Abstract:
Abstract Evsey Domar investigated in the 1940s the implementation of growth stabilization policy under the assumption that policy makers and businessmen alike believed his theoretical growth model. Economic policy was supposed to work merely through the impact of its announcement on expectations. He claimed that confident expectations, generated by government’s assurance of future growth through fiscal policy, would induce private investment decisions in a scale that would bring about the required growth rate and by that justify the expectations, without putting the guarantee to test. Domar’s policy framework contrasts with the policy-ineffectiveness proposition of New Classical macroeconomics advanced in the 1970s. Domar’s stabilization plan is discussed in detail in the context of his growth model, together with similar ideas put forward by Roy Harrod, as the latter modified aspects of his original growth model, and critical reactions by Alvin Hansen.

Abstract:
Neste artigo pretendemos refletir sobre o processo de aprendizagem das tecnologias digitais por idosos, a partir de pesquisa etnográfica realizada no ano de 2016 em plataformas como o Facebook e no curso de informática para a Melhor Idade ofertado pelo Laboratório de Informática da PRAE/CPD da UFSM. Nossa intenção é mostrar como o relacionamento com computadores constitui um processo complexo para esses sujeitos que estão tendo contato com a tecnologia digital pela primeira vez, requerendo o aprendizado de uma série de ações e dos gestos técnicos. Através de distintas situações etnográficas discorreremos sobre a constituição de um conjunto de saberes e gestos que são corporificados e ilustram a relação entre a materialidade da tecnologia, corpo e motricidade no processo de “pegar o jeito” do computador e “domá-lo”.

Abstract:

Sverige har traditionellt sett haft en negativ inställning till erkännande och verkställighet av utländska domar. Enligt 3 kap 2 § utsökningsbalken krävs stöd i lag för erkännande och verkställighet av en utländsk dom i Sverige.

Sedan Sveriges inträde i EU, och Bryssel I-förordningens införande, har synen på domar som härrör från medlemstater inom EU förändrats. Det kan numera sägas att fri rörlighet av domar förekommer inom EU. Det leder till att Sverige erkänner och verkställer utländska domar som har avgjorts inom EU.

Mellan Sverige och tredje land är läget ett annat. Problem uppstod då Nacka tingsrätt valde att lägga amerikanska domar till grund för en svensk dom, utan stöd i lag. Tingsrätten argumenterade för att svenska medborgare som väcker talan utomlands måste stå för konsekvenserna. I uppsatsen analyseras Nacka tingsrätts dom och om 3 kap 2 § utsökningsbalken behöver revideras.

Efter en jämförelse av rättsfall i uppsatsen är bedömningen att Sveriges syn på utländska domar har förändrats något. Sverige bör i viss mån kunna öka samarbetet med vissa stater. Jag anser att 3 kap 2 § utsökningsbalken bör behållas med med vissa förändringar i form av undantag till huvudregeln.

Abstract:
Lagen om särskilda bestämmelser om vård av unga (LVU) genomgick år 1990 en uppdatering. Rekvisiten som behöver föreligga för att lagen ska kunna tillämpas ändrades från att ha behövt uppnå graden fara och allvarlig fara för den unges hälsa och utveckling, till att endast behöva uppfylla påtaglig risk för den unges hälsa och utveckling. Denna förändring medförde att det idag inte krävs lika allvarliga omständigheter för att ett beslut om LVU ska kunna fattas, vilket påverkar beskrivningarna av ärendena i sig men även beskrivningarna av barnen och föräldrarna. Syftet med denna studie är att utifrån ett jämförande perspektiv belysa likheter och skillnader i LVU-domar från två olika årsperioder, 1985-1989 och 2012-2016. Studien utgår från en kvalitativ forskningsansats med avstamp i det socialkonstruktivistiska perspektivet. Teorierna som studien utgår från är diskursteori och barndomssociologi. Det empiriska materialet består av LVU-domar som har inhämtats från en förvaltningsrätt i en medelstor svensk kommun. Det empiriska materialet har bearbetats genom kodning vilket har resulterat i fyra genomgående teman: Barnets beteende, Barnets behov och barnets vilja, Föräldraförmåga och Domstolens bedömning av samtyckets tillförlitlighet. Materialet har analyserats med hjälp av diskursanalys och studiens resultat presenteras i resultatkapitlet. Det som framkommit i resultatet visar på både likheter och skillnader i domarna mellan tidsperioderna. Diskursen och språket i domarna gällande barnet, föräldrarna och deras föräldraförmåga samt den språkliga framställningen av föräldrarnas och barnets vilja skiljer sig åt mellan tidsperioderna. De likheter som framkommit mellan informationen i domarna gäller bland annat den normativa synen på vad som är ett avvikande problembeteende. De skillnader som framkommit gäller bland annat att i de nyare domarna får barnet och föräldrarna mer utrymme att uttrycka sin åsikt. Likaså ger även språkbruket en mer uttömmande beskrivning av barnets och föräldrarnas situation.

En person kan bli antingen obegränsad eller begränsad skattskyldigför sina inkomster. Det som blir avgörande är (1) om en person är bosatt i Sverige, (2) stadigvarande vistas i Sverige eller (3) har väsentlig anknytning på grund av att personen tidigare har varit bosatt här. De två första punkterna är relativt enkla att avgöra men den sista punkten har skapat oförutsägbara domar. I domar har det funnits skiljaktiga meningar som förekommer gällande om en fysisk person ska anses vara begränsad eller obegränsad skattskyldig. En tydlig praxis har sällan förekommit gällande väsentlig anknytning utan olika pusselbitar har fått läggas ihop för att man sedan avgöra och skapa sig en ungefärlig uppfattning kring väsentlig anknytning. De tio avgörande faktorerna som står i 3 kap 7 § IL kan tillsammans och ensamt bidra till väsentlig anknytning. Begreppet väsentlig anknytning har öppnat upp för tolkningsmöjligheter med oförutsedda domar. En vid mening att kunna tolka lagen och vad som de facto avgör att en person kan få väsentlig anknytning har blivit viktigt.

Sammanfattning Eftersom det blev förbjudet att köpa sexuella tjänster i Sverige har denna uppsats, med hjälp av diskursanalys, undersökt hur rätten framställer sexköp som fenomen, sexköpare och även säljare av sexuella tjänster. Domar från olika svenska tingsrätter har analyserats, avseende vilka ord som används i framställningen av fenomenet. Socialkonstruktivistiska teorier har använts för att förstå hur konstruktionen sker av kön, prostitution som fenomen och hur offer samt gärningsman konstrueras. Då prostitution kan sägas vara en del i hur genus konstrueras i samhället idag har dikotomin mellan könen, samt mannen som norm, blivit en central del i uppsatsen. De gråzoner som finns i genuskontraktet kan tänkas utnyttjas av både män och kvinnor, där män låter sig köpa kvinnor, men kvinnor också med mer eller mindre frivillighet låter sig köpas. Detta bidrar till hur samhället ser på dem som säljer sex, de prostituerade blir medbrottslingar och delvis själva ansvariga för brottet. Detta leder i sin tur till att både gärningsmän och offer osynliggörs i samhället, och kan bidra till att brottet förringas. Om brottet inte uppmärksammas i tillräckligt hög grad kan staten vinna på det, speciellt med tanke på att den dolda prostitutionen inte är fullt så möjligt att komma åt och lagen framstår som ett misslyckande. Den verkligt viktiga frågan att ställa för en långsiktig förändring av attityder kring fenomenet, är varför män har ett behov av att köpa kvinnors kroppar för sexuellt bruk. Genussystemet möjliggör prostitution samtidigt som prostitution också i förlängningen är med och reproducerar genussystemet och kvinnans underordning i förhållande till mannen.
Abstract Since it became illegal to buy sexual services in Sweden, this essay examines, using discourse analysis, how the courts produces buying sex as a phenomenon, sex buyers and also sellers of sexual services. Judgments from various Swedish district courts have been analyzed in relation to which words used to describe the phenomenon. Social constructivist theories have been used to understand how the construction is done by sex, prostitution as a phenomenon and how victims and perpetrators are constructed. Since prostitution can be said to be a part of how gender is constructed in society today has the dichotomy between the sexes, and the man as the norm, become a central part of the essay. The gray areas of the gender contract may be used by both men and women, where men allow themselves to buy women, but women are also more or less free will allow themselves to be bought. This contributes to societies view those who sell sex, the prostitutes become accomplices and partly themselves responsible for the crime. This in turn leads to both offenders and victims are rendered invisible in society and can contribute to the offense belittled. If the crime is not addressed sufficiently the state can gain from it, especially given that the hidden prostitution is not quite as possible to access and the law appears to be a failure. The really important question to ask for a long-term change in attitudes towards the phenomenon, is why men have a need to buy women's bodies for sexual use. The gender system allows prostitution, while prostitution also, by extension, is part of and reproduces the gender system and the subordination of women in relation to man.

Abstract:

I de flesta medlemsstater kan vinster och förluster som uppkommer i samma koncern utjämnas om bolagen i koncernen är belägna i samma medlemsstat. Den typen av utjämning utsträcker sig inte i allmänhet till en koncern etablerad i flera medlemsstater. Eftersom en EU-harmonisering vid gränsöverskridande förlustutjämning saknas, riskerar vinster och förluster inom en koncern att hamna mellan olika skattelagstiftningar. Det medför i sin tur att förlustutjämning inom en koncern inskränks till den medlemsstat där vinsten eller förlusten uppstår. En koncern etablerad i flera medlemsstater riskerar härmed att beskattas högre än deras sammanlagda resultat på EU-nivå.

Problemet med gränsöverskridande förlustutjämning är inte begränsat till att endast avse koncerner belägna i flera medlemsstater utan omfattar även företag med ett fast driftsställe i en annan medlemsstat än sin hemviststat. Precis som för inhemska koncerner tillåter medlemstater förlustutjämning för nationella företag med ett inhemskt fast driftsställe. När ett företag bedriver verksamhet från ett fast driftställe i en annan medlemsstat är det den avräkningsmetod som valts i de dubbelbeskattningsavtal som ingåtts mellan medlemsstaterna, som avgör om det fasta driftsställets förluster ska beaktas vid beräkningen av hela företagets resultat.

I Marks & Spencer tillät domstolen för första gången en gränsöverskridande förlustutjämning. Enligt Marks & Spencer-målet kan ett moderbolag ta emot ett dotterbolags förlust vid det fall dotterbolaget har uttömt alla möjligheter till att beakta förlusten i sin hemviststat. Vad som anses med att dotterbolaget har uttömt möjligheterna till att beakta förlusten i sin hemviststat är oklart. Att ett dotterbolag ska likvideras eller tas över av en tredje part får i nuläget anses innebära att förlusterna är definitiva och en medlemsstats lagstiftning inte kan hindra att en sådan förlust beaktas i moderbolagets hemviststat.

Precis som för koncerner är det, genom Lidl-målet, fastställt att domen i Marks & Spencer utsträcker sig till att även avse fasta driftställen. En gränsöverskridande förlustutjämning kan få företas med ett bolags fasta driftställe beläget i en annan medlemsstat, men bara om det rör sig om definitiva förluster och det fasta driftstället har uttömt möjligheterna till att beakta förlusten i etableringsstaten. I ett sådant fall är inte nationell lagstiftning proportionell och går längre än vad som är nödvändigt för att uppnå de eftersträvade ändamålen.

Gender in Administrative Court of Appeal - A discourse analysis of verdicts concerning compulsory drug treatment The purpose of this study was to examine gender discourses that could be identified inverdicts concerning compulsory drug treatment. A discourse analysis was conducted of 46verdicts from an administrative court of appeal, located in central Sweden. The main findingsof the study was that the descriptions of women, more often than men, are based on factorsother than their addiction, such as appearance and social environment. Men are in all casesdescribed by their addiction and on their own behavior. Women are presented as they riskvulnerability, while men are presented already suffer from vulnerability. Socioeconomicstatus and age have had importance for the description of women and men in the verdicts.Verbal ability has proved to be important of whether the administrative court decides oncompulsory treatment or not.

Foreign direct investment is a critical source of external instruments for financing development for Turkey, FDI can contribute to technology diffusion, Economic growth, Employment generation and Sustainable development. However; the Objective of this research is to examine whether foreign direct investment as an external source of financing effects economic growth in Turkey, based on time series data from 2003 to 2016 during the Erdoğan administration. This study employed Harrod-domar growth model using under OLS method. The paper considerate main variables foreign direct investment, Exchange rate and labor force. Based on empirically investigated the study confirmed that foreign direct investment and Labor force has a positive significant relationship to economic growth in Turkey while exchange rate has a negative significant relationship to economic growth in Turkey. So this paper recommends that movement of Turkey should promote policies encourage and creation of a good microeconomic and macroeconomic a friendly environment and utilization of the careful of loose monetary policy to economic performance.

Abstract:
In this article, we will cover the main anti-Keynesian views and macroeconomic systems that arose in the post Keynes period as well as their fiscal and monetary policy guidelines. As is known, the early Classical economists introduced a macroeconomic system based on the Quantity Theory and Say’s Law resulting in automatic full-employment equilibrium; and finally after 1929-1934 Great World Depression, the Keynesian System was introduced as a “revolution” (Keynesian Revolution) in theory and practice. As a result of the Keynesian policies implemented, European countries and the United States not only got over the Great World Depression but also in the years following the World War II, they have observed a fast and stable growth for a long time. Moreover, cyclical fluctuations have been controlled to a great extent. Even so, at the stage when the Keynesian System was introduced, anti-Keynesian views and macroeconomic systems were immediately introduced. Intense academic discussions between advocates of these views and the Keynesian economists have continued up until today. Meanwhile, many economists such as J.R. Hicks, R.F. Harrod, N. Kaldor, M. Kalesci, A.W. Philips, A. Hansen, P.A. Samuelson, E. Domar, J. Tobin, R. Solow, A.M. Okun, W. Helier, G. Ackler, F. Modigliani, and R. Musgrave and many others have developed and defended the Keynesian System from different aspects. We can characterize significant anti-Keynesian views and macroeconomic systems as the “Counter-Revolution”.
