Abstract:
Economic literature attempts to explain the effect of divorce law on divorce rates. Mutual consent divorce law was promulgated in the 1970âs. Although this amendment was a reflection of the social change occurring in the United States of America, unilateral divorce was still feared because some expected it to increase divorce rate. Friedberg and Wolfers made big contributions in this field of study. Friedberg believed that divorce rates have increased as a result of the law change while Wolfers agrees that an initial spike is clear but argues that the effect of the new legislations dissipates with time. I adjust the data they use to take into account separation requirements which they have not considered or merely thought of as an extra cost. Some states did require individuals to separate for a certain amount of time before granting them divorce. I use the same regressions as Friedberg and Wolfers for the same period of time but with a different dependant variable: divorce initiation rate. My results then differ when aligning divorces with the period when they got initiated. I conclude that Friedberg overestimated the effect but that the effect did persist and did not disappear like Wolfers claimed.

Abstract:
Islamic Law in Canada: Marriage and Divorce provides an analysis of how Canadian society and the Canadian judicial system have responded to the use of the Shari'a to resolve issues relating to Islamic marriage and divorce in Canada. This dissertation explores two instances where Canadian society has been forced to address the role of the Shari'a in Canada and its interaction with Canadian laws and values. The first involves the debate that took place in Ontario over the last decade concerning the use of Islamic arbitration in family matters. This public debate ultimately led to the rejection of faith-based arbitration in that province, a decision apparently consistent with traditional Canadian attitudes towards multiculturalism. The second area of interaction between Canadian and Islamic law is within the Canadian court system itself. In particular, Canadian judges are occasionally required to grapple with Islamic family law issues when rendering judgments on certain cases that appear before them. This dissertation will examine a number of such cases in order to illustrate how the Shari'a has been addressed by Canadian judges. The overall aim of this work is to situate Islamic law within Canada's liberal framework. It is argued that although Canadians are amenable to certain levels of diversity, values that fall outside mainstream liberalism are not granted recognition. This dissertation will also demonstrate that the failure to legitimize Islamic arbitration represents a lost opportunity that would have broadened the scope of Canadian justice to include minority voices. The decision to reject faith-based arbitration will motivate some Muslims to seek justice from ad-hoc bodies of authority. Devoid of government oversight, these forms of underground Islamic justice may negatively affect certain members of Canada's Muslim community.

Divorce has become an established phenomenon in an "age of discontinuity."* Together with altered patterns of family behaviour, new forms of wealth and modes of consumption, and the apotheosis of the individual and his right of self-determination, it has focused the attention on the de iure sorting out of financial or property issues between autonomous ex-spouses. The law can do nothing to artificially sustain the marriage, but it can assist in the adjustment which individuals must face in the event of divorce.
This thesis is mainly concerned with the economic adjustment, which the spouses to a disintegrated marriage face, following divorce and how the law of matrimonial property functions to accomplish a just and fair result. The ex post facto solution reached is based on the cognizable trend in modern matrimonial property laws of limited sharing of less property adapted to the individual circumstances.
Throughout the treatment of the subject matter, extensive historical, critical and analytical references are made to the law of major Western countries--Canada, England, France, Germany and the U.S.A.--in an effort to deduce a coherent guide to the discretionary redistribution of marital means between husband and wife upon divorce. ftn * P. Abstract:
My thesis addresses the complex inter-relationship between the divorce law and the Divorce Court, and press-based cultural production and consumption, in early twentieth-century New South Wales (1900-1930). Established histories prioritise major legislative developments in 1873 and 1892, and the 1890s divorce boom. I argue that it is equally historically important to consider divorce procedures and public engagement with them outside of these immediate periods of legal change. As divorce debates moved out of the all-male Legislature and into the courtroom, ongoing concerns about social stability, moral integrity and gender relations were expressed through entertaining press reports. Drawing on two bodies of primary evidence—legal transcripts and tabloid newspapers—I consider how the Court and the press exerted influence over each other. Two broad related trends are at the core of this study. Firstly, granted new legal rights under the divorce Extension Act 1892, women petitioners consistently outnumbered male petitioners. Secondly, a journalistic culture dominated by ‘feminised’ melodramatic courtroom narratives flourished alongside the Divorce Court as a place of public theatre. The Court, which demanded public exposure of private suffering, directed the nature of tabloid coverage of divorce proceedings. In turn, press interest in legal procedure had a discernible effect on courtroom happenings. Through this analysis of courtroom proceedings, spectatorship and journalism, it becomes clear that divorce occupied a particularly complex position. It was attached to the rights and status of women, whilst existing within the male-dominated arenas of politics and law. Divorce also fitted into the spaces between law and culture, law and emotion, private and public life, and scandalous entertainment and legal/moral education. The boundaries traditionally constructed between law/politics as masculine and divorce/melodrama as feminine were in reality porous and unstable.

Abstract:
This thesis of approximately 98000 words is an empirically based study of the divorce process and women's experiences of the law. It begins by looking at the historical background of marriage and divorce through the different periods starting with colonization. It then looks at modern marriage and divorce. This is a sociological study of the types of relationships which people have and goes beyond the three state recognised marriages to look at other more informal unions and at the modes of dissolution thereof. It then discusses the research design and relates the study population to the general population before moving on to consider the reasons for the women's dissatisfaction in their relationships and the process of justifying or legitimating their discontent. The helpseeking careers of the women are examined paying particular attention to the agents consulted and the advice that they received from the various agencies. A theory of disputing which sees the litigation process as being less orderly and more dynamic than that advanced in traditional literature on dispute processing is advanced. The thesis then moves on to look at the women's use of the formal legal system examining barriers to access, the use of lawyers as the agents of transformation of disputes from the informal into the formal sphere and also at the provision of legal aid. The various actions instituted are considered in greater detail as are the difficulties encountered in trying to enforce the judgements obtained in court. The final data based chapter is an examination of the women's post-divorce lives from an economic and social perspective. Ultimately, it would seem that the problem may not be one of obtaining access to law, but rather of trying to obtain substantive satisfaction of the claim. Methods of enforcement and at state provision of assistance to lone parent families is considered in the light of constraints facing a developing country with limited resources.

La littérature juridique nous apprend que le divorce, institution fort ancienne permettant de rompre de manière définitive et radicale le lien conjugal, est étroitement lié à l'idéologie dominante et aux fluctuations politiques du pays considéré. La comparaison des législations en matière de divorce, objet de notre étude, permet alors, d'une part, de constater que l'évolution du « droit de divorcer » est marquée par des étapes successives d'interdiction et de rétablissement du divorce aussi bien en France qu'en Corée du Sud. Le principe du « droit de divorcer » une fois admis, cette démarche comparative permet d'autre part, de découvrir que, s'agissant du « droit du divorce », le choix législatif fondamental s'articule autour de deux idées dans les deux systèmes juridiques : diversifier les cas de divorce afin de répondre à la diversité des situations de crise conjugale, et dédramatiser le divorce en incitant les époux à trouver un accord sur les conséquences du divorce. L'approche comparative révèle une fois encore que les règles aboutissent à des solutions souvent proches mais que pour y parvenir, les législateurs respectifs des deux pays ont parfois emprunté des chemins différents
The legal literature let us know that a divorce, very old institution allowing to break the marital relation in a definitive and radical way, is closely linked to the prevailing ideology and political movements of the country. The comparison of legislations in divorce, purpose of our study, allows, on the one hand, to notice the evolution of the “right to divorce” is underlined by successive steps of prohibition of divorce and recovery both in France and in South Korea. The principle of “right to divorce” once accepted, this comparative approach allows on the other hand, to perceive that, regarding “divorce law”, the fundamental legislative choice turns on two ideas in both legal systems : diversify divorce cases to answer the diversity of a marital crisis, and not dramatize divorce encouraging spouses to reach an agreement on the consequences of divorce. The comparative approach reveals once again that the rules often lead to similar solutions but to accomplish goals, sometimes the legislators of the both countries have took different ways

As khul' is part of a larger concept, namely, divorce initiated or approved by women, attention will also be given to the other options that Islamic law---or, on some points, cultural practices---grants women in order to obtain release from the marital bond. A comparative analysis between the application of marriage and divorce laws under the Ottomans and in contemporary Egypt will then be conducted with a view to shedding light on the effect that the rise of the nation-state has had on gender inequality.

Abstract:
This socio-legal study investigates the phenomenon of Islamic divorce in the UK. The background to the research problem is situated in discussions on Muslim women's rights in topics such as Shariah law, multiculturalism and legal pluralism. These may echo concerns that classical interpretation of Muslim family law (MFL) follows patriarchal practices that discriminate against Muslim women, whilst civil law is committed to gender equality as promoting social progress. The debate regarding the diasporic Muslim communities in Britain focuses on concepts such as multiculturalism and legal pluralism. Critics of MFL argue against policies that accommodate group rights and contend cultures socialise members to their designated status, with oppressive practices hidden in the private and domestic spheres, and specifically in the use of Shariah councils. Proponents, by contrast, argue for religious freedom, among other grounds. Many agree that further empirical research is required on the subject. This study addresses this empirical gap. The central research question asks, 'how do British-Bangladeshi Muslim Women (BBMW) pursue divorce in the UK?' and investigates the choices women made, as well as the role of experts, religion and culture in influencing decisions. It uses a phenomenological-inspired methodology, with data collection involving 27 in-depth interviews with BBMW, 12 interviews with experts, participant observation of Shariah Council hearings, and document analysis. Thematic analysis of data produced findings with conclusions applicable to the British-Bangladeshi Muslim community and to a wider field including legal practitioners and mediators, academics, policy-makers and others. The insights gained reveal the strong influence of religion and culture in establishing norms, dictating the importance of nikah, and in establishing the marriage, whilst the taboo of divorce hindered women from divorcing and affected them moving on, post-divorce. The community avoided professional mediation and viewed family disputes as a private matter. The diversity of Islamic opinions caused further confusion suggesting a need for a specific information reference point for British Muslims. The women displayed a multifaceted approach in dealing with civil and Islamic divorce, and utilised the different systems to their benefit, forming new mechanisms of securing religious divorce without the use of Shariah councils.

Nigerian divorce laws and the divorce litigation process pose severe psychological, social-cultural, economic, and legal problems for families going through divorce in Nigeria. This thesis argues that divorce mediation may be able to ameliorate the harsh effects of these laws and process. This thesis seeks to achieve the following objectives: (1) To determine if the divorce mediation process can achieve the goals of a good divorce process, (2) To determine if the divorce mediation process can provide solutions to the myriad of unique problems which face families going through divorce in Nigeria, and (3) To determine the possibility of incorporating divorce mediation into the family dispute resolution system in Nigeria through an institutionalized divorce mediation program at the government-funded citizens' mediation centres. These objectives are achieved through an in-depth review of the customary and statutory laws regulating marriage and divorce in Nigeria as well as a review of the divorce litigation process in Nigeria. This thesis employs both desk and empirical research methods. It examines legislation, policy documents and academic treatises on divorce and divorce mediation. It also utilizes semistructured interviews to examine the Citizens' Rights and Mediation Centre, Enugu State, to determine its viability as a vehicle for the institutionalization of divorce mediation in Nigeria. The thesis finds that indeed divorce mediation achieves the aims of good divorce law. It further finds that while the divorce mediation process is not a panacea, its features lend themselves easily to the resolution of the myriad of problems which face families going through divorce in Nigeria. It also finds that divorce mediation can be incorporated into the Nigerian family dispute resolution system through an institutionalized divorce mediation program at the state-funded citizens' mediation centres present in several states in the country. It concludes that incorporating divorce mediation into the family dispute resolution system in Nigeria will ameliorate some of the harsh effects of the current divorce system. It offers short and long term proposals for the institutionalization of divorce mediation in Nigeria.

This the sis investigates how this causes serious problems for Muslim women who suffer grave injustices upo n divorce due to the non recognition and non regulati on of Muslim marriages It highlights t he State refus al to enact legislation despite the dicta and obiter comments from the courts spanning more than two decad es enjoining the state to effect legislation to achieve this purpose. South African law is still fundamentally lacking in the recognition of the rights of parties to marriages contracted only in terms of M PL . For couples married in accordance with civil law, marriages and divorces are dealt with under the relevant statutes, namely the Marriage Act 25 of 1961, t he Civil Union Act 17 of 2006 and the Divorce Act 70 of 1979. No provision has been made in statu tor y law for MP L . Previously the courts have held that this was due to the potentially polygyn ous nature of Muslim marriages. Muslim m arriages are inadequately regulated resulting in serious hardships to Muslim women and children. This thesis furthermore inve stigate s the need to recognize MPL .

The number of multi-million dollar divorce settlements has been increasing rapidly in the last decade. Il ne fait plus de doute que le divorce fait partie intégrante du paysage familial. Pour autant le droit au divorce a vacillé entre droit permissif et droit coercitif. La loi du 11 juillet 1975 a insufflé un mouvement de libéralisation qui va régner sur le droit du divorce. Mais c'est avec la loi du 26 mai 2004 que la libéralisation va prendre toute son ampleur. Même si elle s'inscrit dans une certaine continuité en maintenant la pluralité des cas de divorce, elle ouvre plus largement les portes de celui-ci. Les règles de fond et de forme sont étroitement liées dans le procès du divorce. La loi a donc supprimé de nombreuses barrières procédurales qui ont eu pour conséquence directe de simplifier la procédure et favoriser l'obtention du divorce. Les époux doivent respecter les obligations procédurales pour parvenir au prononcé du divorce. Les règles procédurales absorbent ainsi les règles substantielles. L'ouverture découle également d'une objectivation du droit du divorce. La cause de divorce trouve essentiellement sa source dans le constat d'échec du mariage. La loi a d'ailleurs consacré un véritable divorce faillite pour ne pas dire droit au divorce sur demande unilatérale qui n'exige qu'une cessation de vie commune pendant deux ans pour être prononcé. Elle fait également triompher la dimension individuelle sur la conception institutionnelle de l'union. Les arrangements constitutent la pierre angulaire du règlement du divorce. Les accords se retrouvent à tous stades de la procédure et dans tous les cas de divroce. L'ordre public conjugal connait donc un certain infléchissement corroboré par un relâchement de la faute dans le divorce et l'instauration d'un droit commun des effets du divorce. La réunion de ces différents facteurs contribue à l'émergence d'un droit subjectif au divorce.

This thesis is about the possibility of addressing power disparities in divorce mediation in order to maximize the benefits that this alternative practice offers. It describes the development of Alternative Dispute Resolution (ADR) in general and of divorce mediation in particular, primarily through a feminist lens. In doing so it discusses the promise that feminist proponents saw in mediation initially, and then proceeds to describe the breaking of the promise that developed into some of the harshest critique of this process. The thesis explores a critical element of this critique, namely the problematic nature of utilizing mediation in the face of existing power imbalances generally, and in the context of divorce specifically. In order to facilitate the address of incongruities of power, it delves into an examination of the concept of power from several angles. To enhance and deepen the analysis of this concept, it describes Foucault's definitions and understanding of the term, and applies these towards advancing the discussion regarding the possibility of addressing existing inequality in power between parties to a dispute. Finally, it offers some tools that can be used in addressing power disparities in order to ameliorate the mediation process and its results. To this end it describes the ethical guidelines that can be utilized, comprised of internal tools to address power imbalances through mediation styles, as well as external ethical guidelines inherent to the process. Additionally, it suggests legal boundaries that may be utilized to offset possible power discrepancies. It ends with a hopeful message of the possibility of transformation in the face of conflict, thereby entertaining the prospects of a promising future for this alternative to resolving disputes.

Abstract:
Despite the Arizona family court's purported focus on the "best interests" of the child, it is inherently parent-centered and does not, in actuality, serve children's well-being. When children are offered opportunities to participate in this legal system, studies have found positive impacts to both the children and the judicial system. The overwhelming majority of these studies were conducted in countries that have ratified the United Nations Convention on the Rights of the Child; the United States is not one of those countries. As such, facilitating children's participation in the court process by encouraging judicial interviews is one way Arizona family law could better promote children's best interests and well-being. What began as a quest for research on how judicial interviews affected children emotionally and psychologically, has evolved into a critical analysis of the family law framework as it exists in the United States—particularly, the State of Arizona. Through a detailed presentation of Arizona family law, this papers demonstrates the court's focus on parents' rights—often in the absence of children's rights. An exploration of the ways in which various philosophical and legal theories work to critique and expose the dominant power relationships in the family law structure follows. It is only through such deconstruction of this law that children's voices can be effectively reincorporated into the family law schema and their "best interests" properly considered.

Abstract:
This thesis examines the appointment of the Commissaries of Edinburgh, the court over which they presided, and their consistorial jurisdiction during the era of the Scottish Reformation. It is argued that the Commissaries of Edinburgh were appointed by Mary, Queen of Scots, in February 1563/4 as a temporary measure following the suppression of the courts of the Catholic Church in Scotland during the Wars of the Congregation. The Commissaries’ jurisdiction was substantially that of the pre-Reformation Officials centralized into a national jurisdiction administered from Edinburgh. The Commissaries of Edinburgh’s jurisdictional relations with the inferior Commissaries, the Lords of Council and Session, the suppressed courts of the Catholic Church and the Lords Interpreters of the Law of Oblivion are examined, whilst their relations with the tribunals of the Protestant Kirk are given particular attention. The thesis argues that despite the complex constitutional, legal and religious legacy of the spiritual jurisdiction in Scotland, the Commissaries and Kirk achieved a high degree of jurisdictional harmony, despite occasional conflicts. The Commissaries continued to administer the Canon law of the medieval Church in consistorial matters, with the prominent exception of the innovation introduced into Scotland by the Protestant Kirk from 1559 concerning divorce and remarriage on the grounds of adultery. Through an analysis of sentences and decreets pronounced by pre-Reformation Officials, the Commissaries of Edinburgh, and the tribunals of the Protestant Kirk, it is argued that this reform was essentially a reform of divorce a mensa et thoro using concepts and formulas borrowed from pre- Reformation sentences of annulment. The result was a type of divorce unique to Scotland, where the innocent party was immediately freed to remarry, whilst the guilty party remained bound to the failed marriage until freed to remarry by the death of their innocent spouse. An analysis of consistorial litigation before the Commissaries of Edinburgh is used to explain and illustrate the Romano-canonical procedure used in their court and the documentation generated during litigation. Litigants’ gender, domicile and social status are also analysed, together with their use of procurators and the expenses incurred during litigation.

The majority of courts have instituted a non-adversarial process, mediation, to enable divorcing couples to settle regarding parenting time and custody agreements. To date, there are plenty of studies analyzing the effectiveness of parenting time and custody mediation and the effect on the children involved. The studies, however, do not focus on couples who return to mediation a second, third, and fourth time even after the initial mediation has been settled. The study analyzed 965 couples mandated to attend custody and parenting time mediation in one jurisdiction within a four year follow up period after the initial mediation occurred. Of those couples, 160 (17%) returned to mediation. Of those 160, 24 (2.5%) couples returned a second time and later one couple (.1%) returned to mediation a third time. The outcomes of these returns should be considered when couples voluntarily return versus when they are court mandated to return and differences varying upon fathers and mothers reasons for returning. Data suggests the greater the amount of returns, the greater the inconsistency on why mothers and fathers decide to return to mediation. The study intends to fill in the gaps of mediation research in an attempt to better parenting time and custody mediation.

L’objet de cette thèse est d’étudier « La confrontation de la dissolution du lien conjugal et ses effets entre les États maghrébins et les États européens francophones (France et Belgique) ». Les difficultés de coordination des systèmes islamiques et européens de droit international privé proviennent de l’écart entre leurs législations relatives au statut personnel et au droit de la famille. En droit musulman, les matières du statut personnel sont solidaires des donnés religieuses. Les ressortissants maghrébins établis dans des pays européens se retrouvent souvent confrontés au croisement du système juridique maghrébin et celui de leur pays d’accueil.

S’il est un domaine où se heurtent des visions difficilement conciliables entre l’Europe et certains pays musulmans, c’est bien celui du mariage mixte et particulièrement celui de la répudiation. Il faut souligner que le problème perdure depuis plus de vingt ans.

Toutefois un grand nombre de ressortissants Marocains réside en Belgique ce qui conduit inévitablement à ce que des problèmes liés à la dissolution de leur mariage se posent. A ces difficultés viennent s’ajouter les problèmes de conflits de lois. Cette étude a donc tenté de dégager les caractéristiques des différents systèmes étudiés et de montrer les divergences qu’ils comportent en terme de méthodes utilisées dans le règlement des conséquences du divorce ou de répudiation.

La présence d’une communauté immigrée de statut personnel musulman et la rencontre de l’ordre juridique européen avec ce phénomène, posent l’épineux problème de l’harmonisation de deux systèmes juridiques fondamentalement différents et a ainsi pu être qualifié de « conflit de civilisations ». Ce qui permet une vue globale du sujet.

Summary: The purpose of this thesis is to study the dissolution of a marriage tie between North African states and European French speaking states, and what this dissolution means in term of confrontation on both sides concerning the juridic systems european and islamic. The difficulties of coordination between the islamic way of life and the international law are the result of divergence relating with personal status and family right. In the islamic law, personal status and religious faith are closely interlinked. Moroccan nationals who step up house in an european country are confronted with the law of the Maghreb and the law of the country witch welcomes them.

Mixed marriages and in particularly in a case of repudiations are a sphere where european nations and some muslim nations don’t see things in the same way. One has to emphasize that these problems have been enduring for over tweenty years. A great numbers of Morocans lives in Belgium which leads to difficulties if their marriages have to be dissolved. Over these difficulties problems of laws conflicts are added. This study have tried to show the characteristics of these systems and the different way to solve the consequences of the divorce or of the repudiation. The presence of an immigrated community of personal muslim status and the encounter of the juridic european system with this phenomenon set the acute issue of the harmonization of two juridics systems deeply different. This can be described as a “conflict of civilisations”. This allows a broad view of the subject

Le phénomène de conventionnalisation du droit de la famille, plus précisément le rôle assigné à la volonté individuelle lors d'un divorce se développe de manière exponentielle. Les sources des obligations conventionnelles étant multiples, il convient de définir les éléments qui les composent. Le contrat ne constitue pas l’unique source des obligations conventionnelles. Cette catégorie doit comprendre l’ensemble des actes juridiques conventionnels. Ceux-ci se définissent comme des manifestations de volonté produisant des effets de droit.En droit du divorce, nombreux sont les accords de volontés que les époux peuvent conclure afin de régler les conséquences patrimoniales et extra-patrimoniales de leur rupture. Cette place croissante, accordée par la loi aux volontés individuelles dans l’aménagement des conséquences du divorce, invite à s’interroger sur la qualification des accords conclus par les époux. L’étude des obligations conventionnelles nées du divorce permet de démontrer que des contrats de droit commun s’épanouissent dans le droit du divorce et que parallèlement des conventions du divorce, caractérisées par l’intervention du juge, se développent en marge des principes issus du droit des contrats.En définitive, dans un contexte où est promue la liberté individuelle, les contrats de droit commun constituent un instrument privilégié pour des époux qui souhaitent organiser les conséquences patrimoniales de leur rupture. Cependant, l’ordre public familial inhérent au domaine extra-patrimonial persiste. À cet égard, il faut souligner que la théorie générale des obligations n’a pas vocation à mettre en péril l’état des personnes qui par nature doit demeurer indisponible
The phenomenon of conventionalisation of family law and more precisely the role assigned to individual will in divorce has been increasing exponentially. As the sources of conventional obligations are multiple, it appears essential to define the variouselements that make up this specific group. Contracts are not the only source of conventional obligations. This last category should include all conventional legal acts which can be defined as expressions of will intending to produce legal effect.In divorce law, the voluntary agreements spouses are allowed to conclude in order tosettle the patrimonial and extra-patrimonial consequences of their separation are numerous. The growing importance given by law to individual will in order to settle the consequences of divorce calls for the examination of the genuine qualification ofspouses’ agreements. The analysis of the conventional obligations originating from divorce demonstrates that common law contracts flourish in divorce law while, at the same time, divorce agreements develop on the fringes of the guiding principles of contract law. Regarding these conventions, judges’ interventions add to individual willso as to reach perfect agreements. Eventually, in a context where individual freedom is promoted, common law contracts are a privileged tool for spouses who wish to organize themselves the patrimonial consequences of their separation. However, matrimonial public order legislation remains and cannot be dissociated from the extra-patrimonial field. In this regard, it should be noted that the general theory of the law of obligations does not intend to endanger the status of persons which must inherently remain inalienable

Although the importance of fathers' post divorce contact with their children has been linked with a better outcome for the children and is valued by society, studies in the United States and Australia have suggested that up to 30 percent of fathers do not maintain regular contact with their children post divorce. To date, the literature has focused mainly on demographic variables and some personal characteristics of the father. An area, which has been neglected, is the influence of fathers' perception of legal proceedings and rules on their contact with their children post divorce. This study aimed to explore the underlying concepts of satisfaction and examine fathers' perception of satisfaction in relation to their experience with the Family Court of Western Australia. This was done by utilising qualitative research methodology. Twenty·four fathers were interviewed using an interview schedule adapted from Tyler (1988). Results from the present study indicated that fathers' satisfaction was primarily influenced by a favourable outcome in relation to contact with their children. Factors found to result in dissatisfaction included fathers’ feelings that their father role had been eroded, a perceived bias by the family law system in favour of the mother, and a lack of legal assistance and limited availability of legal personnel. In order to clarify a number of issues, a subset often fathers from the original sample were re-interviewed. Further analysis confirmed that fathers' unresolved issues in relation to their separation; strong emotions including anger and distress during the court process; and unrealistic expectations in relation to contact with their children, made dissatisfaction with the legal system, and in particular court outcomes, more likely. This research suggests that early intervention for fathers is needed to allow them to address any unresolved issues surrounding their separation, and the emotions such as anger and grief that often follow separation. Services, which provide legal assistance and direction prior to entering and during legal proceedings, also appear to be necessary.

The subject of this thesis is a comparison of the law, practice and procedure relating to divorce among Muslims and non-Muslims in Malaysia. This study analyses divorce in the predominantly urban society of the Federal Territory of Kuala Lumpur against the background of changes in the social structure, the family and social norms, with the aim of clarifying of how and why contemporary divorce needs to be rethought and reformed. Structurally, the thesis is divided into three parts. Part 1, consisting of three chapters, is introductory, and covers the historical and legal background necessary for the proper appreciation of the topics discussed later. Part 2 is an analysis of divorce statistics for Muslims and non-Muslims in the Federal Territory of Kuala Lumpur and an identification of factors related to it. The discussion of statistical trends and social influences is placed in a smaller context to permit the statistical information analysed in the present study to be refined at the local level. Part 3, the concluding part, consists of two chapters, and deals with reforms that have taken place in other countries that could serve as models for the reform of divorce laws in Malaysia. Among the areas that are touched are legal reforms to protect women, grounds for divorce under Islamic law and civil law, and also the setting up of family courts and systems of conciliation.

The purpose of this research was to investigate the interrelationships between marital adjustment, group commitment, religiosity and attitude to divorce in the Jewish group. It amounted to a within group empirical study of the Jewish community of Cape Town. Research, to date, has focused on marital stability where researchers have found that Jews have lower divorce rates than the general population. The present study attempted to assess the psycho-social outcomes of group commitment in the form of marital adjustment, thus bridging the gap between marital quality and marital stability in the Jewish group. On a wider level, the purpose of this research was to assess whether a social structural framework, utilizing the concept of social integration, is a perspective that can be used in explaining variations in marital adjustment. The following were the findings of the research : Religiosity was correlated to group commitment but not to marital adjustment; group commitment was correlated to marital adjustment; a negative attitude to divorce was not correlated to marital adjustment, group commitment or religiosity.

Mais la réglementation législative de cette institution cache un consensus entre les deux courants : conservateur traditionaliste et celui favorable à la promotion des droits de la femme, ce qui ne manque de se répercuter sur la pratique jurisprudentielle et l’appréhension doctrinale de la procédure de divorce et menace l’existence même des motifs classiques de divorce voire de la répudiation
Restoring the equality disrupted between spouses is one of the big issues which motivated the claims to reform the family code in Morocco.The new divorce on the ground of discord is to grant women the right to free herself from the marriage bond without providing a cause, same as the right of men of repudiation.The discord procedure, which is purely religious, aims at answering the religious terms of reference and restoring the equality between men and women when the marital bond is terminated.However, the legislative regulation in this institution hides a consensus between the two parties: conservative and traditionalist vrs the one in favor of promoting women’s right. [Truncated abstract] The 1974 Indonesian Marriage Law required all divorces to be ratified by courts and vested household leadership with husbands. This thesis examines the impact of this law upon the negotiation of divorce, and its implications for the constitution of state and social power. I argue that the New Order state used this law to attempt to control gender relations and reinforce political legitimacy, but that women and men resisted this project in a variety of ways. Divorce may entail the contestation of state ideological prescriptions on gender. It also reveals gender relations operating independently of the state. As such, it is a particularly fruitful site for an analysis of the location and constitution of state and social power.
