Abstract:
The words of the federal discrimination laws explicitly prohibit discrimination. Over time, however, federal judges have created a system of frameworks, rules, and inferences that distract them away from the central question of discrimination law and that push cases toward dismissal. This chapter discusses ways to ensure that the courts robustly enforce the federal antidiscrimination mandates. It sets forth measures legislatures, the EEOC, the judiciary, litigants, companies, and citizens can take to introduce more neutrality into discrimination law.

Full text
Abstract:
Despite the growth of specialty palliative care over the past twenty years, the experience of most seriously ill patients in America has not changed. Although some have argued that the solution to this problem is to increase specialist palliative care (SPC), the author argues that this is a mistake. The growth of SPC may distract attention from solutions that are more likely to improve care for most seriously ill patients. SPC may decrease the quality and quantity of palliative care provided by nonspecialists by allowing the health care system to continue to deny death and “ghetto-izing” and d

Abstract:
This chapter discusses another hurdle workers face: the frameworks that courts use to evaluate employment discrimination cases. When Congress enacted the federal discrimination statutes, it appeared to formulate a simple way to determine whether discrimination happened. The words of the statutes ask the fact-finder to decide whether a particular employment outcome occurred because of a worker’s race, sex, or other protected trait. But since the 1970s, the federal courts have not always used that language to analyze discrimination cases. Instead, the Supreme Court has created a set of framework

Abstract:
The last chapter focuses on daily prison life. It starts in interrogation rooms and moves to prison cells. Women prisoners undertook various activities to distract themselves from the idleness of their world. They spent their days learning, reading, and engaging in their own cultural activities. As they recreated their lives in prison, they chose traditionally female roles of sharing, providing for, and taking care of their cellmates. These new cell roles appeared to be stable. When they laughed at and ridiculed each other, they challenged this supportive model. Close attention is paid to the

In March 2011, for the first time in its history, the responsibility to protect (R2P) principle was invoked by the UN Security Council while imposing coercive military measures against a UN Member State without its consent. However, neither the ferocity of the subsequent diplomatic debate around R2P, nor the intensity of the current crisis in post-Gadhafi Libya, should distract us from the fact that Resolutions 1970 and 1973 constituted an appropriate response to a complex mass atrocity situation. The problem was in the disputed implementation of the civilian protection mandate. This chapter a

Abstract:
This chapter examines and criticizes the suggestion that we should interpret the “human” in “human rights” as (i) referring to the appropriate sort of action when certain rights are violated rather than (ii) the (human) universality of certain rights. It considers first a crude version of (i)—the view that human rights are rights in response to whose violation we are prepared to countenance humanitarian intervention; then it considers more cautious and sophisticated versions of (i). It is argued that all versions of (i) distract us with side issues in our thinking about human rights, and sell

Abstract:
Cinema Pessimism uses the medium of film to explore the dilemmas of democratic representation. When is representation an aid to democracy, and when is it an obstacle? Why are democratic populations so perpetually dissatisfied with their representatives? An exploration of film representation gives us a unique standpoint from which to answer these and other questions. Representation contains dangers for democracy, including its ability to foster illusions of power and freedom in a citizenry rather than genuine autonomy. Film itself can be a powerful political narcotic, suppressing rather than ex

Abstract:
This chapter explains why it is possible for Plotinus to appreciate the beauty of bodies, including human bodies, even while he was personally ashamed of his own embodiment. It accomplishes this task first by introducing distinctions between body, matter, form, soul, and entelechy that are made in Plotinus’ arguments with the philosophies of materialism, simple hylomorphism, and Gnosticism. For Plotinus, body is distinguished from matter because a body is formed matter. Since form is inherently good in his philosophy, bodies—as formed matter—cannot be evil. Abstract:
After the Second World War, the United States offered a new kind of atom that differed from the bombs that destroyed Hiroshima and Nagasaki. This atom would cure diseases, produce new foods, make deserts bloom, and provide abundant energy for all. It was an atom destined for the formerly colonized, recently occupied, and mostly non-white parts of the world that were dubbed the “wretched of the earth” by Frantz Fanon. The “peaceful atom” had so much propaganda potential that President Dwight Eisenhower used it to distract the world from his plan to test even bigger thermonuclear weapons. His sc
