The paper is focused on the legal regulation of fixed-term employment. The author critically evaluates the current decision-making practice of high courts (The Supreme Court and the Constitutional Court). In addition, the author presents his considerations de lege ferenda. Furthermore, the paper is focused to selected points of the draft of the current amendment to the Labour Code. Specifically, it focuses on the proposal to change the legal regulation of the probationary period, the notice period or the delivery of documents to the employee in his own hands.

This article focuses on the issue of employee liability. A certain anomaly has taken root in the Czech Republic since the 1960s. This anomaly consists of the fact that an employee cannot be sued for damages by an injured party. The injured party must always sue the employer instead of the employee. Although the legislature attempted to abolish this rule so that injured parties could sue the employee, the Supreme Court has prohibited this practice through its case law. The Gender reassingnment is practically defined primarily at the level of human rights, as evidenced by the jurisprudence of the Constitutional Court of the Czech Republic and the European Court of Human Rights. However, this law‘s institute also extends into other legal fields, including labor law. Within it, it is acceptable for employees to be divided according to gender. However, § 16 of Act No. 262/2006 Coll., the Labor Code, as amended, must not be violated.
