vacinar ou não os rapazes contra o HPV em Portugal. Em primeiro lugar recolheu-se evidência científica acerca da relação entre a infecção por HPV e o desenvolvimento de carcinomas de diversas regiões anatómicas. Em segundo lugar compilaram-se dados epidemiológicos sobre a incidência e sobrevivência associada aos diferentes tipos de tumores potencialmente associados à infecção por HPV, dando especial ênfase à realidade portuguesa. Em terceiro lugar enquadrou-se sucintamente a história da vacinação contra o HPV em Portugal e as vacinas existentes para prevenir esta infecção. Em quarto lugar foram revistos estudos de avaliação económica da vacinação contra o HPV quer em mulheres quer em homens, após uma introdução ao conceito de avaliação económica do medicamento. Em quinto lugar, foi feita uma estimativa dos custos com a vacinação dos rapazes contra o HPV durante os próximos 20 anos. Por último, procurou-se reflectir acerca das implicações de se alargar ou não a vacinação contra o HPV aos rapazes em Portugal.
ABSTRACT - The infection with Human Papilloma Virus (HPV) is a sexually transmitted infection very frequent throughout the world. The discovery that this infection is responsible for cervical carcinoma spurred the development of vaccines against HPV. In Portugal, the quadrivalent vaccine against HPV is part of the National Vaccination Plan, and it is administered only to 13 years old girls as a prophylactic measure of cervical carcinoma. In the United States of America, in December 2010, the Food and Drug Administration (FDA) approved the use of the quadrivalent vaccine for the prevention of pre-cancerous and cancerous lesions of the anus in both boys and girls from 9 to 26 years. On October 25th 2011, the Advisory Committee on Immunization Practices (ACIP) recommended that all boys 11 and 12 years old should be vaccinated against HPV with the quadrivalent vaccine. Given this context, what is intended with this study is to compile enough evidence that allows further consideration of the implications of whether or not to vaccinate boys against HPV in Portugal. Firstly, one collected scientific evidence about the relationship between HPV infection and the development of carcinomas of different anatomical regions. Secondly, epidemiological data on incidence and survival associated with different types of malignant tumors potentially associated with HPV infection was compiled, with special emphasis on the Portuguese reality. Thirdly, the history of HPV vaccination in Portugal and existing vaccines to prevent this infection were framed up succinctly. In fourth place, economic evaluation studies of HPV vaccination both in women as in men were reviewed, following an introduction to the subject of economic evaluation of pharmaceuticals. In fifth place, one estimated the costs of vaccinating boys against HPV over the next 20 years. Finally, one tried to reflect upon the implications of extending or not the HPV vaccination to boys in Portugal.

Esta dissertação é produzida a partir da perspectiva da Filosofia da diferença em suas intersecções com a educação. Ela busca responder à pergunta: O que pode o devir-infantil do pós-currículo?, apropriando-se do conceito de pós-currículo, invenção de Corazza, e buscando atualizá-lo e reinventá-lo. Explicita o sentido de devir-infantil, afirmando que ele não se refere ao sujeito criança, e tampouco a outro sujeito qualquer, pois um devir se constitui por movimento e transformação, não se fixando em nenhuma forma de identidade. Atribui ao devir-infantil do pós-currículo um caráter minoritário, devido à sua constituição por fluxos moleculares e linhas de fuga, e ao polilingüismo que o atravessa. Afirma, ainda, o nomadismo do devir-infantil, atribuindo-lhe a invenção de uma máquina de guerra constituída pelo riso. Reunindo estes conceitos, apresenta um pós-currículo movido pelo devir-infantil que problematiza e desestabiliza o pensamento e as práticas escolares.
This paper is produced from the difference’s philosophy’s perspective and it’s intersections with education. It aims to answer the question: What can the post-curriculum child-becoming do?, taking property of the meaning of post-curriculum, invented by Corazza, and trying to update and reivent it. It explains that the meaning of child-becoming is not referred to the child individual, neither any other individual, because a becoming is made of movement and transformation, it doesn’t fit in any kind of identity forms. It attributes to the post-curriculum child-becoming a minority character due to its molecular flows and escape lines constitution and to the multilinguism that crosses it. It also affirms the child-becoming’s nomadism, attributing to it the invention of a war machine made by laughter. Putting these concepts together, a post-curriculum moved by child-becoming is presented, which problemizes and destabilizes the thinking and school practices.

It has been long suggested that hypoxia tolerant species should have a great capacity to generate energy through anaerobic pathways to maintain energy balance when oxygen is limited; however, this assertion has not been rigorously tested. In the present study, I characterized hypoxia tolerance in 12 groups representing 10 species from the genera Danio and Devario (with three strains of D. rerio) and examined whether there is a phylogenetically independent relationship between variation in hypoxia tolerance and anaerobic capacity as judged by enzyme activity and anaerobic substrate concentrations present in various tissues. Hypoxia tolerance was assessed using two measures: time to loss of equilibrium (LOE) and the oxygen tension that yields 50% LOE in a group of fish over 8 hr (TLE₅₀). Time to LOE to low oxygen was very sensitive to changes in water PO₂, with no LOE seen over 8 hr in some species at 16 torr (2.1 kPa) and complete LOE within 30 min at 8 torr (1.1 kPa). At 12 torr (1.6 kPa) however, there was significant variation in time to LOE among all the species investigated. In three species (Danio rerio, Danio albolineatus and Danio choprai) time to LOE at 12 torr showed the same pattern of hypoxia tolerance as TLE₅₀. Despite the variation in hypoxia tolerance seen among the species under study, there was very little variation in the critical oxygen tension (Pcrit), which is the environmental PO₂ at which fish transition from an oxyregulating strategy to an oxyconforming strategy. Routine Ṁ₀₂ varied between the species, but the variation was primarily explained by body size and not hypoxia tolerance. Anaerobic energy capacity was estimated by measuring maximal enzyme activities of pyruvate kinase (PK), lactate dehydrogenase (LDH) and creatine phosphokinase (CPK), and concentrations of glycogen and glucose in muscle, liver and brain, plus creatine phosphate (CrP) and ATP in muscle. Through comparative analysis, I showed that the variation in hypoxia tolerance seen among species was related to some aspects of anaerobic energy metabolism, but not in a consistent fashion, indicating that other factors contribute to describing the variation in hypoxia tolerance.

Le manquement au devoir d’humanité, dans les actes médicaux, est rarement défini comme tel par les juges bien qu’il soit l’objet de plaintes répétitives de malades qui le ressentent essentiellement comme une atteinte à la dignité humaine. En première partie, les différents aspects de l’inhumanité dans les actes médicaux sont abordés avec référence principale au code de déontologie médicale : reflet de la médecine « au service de l’humanité » qui réglemente le respect de la personne humaine, le respect de son intégrité physique, psychique, la liberté du malade, son libre choix et son consentement. Des exemples réels de vécus de malades victimes de ces actes d’inhumanité sont présentés. En seconde partie, les conséquences juridiques du manquement au devoir d’humanité permettent d’éclairer les propos sur la responsabilité médicale, le droit des malades, consacré par la loi du 4 mars 2002, la notion de faute médicale par défaut d’humanité et la réparation des accidents médicaux. En conclusion, le médecin, le soignant se doit d’appliquer, l’adage « Science sans conscience n’est que ruine de l’âme »
The failure with the duty of humanity, in the medical acts, is seldom defined as such by the judges although it is the object of repetitive complaints of patients who primarily feel it like an attack with human dignity. In first part, the various aspects of inhumanity in the medical acts are approached with principal reference to the medical code of ethics: reflection of medicine "to the service of the humanity" which regulates the respect for human dignity, the respect of its physical integrity, psychic, the freedom of the patient, its free choice and its assent. Real examples of lived of patients victims of these acts of inhumanity are presented. In second part, the legal consequences of the failure to the duty of humanity make it possible to inform the remarks on the medical responsibility, right of the patients, devoted by the law of March 4, 2002, concept of medical fault per defect of humanity and the repair of the medical accidents. In conclusion, the doctor, looking after must apply, the proverb "Science without conscience is only ruin of the heart"

L’importance et le nombre des litiges privés à dimension internationale se sont accrus au cours des dernières années. Ce développement quantitatif du contentieux s’accompagne d’une multiplication de détournements contestables des règles de procédure. Ces pratiques procédurales dilatoires ne peuvent rester sans réponses. Au carrefour de la morale et du droit, la notion de loyauté impose, aux parties, aux juges, et aux avocats, les exigences de transparence, de cohérence, de considération et de coopération dans le cadre de la résolution des différends privés internationaux. Certaines règles du droit positif participent d’ores et déjà au respect du devoir de loyauté : que l’on songe à la litispendance ou encore à la condition du respect de l’ordre public de procédure dans le contentieux de l’exequatur. Cependant, le droit des procès privés transnationaux laisse encore trop de place aux volontés déloyales des parties. La reconnaissance de l’abus de droit, au stade de la recherche du tribunal internationalement compétent, ou de l’interdiction de se contredire au détriment d’autrui est un moyen de garantir la loyauté du processus judiciaire. Si le devoir de loyauté présente une utilité difficilement contestable, aucune valeur définitive ne lui a encore été attribuée en droit positif. Parmi les outils disponibles, en particulier le principe du droit, l’approche de la notion par le biais du droit du contentieux privé international appelle la reconnaissance d’un standard de loyauté. Renforçant immédiatement la qualité du processus judiciaire, le standard de loyauté est aussi porteur d’évolutions prochaines du droit des procès privés internationaux
The frequency and the numbers of international private trials have grown up during the last decades. With this development, dilatory proceedings tactics have multiplied. An answer must be opposed to those unfair behaviours. Between moral and law, the notion of “loyalty – fairness” commands to parties, lawyers and judges the requirements of transparency, harmonization, esteem and cooperation during the resolution of an international private trial. Some of our actual positive rules already command the respect of the loyalty-fairness: we can speak of the requirement of the fairness of the foreign proceedings during the exequatur. However, there are still too many possibilities for bad procedural behaviours during private international trials. The recognition of a principle of abuse of right, or of the estoppel can be two ways, among others, to protect the fairness of the judicial proceedings. If it is hard to question the utility of the requirement of loyalty-fairness, this notion has no still effective value in positive law. Among the tools that we know, especially the principle of law, the study of the loyalty-fairness in international private litigation asks the recognition of a new standard of loyalty-fairness. The standard can be immediately effective, reinforcing the quality of the judicial process, but the standard of loyalty-fairness also bears some of the next evolutions of the international private litigation rules

Stemming from monomanias and isolated by freud since 1894, the constraint neurosis is still "the richest field of exploration for the analytic research". This neurosis equally shared between men and woman, joins elements of its causalities in the subjet's pre-history-period during which the mother alienated the child to herself under the conniving eye of an undesired husband. The link between the mother and her young has been gone with an injunction: "you will desire only my desire", fixation-point where the child will regress as soon as a trauma-event will happen-always after the castration he acknoledged. Facing the risk of a return to an object place that was once assigned by the mother, period of lake of unconcern sexual differenciation and place where the promimity of "la chose" can nothing but feminize, period before every signifiant. Les travaux concernant l'histoire de l'édition se sont multipliés depuis une dizaine d'années, mettant en oeuvre une pluralité d'approches méthodologiques : biographies, bibliologie, monographies. C'est de ce dernier genre que relève a priori un travail consacré aux Editions de minuit, élaboré à partir d'archives inédites (nouveau fonds découvert pour la période de l'Occupation ; ouverture intégrale des archives de la maison pour les années 1944-1955). S'appuyant sur des informations neuves fournies par des documents inédits, ce travail essaie d'explorer l'importance de la notion de catalogue pour l'étude d'une maison d'édition. Petite structure ne publiant qu'une vingtaine de textes par an, et ce depuis leur création ; occupant une position singulière dans le monde éditorial à cause de leur histoire et de la nature de leur production littéraire et politique, les Editions de minuit sont un laboratoire privilégié pour l'application d'une nouvelle approche et un observatoire permettant de mieux comprendre l'histoire récente du monde de l'édition française
Several works on the history of publishing have appeared in the past ten years, initiating a plurality of methodological approaches : biographies, bibliology, monographs. It is this last method which has been used for a work pertaining to the Editions de minuit elaborated from undisclosed archives (new sources discovered for the period of the German occupation ; complete access to the archives of the publishing house for the years 1944-1955). Integrating new information from undisclosed documents, this work tries to explore the importance of the notion of a catalogue in the study of a publishing house. A small structure publishing only about twenty texts a year since its foundation ; occupying a singular position in the publishing world due to its history and the nature of its literary and political production, the Editions de minuit are a privileged laboratory for the application of a new approach and an observatory allowing a better understanding of the recent history of the French publishing world
