Full textThe purpose of this study is to present an analysis of the notarial protest of negotiable instruments, contracts and other types of documents, based on a compilation of knowledge on mentioned subject. The initial part is dedicated to the notarial activity, followed by the study of the theme from a historical and Comparative Law perspective. The next chapter provides an overview of the current regulation of notarial protest in Brazil. Finally, there are some personal reflections regarding the theme, including economic analysis, a Comparative Law approach and the study of current challenges and future perspectives on the subject. The notarial protest is a fast and effective procedure used to obtain formal proof of dishonor. Moreover, it gives the debtor an opportunity to pay or to declare the reason why it is excused, in three business days. The act is drawn up by a public notary, an independent legal professional appointed by the State, who acts under the supervision of the court. The notarial protest plays a relevant economic role in Brazil, providing reliable information to the credit market and encouraging prompt payment. Furthermore, it is a useful debt recovery tool. In conclusion, the notarial protest is an important element in the Brazilian legal system that contributes to improve the quality of the institutional environment.

The subprime mortgage emanating financial crisis of the world in the mid of 2008 from the U.S. and follow-up the credit crunch have significant impacted enterprises as well as the whole economy. At this point, credit spread that measures tight level of funds in the financial market will rise. It represents borrowing costs of a general corporate will increase, default rates of corporate bond may climb and occur business failures. Even it may also produce clustering phenomenon of business failures; these phenomena may reflect changes in the economy. Therefore, it’s necessary to explore that enterprises response according to changing in the business cycle and the credit spread to take further ahead affecting the cost of borrowing as well as additions and reduction of default themselves. In view of this, our study will explore the dynamic relation among credit spread, dishonored rate and the business cycle. In this paper, our object of research is Taiwan''s financial system from January 1985 to January 2009, and the research adopts database from Directorate- General of Budget, Accounting and Statistics, Executive Yuan, R. O. C. ; Taiwan-Central Bank of China and Financial Statistics Monthly Republic of China (Taiwan) to analysis to experiment evidence. According to the empirical results that shows dishonored rate leads the business cycle in Granger causality test. Through contemporaneous coefficient on the structural parameters of A, we’ve got the result as following: (1) dishonored rate of increase usually occurs in stages of economic overheating. (2) the gap in credit spread will be greater, when business cycle sinks into downturn. The expected from the variance decomposition results exhibit that: (1) explainable power of dishonored rate to the business cycle is relatively stronger that it has a considerable influenced. (2) credit spread is affected low by the business cycle and dishonored rate. (3) explainable effect of credit spread to the business cycle is relatively less, but explainable proportion of credit spread to dishonored rate is ten times the credit spread to the business cycle. According to the impulse response analysis to get as following: (1) dishonored rate is struck by credit spreads and the business cycle that has a extremely slight response. (2) credit spreads faced struck from dishonored rate is positive response and from the business cycle is negative response. (3) the business cycle is struck by dishonored rate and credit spreads that has a comparative apparent. Based on the conclusions of our study to get the dishonored rate may be considered as an index of business cycle and thus make the following recommendations: (1) In this study about to set up index of the business cycle in Taiwan. It may consideration dishonored rate as a candidate for the economic indicators. Besides, plenty and minority of dishonored rate will reflect the economic prosperity and recession It’s more careful to deal with these policies of dishonored bill for clearinghouse and departments of government. (2) Our result of research is agrees with sub-prime mortgage causes the threat of expansion of credit spreads. The credit spread on the economy has high sensitivity, it can be the condition of the business cycle to forecast economy in the future.

The study utilizes the financial data from the bank’s dishonored SME accounts during 2011 to 2013 as sample bases to proceed empirical analysis. Based on the credited moment, the financial data of the last three years and enterprise characteristics to scrutinize financial data, life cycle of enterprises and types of collateral and so on to statistically analyze. Hopefully, the study will obtain the common symbols and verifications from the dishonored SME accounts. Each financial analysis data from dishonored SME accounts should be lower than general normal SME accounts, which compared with major business’ financial ratio of Joint Credit Information Center. The study approves that business financial data performances of dishonored SME accounts averagely are better than general normal companies, and present a positively development trend. Through filtering individual financial ratio are debt ratio, accounts receivable turnover ratio and inventory turnover rate as three indexes. It indicates that they are regressing yearly and with statistics advantages. Trend and dishonored SME accounts are identical and match expectation. Other financial data, majorly developing positively onward by check items and quantities are obviously superior. Up to 70% dishonored SME accounts at the credited moment, their deposit and loan rate is below 5%, and 90% dishonored SME accounts cannot offer collateral.

There’s intensive correlation between good or bad economic boom and frequent transaction behavior. Usage rate of bill can reflect both the good and the bad in overall economy or individual production and marketing as well as profit, and whether the fund is tight, so that cheque in usage rate symbolizes if it’s frequent transaction behavior. The so-called dishonored rate means dishonored bill accounts for the percentage of the clearing after bank’s business hours as deposit balance is not enough to pay the sum of bill. It can be seen dishonored rate should have correlation to some extent with the presentation of different economic booms. Therefore, this study would plan to understand dishonored rate in which kind of economic booms may easy to cause credit default (dishonored bill) and analyze dishonored rate in the relationship between leading and coincident business indicator. Meanwhile, the study examines the measurement for the rate of dishonored amount or number in leading and coincident business indicator. This study adopted unit root test to solve the problems of residual autocorrelation and heteroscedasticity by using ARMA model to estimate data creation process in variable time series and select based on SBC rule to obtain SBC minimum value as the optimal deferred order; method of maximum likelihood for cointegration test based on the test method proposed by Granger (1969) and Sims (1972) was taken to determine causal relationship between the variables, and then Vector Autoregressions (VAR) was used to find out impulse response function and forecast error variance decomposition for empirical results. According to empirical findings, the rate of dishonored amount or number in leading business indicator showed negative cycle, and business turnover in coincident business indicator also showed negative but unobvious cycle; dishonored rate has displayed weak interpretation of economic importance, remaining the same obvious correspondence to cycle in overall economy, but it’s just a reference indicator at most.
