Abstract:
Purpose – The purpose of this paper is to look at the practical considerations of valuations undertaken in the UK at the end of leases when the landlord and the tenant are negotiating on the dilapidations claim. Design/methodology/approach – The paper is a review of current professional practice and highlights the salient issues to consider when looking at dilapidation claims. Findings – The paper considers a fundamental principle of dilapidations. That is, how much has the market value of the landlord’s interest diminished at the end of the lease by reason of the disrepair. Research limitations/implications – The paper is based on the interpretation of current statute and case law. Diminution valuations are hotly contested and there is currently little professional guidance available to practitioners. Practical implications – The paper guides landlords, tenants, building surveyors and their valuers on the thought process and practical approach to be adopted in assessing loss in dilapidations cases where the underlying assessment will be carried out on the basis of diminution in value. Originality/value – There is very little written on the practical implications of diminution valuations when assessing dilapidation claims. This paper addresses that shortcoming.

Abstract:
Purpose: This study investigated teachers’ perception on the influence of dilapidated school structures on the academic performance of pupils in primary schools in Kogi State. Seven research questions guided the study which clustered on the state of dilapidation, pupils’ achievement and their relationships across the three Senatorial Districts of the State. One research hypothesis was stated for the study to ascertain the significance or otherwise of the relationship between dilapidated school structures and the academic achievement of primary school pupils.Methodology: The qualitative survey design was used for the study and a sample of 1,500 teachers from a total of 6,850 teachers was drawn from the population of all the public primary school teachers through stratified random sampling. Interviews were conducted to support the questionnaire that was the major instrument for the study. Two were designed with nine (9) items to elicit responses on possible indicators of dilapidation of schools and achievement on a scale of Strongly Disagree, Disagree, Agree, and Strongly Agree with arithmetic values of 1, 2, 3 and 4 respectively. The questionnaires were given to one teacher and one head teacher per senatorial district and two experts in measurement and evaluation to ascertain their validity. To test for their reliability, the Cronbach’s alpha was used and it yielded coefficients of 0.753for dilapidation of schools and 0.663 for achievement. The data generated were analysed using Likert scale percentage analysis, correlation, mean score analysis, ranking, excel coding and SPSS. The data collected was also analyzed using Pearson correlation to determine relationships and test the stated hypothesis at 0. 05 level of significance.Results: The study showed that school dilapidation across the three senatorial districts in Kogi State vary, achievement of pupils were not rated high and there is a linear relationship between school dilapidation and school achievement in Kogi State. However, from the tested hypothesis, school dilapidation does not significantly influence school achievement in the state.Unique contribution to theory, policy and practice: It concluded that if our education must deliver the benefits it holds, then the physical structure of our primary school is a sure area to consider. It recommended among others that Government should ensure that there are sufficient desk in classrooms, repair or replace of bad/damaged seats, avoid the use of buildings with licking class roofs and there should be a declaration of a state of emergency on school system to salvage and surmount the identified challenges.

PurposeIt is evident that organizations are continuously contributing toward environmental dilapidation. This may be reduced by focusing their employees’ involvement in pro-environmental behaviors. Pro-environmental behaviors have ramifications for organizations, employees, leaders and natural environment. Therefore, this study aims at investigating environmental related social responsibility and identification as the predictors of pro-environmental behaviors through the moderating role of empathy in the hospitality sector.Design/methodology/approachThis study collected data from 201 pairs (i.e. supervisors and their subordinates) working in the hospitality sector.FindingsThe study found that employees with high empathy exhibit more pro-environmental behavior and organizational identification when perceiving their organization’s involvement in environment-related social responsibilities.Research limitations/implicationsThe data for this study were collected at one point of time and it has implications for organizations and employees.Originality/valueThis study aims to fill the gap of the underlying mechanism that how perceived CSR affect employee pro-environmental behavior.

Abstract:
La parabole du fils prodigue est connue. Elle conte le retour de celui qui est accueilli avec chaleur par son père après des années d’absence. Mais elle est également l’histoire d’un homme qui revient chez ses père et mère après avoir gaspillé son héritage. C’est dire que la prodigalité, loin d’être un mal d’époque, est un phénomène qui sévit depuis un peu plus de deux mille ans. Le droit a tenté d’encadrer cette attitude. Le droit romain, tout d’abord, puis le droit classique, coutumier, l’ancien droit, avant d’être progressivement délaissée par le législateur. La difficulté résidait -réside toujours- dans l’appréciation de ce comportement, difficile à établir sauf à être absolument notoire. Comment caractériser ce que le droit décrit lui-même comme des « folles dépenses » ? La question est celle de savoir de quel droit le législateur tire sa légitimité, et cela d’autant plus lorsqu’il décide d’intervenir dans la gestion des biens d’autrui. Car la dilapidation des biens relève avant tout d’un problème des familles. Chacun doit être libre de déshériter ses enfants ou, à tout le moins, de faire en sorte que son patrimoine ait un solde négatif afin qu’ils n’héritent de rien. Pour autant, lorsqu’il aboutit à l’état de besoin du débiteur, ce problème des familles devient un problème de société. Le droit se devait d’appréhender ce comportement qui exige la conciliation de deux intérêts somme toute contradictoires : la solidarité des intérêts de la famille et l’émancipation économique du prodigue qui, en vertu de l’absolutisme du droit de propriété, devrait toujours pouvoir disposer de l’ensemble de ses biens. Étudier le prodigue, le définir, puis le qualifier afin de lui proposer un régime de protection adapté, nécessitait donc de retracer l’historique de la prodigalité. Il a précisément fallu identifier les éléments constitutifs à l’origine de cette attitude afin de mettre en exergue le fait que le prodigue n’agit pas à l’instar de l’homme rationnel économique, faisant ainsi de lui une personne inapte à prendre en compte ses intérêts patrimoniaux au sein de la société. Afin de lui éviter une ruine certaine, le péril de ses intérêts et des intérêts de ceux qui dépendent de lui, le législateur devrait encadrer et surtout protéger ces personnes en difficultés. La prodigue n’est pas seulement un mauvais gestionnaire mais dispose d’une volonté défaillante car hétéronome, en ce qu’elle est uniquement guidée par ses passions et ses pulsions dépensières. C’est notamment ce à quoi s’attache à démontrer cette étude<br>The parable of the prodigal son is widely known. It relates the warm welcome given by the father to his son’s return some years later. It also tells us the story of a man coming home after frittered away his inheritance. Prodigality, far from being considered as an evil at the time, is a phenomenon that wreaks havoc for over more than two thousands years. The Law attempted to rule this behaviour. Firstly the Roman Law and then the Classical Law, the customs, the Old French Law, before the legislator gradually deserted it. The difficulty lay in - and still lies in - the legal appreciation of this behavior which is tough to establish when not notorious. How to characterize what the Law describes as « spending sprees » ? The question is about knowing by what right the legislator gains legitimacy to rule this, all the more when he interferes into the assets management of someone. The squandering of estate is first and foremost a family problem. Everyone shall be able to disinherit his children, or at least, making a negative balance so they will inherit nothing. But for all that, when it leads to the debtor’s need, this family matter becomes a society one. The Law had to grasp this behaviour which requires to reconcile family’s interests solidarity with prodigal’s economic emancipation, who must stay able to manage his estate because of the unfettered right of property. Study, define and then qualify the prodigal in order to suggest a legal protection regime, requires to retrace the history of prodigality. Therefore, it leads to identify the constituent elements at the origin of this attitude in order to highlight the fact that the prodigal is, unlike the rational economic man, unable to take into account his property interests. To avoid him an undoubted ruin and the peril of his own interests and those of the people who depend on him, the legislator should frame the prodigality and above all protect these people. The prodigal is not only a bad manager but also has a failing will because heteronomic, guided by passions and financial impulses. This is, among other things, what this research will demonstrate

Abstract:
Over recent years, it has seemed that the threat to listed buildings and unlisted buildings in conservation areas has arisen not only from redevelopment schemes which can be controlled but also from deliberate neglect and inadequate maintenance which is considered just as real a threat. In response to what has been perceived as this threat, English Heritage has proposed buildings at risk registers. The aim of this study is to analyse and determine perceptions of risk and the interpretation of various groups of the powers given to local authorities under the Town and Country Planning Acts. The study examines the assumptions made by English Heritage and others of the causes of the continuing threat to listed buildings, and in particular to test the efficacy of these registers. In particular, the study examines the way in which the registers are compiled and used, and the main causes of the disrepair of the buildings studied. It analyses the decisions made by owners and local authorities, and evaluates the effect of all these factors in terms of the number of buildings that became subsequently restored or demolished. Twenty-four buildings are used as case studies in considerable depth. The findings show that threats have arisen not from ignorance or lack of understanding but rather from the attitudes of owners, local authorities and the general public towards building conservation. The obvious reluctance of local authorities to use enforcement powers against owners has not helped to alleviate these threats, neither was the incentive of grant aid effective. In spite of the reluctance of some local authorities to implement buildings at risk registers, this study concludes that the establishment of such registers is the proper solution to solve these threats. The existence of registers would help in the compilation of lists and full details of all buildings considered at risk: it would help to monitor those buildings that are vulnerable and assist in planning for suitable administrative and practical actions to be taken. Most importantly, it would stop further unnecessary demolition of a valued and recognised heritage.

Student Number : 0210329K - MSc research report - School of Construction Economics and Management - Faculty of Engineering and the Built Environment<br>The government of Lesotho is experiencing a rapid rate of dilapidation of its dwelling houses, and if this goes unabated, the government will lose even more in terms of the expenditure on maintenance and repair, and eventually the houses themselves, thereby losing a good asset base. The research considers the possible causes of the rapid rate of dilapidation of the Lesotho government dwelling houses. It draws attention to the level of effectiveness of the property management structure and or framework of the Lesotho government. Further it considers the possible overall effects of the current continued dilapidation on the management of the property assets by the Lesotho government. The research draws attention to the present system of property management practiced by the government, and compares it with that of the private sector, considers the ways in which the government may have to adapt, and suggests that while the government dwelling houses are neglected in terms of maintenance, there will be some countervailing opportunities for a more effective strategic use of the property asset. A number of respondents drawn from the private sector, two government departments, and the housing occupants, were interviewed using administered and self-administered questionnaires for this research. The hypotheses ‘that efficient property asset management is significantly dependent on a good property management framework/structure’ and ‘that there is a correlation between the declining property values and the level of rentals payable to the Lesotho government’ were confirmed. This is seen in the fact that the Lesotho property management structure lacks the capacity to manage their pool of available housing structure. Moreover, that the kind of expertise available is not fitting to be able to manage the government houses. The Lesotho government lacks the required expertise for the management of its housing assets, and this has led to a rapid dilapidation of the housing stock for the inadequacy in management resulted in poor maintenance of the housing stock, as the management failed to identify key issues in property management. 3 Keywords: Property Dilapidation, Maintenance, Dwelling houses, Government Property Management.

Schubert's Villa in Liboc, Prague and the Phenomenon of Dilapidated Monuments. The View of Heritage Preservation on Renaissance Revival Villa Architecture The main purpose of this thesis is to emphasize the phenomenon of dilapidated renaissance revival monuments. This phenomenon will be shown on destiny of Schubert's villa, even though the villa is a national monument, it is in a very bad condition. Why is the villa dilapidated? Is it the cause of indifference of people, political or social changes? The first chapter will characterize the villa in context of renaissance revival. The chapter will describe the original condition and will emphasize the artistic value. The second chapter will evaluate the development of heritage preservation, mainly with emphasis on villa architecture. The third chapter will focus on political and social changes, which could have had an unfavourable impact. The fourth chapter will analyse nowadays bad state. The chapter will also answer the question if it is a usual phenomenon that the renaissance revival villas are dilapidated and why.
