Abstract:
Description: The purpose of the article is to study theoretical and practical aspects of local government organization and activities in Eastern Europe. The subject of the article is the issues of legislative support of the financial and economic bases of functioning of the municipal authorities of the Eastern Europe Statesю Methodology. In the course of study general scientific and special methods were used, which are the means of scientific research. In particular, comparative legal method was used for the analysis of the norms of substantive law of Eastern European countries, scientific categories, definitions and approaches. Historical and legal method gave an opportunity to reveal the meaning of the concepts of «local budget», «local self-government», to highlight the development of scientific views on specific issues. System analysis method was applied for an integrated generalization of the features of each country under consideration. The system-structural method made it possible to determine the state and government objective factors in the financial and economic spheres. The results of the study. It is recognized that due to the relatively low share of income, the entire financial system of municipalities is unstable, as well as the economic conditions in which local self-government operates. Although the analysis showed that the size of municipal budgets gradually increased, in the end they do not correspond to the level of inflation in these countries Practical implications. To ensure the autonomy of local government, it is especially important to manage the own revenue base of the territories and reduce their dependence on subsidies from higher-level budgets. In our opinion, subsidies should cover only certain types of expenditures of either national or regional importance and ensure equalization of the financial situation of the territories. Value / originality. The analysis of the relevant legislation and legal literature of the countries in question allows us to conclude that the expenditure part of the minimum budget determined by the legislator is calculated according to the norms and standards established by representative higher authorities on the basis of the law and the available funds, while the revenues of the minimum budget should cover the minimum necessary expenses guaranteed by higher authorities.

Abstract:
The subject of this research is the practice of application of antimonopoly legislation of the Russian Federation to budgetary (autonomous) institutions, including in the context of restricting the established by the Section 3 of the Article 15 of the Federal Law No.135-FZ of July 26, 2006 “On Protection of Competition". The goal consists in identification and analysis of possible legal issues emerging due to the dual nature of the status of such institutions, substantiated by the conducted reform for increasing their economic independence. The article provides a scientific assessment of legal consequences of recognition of the budgetary (autonomous) institutions as economic entities for the purpose of application of antimonopoly legislation, taking into account the existing ban on combining functions of government branches and functions of economic entities, as well as authorizing the economic entities for the functions and rights of these branches, including state control and supervision bodies. Content of the concept of “function of the government branch” is reviewed. The author’s special contribution consists in evaluation of the situation, in which in the monopolized by public entity spheres related to the exercise of powers, are established  budgetary (autonomous) institutions that charge for rendering services required and essential for provision of state (municipal) services. The article views the mechanism of social procurement as market-oriented, a competitive way of rendering services using budget funds by both governmental and nongovernmental organizations. The novelty of this work lies in conclusion on the need to consider the principle of fair competition in case if the public legal entity decides to forgo the implementation of a new competitive method for selection of executants established by the law on social procurement, and use the traditional scheme of approval of the state (municipal) assignment.

Abstract:
The topic of improving the system of state and municipal administration is always relevant. In 2020, the importance of reforming local self-government was emphasized during the discussion of amendments to the Constitution of the Russian Federation.
 Among the numerous changes regularly introduced to the basic federal law governing the organization of local self-government in Russia are the radical amendments of May 2014 and 2019 in terms of its territorial foundations. A number of regions have quite successfully switched to a single-tier system of local self-government, having completely eliminated the settlement level, or to a mixed one, when municipal districts with their rural settlements remain within the boundaries of the region, and as a result of the transformations of a number of districts and settlements, new municipal districts are created, or this occurs when urban districts are given the status of municipal ones.
 The authors made an attempt to systematize the experience of the regions that have already created municipal districts, and to project it onto the territory of the Altai Territory. In the course of the study, a number of legal, organizational, socio-economic aspects of the reform were analyzed, recommendations were developed to adapt both the authorities and the population to the upcoming transformations.

Two trends are observed in contemporary cities around the world: whereas some urban areas develop rapidly and experience population growth, a steady population decline is noted in other cities. Demographic changes in urban areas are also accompanied by economic changes. These changes constitute a very serious challenge for sustainable regional growth. However, these problems have not been sufficiently investigated to date, including in Poland. The aim of this study was to identify shrinking cities in Poland and the phenomena that are related to the economic aspects of urban shrinkage in Poland. Empirical research relied on analysis of the population growth rate in Polish urban municipalities, and the phenomena related to the economic aspects of urban shrinkage were identified by multiple linear regression analysis. The period of research was 2003–2019. Thirty-three Polish cities experienced a steady population decline. The economic phenomena related to urban shrinkage included changes in own-source revenues, proportions of government transfers in municipal budgets, unemployment, migration, municipal spending on education, transport, communications, and social welfare. Population decline was not related to changes in the age-dependency ratio, public spending on housing, the number of companies, or the number of vacant homes in cities. The research results can be a source of important information for regional sustainable growth policies used not only in cities and regions in Poland, but also in other Central and Eastern European countries where this phenomenon occurs.

Political scientists have been increasingly interested in entrepreneurs—individuals who change the direction and flow of politics. In this research note, we synthesize aspects of an economic approach to entrepreneurship with concepts used in political science. We then tie these theoretical observations to the emergence of entrepreneurs in local governments and test components of our theory using observations from a large set of suburban municipal governments. Empirically, we identify several conditions that affect the probability that an entrepreneur will emerge in a local government, especially slack budgetary resources that the political entrepreneur can reallocate. We also find that the probability with which an entrepreneur is found in local government is a function of the difficulty of overcoming collective action problems in a community.

Abstract:
The aim of this research was to provide a preliminary investigation of how the HIV and AIDS epidemic will impact on management of municipalities, specifically George Municipality. Municipalities provide a large proportion of essential basic services and also represent one of the primary opportunities for public participation and decision-making at a community level. This paper takes George Municipality in the Western Cape as a case study of the current and potential impact of HIV and AIDS on public demand for services and on the municipality's capacity to govern and provide services. It also reviews the responses of the municipality to HIV and AIDS.The research was conducted using a questionnaire which was distributed to municipal officials in the different departments but also included a review of relevant literature and analysis of quantitative data. The study focused on a single case: An investigation into the impact of HIV and AIDS on municipal management of George Municipality. The study identified strategies utilised by the municipality to reduce the impact of HIV and AIDS. The study drew on people's experiences, perceptions and interpretations of the impact of HIV and AIDS on municipal management, responses and any other related factors that may have impeded the realisation of the reduction of the impact of HIV and AIDS on municipal management in the George Municipality.Fifty questionnaires were distributed, 40 copies by hand delivery and ten copies via e-mail to employees ranging from general worker to senior management. Employees participated in the study through interviews and answering of the questionnaires. An internet search was also conducted using Wed Crawler and by visiting the official website of the George Municipality for all policies, minutes, reports and all other relevant documents regarding HIV and AIDS. The researcher also drew on personal observations because she has been in George for almost six years and is also employed by George Municipality. Participants who were selected by the researcher for interviews purposes were five councillors and five ward committee members because councillors are decision makers in the municipality. The rest were given questionnaires to complete. Data was analysed by using interpretation analysis, namely codes to explain data collected. Results were presented in the form of tables and conclusions warranted by the data are presented. Statistical analysis was done to check correlation between the different aspects in the questionnaire. According to the research findings it can be confirmed that more of the budget needs to be allocated for employment of suitably qualified persons like occupational nurses, who will drive HIV and AIDS education and awareness campaigns. HIV and AIDS mainstreaming should be regarded as a priority in order make people aware about the realities of HIV and AIDS in communities. Leadership and management buy-in should be obtained to win the fight against the epidemic. A comprehensive strategy should be compiled and implemented to reduce the spread and stigma of HIV and AIDS. Proper planning should be done for compiling the strategy. This strategy should specify the budget for HIV and AIDS and how HIV and AIDS is going to be integrated into an IDP. Prevention and management strategies used by the organisation should be explained.

This research study evaluated and assessed the extent to which strategic management processes integrated economic, environmental and social sustainability elements in the fiveyear strategy (2012) of Elundini Local Municipality (ELM). The study focused on three areas of strategic management, that is, environmental analysis, strategic direction and strategy formulation. The study also looked at possible reasons for sustainability integration in ELM strategy or lack thereof and also recommended possible solutions. The literature reviewed revealed that there was adequate basis for municipalities to integrate sustainable development in their strategies even though sustainability was noted as an evolving, complex and changing phenomenon. Local Agenda 21 principles, national legislative & policy framework, regulations and other relevant guidelines were found to be adequate for municipalities to develop credible sustainability strategies. The objectives of the study were achieved by data collected through the review of existing literature; the review of ELM Five Year Strategy (2012-2017); and SIAT-based questionnaires that were filled in by ELM employees. The results of the study showed that economic and social sustainability activities were identified most in the ELM strategy compared to environmental sustainability. The study then mainly recommended the review of the current strategy in order to improve all areas of strategy formulation; introduction of Economic, Social and Environmental sustainability – Strengths, Weaknesses, Opportunities and Threats (ESEs-SWOT) for internal analysis as an improvement of SWOT analysis; introduction of Sustainability Integration and Strategic Management Framework (SISMF) as an improvement to existing framework.

M.Com. (Development Economics)<br>The Local Government Equitable Share (LES) is a lump sum unconditional grant that is legally entitled to municipalities in South Africa. The grant aims to supplement municipal own revenues in the delivery of services. However, increases in the LES allocations to municipalities have coincided with increased service delivery protests and poor revenue management on the part of local government. Given these trends and the ultimate goal of the LES, it is important to assess the actual impact this grant is having on local government fiscal decision. This minor dissertation evaluates the impact of the LES on the expenditure and revenue decisions and performance of local government in South Africa. Specifically, the research seeks to ascertain the nature of such impacts in terms of how expenditure and revenue decisions are adjusted with this grant funding and whether such funds may be creating adverse incentives on the part of local governments to spend inefficiently and/or not maximising their effort in collecting own revenues. The analysis uses a cross sectional dataset for a sample of 129 municipalities for the 2009/10 municipal financial year, with the Stochastic Frontier Analysis as the primary methodology. The analysis finds that the LES has no statistically significant impact on municipal operating expenditure. This suggests that the funds from this grant might not have contributed to municipal service outputs in the 2009/10 financial year. Furthermore, the results found that the LES is positively correlated with expenditure inefficiencies and poor tax/revenue effort. This suggests that the LES funds create perverse incentives for local government to waste LES funds and not collect revenues from local taxes. The latter is due to municipalities substituting tax revenues with funds from the LES, hence resulting in the LES not having an impact on overall expenditure.

Environmental degradation is a global challenge that affects all. One of the most prominent impacts of environmental degradation is the climate change phenomenon. The adverse impacts of climate change have given rise to responses aimed at retarding, halting and learning to live with the already present effects of climate change. These responses to climate change fall into two broad categories: mitigation and adaptation. Mitigation addresses the climate change challenge through seeking a reduction or elimination of anthropogenic generated greenhouse gas emissions into the atmosphere. Adaptation on the other hand addresses climate change through reducing the adverse impacts of climate change as well as exploiting economic and social opportunities presented by climate change. Green procurement has been identified as one of the climate change intervention measures. This is because research shows that procurement policies and practices of both the public and private sectors have the potential to influence environmentally friendly modes of production and the provision of ‘greener’ goods and services that include infrastructure. In many developing countries the big spending power of the public sector, particularly municipalities, makes them influential players in the nature of goods and services production and provision. Against this background, this study investigates the role of South African metropolitan municipalities in addressing environmental decay through green procurement. Specifically, the study aims to assess the levels of green procurement practices of goods and services within South Africa metropolitan municipalities. This is achieved through; (i) determining the level of understanding of sustainable development, and (ii) determining the extent to which green procurement is practiced in South African metropolitan municipalities, and identifying policy and legislative requirements (if any) that support green procurement practices. Given the complexity of means, policy and practices around the green procurement drive; the study employed a mixed method approach. The mixed method approach employed three methods namely: document analysis, interviews and the use of a questionnaire. Analysis of data included content analysis, inductive thematic analysis and basic numerical analysis of the questionnaire, using MS Excel. The study made two broad findings; (i) there is generally a good understanding of the sustainable development discourse among South Africa’s metropolitan officials; and (ii) policy response to green procurement shows that the older metropolitans that include the City of Cape Town, City of Johannesburg, City of Tshwane, Ekurhuleni, eThekwini and Nelson Mandela Bay have made greater progress making explicit reference to green procurement in different policies compared to the younger metropolitans such as Buffalo City and Mangaung. Despite the general understanding of the sustainable development discourse and evidence of explicit reference to green procurement in some metropolitan policy documents there is a general lack of comprehensive implementation of green procurement practices across all the metropolitan municipalities. The current implementation is sporadic and largely through a number of projects that are not always linked to give rise to effective synergies. The study concludes that there is limited implementation of green procurement policies and strategies in all metropolitans. This may be attributed to limited policy understanding and lack of education and training around green economy transition and green procurement issues. The study recommends the mainstreaming of the green procurement concept into already existing policies and to establish new policies where there are none. There is a need to translate the policies into legislation and regulations that carry incentive to reward and encourage the desired green procurement practices. This study was conducted as a result of the various media reports, various law enforcement investigation reports, Public Service Commission, reports of the Auditor General South Africa and the Public Protector South Africa on corruption and the various forms in which corruption manifests itself in the City of Tshwane Metropolitan Municipality and the effectiveness of the various law enforcement agencies and the government in tackling the scourge of corruption in public and private institutions. While South Africa has various anti-corruption strategies, they all seem to be ineffective and have thus far not achieved their desired results. A qualitative research approach was used to investigate this problem. A thorough literature study and documentary analysis was used to gather all the relevant data related to this topic. It has been found that the most common manifestations of corruption that take place in the South African public service are fraud, bribery, extortion, nepotism, conflict of interest, cronyism, favouritism, theft, graft, embezzlement and abuse of power. Other forms of corruption that raise concern are, for example, influence-peddling, insider trading/abuse of privileged information, bid-rigging and kickbacks. South Africa has, on the other hand, seven anti-corruption institutions and seventeen pieces of legislation which are intended to combat corruption in the public and private sector. These pieces of legislation give South African law enforcement and investigators in the public and private sectors a clear mandate with a view to investigating the high levels of corruption. It is the submission of the Public Service Commission (2011:vi) that corruption has become a global concern that seriously hampers development in any country and diverts its resources from where they are needed the most. This study examines the role of Ward Committees in facilitating “authentic” public participation, with particular reference to Ba-Phalaborwa Municipality. The key question of the study is whether Ward Committees serve as effective mechanisms to promote public participation in the local sphere of government in South Africa. To answer this question, this research project focuses on the composition, functioning and responsibilities of Ward Committees, and how these contribute to effective public participation. This is important because one of the mandates of local government in the post-apartheid era in South Africa is to promote local democracy through the participation of communities. The empirical findings of this research project reveal that Ward Committees are confronted with a multitude of challenges where their functioning tends to be compromised. The premise of the research concerns negative spatial legacies and questions doubting the existence of the true post-apartheid city in South Africa. The study describes the socio-spatial structure of the functional urban core of the City of Tshwane Metropolitan Municipality (CTMM). An empirical analysis, a unique segregation-desegregation classification, a relative socio-economic classification and three continuity-discontinuity hypotheses was used to compare past and present socio-spatial characteristics. Structural racial-residential segregation is evident along with high levels of socio-economic inequality. Spatial polarisation of societal attributes has created a clear north-west and south-east divide in the study area. The study area is described as one with a central-south citadel (inhabited by the wealthy) and a dynamic periphery (diverse but relatively deprived). Current socio-spatial characteristics can be attributed to strong spatial legacies, ineffective policy interventions and underlying socio-spatial influences that inhibit true inclusivity and equality in the study area.<br>Geography<br>M. Abstract:
When local governments evaluate the environmental benefits and costs of alternatives for managing non-recyclable municipal solid waste, the relative costs of modern waste-to-energy (WTE) technology can be a significant stumbling block despite WTE technology’s environmental benefits. Although the preceding point is an important economic reality that has constrained WTE development in the United States, fortunately there is a highly effective means — the use of municipal solid waste “flow control” (or “facility designation”) authority — to overcome WTE’s perceived cost disadvantage. The relationship between flow control and WTE development, including significant encouragement for use of flow control as a result of the U.S. Supreme Court’s recent decision in United Haulers Association v. Oneida-Herkimer Solid Waste Management Authority, 127 S.Ct. 1786 (2007), is the focus of this paper, which will address the following topics: Policy Basis for Flow Control — Absent government intervention, management of municipal solid waste will seek the lowest cost (i.e., short-term cost) and frequently less environmentally protective alternatives. Flow control can counter the tendency to choose alternatives with lower short-term costs and at the same time facilitate implementation of the environmentally-preferable waste management alternatives a local government selects, such as WTE technology and other aspects of “integrated waste management.” Flow Control and the Courts — While the authority of a given local government to use flow control is grounded in state law, flow control also implicates matters that arise under federal law, such as Commerce Clause issues, given the possibility that solid waste regulation in one state can affect commercial interests in solid waste management in another state. Although concerns regarding claims of impact on interstate commerce prompted a negative Supreme Court response to flow control in C&amp;A Carbone, Inc. v. Town of Clarkstown, 511 U.S. 383 (1994), the Court’s decision 13 years later in the Oneida-Herkimer case was in many ways just the opposite. WTE’s Correlation with Flow Control and Practical Guideposts — WTE development can be significantly advanced by the use of flow control. That conclusion is borne out by empirical data. The concluding portion of this paper addresses that topic as well as corollary issues, such as public-private collaboration for WTE development and other practical guideposts for implementing flow control ordinances.
