Full textDuration of working hours: factor affectig in which work is performed, characteristic of subordinate labour. Law relating to duration of work based principaly but not exclusively on protection of employees. Workers' demands througthout history for reduction in working hours aimed at increasing leisure time and jos sharing. Legislation allowing derogations permitting working hours to be increased temporarily and excetionally, to meet needs to various occupations. Adjustement of working hours enables rational management of manpower with reference to production needs. Laws regulating adjustements in hours of work accept variations for individual workers and for entire workforces, provided collective bargaining agreements allows this. Legislation now just one method of regulating hours of work. Uncertain and vague implementation of idea of social order. Unprecedented normative power and responsability for partners in social contract who may conclude agreements on hours of work, constituting departure for general role. Industrial sector alone has power duty to ensure coherence of collective bargaining rules. Adjustement of hours of work means end of myth and dogma (autonomy of individual will versus legal rules), enabling experiment with law making process : historical compromise between different conceptions of employment contratc (based on civil law or state intervention)

Full textThis inflexion in the power relationship is made at the advantage of the management and is meant by the transformation of the regulation rules chosen by the social partners to escape the crisis. The social dialogue on how to manage working-time duration has settled on evidence of ambiguity, as considered at on interprofessional level. Nonetheless, the study on our panel of nearly thirty enterprise-based agreements on working-time management seems to be like evidence that the social rules changed by negotiation. The social partners have been working together on the reduction of working-time duration since 1977, in order to find out the most efficient answer to the current surge in unemployment. The social partners will finally confront about the definition of a new power game, theirs completing the transformation of the social relationship traditional basis

Full textThe objective of this thesis is to reconstruct the genesis of Bergson's concept of duration. The main interest is not in understanding what duration is, but rather in seeing how and by what means Bergson introduces it, argues for it, and makes it work. The method applied, that of "micro-reading", follows Bergson's texts closely in order to accentuate his modalities or techniques of thought. The study reveals that the concept becoming that never reduces itself to a particular function. The duration is not a given or a fact ; it defies objectification. Yet it is the sole organizer of the entire field of the Bergson's thought, defining its first and ultimate procedures

Full textThe travel time representation has a major impact on user-oriented routing information. In particular, congestion detection is not perfect in current route planners. Moreover, the travel times cannot be considered as static because of events such as capacity drops, weather disturbances, or demand peaks. Former researches focused on dynamic travel times, i.e. that depend on departure times, in order to improve the representation details, for example concerning the periodicity of congestions. Real-time information is also a significant improvement for users aiming to prepare their travel or aiming to react to on-line events. However these kinds of model still have an important drawback : they do not take into account all the aspects of travel time variability. This dimension is of huge importance, in particular if the user risk aversion is considered. Additionally in a multimodal network, the eventual connections make the travel time uncertainty critical. In this way the current PhD thesis has been dedicated to the study of stochastic travel times, seen as distributed random variables. In a first step, we are interested in the travel time statistical modeling as well as in the travel time variability. In this goal, we propose to use the Halphen family, a probability law system previously developed in hydrology. The Halphen laws show the typical characteristics of travel time distributions, plus they are closed under addition under some parameter hypothesis. By using the distribution moment ratios, we design innovative reliability indexes, that we compare with classical metrics. This holistic approach appears to us as a promising way to produce travel time information, especially for infrastructure managers. Then we extend the analysis to transportation networks, by considering previous results. A set of probability laws is tested during the resolution of the stochastic shortest path problem. This research effort helps us to describe paths according to the different statistical models. We show that the model choice has an impact on the identified paths, and above all, that the stochastic framework is crucial. Furthermore we highlight the inefficiency of algorithms designed for the stochastic shortest path problem. They need long computation times and are consequently incompatible with industrial applications. An accelerated algorithm based on a deterministic state-of-the-art is provided to overcome this problem in the last part of this document. The obtained results let us think that route planners might include travel time stochastic models in a near future

Full textBus is cheaper than other transport modes. However, maintaining optimal operations is harder than for streetcars or subways since buses are surrounded by traffic flows. Sometimes, buses of the same route bunch and travel together instead of keeping constant time headways. This phenomenon increases the average waiting time of passengers. As a result, they may tend to shift to other transport modes. This thesis proposes some methods to keep bus routes regular. Two main lines of research are investigated.First, classical models of bus routes do not account for external events like traffic signals and traffic flows. Due to this gap, existing control strategies only apply on buses through their drivers.Traffic flows are not controlled to favor buses compared to cars. Thus, the first area of research consists in refining bus models to account for external events. Several travel time estimation methods on urban arterials are proposed. They are based on the kinematic wave model (LWR). It is known to be a fine trade-off between simplicity and robustness to properly reproduce traffic dynamics.Second, control strategies are often applied once the bus route is too disrupted to be restored to regularity. Predictions of future bus route states could improve the efficiency of regulations. The second area of research consists in using the refined bus models in real time operations. The model forecasts the evolution of buses on their route for short-term. The predictions are evaluated thanks to real data to guarantee their quality. Then it enables regulations to be applied before bunching. In particular, height holding control methods are presented and compared in simulation

This thesis is a study of daily life of workers regarding their experiences and discourses on the work time and the non- work time. The workplace is the privileged locus of analysis. The empirical research examines the case of Volkswagen-Brazil in its assembly plant in ABC region, São Paulo, emblematic example of initiatives and negociations driven to achieve flexible work conditions and employment relations. The analysis focuses the period 1995-2005 when most intense changes took place. The thesis is divided into two parts. The first part begins with a review of the national and international literature on time and work time as societal constructions; the following two chapters present the recent debate on two opposing experiences, France’s and Brazil’s. In the second part, formed by seven chapters there is an initial presentation of the context of Volkswagen do Brazil, based on the analysis of documental material as well as interviews with workers, union leaders and managers. The last six chapters analyze the daily temporal experience of different groups of workers based on semi-directed interviews and time diaries

Full textFemale paid employment is increasing in quantity, but what about quality? In order to answer this question, it is necessary to understand the relationship between the déterminants of female employment and precariousness in employment over the course of the life cycle. Based on two panel data sets from the Korean Labor and Income Panel Study from 1998 to 2008 and the French portion of the European Community Household Panel between 1994 and 2001, a multiple correspondence analysis compares the situations of precarious employment of women in South Korea with that of those in France. It shows that the reconciliation of work and family life is very différent from one country to another, and that this détermines the fate of women in the labor market. A multi-level discrete-time hazard model examines the déterminants of transitions between différent types of precariousness in both countries, and highlights the important effect of âge and the life cycle, éducation, and family care responsibilities. Precariousness in employment générâtes inequalities between women. The Gini coefficient measures inequalities associated with the observed prevalence of différent types of precariousness among South Korean women from 1998 to 2008. A model of Markov chains calculâtes the prevalence associated with the conditions of the moment. The Gini coefficient corresponding to the inequalities of the moment reveals the current situation to be more egalitarian than that which has been inherited from the past. The comparison between South Korea and France provides évidence that the déterminants of female employment affect the transitions between différent types of precarious employment, with variations from country to country. In both countries, higher educational attainment and work expérience are a means of escaping from precariousness. For South Korean women, family responsibilities do not détermine the variation of precariousness, as they do in France, although this is a major characteristic of South Korean mothers' precariousness. Women's continuous participation in paid employment for both countries does not guarantee a decrease in precariousness. Observed changes from 1998 to 2008 in South Korea indicate an improvement of the lost of women in the employment market

Full textSpinoza makes a distinction between the concepts of duration, eternity and time throughout his entire work. He starts off by assuming that any essence (that is the intelligible) is an eternal truth, necessarily true, which bears no relation to time. Eternity, which is not infinite, is defined by the existence that necessarily follows from an essence and duration by the existence that does not meet this condition. Now, according to his study on Descartes and to letter 12, only the unique absolutely infinite being is eternal, the existence of none of his effects being necessarily connected to an essence. On the other hand, in the ethics, apart from god, eternity is attributed to all infinite modes but also to finite modes such as the souls of all singular things insofar as their existence is conceived to follow solely from the definition of an eternal thing. Most importantly, the distinction between duration and time is always conceived in the same manner. If duration is something real and positive, outside of thought, time presupposes thinking beings. It is a mere appendage to imagination which helps us determine duration

Full textManagers and professionals in France are a category of workers which has experienced significant destabilizations for the last twenty years. Feminizations, the rise of professionals, unemployment, the crumbling of the “trust contract”, are all elements which have impacted the traditional model of the “total commitment” of managers to their company. Work-life balance and the organisation between work and the other times of life (family time, leisure time, etc) constitute new challenges for the firms aiming at retaining their talents. At the same time, the redesigned role of managers and in the organisation, the acceleration of the rhythm of technological and organisational changes, contribute to the decreased boundaries between work and personal life. Consequently, I have developed the concept of time porosity to enlighten the relationships between professional and personal time. Time porosity corresponds to the phenomenon of overlap and interference between personal temporalities and professional temporalities, and reciprocally. This research aims to identify various types of time porosity and to understand the determinants of these phenomena. Among these determinants, gender appears to be fundamental. Thus, the systematic comparison between time porosity among women and men is a key point of this study. It uses qualitative and quantitative methods. After thirty interviews, a reliable questionnaire was constructed to measure time porosity and its determinants (150 questionnaires). The results confirm that time porosity largely depends on gender. Time porosity of women is mainly correlated to their salary and their position in the company. Time porosity of men not only depends on the characteristics of their job but is also highly correlated to a positive attitude regarding work at home and flexibility

Full textThe effects of temporal factors on worker's behavior are analyzed for three classes of temporal conditions : temporal requirements of the task (machine-paced work, time sharing), variability of human functionning (circadian rythmicity), interactions between time of work and off-the-job life (especially concerning shiftwork). Worker's responses to time requirements implies coordination of analyses at three levels : precise identification of situation's parameters for temporal aspects but also for psychological functions ; evaluation of importance of performance as regard time criteria and cost associated to success ; strategies of regulation used by the subject according to the balance between risks of failure and workload. Furthermore analysis of the activity under time pressure must be conducted in the frame work of the global system including work and out-of-work activities. Also social meaning of work needs effective coordination between analysis of worker behaviorin the line of man-machine system-and analysis of worker motivation concerning the activity under temporal constraints. Systematic articulation of the frameworks of ergonomics and social psychology is necessary for the progress of research on workers' response to temporal factors in work situation

Full textThe effective working time can be determined either according to the pmductivistic logic counting the time which is productive for the employer ; or according to the timework logic counting the time during which the employee is at the employers disposal. Whereas in France the productivist logic prevailed until the 1990s, the jurisprudence, and later the law, then imposed a new definition of the effective working time according to the timework logic. However, the two logics exist at the same time. Within the ancient context of the productivistic logic, certain aspects toned down or even inftinged this logic, and within the context of the timework logic, which prevails today, some productivistic aspects still remain

Full textThe starting point of our research study is concerning the evolution of work-time which is embedded in the sociological framework about social times. Two positions have been adopted: the first one considers that work-time is only one of the components of the social temporalities of every day life: the second position considers work-time as a social construction combining references, practice and legal norms. The research object concerns the evolution of the nature and the way time norms are constructed. In this context work-time is still central, even if work-time arrangements are focussing more and more on employment. The results of the investigations show that the idea of time as a unique, homogeneous and stable reference cannot be maintained. As follows 4 reasons let us discuss about the end of the concept of work-time: 1) work-time spreads on a multiplicity of times, that is the main the result of an analysis of 680 agreements reached on the issue of work-time in a french region: there is a loose of centrality of duration of work-time and the end of the monopoly of state-intervention in fixing work-time. 2) nevertheless, the actors are reconstructing temporal forms by arrangements which show the passage from work-time to time of employment: our analysis of 11 businesses in france and 2 businesses in germany. 3) further, such agreements on work-time are found only to be formal; they imply a basic disagreement between employers and employees on the very concept of work-time. The times of production are in opposition to the times of every day life. This is indicated by the analysis of the referentials of the negotiation in 60 interviews conducted basically in france and germany. 4) finally, the last and forth reason concerns the existence of a time of subsistance in the industrialized countries. This time of subsistance is caracterized by fragmentation of professional activites (especially muli-employment) and motivated by the satisfaction of fundamental needs of subsistance. Our inquiries in germany, russia, the united-states and france show that this time of subsistance is directed against work-time defined above as unique social norm. This research, situated in the tradition of sociological thought, will be extended on a theoretical level especially by working on concept concepts used in this study, but also by a more detailed caracterization of the mult

Our approach shows that in the context of long-term unemployment the assessment of labour quality depends no so much on the convergence of individual efforts around a selection criterion as on the variable mental images associated with the notion of a " skilled " laborer—what we call quality conventions. These vary from firm to firm; they work as principles of inclusion/exclusion. Using the TDE-MLT (DARES) survey, we conducted an econometric study to determine the complex relationships between quality convention and long-term unemployment. Our results suggest that employment policies should be amended

Full textThe aim of this thesis is to make a systematic reading of Spinoza's works starting from the distinction between duration and time. Spinoza resumes this distinction built by tradition in order to avoid the difficulties bound to the confusion of these two terms. But the deduction of the very nature of duration from the conatus will allow to go beyond the letter xii conception as it is presented : the point is no more to distinguish a before and an after, to maintain the continuity of the flow in spite of its division into parts, but to understand how the different states which affect the continuation of modal existence are unseparated from the variations of powers that they imply. Duration is not any more a succession of states but the transition of power carried by the least affect. The confusion between duration and time takes then another shape since it is through a time submitted to the mechanisms of imagination that the human body or the body politic refer themselves to the transition which affects their power. The duration of the individual or of the people is dissimulated behind different forms of time in which the memory of the past may produce the contingency or the presence of the future state as for the present one. However when some facts which seem to inscribe themselves in a contingent time find the opportunity to correspond with the development of the modal power it then creates opportune moments. The occasion is a limited period of duration unseparated from the action of which it delimites the effectivity. What could appear like an ultimate confusion between duration and time is, in fact, the exceeding point of this distinction relative to some aspects of the ethical or political analysis

Full textThis thesis raises the question of the relationship between the expressiveness of computer programming tools and musical creation from the perspective of the expression of "time". We have based our reflection on time using the Bergsonian concept of "duration" which exists only in the consciousness of the perceiver as opposed to the objective time, which is that of clocks, independent of consciousness. We have chosen to follow the tradition of written music, i.e. preconceived in a fixed form that allows the composer to evaluate the aesthetic content of his work. Among the various possibilities of implementing duration, we have oriented ourselves towards interactive music, i.e. music that is controlled on stage, in part by the audience. We developed a method of composition based on three concepts: “basic musical elements” which are short musical phrases, “groups” of these basic elements, and “orchestrations”. The groups are made available to the audience who participates in the realization of the music by selecting one or another basic element or by responding to choices that will be proposed to them. The way in which the groups are made available to the audience constitutes the “orchestration” which is implemented by means of the synchronous reactive language HipHop.js. This language combines the programming of complex automata adapted to our orchestration concept, with web programming particularly adapted to the implementation of large-scale interactions. We fed this research with different experiments and musical productions using a software platform called Skini

Full textMany important questions in economics, and especially on the labor market, can be answered by the time elapsed in a given state. The individal behaviours differ and can traduce some complex interaction patterns that the econometrician observes only partially. This thesis is about handling a multiple unobserved heterogeneity in duration models. The existing tools to estimate duration models with several frailties are derived from parametric models and are often specific. This thesis provides a methodological contribution with more flexible semi-parametric approaches. We propose a general procedure to lead the inference in duration models with frailties, which is quicker and numerically more stable than the reference algorithm. We also pay particular attention to comparison of frequentist and Bayesian approaches, which enables us to model complex interaction patterns. The thesis also contributes to the methodological literature on the labor market. We are investigating it's regulation by the International Labour Organization (ILO), and our results indicate that conventions asking for only a broad agreement on general questions are ratified more easily than the more specific ones. Proximity between a convention implications and the legal and economic systems is a determining factor, more important than political guidelines or potential trade sanctions. We are also studying the job mobility with matched employers-employees data. Most studies do not include firms' retention policies, as it is unobserved, and we show that they differ largely from one firm to another. Moreover, the results let us think that the fit between the firms' and workers' characteristics, unobserved by the statistician, influences job mobility

However, labour seems to be subjected to a number of societal modifications deeply rooted in the extreme lability of social life whose various micro and macro-sociological expressions have become valuable tools in the survey of social life. Our task consequently consists of isolating within a field of study what our understanding of it underlies in our post-modern sociability

Full textTermination law must achieve a dangerous balance between the employment protection of the salaried and the need for businesses to be flexible in order to maintain their competitiveness. In this search, French laws form a perfect legal protection regarding salaried workers but also create an obstacle to workers eager to enter the job market. To break the deadlock, it is necessary to insert a common law measure in an equation deemed too strict. In line with the European inclination towards flexicurity, the introduction of an individual negotiated approach is a contrasting remedy on account of professional life securing policies' poor results in times where the rate of unemployment reach record highs. Consequently, the legislator set up new public negotiated measures in order to prevent the termination of an employment contract but at the cost of salary concession and an unprecedented change of legal principles

Full textOur starting point is a consideration that the current crisis is an unemployment crisis; particulary because the growth of long-term unemployment upsets the standard classical norms of unemployment, defined as temporary and involuntary. Therefore, we propose an identification and categorization analysis of unemployment and long-term unemployed highlighting the critical situation of the official categories indicating the lack of unemployment and the emergence of new unofficial and informal categories. The course taken tries to articulate, on the one hand, a macrosociological approach concentrating on the categories of representation of unemployment, more or less fixed in statistical definitions, administrative regulations, conventions, social codes and, on the other hand, a microsociological approach showing how the new identity categories are negotiated in the interactions between the long-term unemployed and the profsionals responsible for dealing with unemployment. For this second part, the method consisted of mixing direct observations of interactions and interviews with the protagonists. We have thus isolated four identity transactions dynamics from certain exclusion to possible reintegration through lasting transition and tolerated transgression which constitute negotiated interpretations of longterm unemployment situations. These new and emerging identity forms, both redefine the traditional categories: false unemployment, true unemployment, excluding unemployment, and anticipate the current transformations of the status of activity and inactivity

Full textThe news work-time organizations represent one of the most interesting forms about the transformations which affect enterprises organizations. They could act for compatibilities between competitiveness and employment. It's for that, necessary to give to work-time organization in the enterprise a theoretical content and an economics way. Work-time may be a production factor because it determines and varies enterprises production capacities. It's an organization factor because it takes fluctuates forms for adaptation to market exigencies and to work-time offers by the workers. On condition to be determined in the enterprise, use like a competitiveness and adaptation tool, work-time organization offers interesting ways to advance news production which improve growth, work-sharing and work-market mobility. A new way is open for this subject around two points : the first is theoretical and develops the work-time like organization and economic factor; the second more operational, result in propositions to improve management practices and tools which answer to competitiveness and employment objectives
