<p>During the local self-government elections that took place in 2018 in Poland, for the first time regional electoral commissions for conducting voting in the circuit and regional electoral commissions for determining the results of voting in the circuit appeared. Both electoral commissions are appointed by the appropriate electoral commissioner from among the voters. The tasks of the regional electoral commission for voting in the circuit include conducting voting in the circuit and ensuring that the election law is observed in the place and time of voting. The purpose of this paper is to answer the question whether the following can incur civil liability for damage caused by an unlawful act or omission committed by members of circuit electoral commissions: Is it the State Treasury or a local government unit or another legal person exercising public authority under the law? In my opinion it is necessary to verify the hypothesis whether the activity of members of circuit electoral commissions constitutes exercise of public authority. Moreover: Is the manner of appointing their members, their qualifications and competences important for qualifying

Whether public opinion influences federal judges is a question that has long motivated—but often eluded—scholars. In this article, we examine two related questions: First, whether federal circuit court judges respond to circuit-level public opinion and, second, whether judges with extensive past elected political experience are even more responsive. The data show that circuit judges indeed respond to public opinion. The results also suggest that judges with greater past elected political experience may be more responsive. The results have implications for democratic control of the unelected ju

This paper analyses the concept of critical infrastructure (CI) in the context of electoral process organization. I will determine whether the seats of circuit electoral commissions (CECs) meet the relevant criteria. How can such facilities be effectively protected? What does international, European, and national law prescribe in this regard? I will examine doctrine and the provisions of the current legal system, including the documents of the National Electoral Commission (NEC). I adopt the statutory1 assumption whereby critical infrastructure should be understood as systems and their functio

Judicial confirmation hearings offer a rare opportunity for senators to engage in a public exchange with current and future members of the federal judiciary. Below the Supreme Court level, however, we know relatively little about how members of the Judiciary Committee use these hearings. In this article, we examine senator mentions of Supreme Court cases at circuit court confirmation hearings between 1993 and 2012 to test whether these hearings serve as a venue for position-taking, as well as for interbranch dialogue. We find evidence that senators do reference decisions in ways that seem moti

This article explores the political economy of Closed-Circuit Television (CCTV) in Australia, providing new insights into the relationship between government policy and its economic implications. I have rationalised state-sponsored street cameras as a component in the cultivation of consent between the state and local communities; a mechanism for government to facilitate the flow of public funds to business through arrangements that are virtually unchecked and non-evidence based; a mechanism for government to facilitate profitable opportunities in and beyond the security technologies industry;

This article argues that the juror franchise became more restrictive in the years immediately after the Sex Disqualification (Removal) Act 1919 had broadened the jury franchise so as to include some women. It argues that the subsequent restrictions on the jury franchise have not standardly been discussed in the literature on the twentieth century jury because of the lengths taken at the time to present these reforms as merely technical in nature. Only six months after the 1919 Act was passed, a dispute broke out at the Western assize circuit regarding the practice–apparently sanctioned in the
