Cecilia McDowall is noted for her ‘practical’ approach to composing choral music to suit the needs and capabilities of local amateur choirs, and she has a growing association with several, notably the St Albans Choral Society, by whom she was commissioned to write a new setting of the Stabat Mater, which duly received its world première in St Albans on 23 October 2004. It was written to celebrate the Diamond Jubilee of St Albans Choral Society, and they duly rose to the occasion lustily in fine spirits.

Two fraudsters persuaded Dextra Bank to draw a cheque for $US2,999,000 payable to the Bank of Jamaica (“BOJ”). They led Dextra to believe that BOJ wished to borrow the money as a loan. BOJ, however, was a victim of the same fraud and knew nothing of the loan. The fraudsters had caused it to believe that Dextra was selling US currency to it. BOJ’s foreign currency agents received Dextra’s cheque, and forwarded it to BOJ which duly received payment on it. Shortly before the agents received Dextra’s cheque—and the timing was significant—they had drawn Jamaican dollar cheques on BOJ’s behalf, payable to the supposed sellers of the US currency. In this they acted on the fraudsters’ instructions. Most of the payees of the cheques were fictitious, and once the proceeds had been paid into the relevant accounts, the fraudsters appropriated them.

Abstract:
The fascinating yet still underexplored world of manuscripts hailing from Southeast Asia, including the nation-state of Indonesia, has received some impetus in recent years, thanks to the new appreciation for this written heritage by state and non-state actors both within and without the country. Traditionally perceived as a dry (and hardly scientific or ‘intellectual’) subject that was the preserve of a small circle of specialist librarians, codicology (and Asian codicology in particular) has become a vibrant discipline, with several teams of scholars and projects worldwide focusing on manuscripts as objects, as well as on ‘manuscript cultures’. These projects and approaches duly recognise the role of manuscripts (and not only texts) as prime carriers of cultural and civilisational values across time and space, as well as their relevance for the culture and identity of contemporary societies. This essay reviews some recent publications on Indonesian manuscripts catering to researchers as well as the wider public.

Abstract:
Craig Russell's book makes important contributions to the study of European music as it was brought to, implemented in, and shaped by the mission communities of Alta California. This field of inquiry by its nature questions received notions of musical historiography, especially as it pertains to the relationship of documentary and ethnographic evidence. Documents are sparse at best for much of this music, and those that survive represent the musical traditions of the Spanish colonizers. In disciplinary terms, this translates into an interrogation of the relationship between musicology and ethnomusicology. The authors, each representing one of these two fields, present a dialogue between the text under review and other existing work on California mission music and on the ethics and epistemology of postcolonial musicology. Further questions are duly raised about how Russell handles the great complexity of the mission situation, as regards colonial power relations, the applicability (or lack thereof) of Eurocentric historicity, and the delicate matter of representing the viewpoint of the California Indians involved in musical negotiations of culture under the mission system.

Abstract:
The Mediterranean area is densely populated and a very popular tourist destination. This study aimed at gathering up-to-date information on current national pool and spa regulations. We formulated and duly distributed to 20 Mediterranean countries a questionnaire divided into two sections: for pool and spa facilities, respectively. The questionnaire was formulated in such a way that a positive answer would imply that the specific topic was addressed effectively. While all 20 countries responded to the swimming-pool-related questionnaire, only 11 of these countries reported the existence of spa-related regulations. When combining the response overall of all countries for pool and spa facilities together, of a grand total of 606 answers, 183 (30.2%) were positive. The positive answers in the pool section of the questionnaire were 29% of the total of 420 answers while positive answers in the spa section of the questionnaire were fewer (27.8% of the total of 176 answers). The countries were grouped by geographical area of the Mediterranean basin where they are situated. Also, the questions were grouped into broad thematic categories. The paper presents conclusions drawn on the basis of the data received according to these geographical and thematic groupings.

Abstract:
Highlighting the negative aspects of a professional activity can be beneficial in identifying matters that need improvement. However, concentrating on the negative side only may lead to a lopsided view of reality. Much of what has been written regarding community interpreting in recent years seems to portray a less than favourable picture of this professional practice in different parts of the world. This paper will present the results of a survey of Australian practising community interpreters who were asked to share positive aspects of their work. The survey concentrated on five main issues which have been debated in recent studies: the interpreters’ satisfaction with their prescribed role, their perceptions of the usefulness of the code of ethics, their evaluations of the training they had received, their impressions of how they were treated by their clients and their reasons for choosing to work as community interpreters. While the findings cannot be regarded as representative, they provide an encouraging picture of the experiences of formally trained Australian community interpreters, who find their work valuable and rewarding and feel they are duly respected as professionals by service providers and service recipients alike.

Rabindranath Tagore (7 May 1861 – 7 August 1941) was the first non-European poet and lyricist who received the most coveted of international awards, the Nobel Prize for Literature in 1913, “because of his profound sensitive, fresh and beautiful verse, by which, with consummate skill, he has made his poetic thought, expressed in his own English words, a part of the literature of the West.” (www.nobelprize.org ) His most notable work highly praised and duly appreciated by The Swedish Academy was Gitanjali: Song Offerings (1912), a collection of poetry, but Tagore is also famous for having written a variety of genres, including drama, essay, novel, novella, short-story, dance-drama, and song. While Tagore is recognized today mostly for his poetry, his short stories also proved to be extremely popular in what is called the Bengali-language version of the genre, and his essays reveal another facet of his personality, and that is his philosophical thought in which he distinguished himself as a language innovator. Rabindranath Tagore’s Śāntiniketan Essays were translated and published by Medha Bhattacharyya in 2020 in a book celebrating Tagore’s “fundamental meditations on life, nature, religion, philosophy, and the world at large.” (Flyer, Bhattacharyya, 2020)

Background: Pregnancy and childbirth related complications are the leading causes of maternal mortality and morbidity in Bangladesh. An estimate shows that about 28,000 mothers die in each year in Bangladesh due to obstetric complications. The aim of this study was to find out the birth practice among rural women in Bangladesh.Material and Methods: This descriptive cross sectional study was carried out among 1220 respondents by purposive sampling technique from 2nd to 4th January, 2017 in different villages of Dhamrai Upazila, Dhaka. Data were collected by a structured questionnaire duly pretested through face to face interview. Data were analyzed manually and by using computer.Results: Then study revealed that majority of the respondents 80% were Muslims by religion and about 26% respondents were found within the age 25-29 years with mean age 31±7.59 years. Most of them 86% were literate and only 14% were found illiterate. Among the respondents 75% were Housewives and 11%, 9%, 1% and 4% were involved in Service, Business, Agriculture and others occupation respectively. Moreover, 78% respondents monthly income were less than TK 3000. About 43% & 16% respondents were found to have 2 & 3 children respectively. In this study, about 73% received antenatal visit and among them 57% received 1 to 3 antenatal visits and 74% received TT immunizations. It was found that 69%, 54% and 59% received antenatal advices on healthy diet, personal hygiene, drug use respectively. Home delivery and Hospital delivery practice were found among 44% & 56% respondents respectively. The reasons for home delivery like Feeling comfortable, Family decision and Financial problem were found in 60%, 26% & 42% respondents respectively. The most common complications during last delivery were obstructed labor, found among 39% respondents.Conclusion: Still now women prefer home delivery. Major reasons for home delivery were Feeling comfortable, Family decisions and Financial problems. Delivery conduction by qualified doctors were found only among 47% women. L'objectif de la thèse est d'étudier la variation temporelle de la qualité des liens dans les réseaux de capteurs sans fil à grande échelle, de concevoir des estimateurs permettant la différenciation, à court terme et long terme, entre liens de qualité hétérogène. Tout d'abord, nous étudions les caractéristiques de deux paramètres de la couche physique: RSSI (l'indicateur de puissance du signal reçu) et LQI (l'indicateur de la qualité de liaison) sur SensLab, une plateforme expérimentale de réseau de capteurs à grande échelle situé à l'intérieur de bâtiments. Nous observons que le RSSI et le LQI permettent de discriminer des liens de différentes qualités. Ensuite, pour obtenir un estimateur de PRR, nous avons approximé le diagramme de dispersion de la moyenne et de l'écart-type du LQI et RSSI par une fonction Fermi-Dirac. La fonction nous permet de trouver le PRR à partir d'un niveau donné de LQI. Nous avons évalué l'estimateur en calculant le PRR sur des fenêtres de tailles variables et en le comparant aux valeurs obtenues avec l'estimateur. Par ailleurs, nous montrons en utilisant le modèle de Gilbert-Elliot (chaîne de Markov à deux états) que la corrélation des pertes de paquets dépend de la catégorie de lien. Le modèle permet de distinguer avec précision les différentes qualités des liens, en se basant sur les probabilités de transition dérivées de la moyenne et de l'écart-type du LQI. Enfin, nous proposons un modèle de routage basé sur la qualité de lien déduite de la fonction de Fermi-Dirac approximant le PRR et du modèle Markov Gilbert-Elliot à deux états. Notre modèle est capable de distinguer avec précision les différentes catégories de liens ainsi que les liens fortement variables
The goal of the thesis is to investigate the issues related to the temporal link quality variation in large scale WSN environments, to design energy efficient link quality estimators able to distinguish among links with different quality on a short and a long term. First, we investigate the characteristics of two physical layer metrics: RSSI (Received Signal Strength Indication) and LQI (Link Quality Indication) on SensLAB, an indoor large scale wireless sensor network testbed. We observe that RSSI and LQI have distinct values that can discriminate the quality of links. Second, to obtain an estimator of PRR, we have fitted a Fermi-Dirac function to the scatter diagram of the average and standard variation of LQI and RSSI. The function enables us to find PRR for a given level of LQI. We evaluate the estimator by computing PRR over a varying size window of transmissions and comparing with the estimator. Furthermore, we show using the Gilbert-Elliot two-state Markov model that the correlation of packet losses and successful receptions depend on the link category. The model allows to accurately distinguish among strongly varying intermediate links based on transition probabilities derived from the average and the standard variation of LQI. Finally, we propose a link quality routing model driven from the F-D fitting functions and the Markov model able to discriminate accurately link categories as well as high variable links

Abstract:

Presently, internal combustion engines provide power to move the majority of vehicles on the roadway. While battery-powered electric vehicles provide an alternative, their widespread acceptance is hindered by range anxiety and longer charging/refueling times. Dynamic wireless power transfer (DWPT) has been proposed as a means to reduce both range anxiety and charging/refueling times. In DWPT, power is provided to a vehicle in motion using electromagnetic fields transmitted by a transmitter embedded within the roadway to a receiver at the underside of the vehicle. For commercial vehicles, DWPT often requires transferring hundreds of kW through a relatively large airgap (> 20 cm). This requires a high-power DC-AC converter at the transmitting end and a DC-AC converter within the vehicle.

In this research, a focus is on the development of models that can be used to support the design of DWPT systems. These include finite element-based models of the transmitter/receiver that are used to predict power transfer, coil loss, and core loss in DWPT systems. The transmitter/receiver models are coupled to behavioral models of power electronic converters to predict converter efficiency, mass, and volume based upon switching frequency, transmitter/receiver currents, and source voltage. To date, these models have been used to explore alternative designs for a DWPT intended to power Class 8-9 vehicles on IN interstates. Specifically, the models have been embedded within a genetic algorithm-based multi-objective optimization in which the objectives include minimizing system mass and minimizing loss. Several designs from the optimization are evaluated to consider practicality of the proposed designs.

Abstract:
From time to time the court delivers a judgment that has a ripple effect beyond what was expected, resulting in estate planners reconsidering their planning strategies. Such a judgment was the judgment delivered by the Supreme Court of Appeal (SCA) in the case of the Commissioner for the South African Revenue Services v Brummeria Renaissance 2007 6 SA 601 (SCA) (Brummeria case). In this case the interest-free loan and the right to use loan capital free of any interest obligation were under scrutiny. The SCA had to rule on whether or not this right had a determinable value and whether or not this value could be taxable in the hands of the borrower. The SCA ruled that the right under an interest-free loan should be included in the gross income of the borrower. Since estate planning often involves the use of an interest-free loan, as estate planning tool, to remove a growth asset from the estate of a planner, it could not be generally accepted any more that the granting of such loan would not have any tax implications. Although the interest-free loans used in the Brummeria case, did not relate to an estate planning exercise, the ruling resulted in much speculation regarding the future of the interest-free loan as estate planning tool. SARS tried to ease the uncertainty by issuing Interpretation Note 58, but there is still uncertainty to some extent. The focus of this mini-dissertation is to explain when and to what extend the provisions of the Income Tax Act 58 of 1962 (ITA) as well as the Estate Duty Act 45 of 1955 (EDA) will apply to the granting of an interest-free loan as part of an estate planning exercise. The provisions of the gross income definition, sections 7 and 64E, the provisions of donations tax as well as paragraph 12(5) and 12A of the Eighth Schedule to the ITA, were explored. Sections 3(3) and 3(5) of the EDA are discussed with the use of these loans for estate planning in mind. The question whether or not the interest-free loan is still a useful estate planning tool is also answered.

This commentary focuses on Article 2.1.16 of the UNIDROIT Principles of International Commercial Contracts (PICC) concerning duty of confidentiality. Art 2.1.16 deals with the disclosure of sensitive orr confidential information by one or both parties in relation to the transaction and the potential use (or misuse) that the other party can make of such information, recognizing that a duty of confidentiality may arise and that its breach will entail liability. Where appropriate, the remedy for breach of that duty may include compensation based on the benefit received by the other party. In this sense, Art 2.1.16 is consistent with other instruments for the harmonization of contract law or private law. This commentary also discusses the consequences of breaches of the duty of confidentiality and the burden of proof relating to such breach of duty.

This chapter deals with issues related to knowing receipt. For an equitable claim for knowing receipt to succeed, the claimant must establish the disposal of his money in breach of fiduciary duty and, secondly, the beneficial receipt of that money by the defendant which is traceable as the claimant’s money where, thirdly, the defendant had the requisite degree of knowledge of the breach of fiduciary duty. This claim has been said to be the equitable counterpart of the common law action for money had and received. The chapter then looks at a real scenario of a case of knowing receipt. It also examines the relevant jurisdiction and applicable law, including the law applicable to the issue of liability for knowing receipt.

A lender's rights and remedies arise from the nature of its security, the powers implied by the Law of Property Act 1925, and any express powers. The lender's right to take possession originated at common law but is now conferred by s87(1) of the 1925 Act. The lender's power of sale and to appoint a receiver are implied by s 101(1)(i) and s101(1)(iii) of the 1925 Act respectively and can only be exercised if the borrower has defaulted. The duties that a lender and receiver owes when selling the mortgaged property are explained as well as the position of a purchaser from a lender or receiver where there has been a breach of duty.

Abstract:
Interpreting sacred notions of the Hebrew Bible in a non-literal sense was part of the hermeneutical manoeuvres of Early Christian writers. They proceeded by deliteralization and metaphorization, meta-linguistic speech acts by which a word usually understood in its literal sense receives a non-literal meaning. The author develops a two-phase model of Paul’s notion of the ‘circumcision of the heart.’ First the initial values (Jewishness and ritual circumcision) are projected upon a newly created target, inwardness. Then the original value is abolished. This process can be termed a value-shift, versus similar instances which should be seen as value-extensions, the source value being preserved and extended to other realms. Corollaries of value-shift and value-extension are duty-shift and duty-extension. From a socio-religious perspective, metaphorization accompanies a widening of the religious community; it reveals itself to be a moment in the genesis of new philosophical concepts, such as inwardness as the locus of redemption.

Chapter 2 examines the view that prevails among the world’s liberal elites on the book’s questions. Specifically, it examines this received view’s theories of the nature of systematic injustice, whether there are global systematic injustices, and the duty to challenge injustice. The received view argues that oppression or systematic injustice is mainly a form of political subjugation of a group, done chiefly by the state. It argues that there are no global systematic injustices, because a systematic injustice can implicate only those people over whom some agency claims political authority, and no agency claims political authority over the whole globe. And it argues that when groups have duties to challenge injustice, this does not imply that their individual members do, and vice versa. As a result, the view has nothing to say about when individuals should join in solidarity against injustice. Ironically, the view thereby sets groups free: rather than Leviathans composed of atomistic individuals jealous of their liberties, groups become Gullivers released from the Lilliputians’ bonds. The chapter then argues that this results in dangerously unchecked groups and a shortfall of responsible agents.

Chapter 3 considers the received view’s answers to the book’s final two questions, as well as the answers given by rival theories to all five of its questions. It begins by challenging three rival theories of the responsibility to combat injustice. These ground it in a duty of universal altruism or equity, in duties we acquire if we could at least potentially harm the injustice’s victims, or in the theory that oppression makes both the oppressed and the oppressor unfree, so that both have reason to abolish it. The chapter then challenges the received view’s theory that only the victim group are made unfree by oppression, as well as the theory saying that the unfree are the oppressor and the oppressed. It concludes by challenging theories holding that oppression’s ultimate harm is that it alienates or dehumanizes victims, constrains them from achieving their potential, or prevents them from living as free equals.

In the summer of 1953, aged 7, I arrived with my father at the port of Southampton from the colony of Nigeria. We were making for Ledsham Court School, a boarding school in St Leonards-on-Sea, Sussex. It was a stately building sitting among many green acres. After about an hour with the headmistress, Mrs Redfarn, my father said goodbye, turned and returned to Nigeria. I did not know then that I would not see or hear from him for 10 years, by which time I had forgotten what he looked like. Ledsham’s only black pupil began his academic life speaking no English. I was duly placed in the kindergarten with daily lessons in the native tongue. After catching up with my age group, in addition to the core subjects I was thereafter given instruction in Latin, ancient Greek, poetry, and nature study. To eradicate ‘that funny African accent’ I was solely accorded a daily class of elocution for a year—one hour a day with a speech therapist, held in a long, oak-panelled gallery with a book on my head to improve my deportment. Although in receipt of the beginnings of a good classical education, I was also given what I came to understand was a prototypical quantity of punishment for a ‘darkie’—for most of that first year I was caned daily and frequently ‘sent to Coventry’ for the slightest indiscretion, usually for not understanding the customs and traditions of an alien white culture. Thus, for refusing to eat salad on my first day, I received ‘three of the best’. The staff were undoubtedly ignorant of the eggs that parasites can lay on raw vegetables in a tropical climate like Nigeria, where all vegetables were cooked and salad was unheard of. Perhaps, I thought with a child’s naivety, that with all the mosquitoes and eating of salad, no wonder West Africa was called the white man’s grave in my books and comics. I woke up—for I had clearly landed in the mother country in the wrong skin colour. It hurt. I had arrived knowing myself to be Yoruba. Suddenly, I was called ‘coloured’ and ‘darkie’.

CARE, this chapter argues, succeeds normatively, or is “completed,” only when it is received by the cared-for as CARING. On this model, an action will count as CARE if it contributes to the well-being, restoration, or flourishing of a being or a subject. It must also be motivated by concern for the welfare of the cared-for. A carer must thus cultivate a “transparent self,” one receptive to the other’s conception of her own needs and wants. This view emphasizes that CARE is active, distinguishes it from paternalism, and indicates the role of moral luck in caring. CARING, then, is an action, and the act of caring requires that the cared-for take up and receive that action as care. The author ends by asking if there is a duty to take up care (when the cared for is capable) that is offered with competence and in good faith.

The proposed system is designed to charge the three different duty vehicles (based on the charging power): heavy-duty vehicle, medium-duty vehicle and small duty vehicle through three different modules (Module-A, B and C) which are connected to one common DC bus. In the proposed system, each module consists of two inductive coils. One is embedded into EV body along with a rectifier and DC-DC converter as a receiver. However, another coil is embedded into the road (on the ground) along with DC-DC converter and high-frequency inverter as a transmitter. Additionally, each module consists of two matching networks with a compensation circuit for effective power transfer. For the analysis and designing of rapid fast charger for different duty range EV, the typical specification of different duty range EV are used. For fast charging of heavyduty range EV, required charging voltage and current are high (600A/550A) as compared to medium (350V/135A) and low (200V/125A) range EV. To achieve these requirements, different ratings of the converter are utilized in the respective charger. In the proposed system, the dedicated qZS boost converter is utilized to boost the input voltage up to required high voltage demand. However, the receiver buck converter steps down the voltage (step current) to the required level to charge the battery. In the proposed system, by controlling the buck converter the battery is charged either in CC or CV mode. Additionally, the two matching networks together compensate for the capacitive reactance of the coupling plates. The proposed system provides rapid DC charging for different duty range EVs from the AC grid along with a controlled rectifier or DC grid thereby reducing the cost, volume density, and complexity of the charging system.
