Abstract:
The records of diocesan and peculiar courts of late medieval England have received extensive academic scrutiny, generating a reasonably clear picture of a hierarchical pyramid ultimately headed by the papal curia. However, that picture is an incomplete depiction of the totality of the ecclesiastical mechanisms of dispute resolution. Existing scholarship largely ignores the use of arbitrated extra-curial settlements to avoid litigation (or, alternatively, a formal sentence). Concentration on the provincial court hierarchy also marginalizes the more directly papal courts of judges delegate and assorted local agents with judicial powers, which functioned within England between 1300 and the Reformation and bypassed the normal fora. Drawing on a wide range of scattered source material, this article introduces these neglected elements of the church's legal system, including the resident papal conservators appointed at the request of petitioners to exercise a general delegated papal judicial authority on their behalf, whose existence has been almost completely unnoticed. It suggests the significance of arbitration, delegation and conservation within the wider structure, and the need to give them much more attention if the practical importance of canon law in pre-Reformation England is to be properly understood and appreciated.

Abstract:
[The correspondence between Rev. Prof. Jan Fijałek and Rev. Dr Jan Kwolek in the years 1919–1936] This paper presents a collection of a few dozen letters written between 1919 and 1938. Their authors were two eminent representatives of the humanities and of the Polish Catholic Church at the turn of the 19th and 20th centuries. One of them, Reverend Professor Jan Nepomucen Fijałek, represented the Kraków Archdiocese, though professionally he was associated with the University of Lviv and the Jagiellonian University. As an outstanding scholar and expert on sources to the history of medieval Church and spiritual culture of Poland, as well as a distinguished pedagogue, he enjoyed great renown in the world of science. The other correspondent, Reverend Doctor Jan Kwolek, a lawyer, lecturer at the Theological Institute of the Latin rite in Przemyśl, chancellor of the Episcopal Curia, organizer and director of a Diocesan Archive, a model for the whole country, unceasingly developed his interests in canon studies, history of the Church, and showed great concern for preserving the archive heritage of the Przemyśl Diocese. The majority of the letters were written by Rev. Kwolek, though they are not complete; the addressee had collected them meticulously, sometimes adding brief commentaries. The Przemyśl priest must not have attached a lot of weight to collecting the letters of the Kraków mentor, as only over a dozen of them have been preserved. The sources present very interesting material. The “supplicant” here is definitely Rev. Kwolek, seeking in the unquestionable scientific authority of Rev. Fijałek advice on organizing the Przemyśl archive but also methodological and factual guidelines for archive research and publications. In the course of time the distance between the two scholars was gradually decreasing, though it never crossed accepted social boundaries. What confirms that is the elaborate titles both correspondents addressed each other with. The subject matter of the letters is rather diverse and includes several themes. The dominant one is Rev. Kwolek’s requests to be recommended relevant literature necessary to complete a reference library needed in research and scholarly work. Quite a lot of space is also devoted to the Przemyśl priest’s reports on the progressing work on completing and organizing the archive of the Episcopal Curia in Przemyśl. Rev. Prof. Fijałek, apparently did not hide his sincere appreciation of the activity of the junior priest, indefatigable archive fanatic, encouraging him, providing him with expert instruction and warning him against naïve faith in the patronage of successive bishops. Another extensive motif is common and readily produced by church circles gossip on different Church dignitaries in Kraków and Przemyśl, as well as expectations of personal reshuffles and new careers with the start of every new pontificate. Without a doubt, the presented material deserves publication, as it shows the effort of creating and then preserving pioneer initiatives on scholarly and religious ground, particularly in Przemyśl in the first half of the 20th century.

Abstract:
Private correspondence between Rome and England in the fifteenth century is not unknown but is usually to be found among the business papers of proctors permanently resident at the Curia, such as William Swan and Thomas Hope. By contrast, the three letters printed below were written by an occasional visitor to Rome, charged with a specific errand. They tell us more about England than Italy, and more about the everyday concerns of a moderately successful clerical careerist than the procedures of the papal court, but they are unusual and valuable precisely for that reason. The author of these letters was Master Robert Thornton. A canon lawyer in the service of Archbishop Kempe, he began his career as an advocate in the prerogative court of York and, during the 1440s, established himself as one of the mainstays of the diocesan administration there: he acted as commissary-general to the court of York and official of the absentee archdeacon of York, besides serving on many ad hoc commissions. By the time these letters were written, Thornton's diligence in the archbishop's service had brought him several desirable benefices: already perpetual vicar of Silkstone (Yorkshire, West Riding), he became rector of Almondbury (Yorkshire, West Riding) in 1451 and was presented by William Bothe, Kempe'ssuccessor as archbishop, to a prebend at St. John's, Chester, in the following year. It was his membership of Kempe' familia that, indirectly, set him on the road to Rome. In May 1452 he was dispatched with a bundle of papers and sixteen marks in cash to pursue the claims of John Berningham, resident canon and treasurer of York, to the vacant deanery.

Abstract:
The major aim of the present article is to assess the credibility and provide criticism of the source value of the first account on the state of the Chełm diocese from 1594 in reference to the organizational state of the diocese at the end of the 16th century, which was before the fire of the archives of the Episcopal curia in Krasnystaw (7 April, 1597), when most of the documents and books burnt down. The account analyzed in the present text is one of the oldest preserved reports sent by the Polish bishops to the Apostolic See after the Council of Trent. The criticism of the Chełm account from 1594 is preceded by an introduction referring to the research tradition and the editorial tradition related to this category of sources. The circumstances and the historical context concerning the account are presented. The evaluation of the reliability of the information passed to the Apostolic See by the representative of bishop Stanisław Gomoliński was conducted by means of the comparative analysis referring to the content of the account together with the information on the state and organization of the Chełm diocese which comes from other sources and scientific studies. The author of the account pointed to a number of difficulties in the functioning of his diocese in the area where the Orthodox Church prevailed and the network of Latin churches, additionally weakened by the Reformation, did not make up a regular and compact territorial structure. This caused a lot of problems in the material protection of the benefices and in pastoral services (a lack of clergymen, accumulation of benefices, disregarding the duty of residence). The account from 1594, as compared to later reports, has the character of a letter (“stylus epistolaris”), and not a form. It is short and fairly general. Its informative value, especially when we analyze particular problems or particular issues, is only supplementary. It can present greater value while studying the bishop’s relation to his diocese and the way of managing it. It is worth looking at this source in the comparative context – especially through the prism of the accounts presented by the same bishop from various dioceses which were under his management during his pastoral career. This will enable criticism of this source and the answer to the question about the extent to which the accounts were the personal work of a given bishop or the work of the Episcopal curia circles and to what extent the traditions of the bishopric.

Abstract:
This article responds to Massimo Faggioli’s desire for early traditions that could be retrieved and supply a theological and moral vision for reforming the Roman Curia, the collaborators of the Bishop of Rome. From the New Testament we have scarce information about Peter’s ‘co-workers.’ Seven certainly authentic letters of Paul, however, show such apostolic collaborators functioning with Paul on his mission, and doing so in a variety of ways that prefigure the tasks of the modern Curia. The diocese of Rome is founded on the martyrdom of Peter and Paul. The Christian men and women who collaborated with Paul supply, not so much markers for some administrative changes, but rather an inspiring vision for a biblically based reform of the Roman Curia.

Abstract:

Abstract:

Abstract:
It makes an organic-functional study of the diocesan curias in southern Portugal (Évora, Portalegre and Elvas) and their archives, during the 16th and 17th centuries. As frequent as possible, this is a comparative approach. The main goal of this thesis is to generate a classification scheme in archives theoretically adjusted to the documental sets of those institutions, within the scope of what would be the diocesan or archdiocesan information systems of the time. To achieve this aim, the project studies both the way in which the Council of Trent marked normative production (synodal constitutions and diocesan court regulations) and the way in which the latter shaped the structure of diocesan administration and the control of information. The documental typologies that the regulations established that should be produced by the information systems of the curias were also identified, at a time in which the written record gained more and more relevance and as well the domain of information to promote the framing of clerics and of lay people. This is a project useful not only for the history of ecclesiastical administration, but also in the field of Information Science.

Abstract:
The first part of the doctoral thesis approaches its topic from the historical point of view: firstly, it summarises the history of the Diocese of Litoměřice from the erection of the Chapter of Canons in 1057; secondly, it briefly describes the history of the Diocese from its foundation in 1655 to 1989; thirdly, the events from 1989 to 2010 are discussed in detail, i.e. the episcopacy of Msgr. Josef Koukl after 15 years of vacant see in the context of the reconstruction of the Diocese after the fall of the communist regime, the situation in the Diocese during the episcopacy of Bishop Pavel Posád, the following period when the Diocese was administered by Dominik Duka and finally the time after Bishop Jan Baxant took canonical possession. The second part of the doctoral thesis is divided into six chapters and approaches the chosen period thematically according to the branches of the Canon Law. It tackles the governance of the Diocese, personnel and territorial-administrative matters, the exercise of the legislative, administrative and judicial power within the establishment and application of the Canon Law from 1990 to 2010. The thesis investigates activities of the Diocesan Bishops, of the Vicars General and Episcopal Vicars and of the Diocesan Curia; it deals with the exercise of the judicial power...

Abstract:
The topic of diocesan Church management structures which I present in this research emerges from concerns concerning the comprehensive implementation of the Second Vatican Council in this regard. It is an attempt to examine, comprehend and present the responses and opinions of members of a diocesan Church in a systematic, clear and simple manner to concerns such as: should diocesan Church management structures change? If so, how should diocesan Church management structures change? What should be the main focus and priority of diocesan Church management structures? Do the current management structures of the diocesan Church respond adequately to the needs of the People of God? Since the Catholic Church has a complex management structure, the entire examination thereof is beyond the scope of this research. However, the aim of this investigation is to critically examine the diocesan management structures of a contemporary local Church. The challenge of this research is to ascertain how ecclesial management, as a vital aspect in the Church, is responding to the challenges of the Second Vatican Council to make the Church not only relevant, but allowing full participation and representation of her members in the management of the diocesan Church.
Department of Philosophy, Practical & Systematic Theology
D.Th (Practical Theology)

Abstract:
The Introduction challenges previous interpretations of the term cura monialium in the historiography of medieval nuns that have restricted its use to the material and spiritual care that these religious women, both as individuals and as communities, received from resident chaplains, visiting priests, and diocesan bishops. Such interpretations too often neglect the other meaning that this term could and did convey: the care that nuns extended to themselves and to those who sought their hospitality, counsel, instruction, healing, absolution, and intercession. Such care was no less vital to nuns’ practices and identities. Indeed, it is the contention of the Introduction and the chapters that follow that examining this meaning of cura monialium gets to the very heart of what it was to be a Benedictine nun in England during the central Middle Ages.
