Abstract:
El presente texto muestra la importancia actual del concepto del derecho subjetivo, según Francisco de Vitoria, en relación con la cuestión de los Derechos Humanos. La noción filosófico-jurídica del derecho subjetivo y del dominio-facultad, en su evolución histórica se remonta, probablemente, a los canonistas de los siglos XII y XIII, que luego pasa a formar parte de la filosofía franciscana del s. XIV (G. de Ockham), y se desenvuelve en el siglo XV por los teólogos de la Universidad de París, Gerson, Summenhart y Mair. Vitoria recibió de dichos teólogos y rescató la noción del derecho-dominio y del derecho-facultad del ámbito filosófico-teológico y la transportó al ámbito jurídico del derecho privado, secularizando el concepto del dominio, que es el centro de su modelo de derecho privado. Define así el derecho subjetivo: «El derecho es la potestad o facultad que conviene a alguien según las leyes», es decir tiene su fuente en la ley. Distingue tres clases de dominio: a) dominio de superioridad (dominium jurisdictionis), b) dominio de propiedad (dominium proprietatis), y c) dominio de sí mismo (dominium sui juris). Francisco de Vitoria puede ser considerado como un precedente de la doctrina de los derechos humanos, precisamente por haber sentado sus fundamentos filosófico-jurídicos, al igual que es considerado fundador del moderno derecho internacional.

Abstract:
Civic republicanism endorses a freedom ideology that can support the corporate social responsibility movement [CSR] in some of the challenges it faces. This article is a call for CSR to embrace this normative guidance as a superior alternative to mainstream liberalism. Part I is the introduction. Part II discusses the institutional changes that gave rise to CSR’s present incarnation. Part III builds upon this discussion, explaining how corporate risk management strategies pose a threat to CSR’s persuasive authority today. It then considers CSR’s options for enhancing governance when such persuasive authority is not available. It determines that inspiring integrity – above all else – is integral to success and that, in turn, the removal of moral distance is key to inspiring such integrity. It also notes that whether a form of coercive authority exists or not to back a governance mechanism, the removal of moral distance will be key to its effectiveness. Part IV notes that efforts to remove moral distance have been attempted since the 1970s, but time has proven that business actors have been resilient to meaningful change. It argues that this failure to reduce moral distance is, in part, the result of mainstream liberalism, which continues to nullify such efforts to make business actors feel more accountable for the impacts of their decision-making. It then explores liberalism, detangling the meaning of possibly the most contested, and normatively powerful, concept from the twentieth century to the present. Part V explains civic republicanism. It then explores civic republicanism’s conceptual proximity to liberalism. Part VI makes the case for why civic republicanism ought to amend the liberal message, recasting the rights and responsibilities of both imperium (that is, the authority of the sovereign) and dominium (that is, the private authority usually emanating from property and contract) within society. Part VII concludes with a short reflection on the ground covered.

Abstract The ideas of a human war on nature, and a human war on animals more specifically, are now current in international politics and international law. This article unearths a historical understanding of war on animals as one paradigm of human relations with animals in the early modern law of nature and of nations (16th to 18th centuries). It shows how dominium (property or mastery) over animals was placed at the origin of all human dominium, and was in consequence conceptually central to its legitimation. It also shows, however, that dominium over animals was not straightforward to justify, because, although they were not human beings, they were seen as sufficiently like human beings in sentience to resist being legally treated like plants or inanimate objects. This article tracks three successive paradigms, all of all of which involve conceptual tensions that are illuminating for current thinking concerning violence against animals.

After more than five hundred years the political ideas of Sir John Fortescue (c. 1394–c. 1476) retain the potency which has ensured that they have seldom suffered total neglect, even if much of the interest they have aroused has been ideological in character. It was perhaps only in the 1930s that Fortescue first received appropriate attention in the context of the history of political thought; and the varied consideration devoted to him by scholars over the past quarter of a century suggests that the process of appraisal is by no means complete. Despite much discussion of Fortescue's basic political categories, it will be argued here, important dimensions of his thought have been fore-shortened – notably in regard to origins, basis, and character of political society as such. Again, some of the perspectives in which the fundamental concept of dominium has been presented may be misleading if they are applied to Fortescue's use of that concept without full recognition of his specific political purposes.

The purpose of this paper is to analyze some of the philosophical problems that derived of the Spanish conquest of America in the perspective of the Spanish Dominican Francisco de Vitoria. Specifically this paper will try to prove that Vitoria considered the Indian commonwealths in the New World, or least some of them, as genuine political entities with the same rights to exercise dominium of their lands and goods as their Europeans counterparts. To justify this, it will be necessary to analyzed key concepts in Vitoria’s thought such as dominium, natural law, and the origins of the civil society. Nevertheless, at the end, it will be examined in which ways Vitoria considers Indian commonwealths inferior to the Europeans, in order to justify the Spanish conquista of the New World.

O conceito de dominium, entre os séculos XVI e XVII, possuía um significado ambivalente, entre as noções de propriedade privada e de poder político, que definiu o paradoxo das relações entre a Coroa e os agentes coloniais mediadas pela tutela e escravidão dos indígenas e africanos. Quais foram os limites definidos pelo dominium senhorial e privado para a emergência da soberania? Analisaremos essa questão em quatro momentos da história americana: na política ultramarina Habsburgo para o Brasil e Angola, entre 1580 e 1640; na colonização britânica e francesa das Antilhas, na segunda metade do século XVII; na política reformista de meados do século XVIII; e nos processos de independência de Cuba, Brasil e EUA.

As especificidades das monarquias ibéricas e de suas experiências coloniais na América e na África Ocidental definiram uma configuração das relações de dominium e poder em uma perspectiva ibero-atlântica, que teve início na passagem do século XV para o XVI, consolidou-se com a União Ibérica e entrou em crise em meados da década de 1610. A conquista da ilha Espanhola e o povoamento de São Tomé, entre 1493 e 1499, revelaram a relação entre o dominium sobre as populações não cristãs e o poder político no processo de colonização. A partir desse ano, as Coroas ibéricas começaram a interferir nas relações de dominium sobre os indígenas e no tráfico de escravos africanos, a fim de definir sua autoridade sobre as sociedades novas estabelecidas nos espaços ultramarinos. A ruptura com o processo de conquista se definiu entre 1542 e 1549, nas Índias Ocidentais, pelo estabelecimento dos vice-reinados e das Leyes Nuevas, e, no Brasil pela instituição do governo-geral e o esboço de uma política indigenista. Entre as décadas de 1570 e 1590 define-se a perspectiva ibérica do poder monárquico e a complementaridade das formas de dominium sobre os indígenas e africanos no Atlântico. A política de Felipe III foi o marco culminante desse processo que definiu os limites e resistências a essa nova arquitetura de poder.<br>The specificities of Iberian monarchies and of their colonial experiences in America and in West Africa defined a configuration of the relationships of dominium and power in a Iberian-Atlantic perspective, which started in the end of the fifteenth century to the sixteenth. It was consolidated with the Iberian Union and started to decline in mid-1610. The conquest of the island Espanhola and the settlement of São Tomé, between 1493 and 1499, revealed the relation between the dominium upon the non Christian populations and the political power in the process of colonization. From that year on the Iberian Crowns started to interfere in the dominium relations upon the Indians and on the traffic of African slaves, to define their authority on the new societies established overseas. The rupture with the process of conquest was defined between 1542 and 1549, in West Indies by the establishment of viceroyalties and the Leyes Nuevas, and in Brazil by the institution of the general government and the sketch of an Indian policy. Between the decades of 1570 and 1590 an Iberian perspective of the monarchical power and the complementarity of dominium forms upon the Indians and Africans in the Atlantic were defined. The policy of Felipe III was the culmination of the process that defined the limits and resistances to the new architecture of power.

This dissertation aims to investigate the conception of dominium present in the work of Bartolus da Sassoferrato (1314-1357). It is known that one of the subjects studied by learned men on the Italian peninsula from the fourteenth century. It was prerequisite for investigate the condition of the emperor as one who held dominium mundi. Among these scholars we can stand out Bartolus Sassoferrato, lawyer and professor at the University of Perugia. He had produced works on the laws that affect other jurists of the Trecento. The proposal is to provide some theoretical approaches concerning the policy and law in the fourteenth century, followed by an overview of coroners life and work. The question of the definition of dominium is presented, seeking to rescue at first the historical appropriation of the concept, then to understand the semantics of the term in the fourteenth century and its relation to studies on the iurisdictio and imperium.<br>Esta dissertação tem como objetivo investigar o conceito de dominium presente na obra de Bartolus da Sassoferrato (1314-1357). Sabe-se que esse foi um dos temas estudados pelos homens de saber na península itálica do século XIV como pressuposto para a investigação da condição do imperador como aquele que detinha o dominium mundi. Dentre esses estudiosos, pode-se destacar Bartolus da Sassoferrato, jurista e professor da Universidade de Perugia, que produziu trabalhos sobre as leis que acabaram por influenciar outros jurisconsultos do trecento. A proposta é apresentar alguns apontamentos teóricos referentes ao estudo da política e do direito no século XIV, seguidos por um panorama da vida e da obra do legista. A questão da definição de dominium é apresentada, buscando-se primeiro resgatar as apropriações históricas do conceito, para então compreender as formulações que influenciaram a semântica do termo no século XIV e sua relação com os estudos sobre iurisdictio e imperium.

La presente tesis comprende el análisis y propuesta para un complejo de oficinas de formato mixto en Miraflores, en la zona más céntrica y de mayor dinamismo de lo que se conoce como “Lima Moderna” y de la ciudad en general. Ante un periodo de pausa en el crecimiento económico del país y el estancamiento del modelo del negocio inmobiliario local actual, este proyecto busca renovar el mercado y la forma en la que se han venido pensando y haciendo los modelos de desarrollo de proyectos en todas sus capas; así como mejorar la calidad de vida de las personas de la ciudad de Lima, y aportar urbanísticamente a mejorar la situación de caos que se vive día a día en ella. En esa línea, no se han detectado productos que ofrezcan un formato novedoso que permita tener una armonía entre la vida privada y el trabajo. Asimismo, el mercado de oficinas prime, ofrece amenities que no llegan necesariamente a cumplir con los estándares que realmente se requieren para poder considerar a los edificios como de esa clasificación y no necesariamente considera el modelo de alquiler de oficinas desde un inicio. En ese sentido, el presente estudio plantea analizar e identificar factores críticos que permitan sustentar esta propuesta. Para poder lograr este propósito, se hace un estudio de la situación actual mundial y nacional, un estudio del mercado de oficinas en Lima, un análisis de la segmentación y target al cual debe ir enfocado el proyecto, así como una propuesta de posicionamiento para optimizar al máximo el value a ofrecer. Luego de realizada la etapa de estudio, se llega a un marketing mix que nos hace afinar el producto hasta obtener un proyecto consistente en una torre de oficinas nivel A+ en el frente principal, a la Av. Ricardo Palma, y un edificio de menor escala hacia la parte posterior, en donde se pueda desarrollar un complejo de viviendas oficina, a manera de las denominadas “Small Offices Home Office” (SOHO), que puedan servir a las empresas de la torre principal y sean un producto complementario a este y, a la vez, sustituto a los pequeños espacios de oficina que los emprendedores, microempresarios, artistas u otros, vienen alquilando o comprando en simultaneo al pago o renta de su casa. Este mix, de 48 SOHOS y 80 Oficinas, es complementado por un zócalo comercial de 14 locales hacia la calle y un área de servicios comunes que sirva de base de ambos edificios, propone ser un formato interesante y novedoso para el desarrollo de la ciudad y la apertura a un nuevo mercado que actualmente está desatendido. Una vez definido el producto, se realiza un análisis económico financiero preparado ad hoc, en donde se plantean tres alternativas con distintas estructuras de negocio. Estas alternativas son de venta total de los inmuebles, una segunda de venta de los SOHO y renta total de las oficinas y los locales comerciales, y una última con venta de las SOHO y venta/alquiler al 50% de las oficinas y los locales comerciales. Estos modelos, en distintas situaciones de estrés, permitirán identificar cuáles son las variables críticas, los umbrales máximos y mínimos de estas, y estimar las distintas rentabilidades que ayudarán a tomar las mejores decisiones para los participantes del negocio en las diferentes circunstancias que pudiesen existir. Estas alternativas no son excluyentes entre sí, sino que permiten prever los diferentes escenarios a los cuales se podría enfrentar el proyecto. Con todo esto, se busca iniciar un modelo de negocio innovador y disruptivo a lo que tradicionalmente se viene ofreciendo en el mercado inmobiliario nacional, que obtenga no solo la satisfacción de los clientes y los stakeholders (accionistas y asociados), sino también del público en general, pudiendo servir de base para modelos pseudo-replicables en el futuro (en el sentido que deberán re-inventarse en cierta medida) con antecedentes exitosos.<br>Tesis

Ce travail étudie la notion de dominium à travers la lecture de trois grands problèmes reliés entre eux dans la Controverse des Indes en Espagne au XVIème siècle : la question de l’esclavage, la justification de la guerre et enfin, la théorie politique qui légitime et donne un fondement politique à la société coloniale. Le travail est structuré autour de quatre grandes parties : dans l’essai méthodologique nous abordons la tradition de l’historiographie de la controverse pour essayer d’analyser les grandes lectures et critiquer des présupposés concernant l’interprétation de la controverse comme débat. Dans la première partie, nous examinons la différence entre la critique de l’encomienda et de l’esclavage pour montrer que ce débat est structuré autour de la question du statut juridique des indiens et non pas de la liberté indienne. Dans une deuxième partie, nous essayons de voir dans quelle mesure le recours à la doctrine de la guerre juste pour justifier le dominium espagnol sur l’Amérique, doit être pensé comme un système de légitimation où la catégorie centrale est le territoire, le dominium, permettant de penser son acquisition selon une analogie entre l’État et les personnes dans le droit civil. La troisième partie enfin, se concentre sur la théorie politique de ce système de gouvernement colonial dont la catégorie de dominium définit les contours : la juridiction territoriale comme centre d’un système où le souverain est un juge qui applique la loi et se soumet à une armature de droits qui contiennent son action<br>This dissertation studies the notion of dominium through the interpretation of three related problems within the great spanish XVIth century debate over the conquest of Americas : the problem of salvery, the justification of war and finally, the political theory that legitimates and gives a political and legal foundation to the new colonial society, and its regime. The work is structured in four great chapters : in the methodological essay we study the different problems treated by tradition of the debate’s historiography ; in the first chapter, we study the theoretical implications of the confrontation between the critic of the encomienda system and the critic of slavery ; in the second, the justification of war through the doctine of just war is analysed through the interpretation of the ideas of international law historians and Carl Schmitt. Finally, in the thrid chapter, we adress the question of dominium as a key concept for the political theory of the spanish monarchy and try to give a new interpretation of its centrality within the perspective of european political philosophy , as confronted with the rise of the « concept of sovereignty ». The final chapter, or conclusion, is a discussion of key issues concerning the place of the colonial question in the fields of political philosophy, the social and political history of the state, and the construction of theoretical categories of belonging in political philosophy

La circulation des biens entre personnes publiques est un phénomène relativement récent qui s'est développé à partir de la fin des années quatre-vingt marquées par un renforcement de la décentralisation territoriale et une altération du droit public économique traditionnel sous l'influence du néolibéralisme. Jusqu'alors les relations patrimoniales étaient marginales entre personnes publiques, qui en raison de leur objet, étaient plus préoccupées par l'exercice de la puissance publique que par le commerce juridique. La circulation des biens publics, indépendamment de leur domanialité, marque aujourd'hui un nouveau mode de communication entre personnes publiques qui se rapproche du droit privé et des valeurs du marché. Ce processus, consacré par le Code général de la propriété des personnes publiques, entré en vigueur en 2006, révèle une véritable mutation de l'administration. Il s'ensuit en effet une transformation des personnes publiques à travers une reconfiguration fonctionnelle des patrimoines administratifs mais aussi du territoire restructuré par la nouvelle distribution des politiques publiques et une banalisation du commerce entre propriétaires publics. De là découlent un approfondissement de la décentralisation et un retour de l'État-gendarme dans sa fonction régulatrice des politiques domaniales. Son imperium prend alors le pas sur son dominium. L'immixtion de la rationalité économique par la circulation des biens entre personnes publiques signe ainsi le passage d'une conception essentialiste à une conception fonctionnaliste des propriétés publiques et du territoire dans lequel elles s'insèrent<br>The circulation of property between public legal entities is a relatively recent phenomenon that has developed since the end of the nineteen eighties, a period characterized by the reinforcement of territorial decentraization and an alteration of traditional public economic law under the influence of neoliberalism. Until then, patrimony relationships between public legal entities were marginalized, since because of their object, the afore mentioned focused more on the exercise of public strength than on juridical business. The circulation of property, independently from their estate regime, is the dawn of communication between public legal ;entities which moves closer to the private law code and market values. This process, consecrated by the "Code général de la propriété des personnes publiques" which was officially sanctioned in 2006, revealed a drastic change in administration. Indeed, the consequence has been the transformation of public legal entities through a functional reconfiguration of administrative patrimony and territory, restructured by a new deal in public politics and a trivialization of business between public entities. A deepening of the decentralization and a return to liberalism with the function of regulating property policies followed. Its imperium prevails over its dominium. The interference of economic rationality by the circulation of properties between public legal entities finalizes the transition from an essentialist to a functionalist conception of public property ans territory

Resumen El desarrollo de proyectos como estrategia de aprendizaje resulta una herramienta muy potente para activar y potenciar el aprendizaje de los alumnos. Tradicionalmente, la evaluación de proyectos mediante ítems numéricos ha sido la técnica más habitual pero la introducción de las competencias transversales en la evaluación del alumno, obliga a actualizar los criterios y formas de evaluación. La presente comunicación presenta la planificación temporal de una asignatura punto de control de Nivel de Dominio III (Master) con un gran número de alumnos que no han trabajo previamente los anteriores dominios. Dentro de la planificación, se encuentra la evaluación para la cual una rúbrica ha sido desarrollada, en la cual los descriptores contienen los ítems que tradicionalmente han sido evaluados y con los que ahora, se evalúa el grado alcanzado por el alumno en cada indicador. Finalmente, se demuestra que la evaluación del grado de adquisición de los resultados de aprendizaje a través de competencias es posible. Se realiza una comparación de notas obtenidas por el sistema tradicional y por competencias, obteniendo resultados muy similares, cuyas diferencias no afectan a la nota final del expediente del alumno. Abstract:
Drawing on Milbank and Agamben, a politico-juridical anthropology matrix can be drawn describing the relations between ius and bios (justice and political life) on the one hand and dominium and zoe (private power and ‘bare life’) on the other hand. Mapping movements in the basic configurations of this matrix over the long sweep of Western cultural history enable us to see where we are currently situated in relation to the nexus between politico-juridical authority (sovereignty) and the emergency use of executive State powers in the context of biosecurity. The argument presented is that pre-19th century understandings of ius and bios presupposed transcendent categories of Justice and the Common Good that were not naturalistically defined. The very recent idea of a purely naturalistic naturalism has made distinctions between bios and zoe un-locatable and civic ius is now disappearing into a strangely ‘private’ total power (dominium) over the bodies of citizens, as exercised by the State. The very meaning of politico-juridical authority and the sovereignty of the State is undergoing radical change when viewed from a long perspective. This paper suggests that the ancient distinction between power and authority is becoming meaningless, and that this loss erodes the ideas of justice and political life in the Western tradition. Early modern capitalism still retained at least the theory of a Providential moral order, but since the late 19th century, morality has become fully naturalized and secularized, such that what moral categories Classical economics had have been radically instrumentalized since. In the postcapitalist neoliberal world order, no high horizon of just power –no spiritual conception of sovereignty– remains. The paper argues that the reduction of authority to power, which flows from the absence of any traditional conception of sovereignty, is happening with particular ease in Australia, and that in Australia it is only the Indigenous attempt to have their prior sovereignty –as a spiritual reality– recognized that is pushing back against the collapse of political authority into mere executive power.
