Abstract:
La RDC est un pays dont le potentiel économique n’est plus à démontrer. Les acteurs privés impliqué dans cette dynamiques au niveau national ont pris la décision de se regrouper de leur propre initiative au tour de la Fédération des entreprises du Congo (FEC), qui est une asbl aux termes de la loi n° 004/2001 du 20juillet 2001 portant dispositions générales applicables aux associations sans but lucratif et aux établissements d’utilité publique. Cette institution privé permet aux entrepreneurs congolais de se réunir et de discuter à propos des sujets qui intéressent leurs activités et, le cas échéant, défendre leurs intérêts pour la réalisation de leurs objectifs individuels ou collectifs. La FEC dispose des organes nationaux et des organes provinciaux et municipaux. Ainsi, elle comprendre des organes à compétence nationale générale qui sont l'Assemblée Générale; le Conseil d'Administration; le Comité de Direction et les Commissaires aux comptes); mais également des organes à compétence nationale spéciale dénommés Commissions ou Chambres et des organes à compétence matérielle générale dans les limites de leur ressort territorial qui sont l'Assemblée Provinciale; le Conseil Provincial; le Comité de District; le Comité de Territoire ou de Commune.

Abstract:
Cet article est focalisé sur les défis du secteur des investissements au regard des mécanismes juridiques pour la promotion des investissements en RDC. L’étude présente l’organisation, le fonctionnement et les missions de l’ANAPI qu’est une institution nationale pour appuyer le gouvernement en ce qui concerne la promotion des investissements. Cette institution est créée et organisée par la Loi n° 004/2002du 21 février 02 portant code des investissements en République Démocratique du Congo qui détermine les modalités de fonctionnement de l’ANAPI et lui assigne la mission de veiller à ce que l’action du gouvernement puisse promouvoir les investissements pour le développement de la nation. Elle est Organisée aux tours de son Conseil d'administration; du Conseil d'agrément; de la Direction Générale; et du Collège des commissaires aux comptes et accompagne les investisseurs et veille au bon usage de l’aide publique disponible pour appuyer les projets d’investissement viables. Au regards des mécanismes de son fonctionnement et des modalités pour l’octroi des fonds publiques aux investisseurs pour appuyer leurs projets d’investissement, cette article démontre la nécessité du renforcement des mécanismes de contrôle et de suivis en amont tout comme en aval pour que l’appui ou les fonds octroyés aux investisseurs puissent être convenablement utilisés et contribuer au développement du pays.

Abstract:
Ambassador Abdou Abarry, Permanent Representative of Niger to the United Nations (UN), presented his credentials to UN Secretary-General Antonío Guterres on 4 June 2019. Mr Abarry had previously been the Special Representative of the Chairperson of the African Union (AU) Commission and AU Head of Office in the Democratic Republic of the Congo since 2014. Prior to that, he headed the AU Liaison Office to the Economic Community of West African States in Abuja, Nigeria, beginning in 2011. A career diplomat, Mr Abarry was Ambassador to Belgium from 2003 to 2011, accredited concurrently to Greece, Luxembourg and the Netherlands; he also had accreditation to the UN Offices in Geneva and Vienna, the European Union Commission and the African, Caribbean and Pacific Group of States. He was Diplomatic Adviser to the President of the Republic of Niger and Director-General of State Protocol from 1999 to 2003, and served as a Counsellor at Niger's Permanent Mission in New York from 1992 to 1997. Mr Abarry holds a master's degree in international relations from the Ecole Supérieure d'Administration et des Carrières Juridiques de Lomé, in Togo, and earned a diploma from the International Relations Institute of Cameroon. He has received honorific distinctions including the Chevalier de l'Ordre National du Mérite du Niger (1999), Grand-Croix de la Couronne du Royaume de Belgique (2011), Commandeur de l'Ordre National du Niger (2014) and Officier de la Légion d'Honneur Française (2014).

The recruitment system of the French higher civil service is quite unique in the world. It's the only country that employs more higher ranking "fonctionnaire" from the external examination than from the internal promotion. And ENA (Ecole Nationale d'Administration, National Administration School ) plays the most important role in this system. 　　Till now ENA is the only well-known and successful public administration school set up for recruiting higher civil servants in the world. The origin of trainees is not based on the middle-class civil servants in the government. On the contrary, for attracting elite from all level's and regionis, French goverment has designed three methods with didfferent restrictions and foered allowances for canddates and trainees to encourage them taking ENA's entrance exam. After graduating from ENA, the trainees are granted higher civil posiitons. All these measures are for ensuring the quality of higher civil service on the top level. 　　This thesis tries to deal with the role which ENA plays in the system of French higher service system, and its influences to the politics and enterprise. Of course, this system could not totally be suitable for Taiwan, but it could be referred as an example if the government intends to reform the system of higher civil service.
