Abstract:
As a result of penal reform (1999-2001) Georgian legislator redefined its concept of dolus directus, based on a view presented in own penal theory two decades ago. By reducing the concept to its intellectual component ([precise] knowledge of illicit effect) penal legislation introduced a new kind of guilty behavior – dolus directus intellectualis as dolus directus of the second degree (theoretical description). On the other hand: Through adding intellectual segment of dolus indirectus to the voluntative one of dolus directus here emerged a further kind of guilty behavior, when person aspires an unlawful damage, but for sees it just as possible effect of his externalized intention – dolus directus voluntatis as dolus directus of the first degree (theoretical description). Authors prove that these legislative transformations do not meet basic requirements of classical continental guilt scheme and confront both innovations with a new version of dolus compositus (1998).

Abstract:
Laesio enormis and dolus in re ipsa nowadays: the question of fault. The mediaeval interpreters of Roman law have worked out the dolus re ipsa-concept to explain the mysterious laesio enormis (C. 4,44,2 [a. 285]). They supposed the inequality in exchange to be a result of malicious undertaking, for which paradoxically, no one was personally liable (D. 45,1,36 [Ulp. 48 Sab.]). In course of time, the incorporation of laesio enormis into the scheme of dolus turned into a presumption of a malicious act on the part of the enriched party, even though the laesio enormis is free from subjective criteria. It is astonishing how little the dolus re ipsa is discussed, although the modern paradigm for correcting inequality in exchange is based on the same assumptions. This ‘Wiederkehr der Rechtsfigur’ certainly deserves more attention.

Celem artykułu jest przybliżenie problematyki zamiaru, jaki towarzyszy sprawcy popełniającemu przestępstwo z art. 148 § 4 k.k., czyli zabójstwo pod wpływem silnego wzburzenia usprawiedliwionego okolicznościami. Omówiono specyfikę tego przestępstwa, zarówno wyjaśniając pojęcie silnego wzburzenia (afektu), jak i przybliżając poglądy na temat okoliczności, które mogą usprawiedliwiać działanie w tym stanie. W dalszej części pracy wyjaśniono specyfikę różnych postaci zamiaru, które znane są polskiemu prawu karnemu. Dokonana analiza obejmuje: zamiar bezpośredni (dolus directus), zamiar ewentualny (dolus eventualis), zamiar nagły (dolus repentinus) oraz zamiar przemyślany (dolus premeditatus). Przedstawiono zarówno poglądy przedstawicieli prawa karnego, jak i bogate orzecznictwo sądowe, odnoszące się do próby wyjaśnienia, czy możliwe jest popełnienie przestępstwa z art. 148 § 4 k.k. w każdym z wymienionych zamiarów, a jeśli tak, to w jaki sposób kształtują się procesy psychiczne sprawcy tego przestępstwa w każdej z tych sytuacji oraz jaka motywacja może mu towarzyszyć.

Abstract:
State v Pistorius provides an opportunity to consider error in objecto in the context of the broader approach to dolus in South African criminal law. For the last 60 years South Africa has taken a consistently subjective approach to assessing intention, evidenced through the courts’ rejection of versari, the presumption of intent and transferred malice. This upholds individual autonomy and assigns blame on a principled basis, thus it has achieved recognition from the Constitutional Court. By recognising foresight/knowledge of unlawfulness as a component of dolus, De Blom took subjectivity to its logical conclusion in 1977. Consequently, error in objecto likely only applies to dolus directus, is heavily influenced by the now defunct doctrine of transferred malice and has not become an entrenched principle in our law. It must thus yield to the basic principles of criminal law, including subjectivity and the putative defences flowing from De Blom. This was the manner in which it was correctly applied in State v Pistorius, although the reasoning was not evident in the judgment. Reviewing error in objecto in the broader scheme of dolus therefore shows that it is inaccurate to claim that the victim’s identity is always irrelevant to a charge of murder.

Ce travail est consacré à l’analyse des scènes de tromperie et de dissimulation dans le corpus tragique de Sénèque. La première section propose une analyse du vocabulaire que les auteurs tragiques ont utilisé, ainsi qu’une étude consacrée à la structure des moments de tromperie et de dissimulation, étude isolant les personnages, les passages scéniques, l’organisation et les modalités. Pour commencer, nous avons étudié les textes d’Ennius, Pacuvius et Accius, où nous avons cherché des références plus ou moins explicites au thème de la tromperie et de la dissimulation. Nous avons donc poursuivi notre analyse avec les textes de Sénèque pour lesquels nous avons classé le vocabulaire, les personnages et les loci dramatiques. Dans la deuxième partie du travail nous nous sommes intéressés à la scénographie des drames, le regnum d’un côté, le paysage naturel de l’autre. Pour le regnum, nous avons approfondi le lien entre pouvoir et dissimulation, thème qui s’insère dans la réflexion de Sénèque, aussi dans les Dialogues et les Epîtres. La représentation du paysage naturel fait ressortir le lien qui unit les personnages et leurs vicissitudes à l’espace que les entoure
This study is dedicated to the analysis of deception and pretence in Seneca’s tragic corpus.The first section is dedicated to the terminology of deception and to its morphology; we propose an analysis of the vocabularies used by the various dramatists together with a study focused on the structure of deceptive moments, to isolate characters, scenic landscapes, organization and modalities. We started from the texts of Ennius, Pacuvius and Accius, in order to find references to the themes of deception and pretence. We moved to the analysis of Seneca’s tragedies to highlight both the lexical choices of the author and the features used to build up the fraudulent actions; on these themes, the study goes on with a classification of the terminology, of the characters and of the dramatic loci. The second section of the thesis is focused on the dramatic scenography, the regnum and the natural environment. In the first case, we aim at investigating the relationship between dissimulation and power, which is really important also in Seneca’s Dialogi et Epistulae, Also focusing on the natural environment, centre of Phaedra and Thyestes, we can notice the close link between the characters, their stories and the place they use

Disertacijoje siekiama pasiremiant tiek Rytų Europos (tame tarpe Lietuvos), tiek Vakarų Europos ir kitų valstybių baudžiamosios teisės pasiekimais, taip pat Lietuvos bei užsienio teismų praktikos analize atskleisti Lietuvos baudžiamojoje teisėje dar beveik nenagrinėtą kaltės sampratos problematiką, išanalizuoti tyčinės kaltės struktūrą ir atskirų jos elementų turinį. Disertacijos tiriamąją dalį sudaro trys dalys. Pirmojoje nagrinėjamos baudžiamosios teisės teorijoje žinomos kaltės teorijos ir prieinama išvados, kad geriausiai baudžiamosios teisės poreikius ir galiojančio baudžiamojo įstatymo nuostatas atitinka ne dabar Lietuvoje vyraujančios psichologinės kaltės teorijos, bet Vakarų Europoje dominuojanti norminė kaltės teorija. Antrojoje dalyje nagrinėjamas tyčinės kaltės intelektinis momentas: apibrėžiamas aplinkybių, kurias turi suvokti tyčia nusikalstantis kaltininkas ratas, gilinamasi į šių aplinkybių suvokimo bei numatymo ypatumus esant skirtingoms tyčios rūšims ar skirtingoms kaltės formoms ir šių ypatumų nustatymo teismų praktikoje problemas. This research examines the problems of dolus in the criminal law. The Latin notion dolus includes not only what common law would call intention and knowledge, but also some cases of recklessness (so called dolus eventualis). Dissertation aims on the basis of achievements of the criminal law of Eastern, Western European and other countries comprehensively analyze the structure of dolus and its particular elements; to identify essential theoretical questions, as well as typical practical problems and to provide suggestions for the solutions of these questions and problems. The research part of the thesis consists of three parts dedicated, respectively, to problems of culpability, of the intellectual part of dolus and the volitional-dispositional part of dolus. The first part analyzes three theories of culpability: pure psychological, social – psychological and normative. It is concluded that normative theory of culpability has no significant faults, common to other theories of culpability, and it complies with provisions of the Penal Code. The second part of the research is dedicated to the analysis of the intellectual part of dolus - perpetrator’s perception of crime social wrongfulness and foresight of prohibited consequences. It reveals the scope and content of perpetrator’s perception and degree of foresight of prohibited consequences in dolus as well. Abstract:
Article II of the Convention on the Prevention and Punishment of the Crime of Genocide stipulates the definition of the crime. A key element of genocide is the criterion of “intent”; this requisite must be met in order to determine criminal liability. Even though “intent” is a paramount element of the crime neither definition nor guidance regarding its interpretation is provided for under Article II, this void of interpretation is absolute throughout the Genocide Convention. Hence, the purpose of this thesis is to examine this void in the provision. In order to fulfill the purpose of this thesis the following research questions have been regarded: How is the requisite intent defined in relevant preparatory work of Genocide Convention? How is the requisite intent interpreted in relevant case law and judicial doctrines and are these interpretations in line with the preparatory work of the Genocide Convention? Is the definition and interpretation of the requisite intent in the abovementioned legal sources consistent with the object and purpose of the Genocide Convention? We found that in the preparatory work of the Genocide Convention, the requisite intent has not been labeled. However, the Drafters definition of intent is in accordance with international criminal law’s definition of specific intent. Also, the case law and judicial doctrines that we have examined all fall within either the purpose-based or the knowledge-based approach. Both approaches acknowledge that a perpetrator needs to possess an inner aim or desire to meet the level of intent required for the Crime. Notwithstanding, the knowledge-based approach holds that “policy or plan” is part of the Crime whereas the purpose-based approach rejects it and consequently the application of genocidal intent is distinctively different. With regard to preparatory work, the purpose-based approach is in line with the definition of the Drafters whereas the knowledge-based approach is not in its literal meaning. However, the Drafters did not explicitly reject the knowledge-based approach in the preparatory work of the Genocide Convention. We have concluded that the purpose-based approach is not consistent with the object and purpose of the Genocide Convention. We hold that the knowledge-based approach is in line with the object and purpose of the Genocide Convention, and hence this approach upholds the goal of preventing and punishing genocide. Moreover, the method for this thesis is in accordance with the method in international law for interpretations of international treaties; the Vienna Convention on the law of Treaties. Hence, the selection, systemization and interpretation of legal sources are in line with the Vienna Convention.

En esta tesis doctoral, presento el estado actual de la discusión acerca del dolo en la teoría general del delito, a partir del análisis de las principales teorías planteadas en el Derecho penal continental, especialmente por autores alemanes y españoles, así como de los criterios jurisprudenciales de inferencia de los estados mentales establecidos en el Derecho penal anglosajón, especialmente por las cortes de Reino Unido. He abordado planteamientos de dos tradiciones jurídicas distintas porque en ellas se evidencian dos distintos niveles de análisis del problema: el nivel conceptual y el nivel aplicativo. Mi finalidad es plantear una teoría procesal de determinación del dolo, que se ajuste a los principios del Estado social y democrático de Derecho. En ese sentido, la teoría de las condiciones para el conocimiento aproxima la teoría del delito al proceso penal. De acuerdo a mi propuesta, el dolo es un juicio subjetivo-normativo de imputación del conocimiento, que se aplica cuando el juzgador verifica tres condiciones objetivas que indican que, en el contexto social y personal de su acción, el imputado tenía un deber limitado de conocer un riesgo específico, la posibilidad efectiva de conocimiento de dicho riesgo y la imposibilidad de confiar ex ante en la no realización de dicho riesgo. Es esta última condición la que permite distinguir las formas de imputación dolosa de la imprudencia. La teoría planteada es, a su vez, una teoría de límites al razonamiento judicial y al proceso de inferencia de los elementos subjetivos del injusto, ya que permite reducir el riesgo de que el juzgador incurra en generalizaciones, aplique máximas de experiencia o recurra a su intuición para resolver un caso. Es a partir de la valoración conjunta de los indicadores objetivos planteados (indicadores de riesgo, evitabilidad, contexto específico, experiencia previa del autor, rol efectivamente asumido, actos específicos y motivos racionales del autor) que el juez penal estará en condiciones de efectuar un adecuado proceso de inferencia de las condiciones para el conocimiento.
In this doctoral thesis, I describe the current state of the discussion about mens rea in criminal law, based on the analysis of the main theories raised in continental criminal law, especially by German and Spanish authors, as well as on the inference rules of the mental states established in Anglo-Saxon criminal law, especially by the United Kingdom courts. I have approached two different legal traditions because they apply two different standards of analysis: conceptual and practical. My aim is to propose a procedural theory, which allows to establish and prove intent and advertent recklessness, in the context of the rule of law principles. In this sense, the theory of knowledge conditions brings criminal law closer to criminal prosecution. According to my proposal, “dolo” (which includes intention and advertent recklessness) is a subjective and normative imputation process of knowledge, which is applied when the judge verifies three objective conditions that indicate, in the social and personal context of his/her action, the accused had a limited duty to know an specific risk, the actual possibility of knowing about such risk and the impossibility to trust on the non-fulfillment of such risk. It is this latter condition that makes it possible to distinguish between forms of “dolo” and negligence. My proposal is also a theory of judicial reasoning limits, since it allows to reduce the risk that the judge falls into generalizations, applies rules of experience or uses his/her intuition to solve a case. The use of objective indicators (risk, avoidance, specific context, author previous experience, role, specific acts and rational motives) allows the criminal judge to make an adequate inference process of the knowledge conditions.
En aquesta tesis doctoral, presento l’estat actual de la discussió del dol dins de la teoria general del delicte tot partint de l’anàlisi de les principals teories plantejades al Dret Penal continental, especialment per autors alemanys i espanyols, així com també els criteris jurisprudencials d’inferència dels estats mentals establert al Dret Penal anglosaxó, especialment per les Corts del Regne Unit. He estudiat plantejaments de dues tradicions jurídiques diferents perquè en elles es poden veure dos nivells d´anàlisi del problema: el nivell conceptual i el nivell aplicatiu. La meva finalitat és plantejar una teoria processal de determinació del dol que s´ajusti als principis de l´Estat social i democràtic de Dret. En aquest sentit, la teoria de les condicions per al coneixement apropa la teoria del delicte al procés penal. D'acord a la meva proposta, el dol és un judici subjectiu-normatiu d'imputació del coneixement, que s'aplica quan el jutge verifica tres condicions objectives que indiquen que, dins del context social i personal de la seva acció, l'imputat tenia un deure limitat de conèixer un risc específic, la possibilitat efectiva de coneixement d'aquest risc i la impossibilitat de confiar ex ante en la no realització d'aquest risc. És aquesta darrera condició la que permet diferenciar les formes d'imputació dolosa de les imprudents. La teoria plantejada és una teoria de límits al raonament judicial i al procés d'inferència dels elements subjectius de l'injust, ja que permet reduir el risc que el jutjador incorri en generalitzacions, apliqui màximes d'experiència o recorri a la seva intuïció per resoldre un cas . És a partir de la valoració conjunta dels indicadors objectius plantejats (indicadors de risc, possibilitat d’evitar el fet, context específic, experiència prèvia de l'autor, paper assumit, actes específics i motius racionals de l'autor) que el jutge penal estarà capacitat per realitzar un adequat procés d'inferència de les condicions per al coneixement.

Historical and cartographic research about the ghost domus built by Frederick II in Principatus et Terra Beneventana regionDuring his reign Frederick II built a series of representative fortified constructions in southern Italy, and after reinforcing the defence line of the border with the State of the Church, he decided to build many residential estates called domus or palacium in the fundamental medieval textual source of Statutum de reparatione castrorum. This research is focused on the study of the landscape in the ancient region of Principatus et Terra Beneventana during the thirteenth century: it is noticed the presence of five imperial domus cited in the Statutum with the name domus Castellucci Battipallae, castrum et palacium Sarni, domus imperatoris in Ebulo, domus imperatoris Apicii and the Castel Belvedere Marano palace. Every domus was studied through a historical and cartographic analysis, and in case of the structure is not recognised on the territory it was organized a landscape analysis in order to propose a hypothetical position. The data that was gathered into ArcGIS software to define the probable locations of the ghost domus were the detailed routes of ancient roads related to the positions of the casalia (little rural communities that paid taxes to maintenance of the royal structures), the Church properties, the urban site, and the other castra and domus.
