From its earliest days, Christianity has debated about when and how force can be used to repel harm without incurring sin. Although moderation and restriction have often been advocated both on a personal and on a social level, strict passivity has rarely been the proposed solution in mainstream Christianity when individuals or nations are confronted with harm. The Just War tradition, in its many variations, was born precisely out of this desire to make sense of how force can be used in a Christian way. And it soon became the prevalent theory throughout Christianity to address issues of violence, war, and force in general. What this thesis intends to argue is that Just War theory, despite all its pervasiveness, is flawed in some crucial aspects when scrutinized from a Christian viewpoint. Three such aspects seem to be especially relevant: Just War tradition is not grounded enough in Scripture; its jus ad bellum and jus in bello criteria do not protect in a satisfactory way the innocent who face harm; and it is a theory that is only reactive to force being imposed upon others. Because of these three flaws, it will be claimed that in the process of giving its support to Just War theory Christianity has largely forgotten an older, broader tradition. The “be angry, but do not sin” tradition has Scriptural and philosophical roots that, when combined, can bring a Christian virtue ethics to a much better understanding of when and how forceful intervention in the social sphere is required. At the very least, this anger tradition does not fall prey to the three criticisms that are addressed towards Just War – and that seems to make it especially valuable. Righteous anger, then, and not Just War, should be what guides Christianity in its thinking about how and when force can be used without incurring sin. That is the contention of this thesis

Full textThe feminist critique is based on the assumption that Niebuhr universally defines the primary sin as pride. It is argued that pride is in fact a distinctly male characteristic, and, while quite plausibly the primary sin for men, is clearly not the primary sin for women. Niebuhr is guilty, that is, of confusing male reality with human reality in the doctrine. Saiving and Plaskow then develop a definition of women's sin which they correspond with Niebuhr's sin of sensuality. This type of sin, rather than being self-aggrandizing, is characterized by inordinate and destructive self-effacement. Their subsidiary argument is that Niebuhr erroneously treats sensuality, which should be equal but opposite to pride, as a secondary form of sin.
My argument in this thesis is that the critique rests on a mistaken assumption about the universality of Niebuhr's claim. His concerns were with the powerful. The contextual claim that pride is the primary form of sin in those who are empowered is being mistaken for a claim that pride is the primary sin for all people, regardless of gender or context. My subsidiary argument is that the correlation of women's sin with Niebuhr's understanding of sensuality is mistaken. What the feminists refer to as women's sin is in fact not sin at all for Niebuhr but evidence of injustice. (Abstract shortened by UMI.)

Full textThe De gratia noui Testamenti (= epistula 140), which is both a treatise and a letter composed by the Bishop of Hippo Regius at the beginning of year 412, presents Augustine’s thoughts on the connections between divine grace and human freedom in a remarkably synthetic way, first because of the circumstances in which it was written, which place it at the junction of very different debates, and secondly because of its originality on a literary point of view, which links it to several genres. This thesis comprises three parts. First, we propose an introduction to the treatise, which presents its main aspects – among which, the historical problems it poses, the literary questions it raises and the insight it offers into Augustine’s way of thinking. Then we have established the edition (which corrects that of the CSEL, which dates from the beginning of the 20th century) and the translation from a study of its manuscript tradition. Finally, our commentary strives to enlighten the debatable passages of the epistle in order to highlight its main historical, literary and philosophical interests

Full textThe doctrine of avoidable loss is a generally recognized principle in Swedish law. The doctrine is often invoked in damage claim disputes of all kinds, and is therefore important in practice. There is plenty of legal literature where the doctrine is treated in the context of sales law and insurance law. On the tort law side, however, there is nothing – this is the first dedicated work on the subject in Sweden. There are many tort cases where the question of avoidable loss is actualized, but due to the way the courts articulate the grounds for their rulings, the cases provide little guidance for the future, and therefore have little value as precedent. This is not necessarily an obstacle to the study. On the contrary, when looking outwards, I have found a wealth of ideas and study material in other areas of civil law, in law and economics, and in foreign law. The structural and methodological framework of the thesis was designed to allow for extraction of material from foreign sources without needing to conduct a thorough (and often uninteresting) comparative study. The main purpose of the investigation was to define the boundaries of the claimant’s liability as imposed by the doctrine. Considering the limited scope of the thesis, it would not have been possible to deconstruct the subject into details and conduct thorough investigations of those. Instead, the work was focused on determining general guidelines, thought patterns and clues; both de lege lata and de lege ferenda. Multiple such guidelines could be defined in various contexts where the doctrine is applied, but also, interestingly, in certain contexts where it is not obvious that considerations of avoidable loss are decisive. Multiple systemic issues have also been found, both in the application of the doctrine and in the underlying norms. I have humbly put forward several suggestions on how these issues could be alleviated to promote legal certainty in the doctrine’s application, both today and in the future.

Full textThis thesis considers South Africa's Nederduitse Gerefonneerde Kerk (NGK) in its journey toward confessional orthodoxy and isolation which began already in the late nineteenth century and continued, through the apartheid era, well into the twentieth. The dates chosen roughly to frame this inquiry (1907 to 1962), however, drive equally toward a particular ecclesial unity. For in 1907, the NGK synods established, out of a desire to cooperate more closely, the Federal Council of Churches (FCC). In 1962 this drive toward ecclesial unity then culminated in the convening of the General Synod, where delegates from all the church's "mother" synods gathered in a single synod for the first time in one hundred years. So united, however, the NGK was, in its ecumenical affiliations, at an all-time low. What were the circumstances within which this unity-in-isolation occurred? In light of the NGK's role in sanctioning and advancing apartheid, this thesis explores Afrikaans church and missionary periodicals and church documents from these years with a view to evaluating what went wrong. More specifically, however, the inquiry is driven by an interest in the complex role of doctrine in hermeneutics and the life of the church. Indeed, this thesis views doctrine as the key to understanding the NGK's journey to isolation and apartheid and asks, how did it function - in the church's ecumenical decisions, internal church matters and even its political involvement during this period? In The Nature of Doctrine1 George Lindbeck offers a metaphor within which to conceive doctrine's role for a healthy church: doctrine is "grammar" for the primary language of Scripture. This thesis employs (with several critical divergences) Lindbeck's theory of doctrine in evaluating healthy and unhealthy dynamics within the NGK. The inquiry is broken into four chapters:1) Lindbeck and the NGK; 2) Ecumenicity and the NGK; 3) Confessional Foundations; and 4) Race Relations and the NGK.

Full textThe subject of this thesis is the study of one of the military doctrine which has had a preponderant role during the cold war for the formation of the french officer until the end of the 50'. The interest of this doctrine, for the political science is central to the definition of the role of the military's relationship with the political power. The study of the institutionalization of this doctrine known as the doctrine of "guerre révolutionnaire" (DGR) inside the french army made thru an analysis of discourse of the main social actors involved in the doctrinal field enlightened several salient points: - the leading role, at the liberation, of General de Lattre, in the formulation of a will to modernize the french military doctrine. This modernization will lead to the integration of behavioural social sciences in the military knowledge and the formulation of the psychological action and warfare. - the heading of "guerre revolutionnaire" expression synthesized the captation of this will of modernization by the colonial infantry and its implementation of the general staff section of psy war during the Indochina and Algeria conflicts. - the codification of this doctrine at the “école supérieure de guerre of Paris, takes place in an atmosphere of political-military tension which provokes conflicts within the doctrinal field. Those conflicts take roots in the will of some officers advocating a more active role of the army in social and political matters. We analyzed also the international aspects of the DGR, pointing out the participation of foreign officers into its elaboration, propagation and applications. A case study demonstrated the technological strength of the french doctrinal discourse in Argentina, hub of the propagation of the DGR thru South America. By this, we have examined the importance of this doctrine during the period 1960-1983 in the establishment of a special type of military dictatorship, pointing out in one hand, the main role played by french military advisors during 1959-1966 period, teaching the DGR at the argentinean army, and in the other hand, the training of argentinean officers at the ESG of Paris between 1952 and 1960

Investiga la importancia que significa la doctrina contable en la formación del contador público, la cual permite mejorar la convicción como la ética y el conocimiento del nacimiento, desarrollo e importancia de la contabilidad como ciencia en el quehacer del ejercicio del contador público de acuerdo a las nuevas exigencias, el nivel competitivo, en el sector gubernamental y privado que así lo exige; por ello, hemos recurrido a la información necesaria, como la visita directa a estudiantes universitarios de la Facultad de Ciencias Contables de la Universidad Nacional Mayor de San Marcos, como a docentes responsables, en la formación académica y sistemas tecnológicos, que se convierten en herramienta en el proceso de su formación, dicha situación permitió verificar los problemas que se presentan en la formación de calidad académica, para el cumplimiento de nuestros objetivos hemos aplicado la metodología de investigación científica. Por ello se ha utilizado la encuesta como técnica para la recopilación de información y documentación en forma directa de estudiantes de los últimos semestres académicos, docentes, autoridades académicas, que tienen relación directa con documentación e información. En la parte teórico-conceptual, se procedió a consultar a diferentes especialistas que ayudaron al conocimiento doctrinario y conceptual. Para el trabajo de campo, se utilizó la técnica de encuesta con su instrumento el cuestionario, conformado por diez (10) preguntas. Finalmente se determinó que la doctrina contable incide favorablemente en la formación del contador público en la Universidad Nacional Mayor de San Marcos.

Full textFormal contacts between the Roman Catholic Church and students of healthcare, especially medical students, either in Catholic Fellowships in Universities (CFUs) under the auspices of chaplains, or in Centres for Mutual Support in Medical Studies run by Jesuits (CMSMSJs), as Laennec Centre in Paris, began in France during the last quarter of the XIXth century. The number of these contacts in CFUs reached a peak in the middle of the XXth century but thereafter suffered a steep decline. This was at a time when the number of medical students had actually increased. In contrast, attendance at CMSMSJs, which admit students irrespective of their religion, remained at a maximal level. This doctoral thesis is based on surveys of 31 CFUs and 3 CMSMSJs in which contacts currently take place. It examines the pastoral, theological and bioethical aspects of these contacts and considers how they might be facilitated. In the CFUs, obstacles to pastoral contact include a general decrease in religious observance and increasing pressures of time on medical students. In the CMSMSJs, attendance by students, whatever their religion, remains maximal owing to the excellent study support provided. However, the pastoral contact with Catholic students is confronted with similar difficulties. Pressure of time remains the main obstacle to discussions on the theology of healthcare (problems relating to sanctity of human life, illness, suffering and death). The same obstacle hinders participation by medical students in discussions justifying Roman Catholic bioethical principles and comparison of these principles with those of other religions. Despite these difficulties, almost impossible to overcome, it is recommended that contacts between these Roman Catholic bodies and medical students should be maintained as far as possible
