Abstract:
The first cultural influences come out in Dobruja together with the appearance of the first German colonists, beginning from 1840 till 1891. The colonization process develops itself in three stages and colonies in places like Tulcea, Malcoci, Almagea, Ciucurova, Cogealac, Tariverde, M. Kog?lniceanu and others set up as a result. The German population has created an original culture, an ethnic and spiritual communication being deeply set up, but at the same time a communication struck by the specific conditions imposed by the history of this south-eastern European area. On the other side, the Turkish invasion of Dobruja started earlier, in 1388, when it was actually defeated by Mircea cel B?trân. In 1393 the Turks succeeded in taking Dobruja and Silistra, but in 1404 Micea cel B?trân re-conquered the greatest part of these regions. Many Turkish and Tartars moved into Dobruja during the long period of Ottoman rule. The 19th century ethnographic maps show a mainly Turkish population in the area of modern day Dobruja, Tartars and Turks in the southern part of Dobruja and Romanians dominating the north of Dobruja. The paper aims at presenting aspects regarding these two different identities and cultures which are to be found in Dobruja, as well as their integration process within the Romanian Dobrujan modern society.

Abstract:
A sensitive topic for decades (for ideological reasons), Dobruja is still a challenge for many Romanian and Bulgarian historians. A peripheral and hardly populated region, this territory lying between the Danube and the Black Sea became the major source of dispute between Bucharest and Sofia at the dawn of the last century. After 1878, legal history and statistics were the pillars of the new identity of this former Ottoman territory di?vided between Romania and Bulgaria, as a result of a decision made by the Great Powers. In order to meet the specific requirements of young national states, Dobruja underwent a colonisation process (whose intensity differed in the two parts of the region). Ethnic diversity caused much concern, particularly in the critical moments that endangered the relations between the two neighbouring countries. The Balkan Wars represented the moment when the Dobruja question officially emerged. Romania?s decision to annex South?ern Dobruja would traumatise Bulgarian society, which would look forward to retaliating. This moment occurred earlier than many Romanian politicians expected. The spirit of revenge explains why the fighting on the Dobrujan front was so intense in the autumn of 1916. Dobruja was the first province of the Romanian Kingdom that fell under the Central Powers? occupation. The documents stored in Romanian archives are too few to make it possible to accurately reconstruct the history of this province during its military occu?pation by the Central Powers. This is not an easy challenge: Romania, Bulgaria, Russia, Serbia, Germany, Turkey and Austro-Hungary were in some way involved in the events in Dobruja in the autumn of 1916.

AbstractLarge numbers of Aromanian immigrants in Southern Dobruja joined the fascist Legion of the Archangel Michael during the early 1930s. Deterritorialised by population transfers and state-building in Greek Macedonia, they reterritorialised themselves as ethnic Romanians ‘coming home’ to colonise Southern Dobruja. This article situates the Aromanian turn to fascist politics within the problems they faced during migration. It argues that Aromanians used fascism to assert their identities as Romanians and to claim ethnic privileges that had been denied them as immigrants.

Abstract:
In July 2020 we analyzed the terrestrial isopod assemblages from different (mostly abandoned) railway constructions in Dobruja, eastern Romania. We identified 10 terrestrial isopod species, of which the most abundant and frequent were Porcellionides pruinosus (Brandt, 1833) and Armadillidium vulgare Latreille, 1804. We identified species that, in Romania, are present only in Dobruja: Leptotrichus pilosus Dollfus, 1905 and Trachelipus squamuliger (Verhoeff, 1907). Most of the species are common, generalist or synanthropic, connected to dry and open habitats. In abandoned railway-stations the number of species/samples was low (at most two), but at the base of a stone railway bridge in Babadag forest six species were found.

Abstract:
The geochemistry of rhyolites uncovered at shallow depth by a borehole on the Kiliya-Zmeinyi uplift of the Black Sea northwestern shelf northeast of Zmeinyi island, in the junction zone of the East European platform and the Scythian plate, has been studied for the first time. This zone is considered by many geologists and geophysicists as a Late Paleozoic collisional suture that had been formed due to subduction of oceanic crust of the ocean, which adjoined the East European platform from the south, under the Scythian plate; it is traced from Dobrudzha to the Caspian Sea and named North Crimean. To check the subduction nature of the boundary between the East European platform and the Scythian plate, igneous rocks’ geochemical characteristics beeng indicators of various geodynamic regimes were used. A petrogeochemical comparison of rhyolites from the borehole in Zmeinyi area with acid igneous rocks known nearby has been carried out, namely with: 1) Late Permian subalkaline granites and rhyolites Turcoaia of the Macin zone of Northern Dobruja; 2) Triassic and / or Triassic-Jurassic trachyrhyolites and rhyolites of the Tulcea zone of Northern Dobruja and the Tatarbunar complex of the Pre-Dobruja depression. Some acid rocks of various ages and genesis from the southernmost margin of the Scythian plate (southwestern Crimea on- and offshore) were taken additionally for comparison. According to the distribution of rare earth elements, the position on the discriminant geochemical diagrams and the shape of curves on the multicomponent spider diagrams, the rhyolites of the Kiliya-Zmeinyi uplift exhibit not subduction but intraplate geochemical features closest to those of granites and rhyolites Turcoaia of the Macin zone of Northern Dobruja. Considering that the latter are reputed to be Late Permian, one can assume the same age for the rhyolites from the borehole in Zmeinyi area. Taking into account section features, geophysical information and geochemical similarity of magmatism, Kiliya-Zmeinyi uplift of the northwestern shelf seems to be a continuation of the Northern Dobruja structure into the Black Sea; it was a part of the hypothetical Late Paleozoic Euxinian orogen near its northern boundary. An absence of subduction geochemical properties in the studied presumably Late Permian rhyolites indicates that the junction zone of the East European platform and the Scythian plate in the Ukrainian shelf area is not a Late Paleozoic suture, but rather represents a thrust of the Euxinian orogen.

Abstract:
Southeast Europe has played an important role in shaping the genetic diversity of sheep due to its proximity to the Danubian route of transport from the Near East into Europe, as well as its possible role as a post-domestication migration network and long tradition of sheep breeding. The history of Romania and, in particular, the historical province of Dobruja, located on the shore of the Black Sea, has been influenced by its geographical position at the intersection between the great powers of the Near East and mainland Europe, with the Middle Ages being an especially animated time in terms of trade, migration, and conflict. In this study, we analyzed the mitochondrial control region of five sheep originating from the Capidava archaeological site (Dobruja, Southeast Romania), radiocarbon dated to the Early Middle Ages (5–10th century AD), in order to better understand the genetic diversity of local sheep populations and human practices in relation to this particular livestock species. The analyses illustrate high haplotype diversity in local medieval sheep, as well as possible genetic continuity in the region. A higher tendency for North to South interaction, rather than East to West, is apparent, together with a lack of interaction along the Asian route. Continuous interaction between the First Bulgarian Empire, which occupied Dobruja starting with the 7th century AD, and the Byzantine Empire is indicated. These results might suggest expanding trade in Southeast Romania in the Early Middle Ages.

Abstract:
The festivals in honor of Jupiter, celebrated in the Roman province of Lower Moesia, have not been studied extensively. Fourteen precisely dated Latin inscriptions have been analyzed for this purpose. The 13th of June is defined as a fixed feast in the calendar of vicus Quintionis, and probably to one more village in Northern Dobruja. Most of the monuments were dedicated on different days and it is impossible to determine whether they were consecrated on a holiday in honor of the god. Some villages in Dobruja, such as vicus Secundini, vicus Clementiani and vicus classicorum performed regular, perhaps even annual dedications to Jupiter, but the day of the consecration of the altars is not specified in the inscriptions. The cyclic recurrence of this act presupposes observance of a certain holiday calendar with a fixed festival of Jupiter.

Abstract We studied various aspects regarding migration behavior of the Common Buzzard for two subspecies (B. b. buteo and B. b. vulpinus) transiting the region which overlaps with the Western Black Sea Corridor. Using vantage points set across Dobruja we managed to count 2,662 individuals. We highlighted the seasonal and diurnal peak passage, flight directions and height of flight for each season. Our results suggest that 57% of the counted individuals belongs to long-distance migrant Steppe Buzzard - B. b. vulpinus. The peek passage period in autumn migration was reached between the 26th of September to the 6th of October, while for the spring migration peek passage remained uncertain. The main autumn passage direction was from N to S, and NNW to SSE but also from NE to SW. For spring passage the main direction was from S to N but also from ESE to WNW. Flight height during autumn migration was mostly at high altitude while in spring migration was more evenly distributed. The most significant activity was recorded in the second time period, between 10:01 and 13:00 (43%).

Abstract A number of spider species were collected in 2011 and 2012 in various microhabitats in and around the village Letea (the Danube Delta, Romania) and on the Bulgarian Dobruja Black Sea coast. The results are the start of a proposed longer survey of the spider fauna in the area. The genus Spermophora Hentz, 1841 (with the species senoculata), Xysticus laetus Thorell, 1875 and Trochosahispanica Simon, 1870 are mentioned in the Romanian fauna for the first time. Floronia bucculenta (Clerck, 1757) is at the first record for the Bulgarian fauna. Diagnostic drawings and photographs are presented.

This article conduct an analysis of ethnocultural stereotypes of the Steppe Crimean Tatars and Dobruja (Romanian) Tatars based on proverbs of the turn of XIX and XX centuries. The subject of this research became the Kipchak Crimean Tatar paremiological fund of that period. The goal consists in an accurate, tolerant elucidation of the topic. Initially, the stereotypes are divided into auto-stereotypes, which is an outlook upon the own ethnic group; and hetero-stereotypes, which is the representations on a neighboring ethnos. The first ones, being an inseparable part of national identity, are prone to exaggeration of merits of their ethnos and carry a complementary character. This fact impedes a realistic assessment of the merits of neighboring ethnos, which is compared to the own in accordance with cultural values. The determined differences serve as a foundation for hetero-stereotypes, which usually belittle the positive sides of the other national portrait. The scientific novelty consists in examination of ethnocultural stereotypes based on proverbs of the turn of XIX and XX centuries. Which contributed to fuller understanding of the mentality of Crimean Tatars and Dobruja (Romanian) Tatars being a diaspora of Crimean Tatar ethnos. Paremiological material allowed dividing the stereotypes into auto-stereotypes and hetero-stereotypes. The research results offered an opportunity to determine and explore the ethnic composition of Crimean Peninsula of the turn of XIX and XX centuries.

Zajączkowski was a historian and turkologist who was interested not only in language and literature but also in traditional culture, which was not so popular among colleagues of his own generation. He conducted ethnographic research among Turkish peoples in a very professional manner. The most important of his works concern the Tatars of Dobruja and the Gagauz people. His main monographs are dedicated to these two groups, their language, literature, traditions and rituals. Today, Zajączkowski’s works are extremely valuable and unique.

Eriogaster catax is a highly threatened species listed on the Annexes II and IV of the Habitats Directive and on the Annex II of the Bern Convention. In Romania, up till now, it was reported only from Banat, Crișana, Satu Mare county, Transylvania and southern Dobruja. A male attracted by a light trap installed near Olteni, Dâmbovița county, in mid-October 2018, has scored the first record of this species in Muntenia. Afterwards, larvae have been found in the same place, confirming the first, adult-based finding.

Only two species of Chthonius (Ephippiochthonius) (Chthoniidae) are presently known from Dobruja, Romania. Among these one should mention Chthonius (Ephippiochthonius) tetrachelatus (Preyssler) (not endemic) and C. (E.) scythicus Georgescu & C?pu?e (endemic). A new cave species belonging to the genus Chthonius - Chthonius (Ephippiochthonius) borissketi Curcic and Sarbu n. sp., is described from a well nr. Movile Cave, Mangalia, Romania and is endemic to the area studied. Its taxonomic relationships with phenetically close congeners, as well as its comparative morphological traits, are described in detail.

The article defines the topicality of the ongoing study of the collection “Rare books with bookplates, inscriptions, and marginalia with the name of Fedir Vovk” from the Library Fund of the National Museum of the Ukrainian History as the source base for ethnology, ethnography, local lore, and Ukrainian studies. It characterizes the object of the research – Fedir Vovk’s scholarly investigation of Ukrainians in Dobrudja (the historical and geographical region between the Lower Danube and the central part of the Balkan Mountains in Bulgaria and Romania), which he conducted during his forced political emigration to Romania in the 1880s. The research is performed by the de visu method and based on two main sources – rare books, including the monograph “Transdanubian Sich (local memoirs and stories)” (1883) and the article “Ukrainian Fishery in Dobrudja” (1899). The research tasks that combine Ukrainian and book studies are based on the relevance of the discussion and its interdisciplinary sense. It has been generalized that the past of the Ukrainian community of Dobrudja can be illustrated in a certain diversity of its history and traditions, although relying on a very narrow historiographical basis besides Fedir Vovk’s research. It has been observed that Fedir Vovk did not only dedicate almost 10 years of his scholarly work to the search, collection, and preservation of the historical memory of his compatriots abroad but also aimed to find the traces of Zaporizhzhian Cossacks military (administrative) centers to study their memory about homeland, way of life, and traditions in a new complex local geographical, social, and political context. The article outlines the research prospects in the context of the mission set by bibliologists, historians, and experts in Ukrainian studies to develop “Professor F. Vovk’s Memory Department”, which was founded in the 1920s by his associates and suspended by the Great Terror.

Abstract In the present article, three spider species are presented as new faunistic elements for Romania: Oecobius maculatus Simon, 1870, Agelena orientalis C. L. Koch, 1837 and Scotolathys simplex Simon, 1884. Out of the three, O. maculatus, by its presence, also raises the count of the spider families known to occur in this territory to 36. O. maculatus appears to be, in Romania, an anthropicdependent element. A. orientalis is a relatively widespread species, rather difficult to distinguish from its sibling species A. labyrinthica, and because of this frequently mislabeled in collections. S. simplex is a rarer Mediterranean element found in Dobruja, close to the Black Sea coast. A case is made in support of an updated Romanian spider checklist.

The paper summarizes all scattered data from the last 116 years on the distribution of the Late Pleistocene cave hyena in Bulgaria, a part of them unpublished. Data from 24 fossil sites (Middle Pleistocene – Late Pleistocene) in the country are presented. The fossil record in Bulgaria proves the wide distribution of the species in the karst areas of the low-mountain regions of the country. Its Pleistocene localities are concentrated in the Predbalkan Mts. (83%), Strandja Mts. (8%), Western Rhodopes Mts. (4%) and southern Dobruja Plain (4%). They are situated at the altitudes between 136 and 1250 m a.s.l., about 75% of them at 136–400 m a. s. l. All (except one) Bulgarian sites represent former human dwellings, which indicates competition between man and this carnivore for the cave spaces.

We analyzed the compositions of mineral pigments for some ceramics and glass items excavated from the commercial settlements on Danube at the border between Ottoman Empire (Dobruja) and Romanian Principalities — Piua Petrii and Dinogetia–Garvan, using external milli-beam PIXE. The problem of mineral pigments used for Turkish ceramics (16th–17th centuries) is very important for the understanding of commercial routes of late medieval period. We determined the elemental compositions of green, red, brown and especially blue pigments. The most interesting case is the one of the Co-based blue pigments. The origin of the raw materials for these pigments in the 17th century could be the mining district of Schneeberg in Germany, characterized by the presence of Ni traces, our study revealing a possible trade route connection between Saxony and Ottoman Empire. As concerning glass samples, we analyzed fragments of Byzantine painted bracelets identifying manganese (mixed with iron) and copper for blue–black bulk-glass color, respectively for green bulk-glass color, a mixture of lead and tin for yellow painting and powders of gold and silver for some painted areas.

The paper summarizes numerous scattered data from the last 120 years on the former distribution of the brown bear (Ursus arctos) in Bulgaria. Data from 52 (13 fossil and 39 subfossil) sites (from the Middle Pleistocene to the 19th century AD) are presented. The brown bear former distribution was much wider than the present occurrence. The species range covered the whole territory of the country, including mountain regions, as well as vast lowland and plain landscapes. The geographical, altitudinal and chronological distribution are presented and analyzed. The record from the Kozarnika Cave (1.000,000–700,000 years BP) is one of the earliest records of this species in Europe. About 73% of the localities are situated between 100 and 500 m a. s. l. Twelve sites contain Paleolithic finds, one Mesolithic, 14 Neolithic, six Chalcolithic, five from the Bronze Age, and two from the Iron Age. The remaining 12 subrecent sites are dated to the last ca. 2,400 years. Most of the species findings came from archeological sites – prehistoric and ancient settlements. The distribution of Ursus arctos once covered the entire territory of the country, including the vast regions such as Ludogorie, Dobruja, the Danube Lowland, the Upper Thracian Lowland, as well as the Sakar, Strandja, Sredna Gora, and the Predbalkan Mts.

Romania is presently located in the eastern part of the Balkans and constitutes the largest piece of land in the Balkans. Romania and Romanian people have been engaged in linguistic and cultural relationswith Turkish tribes such as Huns, Pechenegs, Tatars, etc., in recent history for centuries.This common culture continues to live on in the Dobruja region of Romania. Romania was established after Wallachia and Moldovia left the Ottoman Empire in 1878. In a modern sense, studies on Turkisms in Romanian have begun since Jihac (1879),and many studies have been carried out in about a century and a half since then. Relevant sources were gatheredand classified to gain a collective perspective from these studies. All studies,such as articles, proceedings, Ph.D.dissertations, etc., were compared in the tables according to criteria such as country, city, language, and the researcher’s nationality. A total of 273 studies, including over 70 studies that act as the source for the transition of Turkism into Romanian and Turkism studies and 203 studies directly or indirectly related to Turkism in Romanian, was listed in references. The listed studies were presentedwithina four-step(identification, classification, analysis,and reclamation)and 53 subtitled frame,and the results obtained were interpreted.

Abstract In the 1 9th century the long-legged buzzard bred in the Balkan Peninsula only in Greece. From the first half of the 20th century it began to expand to the north, and at the end of 201 2 the northern boundary of its breeding expansion in south-eastern Europe extended to central Hungary, south-western Romania, Romanian Dobruja, the southern half of Ukraine and along the western border of Kazakhstan. In the work are 232 faunistic data on the occurrence of the species on the territory of Slovakia from the year 1 870 to the end of 201 2. In the period from 1 911-1 950 only 7 cases were found here; from the period 1 951-2000 43 observations exist, and for the short period from 2001-201 2 there are as many as 1 80, of which 98 occurred in the year 201 2 alone. The text in particular evaluates the invasive occurrence of the species in 201 2 in Slovakia and its neighbouring countries (Austria, Czech Republic and Poland). Given this increasing trend in the frequency of occurrence of the long-legged buzzard in Slovakia, its breeding on the territory of Slovakia in the near future can be anticipated, though by the end of 201 2 this had not yet to be confirmed.

Abstract The study represents a synthesis about the distribution of the species from superfamily Chrysomeloidea in Dobruja (Dobrogea) region (South-eastern Romania). 407 species from 132 genera and 15 subfamilies are recorded, based on the published data and on the study of material preserved in the collections of the “Grigore Antipa” National Museum of Natural History (Bucharest) and the Institute of Biology Bucharest of the Romanian Academy. The species Lilioceris lilii (Scopoli), Oulema erichsonii (Suffrian), Euluperus cyaneus (Joannis) and Altica quercetorum quercetorum Foudras are mentioned for the first time in fauna of Dobrogea. Some endemic species are highlighted: Vadonia hirsuta (K. Daniel & J. Daniel), Dorcadion equestre transsilvanicum Ganglbauer, D.gashtarovi Sama, Dascălu & Pesarini, D. axillare Küster and Brachyta balcanica Hampe. Rosaliaalpina alpina Linnaeus, Morimus asper funereus Mulsant and Cerambyx cerdo cerdo Linnaeus are protected species, included in the annexes of the Council Directive 92/43/EEC on the conservation of natural habitats and wild fauna and flora. Also, Brachyta balcanica Hampe, Pedostrangaliaverticalis Germar and Neodorcadion exornatum (Frivaldsky von Frivald) are species of national interest requiring strict protection, listed in the Government Emergency Ordinance no. 57/2007 on the regime of natural protected areas, the conservation of natural habitats, wild fauna and flora. The life and work of father Nicholai Velimirovich (1880–1956) is a limitless historical source, which has been encouraging, for the past 100 years, various researches in the Serbian, English, and other languages around the world. Velimirovich, as a person, and his numerous writings can be viewed from different aspects. This article, that is dedicated to father Nicholai Velimirovich, is an attempt to highlight his mission and role in the Great Britain during the First World War. In order to better understand the importance of his mission, we have described the establishment and operation of the Serbian Relief Fund, the Committee of the Serbian Red Cross Society, and the Scottish Women’s Hospitals in their medical and humanitarian missions for the Serbian people in the Great War. Apart from the significant role of father Nicholai Velimirovich, we remember many other great humanists and humanitarians working with and within these various medical and humanitarian missions. With their unforgettable achievements they helped treat people. and to mitigate the terrible suffering of the Serbian people during the great epidemic of typhus in Serbia, and during the great Exodus through the rugged Albanian mountains, during the exile on Corfu, at the Salonica Front, North Africa, Corsica, and France, as well as on the Russian Front, and in Dobruja and even after the Great War. As a representative of the small Serbian nation, father Nicholai Velimirovich held arousing speeches, religious sermons, and wrote numerous literary religious writings, and thereby he confirmed that in the midst of wartime conflagration it is possible for great humane achievements to appear. That is why that impressive spiritual dimension of the mission, which included father Velimirovich and his contemporaries, did not cease to continue to inspire historians, writers and other authors — in the past, present, and the future.

Cilj je ovoga rada pokazati da Toma Akvinski problem zla promišlja ne samo kao pitanje zla u njemu samome nego i u puno širem kontekstu Božjeg stvarateljskog djela i providnosnog upravljanja te na taj način dokazuje da činjenica postojanja zla u svijetu nije održiv argument protiv Božjeg postojanja. Naime, za Tomu Akvinskog zlo nije nešto, nekakvo biće sa svojom biti i naravi, nego je ono lišenost dobra, nedostatak onoga dobra koje je neko biće po naravi dužno imati. Zlo ima dobro za svoj subjekt, objekt i uzrok, a može na koncu imati i dobro kao svoj učinak. Takva potpuna uronjenost i ovisnost zla o dobru kazuje da je ontološki status zla s jedne strane realan, a s druge strane da nije apsolutan. Zlo ne može postojati od sebe, po sebi i za sebe. Ono je pod svakim vidom podređeno dobru. Takav statuszla postaje još očitiji u Akvinčevu osvrtu na odnos zla i apsolutnog dobra koje je Bog. Bog je onaj koji jest u apsolutnom smislu, a zlo postoji samo u odnosu na dobro koje je Božje stvorenje. Propadanje stvari je tek posljedica Božjeg stvaranja dobrog svijeta u kojemu postoje bića koja mogu biti deficijentna u dobru, što ona ponekad i jesu. To znači da Bog ne želi zlo, nego ga na neki način dopušta dok sve providnosno upravlja k dobru koje je on sam. Naime, Bog je toliko svemoguć da dopuštajući zlo može ostvariti i veća i brojnija dobra. U djelu Božjega upravljanja svijetom čovjek zauzima posebno mjesto jer je sposoban za osobni odnos s Bogom. No čovjek se slobodnom voljom može i odmetnuti od poretka i pravila koji ga vodi sjedinjenju s njegovim krajnjim dobrom koje je Bog. Takav čin se naziva moralno zlo krivnje ili grijeh. Toma Akvinski primjer i uzor pobjede dobra nad zlom nalazi u liku pravednog i nevinog Joba koji je, upravo zahvaljujući iskustvu strahovitoga zla, shvatio da Bog beskrajno transcendira ljudsku spoznaju, bitak i moć, te da bi svako pripisivanje zla Bogu bilo ludost, a svako nijekanje Božjega postojanja zbog zla koje ga je zadesilo bezumlje. Job je shvatio da Božja pravednost i logos vladaju svime i da je konačna pobjeda dobra sigurna.

Autor rozważa możliwość akceptacji dobra wspólnego jako elementu wewnętrznego ustawy do ustawy kanonicznej. Przedstawia rozumienie dobra wspólnego w filozofii i naukach społecznych oraz w nauce społecznej Kościoła. Wskazuje na wypowiedzi Pawła VI i Jana Pawła II, którzy mówili o dobru wspólnym we wspólnocie Kościoła. Autor stwierdza, że istnieje możliwość akceptacji dobra wspólnego jako elementu ustawy kanonicznej. Odwołuje się w tym do Tomasza z Akwinu i jego rozumienia dobra wspólnego jako wspólnej przyczyny celowej działania. Istotą dobra wspólnego jest bonum communionis. Tak rozumiane dobro wspólne nie traci swojego miejsca w definicji ustawy kanonicznej, gdyż, jak stwierdził Jan Paweł II posłuszeństwo normom kanonicznym przyczynia się do wzrostu wspólnoty kościelnej.

U radu se analiziraju međunarodna, europska i hrvatska pravila u području prometa kulturnim dobrima te se autori kritički osvrću na činjenicu kako ona nisu prepoznala važnost stvarnopravnih mehanizama u borbi protiv nezakonitog prometa kulturnim dobrima. Ukazuje se na važnost privatnopravnih mehanizama u borbi protiv nezakonitog prometa kulturnim dobrima. Razmatra se problem izvoza kulturnih dobara u treće države i reakcije EU-a na iračku i sirijsku krizu u pogledu uvoza kulturnih dobara. Raspravlja se o novim mjerama EU-a u pogledu regulacije uvoza kulturnih dobara iz trećih država kao dijelu sveobuhvatne agende u borbi protiv fi nanciranja terorizma. Autori se osvrću na postojeću regulaciju unutarnjeg prometa kulturnih dobara u kontekstu slobode kretanja robe, te se analiziraju ograničenja pravnog prometa kulturnih dobara u hrvatskom pravu. Zaključuje se kako je hrvatski režim prometa kulturnim dobrima stvorio dobar okvir za borbu protiv krijumčarenja kulturnih dobara te on već sada doprinosi antiterorističkoj politici EU-a, ali i to da ima prostora za poboljšanja, posebno u privatnopravnoj sferi. Pritom se problematiziraju pitanja odabira načela lex rei sitae kao stvarnopravnog statuta za kulturna dobra, kao i pitanja vezana uz tradicionalne institute stjecanja od nevlasnika i dosjelosti. U radu se iznosi nekoliko preporuka i za budući sustav zaštite kulturnih dobara u uvozu.

Po pierwsze, dobro wspólne zasadza się w uznaniu godności człowieka; po wtóre, udaremnienie realizacji dobra wspólnego przez prawo i państwo jest podważeniem godności ludzkiej osoby; po trzecie, położenie akcentu na podmiotowość człowieka (jego godność) oraz przyporządkowanie instytucji społecznych dobru wspólnemu pozwala na odróżnienie tego, co jest celem działania państwa, a co środkiem do niego prowadzącym.

The end of the age of revisionism – 1945 in the journal Carkoven vestnikThe main purpose of this article is to show a Bulgarian political and cultural memorial space from the perspective of the Orthodox Church, which is emblematic for the Second World War. In my work I analyse publications which appeared in the journal Carkoven vestnik between 1940 and 1944 concerning the religious, historical, political and social issues of the time. It is not my intention to deal with the religiosity of the Bulgarian people during this difficult period, even though the source material would suggest it. The idea is to reconstruct the attitudes of the Orthodox Church to the main contemporary ideologies and policies pursued by government of Tsar Boris III. I analyse the position of the Orthodox Church, which on the one hand stresses its role as the spiritual centre of Bulgarian society, and on the other as an institution serving national interests. I pay particular attention to the role of the „Great Bulgaria” myth and the age of revisionism, nurtured in the Church, in context of German assistance in regaining the territories lost after the First World War and Balkan wars. I present a detailed historical record of the annexation of Dobruja. All studies are placed in the broad social and cultural context of the age, as well as the context of local cultural texts. I base my analysis on the typology of Eric Voegelin, who showed Gnostic political influences in his works The New Science of Politics and Hitler und die Deutschen. Koniec epoki rewizjonizmu – rok 1945 w publikacjach gazety „Църковен вестник”Na łamach gazety „Църковен вестник”, będącej oficjalnym organem Bułgarskiej Cerkwi Prawosławnej, w czasie II wojny światowej publikowano teksty o treściach wyraźnie inspirowanych ideologią narodowosocjalistyczną, jednoznacznie wskazujące na polityczne zaangażowanie, wiążące interesy Cerkwi i państwa. Artykuł miał na celu pokazanie środków perswazji, jakimi posługiwała się ta jawna propaganda oraz stopnia zależności oficjalnego sta­nowiska Cerkwi od koniunktury politycznej w kraju i Europie. W refleksji na ten temat użyto terminologię zaproponowaną przez Erica Voegelina, autora takich pozycji jak Hitler und die Deutschen czy Nowa nauka polityki, ze szczególnym uwzględnieniem szeroko omawianych przez autora gnostyckich inspiracji „odnowy świata”. Do przybliżenia złożoności problemu relacji kościelno-politycznych w Bułgarii oraz do przedstawienia wpływu haseł bułgarskiego rewizjonizmu terytorialnego na działania Cerkwi posłużyła analiza publikacji gazety kościelnej odnoszących się do aneksji Dobrudży Południowej.

Filozofia dialogu przywróciła dialogowi właściwe miejsce w kulturze. W ostatnich dekadach dialog nie tylko, że przestał być inkryminowany, ale powszechnie uznaje się go za wartość, której urzeczywistnianie nadaje właściwy kształt kulturze. Jedną z dziedzin kultury jest moralność. Kultura dialogu w obszarze moralności nakierowuje podmioty ludzkie na osiąganie dobra godziwego, tworzy sprzyjający klimat dojrzewania przez moralność do pełni człowieczeństwa. Jednakże dialog w obszarze moralności zależy od przyjmowanych bazowych teorii etycznych. Współcześnie silne oddziaływanie woluntaryzmu etycznego, jako podstawowej teorii wyjaśniającej powstawanie porządku dobra, skłania do badania możliwości tworzenia kultury dialogu w kontekście woluntaryzmu etycznego. W niniejszej pracy wysuwa się hipotezę, iż woluntaryzm etyczny nie tworzy kultury dialogu, zamyka uczestników wspólnego myślenia na prawdę o rzeczywistym dobru, uruchamia proces totalizowania się społeczeństwa. Konfirmacja wysuniętej hipotezy jest zasadniczym zrealizowanym celem niniejszej pracy.

Podstawowym prawem wynikającym z dyrektywy Rady 2006/112/WE jest prawo do odliczenia podatku naliczonego, które to prawo może zostać — wyjątkowo tylko — ograniczone przez państwa członkowskie. Zarówno polskie, jak i unijne przepisy nie definiują pojęć „należyta staranność” oraz „dobra wiara”. Pojęcia te są tak zwanymi klauzulami generalnymi i zdefiniowane zostały na potrzeby prawa do odliczenia podatku VAT jedynie w orzecznictwie TSUE. Zapewniają one — przy dokonywaniu konkretnej oceny stanu faktycznego — tak zwany luz interpretacyjny, który pozwala uwzględnić kryteria pozaprawne mające znaczenie w funkcjonowaniu obrotu gospo-darczego. Wydaje się, że nie jest możliwe precyzyjne i zarazem niebudzące kontrowersji w procesie stosowania prawa zdefiniowanie pojęć „należyta staranność” czy „dobra wiara”. Należy postulować rozumienie należytej staranności jako zwykłej kupieckiej, zwyczajowo przyjętej staranności, która związana jest z przekonaniem, że towar czy też usługa nie jest dokonana/wykonana przez oso-bę zamierzającą „obejść” przepisy prawa podatkowego. Podatnik powinien dochować minimum staranności i dobrej wiary przy sprawdzaniu kontrahenta, a nie za organy podatkowe poszukiwać nieuczciwych przedsiębiorców.

Abstract:
Pandemia COVID-19 skłoniła rząd polski do działania, którego skutkiem ubocznym było naruszenie wolności religijnej. Problem głównie dotyczył obostrzeń w ilości osób mogących uczestniczyć w nabożeństwach. Istnieją zastrzeżenia co do konstytucyjności podjętych w dobrej wierze działań. Działanie państwa wiązało się z dobrze uzasadnionym celem. Było ono adekwatne i potrzebne. Wątpliwości budziło arbitralne i nieproporcjonalne narzucanie Kościołowi ograniczeń, co do których zastosowanej skali brakowało jasnego i przekonywającego uzasadnienia. Ponadto sposób wprowadzenia obostrzeń w zbyt małym stopniu opierał się na poszanowaniu autonomii Kościoła. Pandemia wykazała, że oba podmioty powinny wyciągnąć wnioski celem pogłębienia i rozwoju owocnej współpracy na rzecz dobra człowieka i społeczeństwa.

Punih je petnaest godina Lav Nikolajevič Tolstoj (1828. – 1910.) radio na svom jedinom estetskom traktatu Što je umjetnost? (1897. – 1898.) u kojem je zapisao da umjetnost nije pojava neke tajanstvene ideje ili ljepote Boga, ni produkt čovjekove energije ili manifestacija njegovih emocija, već sredstvo za međusobno komuniciranje ljudi, potrebno za život i nagnuće prema dobru svakog čovjeka. Umjetnost je za njega oblik komunikativnog stvaralaštva koje sjedinjuje ljude u istim osjećanjima među kojima se osobito ističe važnost Dobra. Upravo je prenošenje osjećajâ putem simboličkog govora glavna osobina umjetnosti. Cilj je ovoga rada iščitavanje po mnogim mjestima razasutih Tolstojevih stavova o estetici i umjetnosti da bismo došli do vizije po kojoj je umjetnost sasvim osobiti vid ‘potrage-za’, ali i odraz samoga Dobra. Rad je pisan u uvjerenju da obuhvatnije istraživanje Tolstojevih estetskih pogleda može pružiti skroman doprinos ‘rehumanizaciji umjetnosti’.
