Full textAmmißaduqa, penultimate king of the Ôammurabi dynasty in the Old Babylonian period, reigned from 1646-1626 BCE, and issued a mēšarum edict which Finkelstein described as “a single tablet, inscribed with a most unique text of an importance for the socio-economic life of Babylonia second to no other.” It is essential to define ancient royal edicts within their cultural context. This thesis examines, within the broad legal, religious, political and social background of the Ancient Near East, the design of royal edicts, their aims, beneficiaries and legal implications. The primary goal of this thesis is to improve our understanding of the motives for the promulgation of mēšarum decrees within the ancient cultures, and in particular, the motives for Ammißaduqa’s first edict. There is a strong scholarly tendency to seek the motives in the economic faction, even likening this decree to a “modern-day economic stimulus package,” a type of “RDP”. Kraus noted that the first promulgation was designed and executed for ideological purposes, subsequent mēšarum edicts were economic emergency measures. Nel agreed that the proclamation of a mēšarum was part of the propaganda strategy to strengthen the royal administration and to legitimize its power. The mēšarum was not designed to bring prosperity, but to stimulate agricultural production and prevent uncontrolled urbanization. Olivier noted that the mēšarum was intended, not to reform the economic system, but to remedy the unbearable economic situation. The economic motive is therefore of prime importance for all subsequent edicts, although an overlapping of all three motives – ethics, ego and economy – is highly likely. The base-line conclusion is that the motive and the occasion are inseparable. The aim of this thesis was to produce sufficient evidence that king Ammißaduqa was primarily inspired by ethics and ego, and not economics, when declaring his first mēšarum edict.

Full textThe Edict of Ammisaduqa and the Jubilee Year legislation in Leviticus 25 provide the most extensive evidence for the debt relief tradition throughout the ancient Near East. A comparative analysis of these texts points to an indirect relationship between them based upon a common theme, debt-slavery of the head of the household, and terminology, andurārum and drr. However, the substantial differences in content between the two texts suggest that there is no direct relationship between them. In light of this analysis it is possible that the tradition of debt relief entered ancient Israel in some form at an early date and then was later re-emphasized during the late monarchic period under Neo-Assyrian influence. This possibility rests upon the debt relief tradition existing in Syro-Palestine under influence from Mari and the Hittites, as well as later under the Neo-Assyrian Empire. Internal evidence in Leviticus 25 also potentially points to an early rural situation for the origination of the Jubilee tradition.

Full textPoisonning is a violation which appeared lately, though poison has been used as a powerful criminal weapon for a long time. In 1682, a specific regulation distinguished it from a manslaughter and supervised the trade of poisonous substances in a rigorous way. Since then, the poisoning has always been incriminated independantly in the French law. So a lot of question was raised by this new law ; in one hand on the constitution of the breach and on the other hand on its repression by the courts. As poisonning is a crime which is hard to proove, evidence have to be found all the time. Therefore, we have to ask the Criminal Justice to understand this new legislation and these specificities which are particular to poisonning, both in the progress of the criminal procedure and in the penalty applied to the poisoners

Full textHenry the 4th ends the religious civil wars in 1598 by ordaining that the remembrance of troubles is « extinguished and abated, like something that did not occur ». How does French drama stand in relation with this politics of oblivion ? What kind of memorial space does it open ? We consider tragedies written between 1629, official end of the troubles and date of publication of the last usual times tragedy, and 1653, end of a new internal division threat embodied by the Fronde. In appearance, tragedy seems to forget a harrowing recent past by turning away from it, but it is simultaneously deeply influenced by what has been forgotten. By starting with what is most visible, the staging of merciful princes, we demonstrate that this official and voluntary oblivion is very much represented on the tragic stage. But forgetfulness is also influencing tragedies in their displaying of family feuds, a frequent tragic topic of these times. Tragedy thus makes surface the present of the past, the memory of division, through allegoric detours. A double-face drama emerges : one of melancholy in which past weighs on present, one of historical reset with an ouverture for renascent prospects. Last, in these years of dramatic theorization, forgetfulness appears to be, for a spectator absorbed by the play, an ideal, as well as it can drag the most naive of them and some comedians into forgetting about their selves in denial of reality and confusion with fiction. The fundamental ambiguity of forgetfulness enables to articulate political theory, drama and staging, in a 17th century where violence is thought to threaten the community with division

Full textIn 1685, the Edict of Nantes is revoked. Royal legislation and “dragonnades” compel the Protestants to abjure. If some accept conversion to Catholicism, others choose illegality, more precisely emigration to the protestants Countries or clandestine practice of their religion. The edict of Fontainebleau is enacted by the sovereign council of Tournai, a court erected in parliament in 1686. The representatives of the king's justice are responsible for enforcing the provisions in a newly conquered border province which has its own religious history and favors, due toits situation, exile abroad. The purpose of this study is to analyse the application of the Revocation in the provinces of Flanders and Hainaut-Cambrésis and its consequences on local Protestants. Did the juges and the intendants, influenced or not by the specific characteristics of these provinces, favor the enforcementof legislation, or, on the contrary, were they rather lenient? The massive exile of Protestants of other French provinces and the fear of a deterioration of the Kingdom's economy made it difficult to enforce the legislation strictly

Full textThis research is set within the framework of XVIIth-century preaching during the Edict of Nantes period (1598-1685). It regards the expression of vanity in oratorical works (Catholic and Protestant sermons) as well as pictorial works (Vanitas, altar paintings). These last years, the study of rhetoric opened new paths that are interesting to explore. The issue at thecore of this study is the way the concept of vanity led to a renewal of the rhetoric of preaching in that period. In other words, I will show that for preachers the concept of vanityis both a theological and a literary concern. Thus my approach is to study the characteristics of a form of speech which, while it is heir to ancient conceptions, is also remodeled in order to adapt tonew circumstances that demand necessary reflections about nature and the power of speech as expressed in sermons and in Vanitas. The concept of vanity isnot only evidence of painful anthropological assessments, but is also used as a moral and religious argumentin sermons, while paradoxically generating an aesthetic fascination. I will thus consider moreparticularly the preachers’ favorite themes (death, scorn for the world, penitence) and their speech strategies, as Catholics and as Protestants, in order to study the paradoxes of speeches about vanity

Full textRelatively little is known about the way the pastoral ministry was exercised in France during the period of the Edict of Nantes (1598-1685). The case of Paul Ferry (1591-1669), who became pastor at Metz in 1612 and remained there until his death in 1669, makes it possible to enter into the world of the « ministers of the Holy Word » in the seventeenth century. This study attempts to analyze the forms and models of the pastorate. These are not only religious and confessional, but also political, social, cultural and intellectual. The impact of the minister could be felt at different levels, ranging from the local to the national and, due to an exceptional network of correspondence, even to the international. The Reformed pastor, a cleric who differs radically from the Roman Catholic priest, has the duty continually to reassure the members of his congregation in their faith and about their salvation. He does so especially in the preaching, but also in the administration of the sacraments, and as well as by way of acculturation in imposing Reformed morals and discipline on his flock. Even the « private » life of the pastor can be considered as a form of edification, and therefore as a pastoral act. It is the pastor’s duty to give an example of the good Christian life, especially since with the Reformation’s emphasis on the priesthood of all believers he is no longer ontologically different from his congregation. The pastor can also assume the role of protector of his congregation as a political guide and church spokesman, in particular in face of Catholic polemics and powers, or else the role of a historian, writer, or rector to a collège. In that Ferry assumed all of these functions by virtue of his position as minister, he can – notwithstanding the opposition he at times encountered from within his own consistory – be considered a model of those pastors who exercised their ministry under the Edict of Nantes

This thesis introduces such a model --- a formalism to describe general structure edit operations for text oriented documents. The model allows free bottom-up editing for any tree-based structural document with a textual content. It can also handle attribute and erroneous structures. Some classes of common structures have been identified and structure editor specifications constructed for them, which can be used and combined in the creation of other structure editors.

Full textThe objective of this study is to analyze the Huguenot written production in exile during a period of approximately thirty years (1676-1707), a time marked by the revocation of the Edict of Nantes (1685). Amongst tens of thousands of protestants banned from France because of religious persecution that occurred throughout the reign of Louis XIV, some individuals published, particularly in England and the United Provinces, completely different genres of writings, like travel accounts, pastoral letters, political, theological and philosophical treaties, utopias and colonial projects. The purpose of the dissertation is to examine these writings in detail, identifying proposals and debates on political, social, economic and/or religious order, which undoubtedly reflected the concerns and expectations of the Huguenots in that time, ie, their different reactions under an antagonistic context.

Graphs are abstract data structures used to model real problems with two basic entities: nodes and edges. Each node or vertex represents a relevant point of interest of a problem, and each edge represents the relationship between these points. Nodes and edges could be attributed to increase the accuracy of the model, which means that these attributes could vary from feature vectors to description labels. Due to this versatility, many applications have been found in fields such as computer vision, biomedics, and network analysis, and so on .The first part of this thesis presents a general method to automatically learn the edit costs involved in the Graph Edit Distance. The method is based on embedding pairs of graphs and their ground-truth node-tonode mapping into a Euclidean space. In this way, the learning algorithm does not need to compute any Error-Tolerant Graph Matching, which is the main drawback of other methods due to its intrinsic exponential computational complexity. Nevertheless, the learning method has the main restriction that edit costs have to be constant. Then we test this method with several graph databases and also we apply it to perform image registration. In the second part of the thesis, this method is particularized to fingerprint verification. The two main differences with respect to the other method are that we only define the substitution edit costs on the nodes. Thus, we assume graphs do not have edges. And also, the learning method is not based on a linear classification but on a linear regression.

Full textAt the beginning of the Roman Empire era Women enjoyed a certain degree of autonomy. We wondered how it evolved when Roman civilisation had to face the durable installation of Germanic populations on its lands. We undertook to study the turning-point during the 5th to the 7th century. How did legal provisions regarding women, which were derived from the Codex Theodosianus, evolve when Barbarian kings decided in turn to enact written laws? To evaluate the impact of legislative measures on society, we have drawn upon the comments of contemporary authors and compared the text of legal dispositions with practitioners' forms. In order to measure Christian influence on imperial constitutions and on Germanic texts, we read the Fathers of the Church and conciliar decisions. We tried to grasp the reasons for the adoption of particular measures. We have attempted to examine whether it is possible to refer to "women's rights", from the Roman Empire to the Burgundian, Frankish, Visigoth and Ostrogoth kingdoms. Roman law appears to be the common thread which links the Empire to the Barbarian kingdoms, without breaking. It shaped the way women were considered in societies which had become Romano-Germanic. Law and societies' permeation by Roman mores contributed to the merging of peoples. Some Germanic customs obviously survived. Legislation sometimes drew on the fertile ground of Christian thought. We have attempted, in our research, to map these currents

For this thesis, I refined and tested a computer-based engineering teaching tool called EDICS. EDICS (Engineering Design Instructional Computer Program) has proven to be a fun and intriguing means of conveying a wide variety of engineering design subjects to undergraduate students. The core audience of EDICS was assumed to be undergraduate engineering students who lacked the practical experience of manipulating common mechanical components and devices. It has been discovered, though, that EDICS is a useful tool for nearly all types of engineering students at many different levels of experience. The testing of EDICS was carried out by having students study either short excerpts from the program or similar subjects covered either in a popular textbook or a booklet, then testing their knowledge retention by subjecting them to a short, written exam. The subjects that were studied were: transmissions, fastening and joining techniques, and engineering drawing and drafting. The results of this evaluation show that in the subjects of transmissions and fastening and joining, students who used EDICS to study performed significantly better than those who studied using paper-based materials. In the subject of engineering drawing and drafting, the students using EDICS scored, on average, better than the students using the paper-based materials, but the difference was found to be not statistically significant.

Full textIn 1685, during the reign of Louis XIV, the French monarchy tried to extirpate the Calvinist alterity from the kingdom by revoking the Edict of Nantes (1598). At that time three contemporaries, Jacques-Bénigne Bossuet (1627-1704), Pierre Jurieu (1637-1713) and Pierre Bayle (1647-1706), the first Catholic, the others Protestants, conceived utopias in which they introduce us to their vision of an ideal France. The general aim of this master's thesis is to analyze these three utopias and show their proposals in matters of government and interfaith relationship. More precisely, we will study the authors' positions about the politico-religious consequences of the Revocation. We will also see in their writings how they understand the tolerance issue.
