The number of free trade agreements (FTAs) concluded by the United States of America (US) has grown vastly over the past two decades. While FTAs contribute to increased global competition and as such may also contribute to socially-undesirable practices in the area of working conditions and the environment, the proliferation in FTAs has paradoxically also augmented the potential for making free trade more fair as some of these agreements now include labour provisions. Abstract This article examines how tribunals set up under the CAFTA-DR have interpreted the fair and equitable treatment (‘FET’) standard under Article 10.5 in the last 15 years. It shows that they have consistently referred to NAFTA case law to define the standard and to interpret the scope and content of the different elements it contains (arbitrary conduct, legitimate expectations, due process). El presente estudio nació como respuesta a la necesidad de conocer los impactos que el tratado de libre comercio con los Estados Unidos (DR-CAFTA) tendría en la economía rural, en particular en sus segmentos más pobres. La metodología utilizada toma en cuenta la heterogeneidad de los hogares rurales de Honduras, las vinculaciones económicas entre ellos y sus relaciones con los mercados.
