Full textThis doctoral dissertation deals with the substantive function of Philology by performing the semidiplomatic transcription of 100 eighteenth-century official documents registered by the chancelleries within the period from 1765 to 1775. This range of official handwritten documents covers examples of the administrative documentation as much the ascendant type (active) as the descendant type (passive) of the governor and captain-general of the captaincy of São Paulo, the Morgado de Mateus. The Morgado de Mateus figures as the author in the active documents and in the passive ones as the interlocutor of the Portuguese Kingdom, which is personified by the superior authority of the King Joseph I. The king is represented by the minister of the Kingdom, the Count of Oeiras (posteriorly, the Marquis of Pombal) and its two secretaries, Francisco Xavier de Mendonça Furtado and Martinho de Melo e Castro. The analysis of the corpus is developed on the basis of the philological, adjective and transcendent functions and supported by the light of auxiliary sciences of Philology: the Codicology, the Textual Criticism, the Diplomatic and the Paleography. Patterns of differentiation of codicologic, diplomatic and paleographic order depict from this sort of approach among the active and passive documents. The opposition between the active and the passive documents (or ascendant and descendant) is also established at the discursive level. The main theoretical premises behind the attempt of identifying different discursive patterns from the corpus are those of the Systemic-Functional Linguistic shared by Halliday and Matthiessen (2004), which consider the language as a web of systems capable of producing significance according to the context in which it is used. The language assumed as an open and dynamic system oriented to the acting and the thinking is employed as much in order to build and communicate human experiences as to negotiate interpersonal relationships involved in communication, accomplishing both metafunctions, ideational and interpersonal. The textual metafunction, as a complement to these, is to be the codification of the texts, as processes of significance in language produced in relation to a given context of situational and sociocultural order. The importance attached to the context by the Systemic-Functional Linguistic designs the lines of historical contextualization to the analysis of the discursive-textual construction and structuring of the corpus. On these grounds, the analysis evidences the interpersonal metafunction by means of the linguistics marks indicating valuation. This study adopts the Appraisal Theory postulated by Martin and White (2005) for the reason of these evidences. In this way, analysis based on theoretic-methodological premises that allow the analytical refining of the subsystems of Attitude, Graduation and Engagement reaffirmed the distinctiveness between the ascendant and the descendant axles of the corpus. Aiming the deepening of the present studies, the documents are classified according to the type of intersubjective negotiation targeted. In addition to the collecting of evaluative resources, by which we envisioned some aspects of the trending intersubjectivity and ideology, this work presents a mapping of the formula inherent to the administrative official documentation. From the outcome of our investigation, carried out through the association of the philological and the discursive perspective, it is provided confirmatory evidence to prove the central hypothesis of this work: the official correspondence analyzed demonstrates the existence of different philological and discursive patterns that are conditioned by factors from sociocultural and linguistic order affecting who writes the documents and also who controls the writing of these sort of papers.

Full textThe present research work was carried out in the « Registro Nacional de Identificación y Estado Civil » (National Registry of Identification and Civil Status - RENIEC) and in the « Archivo General de la Nación » (General Archive of the Nation - AGN) in its capacity as governing body of the National Archives System; having as objective to propose a strategy to improve the conservation of the administrative documents, generated in the RENIEC in the fulfillment of its functions. This work consists of five chapters, as follow: Chapter I: The Theoretical Framework, the fundamental concepts on the subject of investigation are presented. Chapter II: Research Methodology, where a study has been made through grounded theory about archival technical processes and how relevant is the use of technology for the custody and conservation of documents, taking as a study population a sample of twenty (20) people. Chapter III: Data Analysis and Results: the aspects related to the research topic will be analyzed, in order to achieve our strategic objectives. Chapter IV: Discussion of Results: the results of the research are presented, based on the application of the grounded theory. Finally, in Chapter V: Conclusions and Recommendations: conclusions and recommendations are presented regarding the objectives with which it is expected to contribute to the conservation of RENIEC documents.

Full textLa presente tesis doctoral muestra un método para el análisis morfológico y el estudio de las filigranas presentes en documentos administrativos del s. XVIII custodiados en el Archivo Histórico Municipal de Alicante (A.M.A.). Para ello se han estudiado 88 expedientes insertos en el Libro 42, (Armario 1) titulados Órdenes sobre Diputados y Personeros del común y economía y gobierno de abastos de los años 1766-1768. Dichos expedientes pertenecen al grupo documental Órdenes de gobierno y a la serie Privilegios y Provisiones Reales de la Ciudad de Alicante. Para este estudio se ha elegido el Archivo Histórico Municipal de Alicante (A.M.A.) por poseer una documentación muy variada, rica y amplia en documentos de la ciudad de Alicante desde el s. XIII hasta nuestros días. La presente tesis doctoral, más allá de un mero catálogo tipológico y cronológico, pretende realizar un estudio profundo de filigranas que permita abordar la existencia de patrones en un grupo específico de documentos así como determinar el uso que se le dio al papel en su contexto temporal y geográfico específico en función de su tipología documental. Para ello se establecieron una serie de parámetros de registro, la creación de una base de datos, una ficha técnica y además, se ha podido concretar una nueva tipología de filigranas en las obras estudiadas. Esto último se debe a que en el transcurso de la investigación pudo observarse que el pliego de papel podía presentar dos filigranas (ocupando ambas páginas del pliego), siendo complementarias en unos casos y/o diferente en otros. Por ello se ha podido establecer una nueva tipología. La dificultad añadida ha estado en poder establecer criterios de clasificación para un material profundamente heterogéneo a partir del estudio del pliego de papel dado que, hasta el momento, los estudios de las mismas se venían rigiendo por el método tradicional que clasifica la filigrana por motivo, es decir, por hoja individual. Finalmente se han localizado un total de 279 filigranas que -según la clasificación establecida-, se pueden agrupar en 47 Tipos distintos. Esta nueva metodología pretende aportar información más completa sobre las filigranas y el documento que las alberga, así como establecer criterios comunes de clasificación, evitando repeticiones y facilitando la extracción de datos concluyentes, con el fin de abrir el campo de la filigranología a nuevas y futuras investigaciones.

La dificultat afegida ha estat a poder establir criteris de classificació per a un material profundament heterogeni a partir de l ¿estudi del plec de paper atés que, fins al moment, els estudis de les mateixes es venien regint pel mètode tradicional que classifica la filigrana per motiu, és a dir, per full individual. Full textThis study aims at investigating the concept of territory in the national documents of Geography for High School grade levels, PCNEM, from 1999, PCN+, from 2002 and OCEM, from 2006. It starts with a brief contextualization of political, economic and social changes in the 90´s that have influenced the education, mainly in the High School. We analyzed and tried to read the national documents of Geography from a critical point of view looking for particular characteristics of the concept of territory stated in these documents. We tried to know, therefore, the similarities and differences that permeate this concept, so we identified the theoretical lines and the common and singular components in each document, as also the discussion about the concept of territory, which is expanded beyond the idea of State-Nation. The investigation showed the effect on High School brought about by the changes in the productive process, either by the acquisition of basic competences for job opportunities, or by an education throughout a life, not to mention the ideas of competence that permeate the three national documents for High school grade levels which have been analyzed. The research allows the understanding of how the PCNEM and the OCEM enlarge the approach of the concept of territory to other scales, besides the scale of State-Nation while the PCN+ approaches in their board of topics only one scale of State-Nation
O presente trabalho teve o objetivo de investigar o conceito de território nos documentos nacionais de Geografia para o Ensino Médio PCNEM, de 1999, PCN+, de 2002 e OCEM, de 2006. Partimos de uma breve contextualização das mudanças políticas, econômicas e sociais da década de 1990, que repercutiram na educação, sobretudo no Ensino Médio. Analisamos e procuramos ler criticamente os documentos nacionais de Geografia buscando características particulares do conceito de território expresso nesses documentos. Procuramos conhecer, portanto, semelhanças e diferenças que permeiam esse conceito, para tanto, identificamos as linhas teóricas e os componentes comuns e singulares em cada documento, bem como a discussão do conceito de território, ampliada para além da idéia de Estado-Nação. A investigação evidenciou como as mudanças no processo produtivo repercutiram no Ensino Médio, seja por meio de aquisição de competências básicas para o mundo do trabalho, seja por uma educação ao longo de toda vida, bem como o ideário de competências que permeou os três documentos nacionais para o Ensino Médio analisados. A pesquisa possibilitou compreender como os PCNEM e as OCEM ampliam a abordagem do conceito de território para outras escalas, além da escala do Estado-Nação, no entanto, os PCN+, abordam, em seu quadro de eixos temáticos, apenas uma escala de Estado-Nação

Têm-se desenvolvido estratégias e programas de apoio à modernização administrativa com vista a contribuir para o desenvolvimento de uma administração pública moderna, eficaz, eficiente e com qualidade. Atendendo a esta lógica de ação, o presente trabalho de projeto, no âmbito do curso de Mestrado em Gestão e Políticas Públicas, pretende, mediante proposta de implementação de um sistema de gestão documental e workflow, contribuir para a melhoria contínua do processo de desenvolvimento de modelos documentais, com vista a melhorar substancialmente o desempenho e a qualidade dos serviços prestados pela Direção-Geral da Política de Justiça (DGPJ).
Along the last years, one of the main guidelines in Public Administration has been the consistent bet in the simplification and dematerialization of processes, aiming the optimization of the available resources, both human and material. Strategies and support programs to administrative modernization have been carried out in order to contribute to the development of a modern, efficient and qualified public administration. Given to this logic of action, the present project work, in the scope of the Master’s Degree in Management and Public Policy, intends to, upon an implementation proposal of a documental management system and workflow, contribute to the continuous improvement of the development process of the documental models, seeking significant improvement of the performance and quality of the provided services by the Directorate-General for Justice Policy (DGPJ).

Full textIndustrial companies receive huge volumes of documents everyday. Automation, traceability, feeding information systems, reducing costs and processing times, dematerialization has a clear economic impact. In order to respect the industrial constraints, the traditional digitization process simplifies the images by performing a background/foreground separation. However, this binarization can lead to some segmentation and recognition errors. With the improvements of technology, the community of document analysis has shown a growing interest in the integration of color information in the process to enhance its performance. In order to work within the scope provided by our industrial partner in the digitization flow, an unsupervised segmentation approach was chosen. Our goal is to be able to cope with document images, even when they are encountered for the first time, regardless their content, their structure, and their color properties. To this end, the first issue of this project was to identify a reasonable number of main colors which are observable on an image. Then, we aim to group pixels having both close color properties and a logical or semantic unit into consistent color layers. Thus, provided as a set of binary images, these layers may be reinjected into the digitization chain as an alternative to the conventional binarization. Moreover, they also provide extra-information about colors which could be exploited for segmentation purpose, elements spotting, or as a descriptor. Therefore, we have proposed a spatio-colorimetric approach which gives a set of local regions, known as superpixels, which are perceptually meaningful. Their size is adapted to the content of the document images. These regions are then merged into global color layers by means of a multiresolution analysis

Full textThis thesis describes our work in the field of multilingual multi-script complex document image segmentation: case of official documents. We proposed texture-based approach. Two different subjects are presented: (1) document image segmentation; (2) Arabic and Latin script identification in printed ant/ or handwriten types. The developed approaches concern the flow of documents that do not obey to a specific model. Chapter 1 presents the problematic and state of the complex document image segmentation and script identification. The work described in chapter 2 aimed at finding new models for complex multilingual multi-script document image segmentation. Algorythms have been developed for the segmentation of document images into homogeneous regions, identifying the script of textual blocs contained in document image and also can segment out a particular object in an image. The approach is based on classification on text and non text regions by mean of steerable pyramid features. Chapter 3 describes our work on official documents images segmentation based on steerable pyramid features. Chapter 4 describes our work on Arabic and Latin script identification in printed and/ or handwritten types. Experimental results shows that the proposed approaches perform consistently well on large sets of complex document images. Examples of application, performance tests and comparative studies are also presented

Essa dissertação tem o objetivo de discutir o processo administrativo, os procedimentos de protocolo aplicados a ele e seu adequado tratamento técnico-científico. O processo administrativo é, se analisado pelos normativos do Direito Público, a espécie documental mais importante para a Administração Pública Federal. Ao mesmo tempo em que é perceptível sua importância, é notável a ausência de estudos arquivísticos relacionados a essa espécie. Como um documento dotado de características próprias, que se distingue dos outros documentos e exige regras específicas para seu controle, o processo administrativo precisa ser mais bem situado dentro do Programa de Gestão de Documentos. Essa dissertação trata-se de um estudo descritivo, qualitativo e prático. Para estudar o objeto da pesquisa, considerando seus caracteres específicos, esse projeto tem por objetivo a definição dos requisitos para seu tratamento arquivístico, abordando a aplicação e o controle dos procedimentos específicos vinculados a ele (os procedimentos de protocolo) dentro do Programa de Gestão de Documentos, visando garantir a autenticidade, a recuperação da informação e o atendimento aos normativos legais. Para tanto, realizou-se a revisão bibliográfica de obras de: Arquivologia, especialmente aquelas que tratam de Gestão de Documentos; Diplomática e Direito Administrativo, como forma a subsidiar o restante da pesquisa. Nesse aspecto, delimitou-se uma concepção que sintetizou os aspectos identificados do processo administrativo a partir dessas três áreas. Utilizou-se a perspectiva diplomática para identificar as razões de ser do processo administrativo, isto é, sua gênese documental, com a finalidade de destacar a relação entre o que deve vir a ser um processo e a necessidade dos procedimentos de protocolo vinculados a ele. Adicionalmente, a partir da análise documental estudou-se a legislação afeta ao processo administrativo e especificamente os dois últimos normativos vigentes que tratam dos procedimentos de protocolo. A partir desse estudo, foi possível analisar e descrever esses procedimentos e indicar os requisitos para seu devido controle no contexto da gestão de documentos. Constatou-se que os procedimentos de protocolo em geral, inclusive aqueles aplicáveis somente aos processos administrativos, são essenciais para à autenticidade, controle, recuperação e atendimento aos normativos. Se tratando de processos digitais, o controle desses procedimentos é ainda mais essencial para garantir a validade dos processos e dos atos contidos.
This dissertation aims to discuss the administrative process, the protocol procedures applied to it and its appropriate technical-scientific treatment. The administrative process is, if analyzed by the Public Law normative, the most important documentary type for the Federal Public Administration. At the same time that its importance is noticeable, is also possible to note the absence of archival studies related to this specie. As a document with its own characteristics being different from other documents and that requires specific rules for its control, the administrative process must be better placed within the Document Management Program. In order to study it considering its specific characters, this project aims to identify the requirements for its technical-scientific treatment approaching the application and control of the specific procedures related to it (the protocol procedures) within the Management Program of Documents. This is a descriptive, qualitative and practical study. Therefore, it was done a literature review of Archivology, especially those who talk about Document Management; Diplomatics and Administrative Law works as a way of subsidize the remaining research. In this aspect, a conception was delineated that synthesized the identified aspects of the administrative process from these three areas. The diplomatics perspective was used to identify the reasons of being of the administrative process, in other words, its genesis, in order to highlight the relationship between what must become a process and the need for its protocol procedures. In addition, it was studied through documentary analysis, the legislation of the administrative process and most specifically the last two normative that deals with the protocol procedures. From this part, it was possible to analyze and describe these procedures and indicate the requirements for their proper control in the context of document management. It was found that in general the protocol procedures, including those applicable only to administrative processes, are essential for authenticity, control, recovery and compliance with regulations. In the case of digital processes the control of these procedures is even more essential to guarantee the validity of the processes and the acts contained.

Full textA major point in the evolution of the relations between the administration and citizens, the right of access to administrative records, recognized in the united states since 1966, was established in similar terms by the french law of july 17, 1978. Based mainly on an analysis of the american system and on a comparison with the french experience, this research intends to measure the importance and the degree of efficiency of the right of access to administrative records in a western democracy today. After analysing the foundation and origins of this right, it would be necessary to first present its general structure. The conditions which define its field of application, from the point of view of the parties and documents involved, give a first indication of the extent and the limits of openness. The elements of organization of the right give a second indication. To guarantee the efficiency of this new right, certain types of nonjudicial and judicial control are established, revealing in particular the originality of the french system as compared to the american model. In both countries, however, limits are designated to protect legimitate secrecy. Interests of the nation or those of third parties impose, in fact, a specific system of protection, constituting one of the first conditions of viability of the right of access. If the proper balance between openness and secrecy is found, the institution of the right of access to administrative records should mark a certain progress for both the administration and for democracy

Reforms concerned not just recruitment, management and civil service organization, but also the training of officials in order to improve their skills. The introduction of the Master of Public Administration (MPA) in 1999 enhanced the scientific character of administrative knowledge while pre‑existing selective mechanisms were retained. The MPA supports the country’s modernization by enabling the State‑Party to undertake continuous reform of public administration. It allows as well the emergence of a new ethos and a community of vision among the new generation of civil servants, whose competences are adjustable to several possible political scenarios

Full textIn the wake of the transformation of the French welfare state, the conditions for gaining access to social rights have changed. Since the 1980s, social policies target smaller populations and increase the control over the “good use” of public money by making greater demands on individuals in return for subsidies. The question is whether this transformation creates distance between vulnerable populations and social institutions? In order to describe how individuals gain eligibility to social law under these new circumstances, this thesis takes a close look at the practices of writing that are meant to establish a “good record”. The ethnographic fieldwork was conducted in the archives and at the counters of a municipal administration, at a social housing office, at an association for over-indepted citizens, at a welfare office, at the state secretary for poverty, as well as with overindepted families. Filling out forms, gathering papers to prove over-indeptedness, and appealing to a decision before the state secretary: “paperwork” is a multiform activity, drawing on various ways of thinking about oneself and about legality. As legal categories can change their meaning and implications from one institutional frame to another, how do individuals establish coherence within their file? By following citizens and files through a highly differentiated administrative landscape, this thesis highlights the immense amount of cognitive, emotional, biographical and legal work necessary to gain access to social rights

Full textThe Document Understanding is the Artificial Intelligence ability for machines to Read documents. In a global vision, it aims the understanding of the document function, the document class, and in a more local vision, it aims the understanding of some specific details like entities. The scientific challenge is to recognize more than 90% of the data. While the industrial challenge requires this performance with the least human effort to train the machine. This thesis defends that Incremental Learning methods can cope with both challenges. The proposals enable an efficient iterative training with very few document samples. For the classification task, we demonstrate (1) the continue learning of textual descriptors, (2) the benefit of the discourse sequence, (3) the benefit of integrating a Souvenir of few samples in the knowledge model. For the data extraction task, we demonstrate an iterative structural model, based on a star-graph representation, which is enhanced by the embedding of few a priori knowledges. Aware about economic and societal impacts because the document fraud, this thesis deals with this issue too. Our modest contribution is only to study the different fraud categories to open further research. This research work has been done in a non-classic framework, in conjunction of industrial activities for Yooz and collaborative research projects like the FEDER Securdoc project supported by la région Nouvelle Aquitaine, and the Labcom IDEAS supported by the ANR

Full textAdministrative documents can be found everywhere today. They are numerous, diverse and can be of two types: physical and numerical. The need to switch between these two forms required the development of new solutions. After document digitization (mainly with a scanner), one of the first problems is to determine the type of the document, which will simplify all future processes. Automatic classification is a complex process that has multiple solutions in the state of the art. Therefore, the document classification, the imbalanced context and industrial constraints will heavily challenge these solutions. This thesis focuses on the automatic classification of document streams with research of solutions to the three major problems previously introduced. To this end, we first propose an evaluation of existing methods adaptation to document streams context. In addition, this work proposes an evaluation of state-of-the-art solutions to contextual constraints and possible combinations between them. Finally, we propose a new combination method that uses a cascade of systems to offer a gradual solution. The most effective solutions are, at first, a multimodal neural network reinforced by an attention model that is able to classify a great variety of documents. In second, a cascade of three complementary networks with : a one network for text classification, one for image classification and one for low represented classes. These two options provide good results as well in ideal context than in imbalanced context. In the first case, it challenges the state of the art. In the second case, it shows an improvement of +6% F0.5-Measure in comparison to the state of the art

Full textEGovernment is currently the main focus of interest for legislators and rulers, contextualized in fact bigger one, called the "Digital World" introduced by Negroponte. Technology has led to a new set of rules to improve the efficiency, effectiveness and save (economics and management) in the administrative process and legal certainty. Throughout history, the Administration has indicated its action through the documents contained in the files. This procedure was substantially modified when Computing Science was progressively introduced into the management, began to work more with data with documents. Current technology allows us to recover the lost ground, returning to the document their originary role. EGovernment creates a new context for the communication between states and citizens: the documents will be created and / or transmitted electronically, which entails that will require the use of new tools to access to their content. The right of citizens to such access, as well as legal and social requirements should not be diminished, but rather it should increase into this environment. From of a comprehensive review of the regulations developed and a study of the scientific literature, we can conclude that the current trend to save "new wine in old bottles" in the implementation of this new administration. This leads to make a proposal of change of the paradigm, especially focused on building electronic administrative documents sufficiently capable to solve the needs of citizens and replace certain vices imported from the previous context and meaningless at present. This proposed change meets criteria for interoperability, query literal, level of security of the information, strengthening the integrity of the document by electronic signature and seal, adopting the method of activation biometric electronic signature process. The metadata stored in the documents will acquire a important role by reference to the proposed scheme by the Ministry of Finance and Public Administration. Documents will be built from the sequencing of a set of layers, coincident with each of the elements that compose it. Each layer will contain a set of attributes such as metadata and content, as well as an assessment of whether data has protected and / or reserved. Partial true copies construction -another novelty of our proposal- will be done automatically, removing the protected data and / or reserved of the report to be delivered to the citizen who is not entitled to your inquiry, being able to automate the access to documents (and copies) based on the role of the concerned person.

Full textReminiscence of the organisational and decisional way of the cities, the local planning documents are indisputably topical because of both their multiplication and their expanding diversity. Besides they are still outstanding in the french legal system so much so that from now on we can legitimately ask ourselves about the future of the law (more particularly the administration law and its corollary the administration). Activities organisation ways in a restricting temporal and territorial defined case, they can be distinguished not only because they organise the administrative action but also because they set up a power which ensures the modification of legal situations with the only will of the authorities in charge of its elaboration. In spite of numerous legislative attempts to make the decision process clearer and fuller of democratic adhesion, these particular masterpieces of the public administration are the last expression of the breathless local democracy. Two caracteristics make them different from the numerous implements the administration can use to bring its general benefit mission to a successfull conclusion. The first one is the temporalized plannification “which rhyms” with the anticipation of a close future. The second one is the spatialisation which equals the territorial application of the law. Then they evolve with the time before becoming a complete category. Unity or disparity(ies)? Reformation cause or not of our administration ? Will this new serie of conventional acts will drag with her the administrations? Will they turn them towards more administrative coherence and maybe the end of unceasing wrestlings between administrations? Do we have to foresee the progressive standardization of the administration? As we have to wait and see, the main point will consist in identifying the divergent and convergent elements in the way of the constitution of a new series of acts. It will also consist in setting up how this new legal implement induces consequencies in the organisation of the administration

Full textThis study is related to the Libyan state who testified of weakness and instability since the Ottoman Empire until the fall of Gaddafi, which hindered any administrative reform effort that could have been undertaken to confirm the concept of state, which has always struggled even a real absence. The country lives without state since Gaddafi's fall in 2011, although the transitional period has passed through several stages such as the introduction of a new Constitution and elections to put in place the important institutions. The thesis also exposes the various changes and modifications that have occurred administering, analyzing their objectives and impacts. The objectives of the administration should be in line with those of the state and the needs of society in general and in particular citizens.The need for an effective management system in the state has resulted in considerable changes in political, administrative and social levels. Among the concerns listed on the political agenda since the fall of Gaddafi’s regime are the institutional reforms. This reflects the deeply degraded nature that has characterized and still characterizes the relationship between the State and the Libyan society, this situation resulting, in most cases, the weak state apparatus and organizational deficiencies and supervision that followed. It should however be clarified that the public administration is a sphere of the state, it cannot therefore represent only the administrative state. Thus, it must act in close cooperation with the political state and social bodies. Full textLa présente thèse se propose d’étudier la transaction administrative à l’aune de son environnement juridique : un mode transactionnel de règlement des litiges administratifs peut-il valablement se développer en droit français ? Il apparaît alors que la transaction administrative s’est développée là où elle est désignée pour ce faire. Promouvoir ce mode de règlement des litiges supposait d’en clarifier la définition et le régime juridique. En l’occurrence, comme la transaction de droit privé, la transaction administrative est caractérisée par trois éléments : l’existence d’un litige ─ relevant du juge administratif ─, un accord de volontés et des concessions réciproques. Leur appréhension fait, en revanche, l’objet de quelques adaptations de façon à tenir compte des problématiques du droit administratif que soulèvent nécessairement les litiges administratifs. C’est donc une transaction largement inspirée de la transaction de droit privé et faiblement dérogatoire au droit commun que le Conseil d’Etat a façonnée. Depuis, la transaction administrative s’est effectivement développée. Toutefois, un plus grand développement encore ne semble pas envisageable, du moins à court terme, tant les entraves sont importantes. Celles-ci sont nombreuses, de nature hétéroclite et pour certaines, difficilement remédiables. Ni le système juridique français, ni les caractéristiques propres de la transaction ne se prêtent à un développement massif de ce mode de règlement des litiges. Il est donc probable que la transaction administrative demeure, en droit français, un mode secondaire de règlement des litiges. Full textThere is a history of administrative contracts that is commonly shared by the legal experts. Developed at the very time when their theory was designed, it argues that the Council of State would have conceptualised the administrative contract in the first years of the 20th century, before the emergence of a general theory proposed by Gaston JÈZE, then Georges PÉQUIGNOT and André de LAUBADÈRE. From this perspective, the administrative law specialists of the 19th century would have been unable to think the administrative contract. If we unquestionably agree that the administrative contracts theory is contemporary with the inter-war period, these specialists did not lack of interest in the administrative contracts according to their very own preoccupations. On one hand, the administrative contracts theory, the paternity of which being traditionally attributed to Gaston JÈZE, is shaped by the inter-war period. The contrast between this time and the “Belle-Époque” period brings to light the motives behind the will of some administrative law specialists to stand up for this idea – unintelligible until then – that there could be two different kinds of contracts (part 2). On the other hand, the administrative law experts of the 19th century focused their worries about the contracts of the administration on contemporary issues. Whether it be to characterise the administration and its jurisdiction, or be it to develop representations of the administrative law. Without constituting a general theory that would emphasise their unity, the contracts of the administration were used to discuss the administrative law, so much so that they were a vector of its dynamism (part 1)

Full textThe distinguishing feature of the French constitutional law is the fact that it uses extensively the administrative law. The Constitutional Council acquire notions, tools and ways of thinking from administrative law, whereas constitutional rules make use of administrative institutions or constructs. Meanwhile, the Council of State has both formal and material constitutional abilities. Councillors of State are ubiquitous in rules redaction, notably about the laws, where they perform a constitutional pre-control. Finally, constitutional authors, instructed in administrative law, study the constitutional rulings with administrative litigation concepts. Thus, inquiring into the administrative foundations of constitutional law involve reflecting on the existence of an administrative culture in this field. This culture comes from the singular history of French public law, which required a strong jurisprudence to compensate the constitutional unsteadiness of the 19th century. Also, it comes from the unusual building of the State and nation since absolute monarchy. French administrative law then appears especially like the first and primary source of constitutional law effectiveness until 1958. This permanence brings up questions about the relation between State and citizen, or liberalism and democracy, in an atypical French legal order

Full textThe rules which govern the convincing value of documents in tax law guarantee the supremacy of the tax authorities in case of trial, when the taxpayer contests his dues towards the tax department. Indeed, the tax judge is wary towards a document given by taxpayer and he considers that the latter is a potential defrauder. In fact, the document given by the taxpayer has to acquire a convincing value. On the contrary, the document given by the tax deparment always has a convincing value and can hardly lose it. This first statement drives us to question ourselves : is such a huge unbalance compatible with the right of having a fair trial as guaranteed by the article 6 of the European convention of human rights. This question can only be answered in two steps. Actualy, the taxpayer is not allowed to bring to conflict the article 6 of the european convention of human rights. The taxpayer dues is not considered as a "civil" right or obligation such as describe in this article. This statement has to change. The consequence of this evolution will not be decisive. An unbalance coming from the rules which govern the obtaining or the use of a document can be justified, in comparison with the procedural rights of the litigant, by a highest interest. It is obvious that the tax trial relates to a vital issue of the state. The unbalance coming from the rules which govern the convincing value of documents is broadly compatible with the requirements of the right to a fair trial

With this ambivalence having been underlined, the durability of the State’s control over administrative authorizations can be questioned when the market itself determines the authorizations’ distribution. Full textAppeared almost twenty years ago in the doctrinal discourse of administrativ law, still today the term of externalisation is paradoxically not very present in the theoretical language of lawyers, and nearly absent in the positiv law and in the courtrooms. Indeed it is employed most of the time as a « cosmetic » and ideological term mainly destined to realize, generally, of the managerial turn borrowed by organization and management of administrative action in the framework of state reform, and under the influence of the New Public Management precepts. However, it is not dedicated to remain simply as an idiom representative of emergence of a new posture of state and public authorities. As it happens, it can be considered as a concept in full integrated to the general theory of administrativ law. As such, it offers opportunity of an original approach of contemporary transformations crossing this disciplinary purview, and allows to provide a definition and a contents properly administrative to this term many times mentioned and so litte specified. Inspired by the achievements of economics and management, and the works conducts by civil law doctrine, the conceptualization of administrative externalisation leads to the discovery of an novel management mode of administrative action based on a logic of cooperation, and covering the recourse by public authorities at traditional juridical instruments endued of a singular function to empower a third party to share in the realisation of an ability assigned to them by the legal order. Thus elaborated, the administrative externalisation concept unflods in the framework of fulfillement of the concret public authorities ability, under multiple juridical forms and in various fields of activity, by the means of an instrumentalization of the obligation revealing a renewed conception of this one. Therefore, it brings unprecedented elements of understanding of evolution of methods of intervention by the administrative authorities. From title to subtitle, theoretical utility of this concept is measured so in terms of the content assigned to it, wich sets the milestones of an administrative externalisation theory and, beyond, of a cooperative management of administrative action theory

Esta pesquisa teve como objetivo estudar os problemas dos arquivos ativos e os das massas documentais acumuladas na administração pública brasileira. Os arquivos ativos são os acervos acumulados nos setores de trabalho. São constituídos de documentos ativos, semi-ativos e inativos, misturados a outros passíveis de eliminação e a documentos não orgânicos, que não são considerados de arquivo. As massas documentais acumuladas são o resultado da transferência dos documentos dos arquivos montados nos setores de trabalho. Elas são denominadas, comumente, de “arquivos mortos”. O tratamento desses arquivos fundamenta-se no empirismo e na improvisação. Não há instrumentos de gerenciamento da classificação intelectual e física e dos prazos de guarda dos documentos. A incipiente organização adotada nos arquivos ativos é geralmente perdida quando os documentos são transferidos para os depósitos de massas documentais acumuladas. O descaso com que é tratada essa questão se traduz, geralmente, em poucos investimentos em instalações, equipamentos, materiais de consumo e na formação e treinamento de pessoal. As experiências de tratamento desses acervos no Brasil são poucas e não se sustentam em políticas estabelecidas, mas em atuações individuais de alguns profissionais. Não se tem uma metodologia consolidada que permita a aplicação dos conceitos e princípios arquivísticos difundidos internacionalmente. Observou-se que o caminho para a compreensão do problema proposto vai além do âmbito estritamente técnico. As particularidades do aparato estatal brasileiro, a instabilidade de suas instituições, o nível de qualificação de seus quadros são elementos que ajudam a esclarecer a questão. Recorreu-se à literatura nacional e estrangeira e à legislação existentes sobre o tema para a realização desse estudo. Foram feitas entrevistas com dirigentes de instituições arquivísticas, professores e membros de organismos arquivísticos internacionais. Analisou-se pormenorizadamente os diagnósticos, os projetos de organização e execução elaborados para alguns órgãos governamentais, que foram desenvolvidos pelo professor Luis Carlos Lopes. Foram abordados os aspectos principais dos arquivos no âmbito do governo federal e do Distrito Federal e as intervenções das instituições arquivísticas. A partir da descrição e análise das experiências pode-se, no final, sugerir uma metodologia para o tratamento dos arquivos em órgãos da administração pública brasileira. Apesar de todas as limitações impostas pela realidade brasileira, acreditamos que seja possível empreender um programa de gerenciamento da informação e de gestão de documentos, elaborando-se, a partir de pesquisas, os instrumentos necessários e treinando-se os seus usuários.
The purpose of this researche was to study the problems of the current records and of the voluminous and loosely organized bodies of records in the Brazilian public administration. The current records are the holdings accumulated in the working offices. They are composed of current records - semi-current and inactive - mixed with others likely to be destroyed and with non-organic records which are not considered archives documents. The voluminous and loosely organized bodies of records are the result of the transfer of those documents in the archives set up in the working offices. They are commonly named “dead archives”. The processing of these archives is based on the empiricism and the improvisation. There are no management tools for the intelectual and physical classification and for the documents retention period. The incipient arrangement of the current records is generally lost when the documents are transferred to the voluminous and loosely organized bodies of records deposits. The carelessness which this subject is dealt with is generally translated into few investments in installation, equipment, consumer goods, and personel training. The processing experiences of these holdings in Brazil are very few and do not uphold themselves in established policies, but in individual perfomance of some professionals. There is not a consolidated methodology wich allows the application of archives concepts and principles internationally diffused. It has been noticed that the way to understand the proposed problem goes beyond the strictly techinical scope. The peculiarities of the Brazilian governamental apparatus, the instability of its institutions, the qualification level of its working team are elements that help to explain the subject. National and foreign literature and the existing legislation on the subject were used in this research. Directors of archives; professors and members of international archives organisms have been interviewed. The surveys, the organization and executation projects which have been done for some government organs and wich hav been developed by Professor Luis Carlos Lopes were analized. The main aspects of the archives in the federal government and in Distrito Federal field of action as well as the archives institutions interferences have been addressed. From the experiences description and analysis it was suggested a methodology for the archives processing in the Brazilian public administration. Despite all the limitations imposed by the Brazilian reality, we believe that it is possible to undertake a management program of records information and management by gradually preparing the necessary tools and giving the users training.

In France, the 30th of June 2000 reform consecrated emergency measures as the only urgent procedure in conferring to the judge new powers in the suspension of the administrative decision and of protection of the basic liberties. To a "simple" emergency certified statement - to a new developed procedure. The examination of those changes allows us to know if the evolution of emergency measures, for this legal systems - emergency certified statement, conservatory, instruction, provisions and pre-contractual - minimizes the traditional delay of administrative justice. Full textStarting with the first contacts mentioned in Chapter 1., to the flourishing of French-Romanian relationships, we have offered through this thesis an image of how has been built and developed the common history of two peoples, so that we can speak afterward of the significant French-Romanian phenomenon. The document that constitutes the basis of our studies is the first edition of the Romanian Constitutional Texts, written in Cyrillic Alphabet, but the version that has been very useful to us is the bilingual French-Romanian version preserved in the 1890 Romanian Parliamentary Annuaries. This has been a very rich source for our lexical, stylistic, morphological, syntactical and translation analysis, aspects presented in Chapter 3. We have structured it into two sections: a theoretical one, having in center two important names in stylistics, Swiss and Romanian representatives, Charles Bally and Tudor Vianu and different translation theoreticians such as: Georges Mounin, Marianne Lederer, John Catford, Henri Meschonnic, Algirdas-Julien Greimas, Eugene Nida, etc.; the second part is a practical one, with contrastive French-Romanian analysis of the two texts: the Romanian text (the source-text) and the French text (the target-text). At the end of our thesis, in Chapter 4, we have detailed some aspects of the nowadays version of the Romanian Constitutional Texts, bilingual version reflecting very well the significant progressive steps taken from the 19th century until now

Full textThe right to a fair trial is enshrined in the article 6§1 of the European Convention on Human Rights and irradiates now all French law. In the context of the subjectivization of the law, administrative law is also subject to this "unstoppable rise of disputes in the name of the right to a fair trial" (Mrs. KOERING-JOULIN). This assertion is particularly true regarding the powers of sanction and the settlement of disputes granted to the administrative authorities. The European definition of the right to a fair trial applied by the Court of Cassation and adapted by the Council of State allows a wide application of this right. So, given the current state of the administrative case law, the right to a fair trial can be usefully claimed against independent administrative authorities as regard either their law enforcement activities or litigation practice. And the tax administration has also been compelled to respect this fundamental right for eight years now. In line with this settled jurisprudence, the extension of the right to a fair trial to all the administrative authorities may be the way of the future. But such an evolution raises a few questions. Isn't the increasing jurisdictionalization of the administration activities as a result of the right to a fair trial an inconsistency in itself? Doesn't it go against the primary goal of the outsourcing of the administrative penalties? More fundamentally, doesn't subjecting the administrative authorities to the specific principles of court procedures participate in reinstating some confusion between administration and jurisdiction? Isn’t it the rebirth, under a new form, of the administrator-judge we thought was long gone?

She represente the jurisdictional activity in administrative subject. Consequently, the contentious administrative functio has to dread as long under the angle of a jurisdiction, that under that of his judge. The institution of a contentious administrative function (office) in Ivory Coast goes back up to the colonial time. However, following the example of most of the French ex-colonies, it is that after the independence in 1960, that the Ivory Coast contentious administrative function asserted itself as autonomous jurisdictional office towards the French system.
