La construcción conceptual de la Drittwirkung ha desempeñado un papel de suma importancia en la historia de la dogmática alemana de los derechos fundamentales. En este trabajo se analizarán las clásicas construcciones que han presentado este concepto dentro de la jurisprudencia y el debate académico. Asimismo, el autor propone ampliar el concepto de la Drittwirkung con el objetivo de adecuarla a los nuevos retos presentados por los derechos fundamentales. Esto último, por medio de la teoría de la transformación de los derechos morales en derechos fundamentales.

Abstract: The theory of the horizontal effect of fundamental rights or Drittwirkung, according to which fundamental rights apply in relationships between private parties, is proclaimed as an innovative and enriching recalibration of private law. Illustrated by means of the issue of conditional bequests, it is argued that this claim is highly exaggerated. The innovation is merely of a terminological nature: fundamental interests have been taken into account since days of old, only to become rephrased more recently in terms of fundamental rights. As a rule, private law does not have to refer to fundamental rights to protect these interests. Moreover, within the horizontal dimension, fundamental rights are inadequate instruments, the application of which is unlikely to offer any additional value. Résumé: La théorie de l’effet horizontal des droits fondamentaux ou Drittwirkung, selon laquelle les droits fondamentaux sont applicables aux relations entre parties privées, est proclamé comme un re–calibrage novateur et enrichissant du droit privé. Illustré par la délivrance de legs conditionnels, cet article défend l’idée que cette affi rmation est fortement exagérée. L’innovation est seulement de nature terminologique: les intérêts fondamentaux ont toujours été pris en considération, et ont uniquement été reformulé récemment en termes de droits fondamentaux. En règle générale, le droit privé n’a pas besoin de se référer aux droits fondamentaux pour protéger ces intérêts. En outre, dans leur dimension horizontale, les droits fondamentaux sont des instruments inadaptés, dont l’application est peu susceptible d’offrir quelque valeur additionnelle que ce soit. Mots clés: Drittwirkung, legs conditionnels. Zusammenfassung: Die Theorie von der Horizontalwirkung der Grundrechte oder ?Drittwirkung?, der entsprechend Grundrechte in der Beziehung zwischen privaten Parteien Anwendung fi nden, wird als eine innovative und bereichernde Neujustierung des Privatrechts gesehen. Veranschaulicht durch die Problematik des bedingten Vermächtnisses, wird argumentiert, dass dieser Anspruch äußerst übertrieben ist. Die Neuerung ist lediglich terminologischer Natur: grundlegende Interessen sind seit jeher Beachtung geschenkt wurden, nur um später im Hinblick auf Grundrechte neu formuliert zu werden. In der Regel muss das Privatrecht sich nicht auf die Grundrechte beziehen, um diese Interessen zu schützen. Weiterhin sind Grundrechte in der horizontalen Dimension unzulängliche Instrumente, deren Anwendung nur unwahrscheinlich einen zusätzlichen Wert zu bieten vermag. Abstract: Constitutional values are slowly but surely gaining territory in private law relationships and disputes – see the scholarly discussion on the so–called ’Drittwirkung’ (horizontal effect) of fundamental rights. While examining the example of linguistic and minority rights, this article shows that one crucial problem in the context of Drittwirkung arises from the fact that the European nations are still far from sharing a precisely and uniformly defi ned set of common values, and that there are even values like diversity, equality and non–discrimination which are bound to lead to contradictory results once applied in European legal practice. As to language–based contractual disputes, this article consequently argues that there is currently no possibility for a uniform solution model for such case patterns on European territory. The author rather opts for a multi– dimensional approach, taking account of all of the various aspects of the problem, and tries to outline some guidelines as a tool for judges confronted with such cases in everyday legal practice. Résumé: Des valeurs constitutionelles deviennent de plus en plus importantes dans les relations et les disputes du droit privé – voir le débat académique actuel sur l’ainsi nommé Drittwirkung (effêt horizontal) des droit ondamentaux. Examinant l’exemple des droits linguistiques et des minoritées, cet article démontre qu’un problème capital dans le contexte de Drittwirkung résulte du fait que les nations européennes se trouvent encore loin d’un ensemble des valeurs défi ni d’une manière précise et homogène. Il y existent même des valeurs comme la diversité, l’égalité et la non–discrimination qui mènent, lors de leur application dans les systèmes juridiques en Europe, nécessairement à des résultats contradictoires. Quant à les disputes contractuelles résultant des problèmes lingustiques, cet article soutient qu’il ne peut pas avoir, à l’heure actuelle, un modèle de solution unitaire pour ces schémas des cas dans le territoire européen. Par contre, l’autrice se prononce en faveur d’une approche multidimensionnelle prenant en compte tous les aspects du problème et essaye de délinéer quelques directives comme instrument pour les juges ayant à traiter de tels dossiers dans leur travail quotidien. Zusammenfassung: Verfassungswerte gewinnen in Privatrechtsbeziehungen und –streitigkeiten immer weiter an Bedeutung – vergleiche die akademische Debatte über die sogenannte Drittwirkung der Grundrechte. Anhand des Beispiels von Sprach– und Minderheitenrechten zeigt dieser Artikel, dass ein Schwerpunktproblem im Bereich der Drittwirkung aus der Tatsache herrührt, dass die europäischen Nationen noch weit von einem genau und einheitlich defi nierten gemeinsamen Wertekanon entfernt sind, und dass es sogar Werte wie Vielfalt, Gleichheit und Nichtdiskriminierung gibt, die bei ihrer praktischen Anwendung in der europäischen Rechtspraxis zwangsläufi g zu widersprüchlichen Ergebnissen führen. Hinsichtlich sprachbasierter Vertragsstreitigkeiten vertritt dieser Artikel folgerichtig die Ansicht, dass es momentan keine Möglichkeit für ein einheitliches Lösungsmodell für derartige Fallschemata auf europäischem Gebietgibt. Europos žmogaus teisių konvencija įtvirtina fundamentalias teises ir laisves, kurios vadovaujantis klasikine teorija negali būti taikomos santykiuose, susiklosčiusiuose tarp privačių individų. Magistro darbas ginčija šią prezumpciją ir pateikia alternatyvų požiūrį – koncepciją, kuri teorijoje žinoma kaip Drittwirkung arba horizontalusis veikimas. Drittwirkung – tai individų galimybė Konvencijos garantuojamas žmogaus teises vykdyti tiek prieš kitus individus, tiek prieš valstybės valdžios institucijas. Magistro darbas analizuoja, kokių Konvencijos teisių atžvilgiu ir kokia apimtimi egzistuoja horizontalusis efektas. Be to, ypatingas dėmesys skiriamas valstybės atsakomybės, kai tiesioginis teisės pažeidėjas yra privatus subjektas, klausimui, nepaliekant nuošaly Europos priežiūros valstybėms ribų nustatymo problemos. Išsami Strasbūro Teismo praktikos analizė atskleidžia, kad pagarba žmogaus teisėms reikalauja apsaugoti individą nuo privačių pažeidimų, o kai valstybė nesugeba imtis adekvačių prevencinių ir baudžiamųjų veiksmų dėl atitinkamo piktnaudžiavimo, tuomet ji gali būti laikoma pažeidusi tarptautinius įsipareigojimus. Horizontalaus efekto taikymo atskirų Konvencijos teisių atžvilgiu analizė leidžia pateikti išsamesnį Konvencijos pareigų valstybėms ir privatiems subjektams supratimą, o tai tiesiogiai padeda gerinti individo teisių apsaugą.
The European Convention on Human Rights sets forth a number of fundamental rights and freedoms which by traditional conception are irrelevant for cases that concern the sphere of relations between individuals. The thesis challenges this presumption and presents an approach to human rights which suggests that Convention is applicable to the behaviour of private parties – the concept known by German word Drittwirkung (effect on third party or horizontal effect). The study seeks to provide a critical examination which Convention rights can be affected by Drittwirkung and to what extent. Furthermore, it discusses the framework of holding the state responsible where the direct source of the infringement is a non-state actor rather than a public authority and attempts to define the limits of increasing burdens on state. Thorough review of the Strasbourg case-law relating to the question of violations of human rights by private bodies leads the author to the conclusion that states are obliged to protect individuals from private acts and where a state has failed to take preventive or punitive action with regard to the abuse, then a state could be in violation of its international obligations. Systematic analysis of the scope of horizontal effect on Convention articles separately enables a fuller understanding of the Convention duties to member states and non-state actors which directly helps to improve the protection of human rights.
