Full textThe notion of strategic efficiency with respect to contracts refers to the contract’s aptitude to meet the needs of the strategy for which it was created. From the legal point of view, the concept of contract’s strategic efficiency cannot be a normative one. Constitutive of the contract goal, efficiency remains in fact on the fringe of law. This does not mean, however, that the judge cannot occasionally and usefully refer to it for the act of interpreting the contract or when it comes to verifying the legitimacy of the parties’ behaviour. That being the case, this possibility is insufficient for integrating efficiency generally into legal reasoning. On the other hand, the concept of contract’s strategic efficiency appears as the essential and determinant objective of the contractual content when seen from the point of view of the parties and in the exercise of their contractual liberties. Furthermore, recent developments in contractual techniques have produced juridical tools more and more refined aimed at introducing into the contract more flexibility and also more safety with regard to the strategic goals, thus making the contractual edifice a truly high-performance instrument

Full textThe management of quality is recognized today like a key element of performance, and thus of differentiation of the companies. The emergent processes, related to the various steps quality, exert a real influence on the performances of the company, and emphasize a complexity which makes their management difficult to control. The objective of this thesis consists in studying the effects of the steps quality on the organisational performances of the company. She seeks to put in light and at better including/understanding the permanent interactions between the installation of step quality and the performances organisational. The problems are declined in four theoretical proposals which direct the empirical study. It is carried out through three case studies realities and diversified, of steps quality. Starting from a study of the literature, of a qualitative analysis of the data collected and discussion of the theoretical proposals, new theoretical proposals are formulated and of the concrete tracks of action are indicated to enrich management by quality. The principal results highlight a positive and significant contribution of the steps quality, in the organisational performances of the companies, via process of changes and organisational trainings. This contribution was supplemented by the forward setting of variable and moderated effects, been dependant on the contextual elements, and the subtlety of the organized system of the steps quality: the quality of management

Full textThis research explores the field of cost and analysis planning and more precisely the efficiency of budgetary systems of quoted companies as a consequence of relationship between the strategic management of corporate officers and the scope of cost and analysis controllers. Our issues are the examinations of clarifying variables in the configuration of the budgetary system, and more precisely the management style of the corporate officers, as well as the budget emphasis so as to determine their role concerning the efficiency in the control and the mix of behavioural and structural patterns which can explain the controller's scope. Our research methodology is based on successive re-iterations of scientific observations in the field (a « qualimetric » approach, at the same time based on qualitative, quantitative and financial data) so as to establish a conceptual model explaining the interaction of different variables (style of management, configuration, budget emphasis, scope) and realising a typological analysis of different efficiency forms of the budgetary system

Full textThe role of Competitive Intelligence (CI) is now recognized. However, despite the development of practices in companies, questions remain concerning the effectiveness of the implementation of CI. Thus, our research provides a contribution to the measurement of the efficiency of CI which has seldom been studied in the literature. In the absence of an available methodology to conduct this evaluation, we created a system of measurement based on the possibilities offered by modeling the implementation of the CI concept and the development of an analysis protocol. Several model configurations were first generated from two criteria based on training of personnel in CI and on the evaluation of CI within the company. These configurations were then put into operation in the empirical field of innovative companies in the aeronautics and aerospace sector. This choice is justified by the importance of innovation and the importance of CI practices in this sector. Conducting a quantitative study allowed us to compute performance profiles for situating businesses in an area bounded by upper and lower limits which provide a certain flexibility for the company. These results show the possibility of measuring the performance of the implementation of the CI concept. It allows businesses to consider improving performance by following the implementation of the CI process. The modeling of the implementation of the CI concept will allow us to deduce future ways to improve this process

Full textStrategic alliances in recent decades experienced a strong growth both in terms of firms management practices and in terms of academic research. This growth has been accompanied by many controversy concerning their outcomes (performance) and the factors influencing these outcomes. Through this research, our objective is to understand the phenomenon of asymmetric strategic alliances by identifying its main characteristics and factors that may positively or negatively influence its performance. In this perspective, our research first phase consisted of the realization of a state of the art on the concepts of strategic alliances in general, asymmetric alliances in particular and performance. On this basis, we established eight research hypotheses that we tested by adopting a qualitative approach by studying 10 cases of asymmetric alliances. Our empirical application concerned strategic alliances between French SMEs and multinational companies operating in the aviation industry and was conducted from the perspective of SMEs involved. Analysis of our research hypotheses allowed us to obtain three main results: the existence of strong links between partners specificities and their alliances motivation; the existence of significant negative links between between partners asymmetries in terms of (size, organizational culture and experiences) and relational performance; and the existence of significant positive relationship between SMEs and multinationals involved resources complementarity and their quantitative results (financial performance and organizational learning). Our results confirm some previous research concerning of asymmetric alliances characteristics and performance. They can also be objects of practical recommendations to managers of SMEs involved in these relationships

Full textTo develop its strategy, a humanitarian Non-Governmental Organization (NGO) needs to conciliate its stakeholders’ expectations, its founding social mission and organizational culture and the environment’s constraints. If it manages to articulate its resources and competences in a wise manner, an NGO can improve its performance by developing new competencies in a recursive and adaptive process of organizational learning. An NGO’s central resources lie in the men and women who constitute it and promote its social mission through their involvement and their faith in the mission. Among these resources, we focus on national staff, recruited directly in the countries where NGOs work. We have noticed a change in French humanitarian NGOs’ practices towards their national staff. These practices tend to be more integrative at administrative, operational and associative levels. We therefore wish to understand how this integration could help humanitarian NGOs renew and develop their competencies through an organizational learning and hybridization process. This integration could therefore contribute to improving their organizational performance. We chose to carry out a case study analysis of the French NGO Médecins Sans Frontières, which has implemented a new integration policy towards its national staff

Full textThis doctoral research focuses on the question of the effects of a strategic partnership between brand and a cause of consumer’s response. This partnership called by Anglo-Saxons “Cause Related Marketing” (CRM) and by French “produit partage" or "promotion-partage”, conducts the company to assume the payment of a sum deducted from the selling price of one of its products or services to a cause. Cause Related marketing is implemented by companies to achieve a twofold objective: the first is to raise awareness, support and make donations to social and / or environmental causes. The second objective is to increase the company's sales, improve its reputation, differentiate its products from those of its competitors, increase customer loyalty, and so on. Although the literature suggests that promotion-sharing could bring many benefits to both parties involved in the partnership, in this regard the brand and the cause, it is clear that in reality, these operations are not always successful (e.g. campaign Race together from Starbucks). As a result, to help companies and organizations with causes to design effectivepromotion-sharing campaigns, this doctoral work explores the effects of several efficiency factors. This doctoral research the effects of two factors that can improve the effectiveness of Cause Related marketing, namely the perceived congruency between the brand and the cause and the framing of the message. It shows the importance of the compensation actionimplemented by the company through Cause Related Marketing, as perceived by the consumer. An experimental study of 603 French consumers, representative of the population, showed that a strong congruence and a negative framing is more effective than a weak congruence and a positive framing to promote a product
