Full textIn European public law, subsidiarity plays its role at two levels : that of the distribution of competences between the State and the local government units and that of the relations between public authorities and individuals. Applicable to the distribution of competences between central and local decentralized authorities in a State, territorial subsidiarity is likely to justify the decentralization policy and the transfers of competences implied by it, and to enhance, therefore, local autonomy. Our dissertation aims at checking this hypothesis, in the context generated by the introduction of the principle of subsidiarity in the French Constitution, subsequent to its revision in 2003. First, the concept of local autonomy is circumscribed. Then, the limits and the content of French local autonomy are analyzed, from the point of view of the ways in which they have been influenced by subsidiarity. A similar approach follows for the Romanian legal system, in the context in which the principle of subsidiarity appears in certain statutes governing the public services and the local public administration

Full textThe chosen topic sets forward the interest of an interdisciplinaryapproach as well as the approach from the perspective of comparative law, thusconferring originality, but also an innovating vision on the intersection of two lawbranches. We propose the analysis of criminal law constitutionalization due to thegeneral trend in which criminal law is equally subscribed, namely that ofinternationalization, Europeanization and constitutionalization of law. Moreover, thestudy of the two law branches is relevant given the highly intimate connectionsbetween them, through rendering more effective the protection of fundamental rightsand liberties.As research method we subscribed the entire thesis to a well-known method ofRomanian and French university school which embraces a new binary structure:problematization – solutions or hypothesis – demonstrations. The problem orhypothesis raised by the thesis is ”What is the starting point and how does the process of constitutionalization of the criminal law acts/functions?”, implicitlyadmitting the existence of such a phenomenon. The solutions or demonstrations arereflected as answers to the central questions, forged on the research plan of thethesis: highlighting the relations between criminal law and the Constitution,respectively of the means of constitutionalization and the effects of this phenomenon.Following the principles exposed by Legal Sociology regarding the integration of aprocess in the limits of a phenomenon, we reached the conclusion that in the case ofconstitutionalization, it fulfills all necessary requirements in order to be catalogued assuch. An argument in this respect is represented by the spread of this phenomenonboth from the spatial perspective (being encountered both in the European space aswell as in the international space) and from the perspective of the branches of law,which are subject to the process of constitutionalization (accordingly, we identified aseries of illustrations from Administrative Law, Labor Law, Economic Law, EuropeanLaw of Contracts or the Right to a Healthy Environment).The crystallization of the constitutionalization notion is carried out by reporting toother terms, so as to configure the delimitation of the concept. In order to delimit theconcept of constitutionalization we conducted a reporting to codification,constitutionalism, conventionality and constitutionality, underlining the existingdiscrepancies between these terms. It is estimated that there are seven stages ofconstitutionalization: 1) rigid constitution, 2) jurisdictional guaranteeing of theConstitution, 3) the compulsory force of the Constitution, 4) ”over-interpretation” ofthe Constitution, 5) interpretation of laws in accordance with the Constitution, 6)direct application of constitutional norms, 7) influence of the Constitution on politicalreports.The binary structure of the doctorate thesis proposes the analysis of theconstitutionalization phenomenon from a dual perspective: the premises ofconstitutionalization (materialized in the supremacy of the Constitution, theconstitutional grounds of criminal law, as well as constitutional guarantees in criminalmatters), and the proper constitutionalization of criminal law (which we equallystructured on the means of achievement of constitutionalization and the effects of thisphenomenon)

Full textIn this dissertation we study the impact/evolution of Universal Service inFrench/Romanian and EU telecommunication-related legislation. We will also address the issue of institutional/financial support of such service during its evolution. The Universal Service legislation is a compromise between two different views; (i) the concept of public monopoles and (ii) the influence of EU regulations that provide equal access to the resources and the competition for the existing and future members. In order to better explain the concept and the current status of such service, first an introductory presentation of the EU-related legislation (telecommunications) will take place. We will focus on the following aspects; the general conditions of liberalization of the telecommunication market, the notions of public service and the need of maintaining a service of general interest within the legislation of EU members while being consistent with the EU legislation. Then, we will explore the mutual relation between universal and public service and demonstrate that such service was initially developed under the strong influence of public monopolies legislation. At the same time we will demonstrate that the evolution of such service had a direct impact on the national legislation. It has led in abandoning one of its core characteristics, the strong and direct relation with the public administration. We will also study the influence of EU Universal Service legislation to a candidate/future member of EU, the Republic of Romania that is still in the process opening the public services (like the telecommunication) to the competition. Such public/service structure reflects on the related legislation. We will focus on the telecommunication-related legislation and discuss the consequences of such opening/liberalization process

Full textThe international joint venture is the best legal device to point out the movement toward a transnational trend of the law. This operation sets up a legal entily, controlled by two or several partners bound together bw deep mutual trust. As a legal entity, joint ventures may have any corporate shape provided for by national law. The corporation, as an insturment, is governed by corporation law, that is only national law. On the other hand, as the legal ties which are set up between parners are affected through international agreements, the latter are submitted to any legal system chosen by the parties and are also characterized by the parties'wide freedom. Joint venture therefore include a twofold resulting from linked on the one hand to national corporation law and and the other hand to international agreements. This aspect can be found in any joint venture, specially those set up in eastem european countries, which are said to be countries in transition. Rumania is the most significant illustration to this political, economical and legal transition. Indeed, on the one side, because thue joint venture is a corposation under national law, ot enables the state's economic intervention through enactment of corporation law. This intervention is more significant when the rumanian partner is itself controlled by the state, which is the most frequent case today. On the other side, it will be possible to limit the effects of national public policy with the internationalizing of the operation. Full textThe thesis finds its main purpose in the study of the recent evolution of French and Romanian civil law of liability during the pre-contractual period. We favored a comparative approach between national rights, in the light of European laws. During the pre-contractual period, the parties are free to negotiate as they please, as long as they do not cause damage to their partner. A bond is created between the parties and it can only be broken in accordance with the principle of good faith. We noted that the basis of liability is fairly controversial and varies from one legal system to another. Indeed, the civil liability is balances between legal security, private autonomy and freedom of contract. In summary, the pre-contractual phase has experienced profound transformations in its evolution. At the time of European harmonization, or even globalization, French and Romanian law undergo modifications in order to clarify the most complicated rules, in particular those relating to pre- contractual civil liability
