A proposta deste trabalho final de mestrado é a criação de um Sistema de Avaliação de Desempenho (SAD), num lar de crianças e jovens em perigo, o Lar Maria Droste. The proposal of this final Master work is the creation of a Performance Evaluation System (PES) applied to a home care for children and young people at risk, called Lar Maria Droste. The project intends to create a PES to optimize the Home Care performance. It is important that this project is in accordance with the mission and objectives of the organization, promoting a better guidance of the human resources, encouraging the fulfillment of their work´s objectives. Furthermore, it intends to improve relationships between the leaders and the rest of the workers. For this reason, the goal of this project is to implement the objectives and mission of this Home Care by improving relationships between leaders and workers and by presenting a proposal that offers a greater proximity through an active and open communication. Therefore, this would promote a better performance of the organization to achieve better results in creating responsible adults.

Abstract:

Este trabalho é guiado por uma questão central que diz respeito ao comportamento de tradutores e editores diante de textos de cujo conteúdo eles talvez discordem. Em termos concretos, analisouse como as traduções de um determinado texto Die Judenbuche (1842), de Annette von DrosteHülshoff, um texto canônico da literatura alemã, ainda sem recepção e sem tradução no Brasil enfrentaram os motifs judaicos nela contidos, motifs estes que apontam para estereótipos antijudaicos. O corpus de análise foi composto por 25 traduções de 12 idiomas e 13 países, todos do âmbito cultural chamado de Ocidente, coincidindo, do ponto de vista temporal, aproximadamente com o século XX. Baseandose em teorias de recepção (principalmente nas vertentes de Wolfgang Iser e da ReaderResponseTheory) e de reescritura (de André Lefevere), a pesquisa buscou mostrar que traduções, uma das formas de recepção e reescritura de literatura, evitam discutir temas sensíveis nos textos nelas publicados e são, assim, mais \"estáticas\" do que a crítica literária, uma outra forma de recepção e reescritura, escolhida aqui como ponto de comparação. Para a análise das traduções, certos trechos e aspectos da Judenbuche foram definidos e analisados em relação ao original. Além dos textos traduzidos, os paratextos das traduções foram também analisados. Nos textos traduzidos, procurouse por shifts indicativos de atitudes; nos paratextos, por menções aos motifs judaicos e discussões sobre eles. A interpretação dos resultados considerou vários contextos (os contextos nacionais e históricos, as editoras, a identidade dos autores dos diferentes gêneros textuais, as convenções dos gêneros, etc.). Como contexto comum e como uma das fontes de reações dos autores dos textos analisados foi presumido o contexto da história judaica no Ocidente. Os resultados da análise confirmaram, por um lado, a hipótese, mostrando que as traduções de fato não costumam debater explicitamente temas sensíveis em textos literários. Ao mesmo tempo, contudo, as traduções mostraram que os motifs judaicos da Judenbuche preocuparam sim os tradutores e editores. Os textos traduzidos mostraram diversos shifts. Nos paratextos, menções explicitas e valorativas aos motifs judaicos foram poucas, mas observouse a tendência de seu aumento nos anos mais recentes, nos quais o tema do antissemitismo na literatura vem ganhando destaque no âmbito dos estudos literários. Traduções inseridas em contextos acadêmicos mostraram mais ocorrências de menções aos motifs judaicos em paratextos do que traduções direcionadas a um público geral. Em relação ao contexto da história judaica do século XX, mudanças no corpus como todo foram observadas; shifts nos textos traduzidos aumentaram no período de 1933 a 1945, enquanto os textos traduzidos de depois de 1945 mostram uma tendência a atenuar as ambiguidades da Judenbuche. Em relação aos contextos nacionais, mudanças foram observadas na direção de um aumento de sensibilidade em relação ao conteúdo da Judenbuche. Concluiuse, assim, que, embora traduções não fossem consideradas uma plataforma de debates abertos sobre o problema do antissemitismo na literatura, os tradutores e editores mostraram um aumento de sensibilidade em relação ao tema no decorrer do tempo.
This study is guided by a question about the behaviour of translators and editors towards texts the contents of which they possibly disagree with. More specifically, the study analysed how the translations of a particular text Die Judenbuche (1842), by Annette von DrosteHülshoff, a canonical text of German literature, as yet without reception or translation in Brazil face the Jewish motifs contained in it, motifs sometimes considered as antiSemitic stereotypes. The corpus of the study, composed of 25 translations into 12 languages and from 13 countries, comprehends the cultural area usually denominated as the West, and coincides temporally with the 20th century. Based on theories of reception studies (by Wolfgang Iser and from ReaderResponseTheory) and on the theory of rewriting (by André Lefevere), the study sought to demonstrate that translations, one of the forms of reception and rewriting of literature, avoid discussing sensitive topics in the translated texts, and are thus more \"static\" than literary criticism, another form of reception and rewriting, chosen as point of comparison. For the analysis of the translations, certain passages and aspects of Die Judenbuche were defined and analysed in comparison with the original. The paratexts of the translations were also analysed. The analysis of the translated texts sought to identify shifts indicatives of attitudes; the analysis of the paratexts sought to identify references to and discussions on the Jewish motifs. The interpretation of the results considered different contexts (the national and historical contexts, the publishing houses, the identity of the authors of the different text genres, conventions of the genres etc.). The Jewish history in the West was presumed as a common context and as one of the sources of attitudes of the authors of the analysed texts. The results of the analysis confirmed the hypothesis, demonstrating that translations in fact do not undertake explicit debates of sensitive topics in literary texts. However, the translations also demonstrated that the Jewish motifs in Die Judenbuche did preoccupy the translators and editors. The translated texts contained diverse shifts. In the paratexts only few explicit and evaluative references to the Jewish motifs were identified, but in recent years, in which literary antiSemitism has received more and more attention in literary studies, an increase in references was observed. Translations from academic contexts showed more references to Jewish motifs in their paratexts than translations for the general public. Against the context of Jewish history in the 20th century, variations have been observed in the corpus as a whole; in the translated texts, shifts increased during the years from 1933 to 1945, while in the years after 1945 tendencies towards an attenuation of Die Judenbuche\'s ambiguities dominated. Within the national contexts, an increase of sensibility towards the content of Die Judenbuche was observed. Thus, even though translations apparently are not considered a platform for debates on problems of antiSemitism in literature, the results evidenced that translators and editors did show, in the course of time, an increase in sensitivity with regard to the topic.

Abstract:

Bien que le domaine du droit d'auteur ne ressortisse pas, a priori, des spheres de competence de la communaute europeenn e, le droit communautaire apprehende cependant la protection juridique de la creation. Cette prise en compte s'effectue selon deux mouvements qui se veulent complementaires. Elle a d'abord consiste en une tentative de conciliation des legislations nationales traitant du droit d'auteur et des droits voisins avec les principes du traite de rome, et ce, dans l'optique de favoriser la realisation d'un marche interieur. A cette demarche revelant ses insuffisances s'est ensuite ajoutee une dynamique d'harmonisation qui s'efforce de mettre en place un regime communautaire du droit d'auteur, seul a meme d'assurer une protection efficace de la creation et des createurs au sein de la communaute et dans les relations internationales. Cette entreprise est encore incomplete; les instances communautaires, guidees par le principe de necessite, n'intervenan t que pas a pas dans ce domaine. Mais l'enchevetrement des questions appelle sans cesse de nouvelles adaptations, rendues particulierement imperieuses a l'heure des revolutions techniques. Though copyright is not part, a priori, of the european community competences field, the community law yet takes in consideration the legal protection of creation. This phenomenom is divided into two complementary directions. It has first consisted in a try to conciliate national legislations about copyright and neighbouring rights with the principles of the rome treaty to ease the realization of an internal market. This approach has reveales its inadequacy, which explains why the community has next iniated an harmonization process, trying to organize a european regime for copyright. Only such an evolution is able to assure an appropriate level of protection for creation and authors inside and outside the community. This concern is not yet achieved. The european community, led by the necessity principle, is intervening step by step in this area. But the tangle of the questions always requires new adjustements, becoming particularly imperious at the time of technical revolutions. Copyright in the european community is coming up

Cette thèse a pour objet de mettre en évidence l’essentiel des rapports existant ou pouvant se faire jour entre le droit d’auteur et les droits de l’Homme. En premier lieu, le droit d’auteur est-il un droit de l’Homme? D’un point de vue axiologique, certaines valeurs ont été mises en évidence qui tendent à démontrer la pertinence de cette qualification. En droit positif, le droit d’auteur est indiscutablement consacré comme un droit de l’Homme, mais de manière souvent incomplète ou ambiguë. Certaines propositions ont ainsi été émises afin de compenser ces carences. En second lieu, le droit d’auteur peut-il constituer une atteinte à certains autres droits de l’Homme? Outre les droits du public à l’information et à la culture, souvent mis en exergue par les opposants à la propriété littéraire et artistique, il s’est agi d’envisager les hypothèses de conflit avec la liberté artistique, le respect de la vie privée ou encore le droit de propriété d’autrui. A l’étude, aucun antagonisme irréductible ne se fait jour, et la conciliation des droits en présence apparaît relativement simple à effectuer dans la mesure où chaque droit est bien défini et que le droit d’auteur reste conforme à ses fondements initiaux
This thesis shows the different links that exist between author’s right and human rights. Primarily, we have determined whether we can qualify author’s right as being a human right. From an axiological point of view, some values have been highlighted to demonstrate the pertinence of this qualification. Regarding the positive right, author’s right as a fundamental right is undoubtly established, but often in an imperfect or ambiguous way. Some suggestions have been made to compensate these deficiencies. Secondly, we have reviewed whether author’s right could be in conflict with certain human rights. Besides the public’s rights to information and culture which are often highlighted by opponents to author’s right, it was necessary to analyse the hypothesis of a conflict with artistic liberty, respect of privacy or property right. The study shows that, in fact, no insurmountable antagonism exists ; coordination of these different rights is relatively simple to put in place, to the extent that every right is well defined, and that the author’s right remains in accordance with its original principles

En ce début de XXIe siècle, il semble presque impensable de traiter d'une question juridique sans faire la moindre référence aux " droits fondamentaux ". Comme si un rattachement aux " droits fondamentaux " était un " label de légitimité ". Pourtant, les études générales relatives à la place et à la signification de ces derniers dans le système juridique sont encore assez rares. Alors que le phénomène de "constitutionnalisation du droit" est constamment étudié, la question de la "théorisation des droits fondamentaux" est délaissée, notamment par le droit privé. Cette étude entend participer à l'enrichissement de la connaissance des droits fondamentaux, indispensable à leur bonne application. Pour ce faire, elle met en relief le lien très fort qui unit les droits fondamentaux et le droit du travail. Le droit du travail véhicule une conception renouvelée du Droit qu'il est possible de nommer " conception sociale du Droit ". Traduisant la nécessité de réaliser concrètement les droits de l'Homme, la conception sociale du Droit a légitimé l'émergence des droits fondamentaux. Le droit du travail enrichit la triple définition formelle, organique et matérielle des droits fondamentaux. Il consolide la théorie juridique des droits fondamentaux. Parallèlement, les droits fondamentaux sont à l'origine non seulement de la formation mais aussi de la transformation du droit du travail. Les droits fondamentaux irriguent le droit de la relation de travail. Les données révélées par l'étude de l'interaction entre ces deux grands domaines conduisent à confirmer l'existence d'une véritable catégorie juridique autonome et, au-delà, à l'émergence d'un Droit des droits fondamentaux
At the very beginning of the 21st century, it seems almost impossible to deal with a legal issue without referring to "fundamental rights" as if such a reference was a "guaranty of legitimacy". Nevertheless, general studies relating to the place and the meaning of "fundamental rights" in the legal system are still rather unusual. Whereas the matter of "law constitutionalization" is regulary studied, the issue of "theorization of fundamental rights" is abandoned, especially by private law. To take part in the enrichment of fundamental rights knowledge, which is essential to a good law enforcement, this study aims at emphasizing the very strong link between fundamental rights and employment law. Employment law conveys a renewed conception of law, which can be called "social conception of law". Expressing the necessity of renforcing the human rights in concrete terms, the social conception of law has legitimated the emergence of fundamental rights. On the one hand, employment law enrichies the triple definition : formal, organic, and material of the fundamental rights and strengthens their legal theory. On the other hand, the fundamental rights are behind not only the development but also the transformation of employment law. They irrigate the law of working relation as well. The data revealed by the study of the interaction between employment law and fundamental rights allow to confirm the existence of a genuine juridical independent category, and beyond, lead to the emergence of a law of fundamental rights

L'expression "libertes et droits fondamentaux" a progressivement penetre le langage des juristes francais avant d'etre consacree par le conseil constitutionnel dans une decision du 22 janvier 1990. Elle designe des prerogatives individuelles et collectives garanties par l'ordre constitutionnel. Cependant, l'emergence d'un corps de regles constitutionnelles substantielles est bien anterieure a l'avenement de l'expression "libertes et droits fondamentaux" dans le langage du droit. Aussi, l'objet designe par cette expression etait-il deja present dans le systeme juridique francais sous d'autre registres de nomination. Il semble donc que l'emploi de l'adjectif "fondamental" traduise la volonte du conseil constitutionnel, d'une part, d'harmoniser sa terminologie sur celle des instances supra-etatiques, d'autre part, de proceder a une sorte de hierarchisation entre les differentes normes de valeur constitutionnelle. Une etude se donnant pour objet d'analyser le droit du travail a la lumiere des droits fondamentaux comporte deux axes de reflexion. Il convient d'abord de s'interroger sur la fonction de la reference aux dispositions constitutionnelles exprimant des droits fondamentaux dansle contentieux du travail. Les decisions de justice qui contiennent une reference aux droits a la constitution peuvent se comprendre comme un produit des contraintes de l'argumentation juridique. Il s'agit egalement d'analyser les formules legislatives et jurisprudentielles qui assujettissent l'exercice par l'employeur de ses prerogatives aux droits des personnes et aux libertes individuelles et collectives ainsi qu'a une exigence de justification des mesures restreignant l'exercice de ces droits et libertes dans l'entreprise.

Abstract:

Inspirés par des objectifs d'humanité, le droit humanitaire et les droits de l'homme tissent des liens très étroits. Ils convergent à plusieurs égards, et se complètent pour protéger la personne humaine. Une analyse comparative des deux systèmes révèle de nombreuses similarités. Toutefois certaines divergences persistent: il s'agit toujours de deux droits distincts mais très proches. Plusieurs critères sont employés pour les mettre en parallèle. La comparaison entre le droit humanitaire et le droit des droits de l'homme débouche sur l'étude de leurs rapports mutuels. Celle-Ci montre le mouvement actuel existant. C'est qu'ils se rapprochent toujours plus et passent d'une simple complémentarité vers une étape beaucoup plus avancée. S'agit-Il d'une réelle intégration entre les deux systèmes?
The objectives of Human Rights and Humanitarian Law are inspired by principles of humanity. They are tightly linked and share many common elements. The two bodies of laws complement each other to protect further human beings. A comparative analysis in this regard shows many similarities. However there are still some differences between them: they are two separate laws despite being too close. Many criteria are used to study them in parallel. This study reveals their mutual relations, and the existing legal movement. They are getting closer and shifting from a mere complementarity to a more advanced stage. Are they moving towards a real integration between their norms?
