Full textThere are huge institutional differences between France, Belgium and England, be it in the functioning of criminal justice or in child welfare. The policies adopted to fight against child sexual abuse therefore vary widely. However, the way in which child sexual abuse emerged as a policy issue has been similar in the three countries: the focus, the time frame, the actors, the dynamics and the discourse were identical. These “unexpected convergences” are difficult to explain with a purely institutionalist approach, since the latter generally pays scant attention to the emergence phase and tends to over-estimate the influence of domestic institutional constraints. Whereas the emergence of paedophilia can be explained as the result of a series of short-term (major cases) and long-term factors (the recognition of children as a category deserving public attention); of micro (role of actors) and macro-elements (transformation of the cognitive context), the convergence between these emergence processes seems to be due in part to the integration of a number of actors in international networks (international conferences and associations, epistemic communities). This gives rise to a series of boundary questions regarding: the contours of the policy issue (child sexual abuse having been redefined as a result of the emergence process); the boundaries of public policy, be they vertical (relationships with the international level) or horizontal (with the civil society); disciplinary boundaries, as the role of lay people suggests that we need to bridge the gap between public policy analysis and political sociology; and the role of the state, in relation to the private sphere

Full textMigrations are a transnational phenomenon that its management has traditionally called attention from the destination states exercising its sovereignty. With the arrival of globalization, the migration perspective has changed. Migrations have an increasingly more important place in the government’s agenda, which has understood that migration management needed the cooperation and the joint action at an international level. The governance of migration involves multiple challenges for the destination countries as well as the countries of origin and for the international community. On one hand, it presents the interest of controlling the arrival of migrants, with a strong influence of security conceptions; on the other hand other ideas have immerged that consider migration as tools for development. Those ideas aim to profit from the effects that are considered as benefits of migration and to stop the negative effects. Finally, we consider the existence of the circumstances that can put in danger migrant’s human rights and for which some measures should be taken. Reconciling the interests surrounding the management of migration is not a simple task. For finding ideal management framework for the governance of migration and the protection of migrant’s human rights, we will explore 5 hypotheses. We will analyze the global administration of migration; the regional administration (in the framework of Latin America); the protection of migrants as vulnerable people having universal rights, as well as the protection from the migrant’s state of origin (in the particular case of Colombia). The assets and the challenges of each one of those discussion environments will be analyzed as well as its contributions to migration’s governance and migrant’s protection

Full textThe Treaty of Lisbon has deeply changed the scope of the external action of the European Union. One of the most important changes it has made to the European Union's external action is the constitutional objectives it now has to meet. Indeed, Article 3 §5 of the Treaty on EU concerns the international objectives of the EU. Among these objectives, one of them is particularly important. Firstly, because it reflects a new interest of the EU and, on the other hand, because it was unexpected: it is the aim of protecting children’s rights. The new status of the protection of children's rights in EU law has been relatively unnoticed and the doctrine has barely relayed it. This new aim on the international scene raises several questions related to the existence of legal tools for its realization or to the effectiveness of the measures adopted to protect children’s rights at an international level. These different issues are answered. However, the achievement of this objective reveals other difficulties that raise issues about the limits of European action and therefore the limits of the functioning of the EU. Children’s rights are a particular matter because they carry legal aspects, of course, but not only. The European Union, by deciding to incorporate their protection into its international objectives, finds itself in a balancing act, particularly in regard of the current international context, which combines armed conflicts, humanitarian crisis and major migratory movements. It is clear that, faced with this situation, there are many difficulties encountered by the EU for the achievement of this aim of protection of children’s right and even in making it a part of its external action

Full textThis research focuses on the psychopathology of asylum seekers in Slovakia, France and Norway, as well as on vulnerability and protection factors which may influence the development of certain disorders. We were able to shed light on the psychological fragility of 120 asylum seekers, by identifying the prevalence and high intensity of post-traumatic stress disorder, depression and anxiety, as well as major comorbidity. Basing our work on the notions of vulnerability and resilience, we identified psychological vulnerability resulting from the interaction of various factors that illustrate the dynamic within the subject-environment relation. We were able to observe the role of such factors as the female sex; a history of traumatic experiences, especially interpersonal traumas that are particularly destructive to their victims, their links with others and their belief system; and the impact of negative events, especially those concerning loss, separation due to exile and the uncertainty of asylum. Such experiences challenge the individual's ability to face events, and we were able to notice, in subjects with psychological distress, a certain vulnerability linked to the weak adaptability of defensive functioning and to a kind of insecure interpersonal attachment style. However, the origin of such inner psychological and interpersonal developments has not been established as of yet. Our observations underline the necessity to assist asylum seekers, in order to establish, within the framework of psychotherapeutic work, a space to encourage the mental elaboration of traumas and the development of protection factors fostering adaptive abilities
