Abstract:
Purpose The purpose of this paper is to employ a case study of the Omeka content management system to demonstrate how the adoption and implementation of a metadata standard (in this case, Dublin Core) can result in contrasting rhetorical arguments regarding metadata utility, quality, and reliability. In the Omeka example, the author illustrate a conceptual disconnect in how two metadata stakeholders – standards creators and standards users – operationalize metadata quality. For standards creators such as the Dublin Core community, metadata quality involves implementing a standard properly, according to established usage principles; in contrast, for standards users like Omeka, metadata quality involves mere adoption of the standard, with little consideration of proper usage and accompanying principles. Design/methodology/approach The paper uses an approach based on rhetorical criticism. The paper aims to establish whether Omeka’s given ends (the position that Omeka claims to take regarding Dublin Core) align with Omeka’s guiding ends (Omeka’s actual argument regarding Dublin Core). To make this assessment, the paper examines both textual evidence (what Omeka says) and material-discursive evidence (what Omeka does). Findings The evidence shows that, while Omeka appears to argue that adopting the Dublin Core is an integral part of Omeka’s mission, the platform’s lack of support for Dublin Core implementation makes an opposing argument. Ultimately, Omeka argues that the appearance of adopting a standard is more important than its careful implementation. Originality/value This study contributes to our understanding of how metadata standards are understood and used in practice. The misalignment between Omeka’s position and the goals of the Dublin Core community suggests that Omeka, and some portion of its users, do not value metadata interoperability and aggregation in the same way that the Dublin Core community does. This indicates that, although certain values regarding standards adoption may be pervasive in the metadata community, these values are not equally shared amongst all stakeholders in a digital library ecosystem. The way that standards creators (Dublin Core) understand what it means to “adopt a standard” is different from the way that standards users (Omeka) understand what it means to “adopt a standard.”

Abstract:
The Dublin regime – in short – determines which EU Member State is responsible to examine an application for asylum. The former Dublin Convention was signed in 1990 and first came into force in 1997. Today, 22 years and several legislative generations later, the Dublin regime is determined by the Dublin-III Regulation. After the 2015 so called ‘migration crisis’ and the collapse of legal principles in the Regulation, European legislators called for a reform of the Dublin system. Beside the will to reform the whole Common European Asylum System (CEAS), special focus lies on the reform of the Dublin-III Regulation. Therefore, the Commission issued its proposal for a new Dublin-IV Regulation. The proposal led to enormous controversies not only in the academic world but also in the European Institutions themselves. The aim of this article is first to analyse the Dublin-IV proposal against the background of fundamental and human rights with the incorporation of relevant case law of the ECJ and the ECtHR. The analysis will show several such violations and contradictions to the relevant jurisdiction. Furthermore, it will be demonstrated that the European Institutions are far from consent with regards to the Commission’s proposal. By showing the different approaches of the Institutions and of the academic world, finally, this article will provide guidelines on how to reform the Dublin regime adequately and in accordance with fundamental and human rights.

Abstract:
The approval of the 2014 joint Global Definition of Social Work required that international social work associations review the associated ethical principles of social work. The Global Social Work Statement of Ethical Principles ( GSWSEP) was approved by international social work bodies in Dublin in July 2018. While the previous Statement of Ethics emphasized liberal humanist values common in the European–North American axis, the GSWSEP recognizes the global nature of the social work profession and locates human dignity at the core of social work ethics. The GSWSEP problematizes the core principles of social work, and responds to calls to decolonize social work in the context of the increasing regulation of social work.

Abstract:
Dublin City University, originally established in 1989, is located approximately 5km to the north of Dublin City Centre and is the most significant and comprehensive provider of university education on the rapidly growing and economically important Irish Eastern corridor. DCU is committed to embedding an ethos of sustainability across the entire institution. Sustainable operations are a core element of the DCU Sustainability Plan. Baseline ecological footprint metrics have been agreed and ambitious targets are set on an annual basis to reduce these with the eventual target of delivering a carbon neutral campus. Such baselines have been agreed for all campuses for water consumption. Several projects have been undertaken both on an operational and research footing to address consumption levels. Such projects include full water surveys of all campuses leading to significant savings due to fixing of leaks. In addition to operational projects, DCU focuses on educating and information its internal and external communities raising awareness of the importance of this essential resource and seeking behavioural change to reduce consumption and increase the implementation of water efficient principles and practices.

Abstract: The teaching and practice of rhetoric at Trinity College, Dublin, in the eighteenth century have been little discussed in the literature. This article describes the curriculum and pedagogy related to the old and “new rhetoric” of the Scottish enlightenment as disclosed by documents in the archives of Trinity College Library; the published lectures of two Erasmus Smith Professors of Oratory and History, John Lawson and Thomas Leland; and the lectures of Thomas Sheridan on elocution. Minutes of the student historical clubs in which debates and harangues are preserved illustrate the interests of the students, their techniques of debate, and the demonstrative exhortations of their officers. The student orations chronicle the gradual absorption of the principles of the new rhetoric at the College.

Abstract:
Abstract The short story of “Araby” by James Joyce was published in 1914 in Dubliners which is a collection of fifteen short stories set in the Dublin city of Northern Ireland. “Araby” is one of those short stories in which traces of the colonization of Ireland by the Great Britain in the nineteenth century can be found. Since the context of the short story is set in Dublin, analyzing it in light of post-colonial theory has made it a special case. Because despite the majority of literary works which are analyzed in light of post-colonial theory and in which the contrast between east and west geographically is quite visible, in “Araby” this contrast is not clear-cut and the culture of two neighbor countries are so close and as a consequent so difficult to claim cultural and religious colonization by a neighbor country. This essay investigates the way Joyce has portrayed the cultural, political, economic and social domination of Britain over Ireland, specifically Dublin. The essay also explores the context where Joyce had the motivation to write Dubliners and shows the fundamental principles of post-colonialism such as language, the notion of superior/inferior, cultural polyvalency, Self/Other and the critical tenets of Homi K. Bhabha including mimicry, liminality or hybridity and finds these tenets within this short story. The essay also investigates the way James Joyce has employed symbolism in order to portray his reaction to the domination of Britain over Ireland.

Abstract:
While many countries and regional authorities in the Caribbean have embraced the concept of integrated water resources management (IWRM) and recognized its guiding principles as beneficial, few have possessed the capacity to implement it since its enunciation in the Dublin Principles of 1992. The Caribbean Water Initiative (CARIWIN) endeavoured over a 6-year period, 2006–2012, to build capacity in a collaborative process with national governments and regional and international agencies. The result of this collaborative process was the selection of three Caribbean-specific tools to support the implementation of the key components of IWRM. These tools were National Water Information Systems, the Caribbean Drought and Precipitation Monitoring Network, and Community Water Strategies. This paper describes these three tools and the process promoted through CARIWIN for their successful adoption and implementation, i.e. a program including professional development, institutional partnerships, research, and dissemination of knowledge.

Full text
Abstract:
This study investigated the use of alternative performance instruction delivery methods on student achievement in a Principles of Marketing course taught at New River Community College during the 1993 fall semester. The study sought to determine if alternative delivery methods of performance instruction would influence students' achievement in the course. The design of the study was quasi-experimental. Two treatment groups were engaged by this study. One group received performance instruction using group-directed lecture methods. The other group received performance instruction using distance-learning methods. The planning and evaluation of course content goals were held constant utilizing an expert system, artificial intelligence (AI) application software suite developed by Instructional Performance Systems, Inc. Delivery of course content goals was controlled, in that, the same instructor taught both sections of the course. Student achievement in the course was measured with teacher developed criterion-referenced mid-term and final examinations. The study tested the null hypothesis that performance instruction delivery methods have no significant effect on student achievement at the 0.05 level. The study was enhanced by the collection and analysis of qualitative student data. A Student Profile Data Survey was developed and piloted. The student data provided the basis to profile the student groups and accent study habits. Descriptive statistics and unpaired t-tests were used to analyze student achievement on the mid-term and fmal examinations. The analysis found no significant difference in student achievement resulting from performance instruction delivery methods. Descriptive statistics and unpaired t-tests were also used to profile student groups and accent study habits. It was concluded, if course syllabi and evaluation are held constant; and delivery is controlled, one can reasonably expect achievement will be the same for group-directed and distance learners.

The presence of bioactive compounds suffers greatly influenced by environmental and genetic factors, and behave differently in each part of the plant. However, there are few studies which deal these aspects of camu-camu. Thus, this study aimed to analyze the physical, physico-chemical composition, the main bioactive compounds and antioxidant capacity of camu-camu bark, depending on the stage of ripeness in fruits of different genotypes from plant matrices Bank Active Germplasm Camucamuzeiro of Embrapa Eastern Amazon. Fruits of three genotypes, selected at random in three maturity stages were collected. Results were expressed on a dry basis and analyzed by Analysis of Variance, Comparison Test Tukey's and Pearson's Correlation Coefficient, with a confidence interval of 95%. For physico-chemical analysis, there was a different one for each progeny, depending on maturity, except that the carbohydrate content increased in all progenies behavior. For vitamin C, the progenies 38 and 44 showed a high content of ascorbic acid, comparing the green and ripe stages, and 17 progeny showed a decrease during maturation; the highest content of vitamin C has been found in 44 progeny, ripe stage (24,02 g/100g). All progenies showed an increase in the content of total phenolics and anthocyanins throughout maturation, with the highest values were demonstrated by progeny 17 (3298,98 AGE/100g mg) and 44 (165,91 mg/100g) respectively. Flavonols and carotenoids showed a distinct and statistically different behavior in each progeny , with the highest content of flavonols was found in 17 progeny in the green stage (343,63 mg QE/100g) and carotenoids in 44 progeny, ripe stage (105,88 mg/100g). Regarding the antioxidant activity based on the DPPH method, the progenies 38 and 44 showed the same behavior throughout maturation, with higher antioxidant activity half ripe and smallest stage in green, with the highest antioxidant activity was found in 17 progeny in the ripe stage (38,95 g fruit/g). Already by ABTS method, the antioxidant activity was statistically different for all progenies and in all stages of maturation, higher value submitted by 44 progeny at maturity (170,63 μM trolox/g). Evaluating the relationship between bioactive compounds and antioxidant activity, the 17 progeny won more statistically significant correlations. It can be concluded that various factors cause differences in the synthesis of various compounds during fruit ripening of camucamuzeiro.

This study aimed to determine physical and physico-chemical characteristics, bioactive compounds and antioxidant capacity from camu-camu pulp of three different progenies, came from Active Germplasm Bank of camucamuzeiro, at Embrapa Amazônia Oriental, in three ripening stages. Over the ripening, the mass and the diameters varied (p ≤ 0.05) just for progeny 44 and the pulp yield increased for all the progenies, with results over 50% in the ripe stage. The ripening stage didn’t show effects in the moisture and ashes content and also pH for progeny 38; ashes for progeny 44 and fat and insoluble fibers for progeny 17. The others results varied with the ripening, but, with different behaviors to each progeny, except for the total sugar, soluble solids contents and the SS/TTA ratio, which showed a tendency to increase, and the total titratable acidity decreased in all the progenies. Overall, a higher level of vitamins C were obtained in the green stage, with a first step of degradation, as it reached the semi-ripe stage, followed by a synthesis step until the end of the ripening stage, except for the progeny 38, which showed a reduction. As for the phenolic compounds, during the ripening stage, the three progenies were characterized for synthesis and degradation processes of the total phenolic compounds; the total flavanols decreased; the flavonols content had a distinct behavior in each progeny, with an increasing in the progenies 17 and 38, and a decreasing in the progeny 44; due to a limitation of the method used to determine small quantities, It was possible to quantify anthocyanins only for progenies 17 and 44 in the ripening stage. The antioxidant capacity, determinated through the methods TEAC and DPPH, decreased in all the progenies. Besides the significant effects of the ripening stage, the results showed that the genetic variability of camu-camu influenced significantly the physical characteristics of the fruits and the continents of all compounds studied, and still the antioxidant capacity obtained through the methods mentioned.

Mulder, Marthinus Wessel. "A political policy analysis of the integrated water resource management approach in South Africa’s water policy (1998 – 2001)." Diss., 2004. http://hdl.handle.net/2263/27901.

Full text
Abstract:
The aim of the study emanates from the research question: Is the incorporation of the integrated water resource management (IWRM) approach in South Africa’s water policy, from a political point of view, appropriate? The IWRM approach, as applied to developing countries, originated in developed countries with predominantly homogeneous societies where there is a broad commitment to democratic principles, the free market system and individualism. Societies in developing countries do not necessarily share the same characteristics associated with those in developed countries. South Africa, classified as a developing country, has a multicultural society that reflects an income disparity and two major cultures, namely a modernised Western and a traditional African culture. As a result two subsidiary research questions follow: Can the commitment and impartiality of all the stakeholders that partake in the decision-making processes of water institutions at all levels be ensured? Is it possible to establish small, efficient and financially viable bureaucratic structures (water institutions) at the level of water management areas (WMA)? The study uses the public choice theory to assess the IWRM approach in selected developed and developing countries. The applicability of public choice concepts with reference to the differences between Western and African cultures are briefly alluded to. It also defines the IWRM approach and certain IWRM elements that have political implications for society at large. The study describes specific elements of the IWRM approach in France and Australia and the relative successes thereof in terms of the public choice theory. The implementation of the IWRM approach in Indochina and selective developing countries in Sub-Saharan Africa are described to highlight certain institutional problems, inadequate financial resources, the lack of capacity and various cultural aspects that inhibit the efficiency and effectiveness of the IWRM approach. In the analysis of South Africa’s water policy, the study found that the multicultural nature of society, the unequal levels of economic development and the limited level of technological and scientific knowledge, will make it extremely difficult to implement the IWRM approach without contextualising it. According to the public choice theory, the net benefits of a policy for a society must outweigh the costs. If not, the policy needs to be either adjusted or abandoned. Since none of the proposed catchment management agencies (CMA) were established between 1998 and 2001, it is not possible to come to a verifiable conclusion. However, the study indicates that the opportunity costs of the IWRM approach are likely to outweigh the benefits for society. Other aspects that necessitate a re-evaluation of South Africa’s water policy are the holistic element of the IWRM approach and the demarcation of WMAs. The study identifies three options: The first option is to revert back to the riparian principle. The second option is to either revisit the concept of public participation, or to re-delineate the WMAs. The third and most favourable option is to abandon the concept of public participation. It would not only negate the need for CMAs (and indirectly WMAs), but would also greatly simplify the management of water resources.

Abstract:
This dissertation aims to analyse the sovereignty clause of the Dublin III Regulation, which determines the criteria to determine the Member State responsible for the analysis of international protection within the European Union, in light of the Principle of Mutual Trust across the Member States of the Union. In order to properly understand this matter, and because the Sovereignty Clause is part of a complex regime, it is necessary to understand the origins of the current system. Secondly, to understand the case law that shapes the clause’s understanding, it is convenient to understand which instruments of International Public Law are referred by the Common European Asylum System, as well as the European Union instruments that complement this system. Furthermore, it is necessary to research the case law of the European Human Rights Court and of the Court of Justice of the European Union that modifies the clause’s interpretation and to consider this case law in light of a possible conflict with the Mutual Trust Principle. Due to the rapid changes of the Union’s asylum reality, the last chapter will focus on the recent modifications on the recast proposal for the Dublin III Regulation.

Abstract:
The legal concept of formal burden of proof of public prosecutor has been discussed for more than 17 years of legislative work on the new Criminal Procedure Code and an increased attention was also paid to it before by the legal science, at the same time with the enforcement of adversary elements of court proceedings. The legal concept in question was established and developed as part of the Anglo-Saxon type of criminal proceedings where trial is based on a dispute between the parties. This involves the exclusive procedural responsibility of public prosecutor to clarify the facts relevant to the indictment filed. Although it is possible to give a brief description of the legal concept in question in a single sentence, its enactment would affect the overall nature of the proceedings before the court and would also be reflected in other stages of the criminal proceedings. The aim of the dissertation was to analyse the prerequisites and consequences of the enactment of the formal burden of proof of public prosecutor in the Czech criminal proceedings. Given the origin of the legal concept, the crucial question was whether its adoption would necessarily constitute a total departure from the legal principles which the existing Criminal Procedure Code is based on or whether it is possible and appropriate...

Hota, Sikha. "Optimal Trajectory Planning for Fixed-Wing Miniature Air Vehicles." Thesis, 2013. http://etd.iisc.ernet.in/2005/3309.

Full text
Abstract:
Applications such as urban surveillance, search and rescue, agricultural applications, military applications, etc., require miniature air vehicles (MAVs) to fly for a long time. But they have restricted flight duration due to their dependence on battery life, which necessitates optimal path planning. The generated optimal path should obey the curvature limits prescribed by the minimum turn radius/ maximum turn rate of the MAV. Further, in a dynamically changing environment, the final configuration that the MAV has to achieve may change en route, which demands the path to be replanned by an airborne processor in real-time. As MAVs are small in size and light in weight, wind has a very significant effect on the flight of MAVs and the computation of the minimum-time path in the presence of wind plays an important role. The thesis develops feasible trajectory generation algorithms which are fast, efficient, optimal and implementable in an onboard computer for rectilinear and circular path convergence problems and waypoint following problems both in the absence and in the presence of wind. The first part of the thesis addresses the problem of computation of optimal trajectories when MAVs fly on a two-dimensional (2D) plane maintaining a constant altitude. The shortest path is computed for MAVs from a given initial position and orientation to a given final path with a specified direction as required for a given mission. Unlike the classical Dubins problem where the shortest path was computed between two given configurations (position and orientation), the final point in this case is not specified. However, the final path, which can either be a rectilinear path or a circular path, and the direction to which the MAV should converge, is specified. The time-optimal path of MAVs is developed in the presence of wind mainly using the geometric approach although a few important properties are also obtained using optimal control theory, specifically, Pontryagin’s minimum principle (which provides only the necessary condition for optimality) for control-constrained systems. The complete optima l solution to this problem in all its generality is a major contribution of this thesis as existing methods in the literature that address this problem are either not optimal or do not give a complete solution. Further, the time-optimal path for specified initial and final configurations is generated in reasonably short time without computing all the path lengths of possible candidate paths, which is the method that exists in the literature for similar problems. Simulation results illustrate path generation for various cases, including the presence of steady and time-varying wind. Another problem in MAV path planning in 2D addressed in this thesis computes an extremal path that transitions between two consecutive waypoint segments (obtained by joining two way points in sequence) in a time-optimal fashion. This designed trajectory, named as γ-trajectory, is also used to track the maximum portion of waypoint segments in minimum time and the shortest distance between this trajectory and the associated waypoint can be set to a desired value. Another optimal path, called the loop trajectory, that goes through the way points as well as through the entire waypoint segments, is also proposed. Subsequently, the thesis proposes algorithms to generate trajectories in the presence of steady wind and compares these with the optimal trajectory generated using nonlinear programming based multiple shooting method to show that the generated paths are optimal in most cases. In three-dimensional (3D) space, if the initial and final configurations – in terms of (X,Y,Z) position, heading angle and flight path angle- of the vehicle are specified then shortest path computation is an interesting problem in literature. The proposed method in this thesis is based on 3D geometry and, unlike the existing iterative methods which yield suboptimal paths and are computationally more intensive, this method generates the shortest path in much less time. Due to its simplicity and low computational requirements, this approach can be implemented on a MAV in real-time. But, If the path demands very high pitch angle (as in the case of steep climbs), the generated path may not be flyable for an aerial vehicle with limited range of flight path angles. In such cases numerical methods, such as multiple shooting, coupled with nonlinear programming, are used to obtain the optimal solution. The time-optimal 3D path is also developed in the presence of wind which has a magnitude comparable to the speed of MAVs. The simulation results show path generation for a few sample cases to show the efficacy of the proposed approach as compared to the available approach in the literature. Next, the path convergence problem is studied in 3D for MAVs. The shortest path is generated to converge to a rectilinear path and a circular path starting from a known initial position and orientation. The method is also extended to compute the time-optimal path in the presence of wind. In simulation, optimal paths are generated for a variety of cases to show the efficacy of the algorithm. The other problem discussed in this thesis considers curvature-constrained trajectory generation technique for following a series of way points in 3D space. Extending the idea used in 2D, a γ-trajectory in 3D is generated to track the maximum portion of waypoint segments with a desired shortest distance between the trajectory and the associated waypoint. Considering the flyability issue of the plane a loop-trajectory is generated which is flyable by a MAV with constrained flight path angle. Simulation results are given for illustrative purposes. The path generation algorithms are all based on a kinematic model, considering the vehicle as a point in space. Implementing these results in a real MAV will require the dynamics of the MAV to be considered. So, a 6-DOF SIMULINK model of a MAV is used to demonstrate the tracking of the computed paths both in 2D plane and in 3D space using autopilots consisting of proportional-integral-derivative (PID )controllers .Achieving terminal condition accurately in real-time, if there is noisy measurement of wind data, is also addressed.

Abstract:
This chapter provides an overview of the development of palliative medicine as a specialized discipline, and seeks to trace the development of international initiatives that have promoted and facilitated the growth of palliative care services. The focus is on palliative care services for adults with life-limiting conditions and advanced disease. A chronological narrative is traced from the first hospices developed in Dublin, Ireland, to the emergence of the modern hospices in the United Kingdom in the 1960s. The global spread of the principles of palliative care is traced in the formation of national and regional organizations. The chapter offers evidence on the progress of educational initiatives, both within medicine and for other members of the multidisciplinary team, at undergraduate and post-qualification level. The proposal for ten core common interdisciplinary competencies defines the essential foundations of palliative care. Finally, the chapter considers what areas of palliative medicine require further development.

Berkeley’s doctrines about mind, the language of nature, substance, minima sensibilia, notions, abstract ideas, inference, and freedom appropriate principles developed by the sixteenth-century logician Peter Ramus and his seventeenth-century followers (e.g. Alexander Richardson, William Ames, John Milton). Even though Berkeley expresses himself in Cartesian or Lockean terms, he relies on a Ramist way of thinking that is not a form of mere rhetoric or pedagogy but a logic and ontology grounded in Stoicism. This chapter summarizes the central features of Ramism, indicates how Berkeley adapts Ramist concepts and strategies, and chronicles Ramism’s pervasiveness in Berkeley’s education, especially at Trinity College Dublin.

Abstract:
This chapter explains how the intellectual principles behind the eurozone's approach to Greece and Ireland were generalised to guide policy in 2010–11 towards larger countries and to the currency union as a whole. Rather than admitting mistakes, leaders came to deem the medicine prescribed for Athens, Dublin and Lisbon suitable for the rest of the eurozone too. So long as they held on to their original diagnosis, they could not recognise that the precedents set in the smaller countries were perpetuating the crisis. The result was a disaster: a self-inflicted second recession, a poisoned politics, and a gratuitous existential threat to the euro itself. By letting the same errors govern policy towards the eurozone's bigger members, its leaders turned what had been a grave crisis into an existential one. The costs of these mistakes are still being paid in ongoing economic suffering, political ill will, and uncertainty.

Abstract:
This chapter discusses the idea of water as an economic good. In the past several decades, there has been greater recognition that how humans manage water scarcity and its competing uses must change. This new perspective is reflected in the International Conference on Water and the Environment's (ICWE) 1992 Dublin Statement on Water and Sustainable Development, which declared as one of its core principles: “Water has an economic value in all its competing uses and should be recognized as an economic good.” If water is an “economic good,” then the institutions for managing water should ensure that scarce water is allocated to its most valuable competing use. Rising freshwater scarcity would mean that all users of water would pay higher costs. Any increasing scarcity would be temporary and the resulting higher costs would be “an important way of achieving efficient and equitable use, and of encouraging conservation and protection of water resources.”

Abstract:
How to allocate responsibility for refugee protection between states forms a salient question in international refugee law. Explicit principles are lacking, yet there is a growing consensus that the issue of responsibility-sharing relates to the system’s most salient deficiencies. Within Europe, the sharing of responsibility for refugees is equally contested. Explicit legal rules exist within the Common European Asylum System (CEAS) of the EU on the one hand, and the European Convention of Human Rights (ECHR) on the other. The chapter explores the schemes of responsibility-sharing that underlie these two frameworks, the scheme of layered responsibility under the ECHR, and the scheme of alternative responsibility under the Dublin legislation of the CEAS. It discusses the respective implications for the regulation of borders and safeguarding of rights. It points to the role of individual procedural rights arguing that lessons can be learned from the European case which can also apply to the international level.

Abstract:
Stephen, Bloom, and Molly apprentice themselves in an experimental spirit to diverse figures from history and legend, figures whose importance to them is something they understand very imperfectly so far. They must speak and act before mixed audiences of fellow Dubliners with diverse senses of history, diverse reasons for minding their business, and diverse claims to understand them better than they understand themselves. So they make ongoing efforts to anticipate the interpretations others might give their sayings and doings, embracing welcome ones while fending off unwelcome ones. To tell their stories, Joyce must break with Flaubert and let the perspectives of diverse characters contest one another within the confines of individual scenes, invoking a character’s distinctive perspective by means of his or her distinctive voice. Two resources he relies on for this purpose are virtual backtalk and what Hugh Kenner called the Uncle Charles Principle.

Abstract:
Chapter 3 describes the principle of primacy of reality in Latin America, namely, in Argentina, Brazil, Chile, and Uruguay. The principle is also contained in the International Labor Organization’s Recommendation 198. The principle posits that facts must be given preference over what parties, particularly employers, state in legal texts, documents, and agreements. It is particularly important when determining threshold questions in labor law, such as employee and employer status. While employers might deny an employment relationship given a formal agreement to hire workers as independent contractors, the facts might show otherwise. However, the chapter also argues that primacy of reality depends on the principle of protection and in dubio pro operario to resolve questions when the facts are not dispositive given vague or missing rules. The chapter then searches primacy of reality in the United States and finds it in various employment tests, such as the common law control test. It is also finds it in employer tests of joint employer status. However, many of those tests remain vague, requiring supplementation with the U.S. versions of in dubio pro operario, i.e., liberal construction of the statutes that derogate the common law, and with legislative purpose. Primacy of reality makes it even more important for legal operators to be cognizant of labor law principles and, principally, the protective principle.

Abstract:
One of the aims of Technological University Dublin (TU Dublin) is to create graduates who problem solve as socially responsible global citizens. We wanted to provide an opportunity for our students to address relevant, marketing and consumption challenges in new and innovative ways, and to develop analytical competences and professional skills and comportment in a real-life context. This paper describes the design, implementation and outcome of an inter-disciplinary and cross-programme ‘authentic assessment’ method which we have termed a ‘live case analysis’. The assessment comprised fieldwork, wider industry engagement, formative assessment components and a summative presentation. The method is discussed against the backdrop of a Curriculum Framework project which is underpinned by four design principles which centre around innovation, application, collaboration and flexibility. The performance of real-world tasks such as live case analysis strongly reflects the central pedagogical values of what, where and how people will learn at TU Dublin in the future.

Abstract:
Making the most of daylight in town planning is one of the important ingredients in the attempts for the sustainable city. Exactly 150 years ago Ildefons Cerdà presented his great work “Teoría General de la Urbanización” including methods for taking care of sunlight. However, with modern software, the possibilities to do comprehensive preparations are much better. This paper presents an urban typology considering daylight with basic geometric forms, shapes and patterns. Later this will be elaborated more in detail. The research includes three steps; choosing typical alternatives for settlements and designing some new principle urban solutions, calculations and evaluations of the alternatives considering especially energy saving. The quality and the quantity of daylight are dependent of the geometry of the urban spaces. That means the volumes for the buildings as well as the empty spaces in between. The accessibility for diffuse daylight from the sky and for direct rays from the sun is measurable by computer calculations where the sun angles and the skylight from the hemisphere are simulated. Relevant parameters are height, width and length. In a settlement with a high urban density it is more difficult to distribute daylight than in a settlement with low density. However the economy for exploitations is also worse with lower density. Therefore the comparisons between different settlements are with the same density. The orientation of the settlements according to the compass is of crucial importance looking to the direct sunlight and the shadows. How the local environment with parks, water, mountains and specific landmarks in the surroundings also affects the daylight distribution is included.References (100 words) Dubois, M.-C., Gentile, N., Amorim, C., Osterhaus, W., Stoffer, S.,Jakobiak, R., Geisler-Moroder, D., Matusiak, B., Onarheim, F.
