Diagnostische Auswertungen im Kinderschutz sind komplex und konfliktbehaftet. In Frankreich ebenso wie in Deutschland versuchen Kinderschutzorganisationen die Risiken ihre diagnostische Methoden bereits im Ansatz so gering wie möglich zu halten und damit ihre Prozesse zu rationalisieren. Dabei laufen sie jedoch Gefahr die Partizipation den Klienten zu vergessen. Die vorliegende Arbeit erstellt eine vergleichende Perspektive zwischen Frankreich und Deutschland, in der Formalisierungsverfahren von diagnostichen Methoden im Kinderschutz sowohl auf der rechtlichen Ebene, als auch in der Praxis der Beschäftigten kritisch beleuchtet werden. Full textThe aim of this study is to assess the legal framework in which the compiling and treataent of evidence of cases of child abuse at home operate. This analysis is based on the assumption that the lock of precision in this field discourages a social reaction to cases of child abuse. Gathering evidence of cases of child abuse is made difficult in the first place because of a too general and conceptual approach which does not favour the understanding of child abuse and in the second place because of aethods which generate some confusion in how to intervene. The treatment of evidence of cases of child abuse is carried but by various means at the disposal of the child welfare system in general and by the society for the prevention of crualty to children in particular. However, the methods of dealing with this evidence are not always suited to every individual case and interveners find it hard to act together in a concerted fashion. Thus, it is urgent to effect a more specific and multidisciplinary intervention based on the conclusions drawn from the teachings of the science of victimology connected with child abuse

Full textChild abuse and neglect in black family circles originating from africa are usually analysed as a result from an opposition between educational system and cultural values which can't match. In such situations the victimized is at the center of a competition even a conflict between norms. As a matter of fact, everything can't be negociated from a legal point of view especially if the situation is a violent one. Reminding the law is essential but proves to be inadequate. In france, the protection of ill-treated children is based on formal legal terms which is a problem since it must apply to families with difficult backgrounds whose normative references result from another logic. However the study of social and cultural mores of the adoptive country and especially the families involved makes it clear that the meeting of these two logics will not necessarily result in a conflict. Immigration is a complex process which, in spite of the vulnerability it induces, allows some flexibility (between various legal registers) which will favour dialogue. Of course preventing ill-treatments means the symbolical function of the law has to be understood and accepted. To do so, a socialization policy enhancing a set of lawful rules and roles in everyday life should be set up. On both sides, innovating ways of regulation show that the quest for an equal dignity between human beings can match plural identities

Full textAs part of their mission of "the protection of children", social workers refer certain families to the intervention of justice when they consider those children to be "endangered". These reports can be understood as family surveillance : they contribute to the classification of family educations; and they belong to a set of practices of government. Building on ethnographic survey of social services, this dissertation describes the kinds of family disorders that are referred for intervention and how the assistance rationale is articulated with other professional judgment. The family moral is put in relation with the social trajectory of social workers. The survey reveals the extent to which these female professionals are submitted to double binds. Writing a report to refer a child is experienced as a test to which social workers respond unequally. Analyzing these inequalities regarding this test allows us to see the conditions of social workers' faith in the mission of ordering families

Full textThis thesis aims at rebuilding the social and historical process of constitution of child abuse as a social issue. What is a stake is to grasp how, from a news-in brief item, child abuse has become a major social issue. Actually, the infrequency of family affairs mentioning ill treatment to minors in the sixties contrast with the amazing proliferation of this kind of problems today and even more in the held of sexual abuse. In other words, the concept of child abuse refers to historical facts and its lexical field has undergone a considerable semantic extension in a matter of four decades. Why lift the veil ? How did it happen ? More generally, this study is driven by a genuine project : to carry out a joint study of child abuse and foster homes, from the A. S. E archives and interviews with medical and social workers. The historical and social building-up of the concept of child abuse partly covers the historical evolutions of the practices and above the argumentation elaborated upon the cases of foster homes. Even though the history of foster homes is one of the passage from the sanction of deviant parental behaviour to a less clear-cut attitude, severing a child from an environment the influence of which is deemed pernicious is a constant practice among social workers. Yet, the way "child wichdrawals" are justified has evolved considerably. The analysis of the interviews leads us to interpret the publicizing of child abuse as the product of the conjunction of several factors, namely the societal, the judicial and the political ones

Full textThis study has two main objectives ; First, to describe the developmental Tate of children who have suffered from shaken baby syndrome white documenting the construction of the child-mother attachment bond ; Second, to understand the complexity of the interrelationships between the medical and relational aspects. This study adopts a long-term perspective involving 45 children evaluated at 12. 18 and 48 months old. A control group composed of children diagnosed with simple craniostenosis has been used for comparison. Psychomotor development was tested using the Brunet Lénine method. Cognitive development was addressed using the WPPSI-III test, Child temperament has been assessed using the QT6 questionnaire, and the social withdrawal behavior by using the Alarm Distress Baby Scale. Behavioral disorders were assessed using the questionnaire Child Behavior Check List and attachment behavior was evaluated using the Strange Situation protocol. Maternal sensitivity was assessed using Ainsworth's Maternal Sensitivity Scale, Results of the psychomotor and cognitive development assessments suggest that there is a link between an initial status epilepticus (in addition to young age) with short and long term low test scores. Child temperament and maternal sensitivity were not shown to be linked to the shaken baby syndrome. Social withdrawl was observed in 23% of the cases and were associated with admission to a child care unit at a young age based on their serious initial medical state, and early relational disorders. Paradoxically, the attachment behavior secure has been found over-represented and the attachment behavior avoidant insecure attachment as been shown to be under-represented

Full textImportance: Childhood abuse is a global public health issue yet there is a serious lack of reliable epidemiological data and the figures reported are very often underestimated. A large part of these children are not diagnosed. Moreover, diagnosed children are not recorded in a single database.Objective: The aim of this study is to provide two estimations of the frequency of child physical abuse requiring hospitalization (hospital prevalence) and the corresponding in-hospital fatality. Design, setting and participants: This was a national retrospective study using a national hospital database (PMSI).We included all children aged less than 2 years old hospitalized at least once in France from 2007 to 2014. Infants less than 1 month old were excluded in order to exclude all pathologies and neonatal complications.Three groups were defined: group1 - physically abused children (identified by the ICD 10 codes used in the PMSI concerning physical abuse); group2 - possible physically abused children (suspicious physical injuries associated with child maltreatment); and group3 - all other hospitalized children (the control group).Main outcomes and measurements: First, based on the number of children aged 0 to 2 years in France in 2010, we provide two estimations of the frequency of child physical abuse requiring hospitalization (hospital prevalence): a lower bound represented by the children of group 1 and an upper bound represented by the children of group 1+2.Secondly, we studied the follow-up of these children from their inclusion to 2014, thanks to the linkage of the differents hospital stays; with regard to the number of hospitalizations, their length of stay, their reasons and in-hospital fatality.Results: In our study, 2,628,386 children were included: 4,172 in group1, 12,024 in group2 and 2,612,190 in group3. The national annual hospital prevalence of child physical abuse (and hospital fatality) in children aged 0 to 2 years ranged from 1.6‰ (2.52%) to 5.7‰ (2.01%). Most hospital deaths occurred during the first hospital stay (between 99% and 99.6%) and are 10 times higher than in the control group. The length of stay of abused children is up to 5 times longer than for other children. Conclusions and relevance: To our knowledge, this is the first study to provide an estimation of the frequency of child physical abuse requiring hospitalization and the corresponding in-hospital fatality. Three out of four children may not be identified as being maltreated and are at risk of recurrent abuses. More effective prevention should be implemented by health professionals in order to identify those children

Full textFamily is a place of ambivalence and contradiction. On the one hand, it can be defined as a zone of comfort, mutual aid, affection and above all protection against all kinds of mistreatment. On the other hand, it can be the very centre of abuse and its first source. This shameful violence compels people to silence and therefore often escapes the authorities. Our study aims at unveiling this important taboo, little known at the time. At exposing and explaining the highly antagonistic relationships between the members of a nuclear/conjugal family. Violence takes many forms. It can be physical (blows, injuries, sexual abuse) but also economic (property offences, need, deprivation, deliberate theft) or even moral (psychological hold on someone, insults, debasement). It can also derive from changes of behaviour, which generate conflicts between spouses (conjugal violence), but also between parents and their offspring (parental violence or child violence towards parents). In a city like Paris – and more generally in the Seine department – which claims to be a centre of modernity, a pioneer as regards changes in social mores and ways of thinking, violence is no less obvious. Its way of life and daily obligations affect family behaviours in a significant manner. Added to this is a difficult context: the pre-war period, marked by economic and political crises, then by German Occupation following French defeat. Full textThis research is a comparative and differential approach of child abuse (0-18 years), in France and Syria. It concerns forensic medicine in the context of medical ethics. The initial issue evokes the reporting abuse and its obstacles, and leads to the following question: How the always main decision of the doctor can integrate the psychological and socio-cultural dimension of child abuse in order that the reporting (or the no reporting) benefits the child and family? The history and evolution of child abuse are exposed, for both countries (some information only for Syria). The child, subject vulnerable, is considered as a psychological and sociocultural entity, as to his/her protection. Then, the medical approach (clinical cases of abuse commonly observed), and the medical management of the child are exposed in the French and Syrian societies. Finally, the legal aspects of child protection are reported with its obstacles as part of an ethical issue, between medicine and law, in specific socio-cultural dimensions. These data are updated in the study of clinical cases, in forensic services: CHU of Dijon, in France, and one hospital, in the area of Aleppo, in Syria (Dao’s synthesis of 2002, on 249 cases, given the current political situation). Then, considering the testimony of the Dr Catherine Bonnet, this study opens the reflection on rape and incest, and highlights some difficulties due to certain judicial decisions which, although correct in view of the law, may be deleterious for the child and his family, if we consider a psychological, emotional and social point of view. Both countries situation is differentiated, again. The moral and ethical conclusion refers to the responsibility of the family (welfare and education of the child). It also refers to a difficult relationship between the doctor’s practice and the judicial decisions that should allow a true care and an effective protection of the abused child. This issue arouses our final questioning: at the world level, perhaps it may be necessary to develop a specific legislation for the child ?

Full textExploration of how violence is perceived in French society using two distinct empirical approaches. The first approach analyzes the historical evolution of statistical categories of violent death (accidents, suicides and homicides), as well as the process whereby a death cornes to be classified under one of these categories. It is shown that in both instances medical criteria (etiologic and anatomy) become subordinated to judicial criteria, (intent and age of the deceased). The second approach examines the social construct of violence against children, using ethnography observations of reports brought to the authorities. Here, again, the law bas significant influence both on how the cases unfold and on the resulting verdicts. Nevertheless, variations in these constructs are apparent in the interaction between plaintiffs and the judicial authorities, and in the change in denominations that the "facts" undergo from the beginning of the complaint process to its end

The study of the tribal canaq society gives the possibility to observe the violence's problem vis-a-vis children and women with another wiew. The clan's pressure redives the person's autonomy. When passing the christian religion behaviour have little changed, i. E. "a human being as a person doesn't exist". For long, private and social violences have been the institued rule for woman as for child. This state does not give satisfaction and raises some questions

Full textThe question of children who are victims of mistreatment is currently a central point of the socio-politic scene. The discourses of both moral and expert points of views tend to trivialize this question. They put it away like a phenomena which is not really recognized as being legitimate and without paying attention. Terror and scandal set the tone of a sensationalist media and introduce a widespread suspicion that adults, especially those who play the role of parents, become potential criminals, and in which the child supposed to be fragile and innocent, could become a potential victim. This study which is highly theoretical issue, tries to understand the subjective logic that could be hidden behind such questioning. To respond to it, the start of our work is to adopt the opposite hypothesis of the dominant discourse. Our point of view focuses on the fact that mistreatment is anchoring in a dynamic process rather than in a simple ‘given fact’, that is ill-treated child. This mistreatment construction has specially something to do with the contemporary subjectivities and the place that occupied by the child. At first, our work strives to highlight the terms of this construction by evoking the notions of danger and of victim in relation with the psychic trauma and with of child of law. In a second time, it is interested in a psychoanalytic approach from the concepts of trauma, of infantile sexuality and of phantasm, articulated at the image of the ill-treated child to ultimately consider the notion of mistreatment as a form of the culture uneasiness

Full textOur research deals with the problem of child psychology rarely addressed by the cognitive psychology of education : forms of child abuse. Our focus is on creating a prevention method applicable in Iran. Child abuses have an impact on the bodily, mental, emotional, sexual and even social aspects disrupting the normal growth of the child. This represents a socio-psychological problem not adequated studied in the past to learn the consequences that is implies on the psychological development of children, even if, particularly in France, sociologists and psychologists are interested in since few years. The aim of this study was to establish an educative method in two forms (Conference and Theater-workshop) in order to prevent child abuse, in family context and outside. In this thesis, we have worked out a preventive method that we have realized in Iranian school. Five hundred and four students, 9 and 11 years old have taken part in our study. All of them have done one of the two forms of the preventive program. With the aid of a pretest and posttest questionnaires realized by children, the effectiveness of our educative program has been evaluated. Gender, school and socio-economic effects have been also measured. The main results show that students' knowledge about child abuse and attitudes to have in order to avoid is better after the educative program of prevention than before, and that, compared to students who did not take part in this type of preventive program. In a political context such as Iran's one, prevention by education is the best hope for Iranian children

The study of the economic social and cultural rights should pay attention to the spirit of this united nations instrument, contended in its preamble : the child, due to his lack of maturity, needs a special protection which falls in priority on his family. But, today, it has to face serious issues, like unemployment and poverty. The evolution of the world economic situation and the spending cuts pass on the family's ability to play its role with efficience, and then on the effective enforcement of the economic, social and cultural rights of the children. Comorbidity between disorders tends to be the rule rather than the exception in individuals who have experienced childhood maltreatment. Given the presence of multiple comorbid psychiatric disorders in this population, the transdiagnostic approach offers a conceptual frame with which to explore common dimensions and risk factors of psychiatric disorders. According to the transdiagnostic approach, dimensions and risk factors shared between psychiatric disorders could be genetic, neurobiological, psychological and neuropsychological. However, few studies have identified neuropsychological mechanisms associated with maltreatment among people with several psychiatric disorders. The general objective of the current thesis is to explore the transdiagnostic neuropsychological mechanisms associated with childhood maltreatment among people with psychiatric disorders. The first study, a meta-analysis, highlighted transdiagnostic neuropsychological mechanisms among people with several psychiatric disorders. Specifically, childhood maltreatment had a significant impact on working memory, verbal episodic memory, intelligence and processing speed. The second study, an empirical study, explored the role of neuropsychological impairments in the presence of psychiatric symptoms among teenagers with a history of childhood maltreatment and multiple psychiatric disorders. This study showed that retrieval in visual episodic memory and planning are predictors of externalizing symptoms among teenagers. Altered executive mechanisms could explain the variance of externalizing symptoms among teenagers with several psychiatric disorders. The work within this current thesis represents the first attempt to explore the common neuropsychological dimensions between psychiatric disorders in a transdiagnostic approach. Indeed, this thesis identifies neuropsychological mechanisms associated with childhood maltreatment that are common among people with several psychiatric disorders. Moreover, some of these neuropsychological mechanisms are predictors of the variance of externalizing symptoms among teenagers. In short, this thesis improves the current understanding of the complex relation between childhood maltreatment, neuropsychological mechanisms and the presence of psychiatric symptoms, according to the conceptual framework of the transdiagnostic approach.

Full textA significant reduction in treatment compliance is found among nearly ail diabetic children when they reach puberty. The purpose of this study is to analyse the reasons for this systematic onset of non-compliance. The ' psychopathology of non-compliance in diabetic adolescents" has been extensively studied. Researchers typically view this behaviour as part of the "illness process", as a result of the "work of adolescence"', or as a combination of the two. Drawn from semi-directive interviews with diabetic teenagers and their parents, we suggest that a different type of psychological process can be expressed through non-compliance. We theorize that the trauma associated with the onset of puberty leads diabetic adolescents to recall a previous trauma that was never fully resolved. Through "harmful treatment", the diabetic adolescent retraces his suffering relationship to his parental imagos and to the presumed psychological pain that he caused his parents by being sick. This fantasmatic relationship, disowned by the parents who run away from the situation by using medical care, represents an experience as traumatic as the diagnosis of the disease. The adolescent tries to "re-present" this trauma in order to symbolise it and elaborate upon it with "harmful treatment" appearing as the clinical expression of a "harm process" that is reaching its final stages. This behaviour symbolises the attempt to cut off the fantasmatic therapeutic relationship that binds the adolescent to his parental imagos by shifting the internal conflict to the treatment. By attracting the attention of doctors, nurses and psychologists to the psychological wounds that have remained "harmfully treated" or "un-treated", the teenager introduces a third "terni" (tiercénë). Thus, "harmful treatment" serves as a means for psychic repair in the self as w-ell as for those around the adolescent, specifïcally his parents. This new psychopathology approach to problems with treatment compliance leads to several therapeutic stratégies that go beyond uniquely medical objectives and tasks

Full textThis research studies the consequences of different kinds of ill-treatments on the building of the individual's narcissistic identity. In particular, the ill-treatments by extreme negligence and psychological ill-treatments of which the major consequence would be to hinder the process of identity in the first stages of life. The clinical and psychoanalytical analysis from interview material with adults having been victims of ill-treatments, either during childhood or later, enables to identify: defence mechanisms and psychical adaptations, aggravating factors and resilient factors to ill-treatment traumatism. A differential analysis enables to emphasize three determining factors in building up the narcissistic identity in situations of ill-treatment: the typology of traumatism, the age of the subject at time of traumatism and the ill-treating surroundings. The link pathology present in all ill-treatment situations, whether within the family or outside the family, leads to calling into question the dynamics of the family or institutional system from subject's view in interaction with his family institutional and social environment

Full textDuring the transition between the XXth century and the third millennium, juvenile aggressiveness and violence burst into the French public debate and temporarily became a crucial topic. Pathological explanations of this phenomenon occurred and led to believe that young rebels or delinquents already were actual psychopaths. Then we wondered what could be the origin of this phenomenon described as a widely spread issue that could potentially come out as a sociological matter. The example of the cases of specific serial killers enabled us to determine the core of the problematic: narcissism, which appears as a perverse "will of power" among sociopathic murderers. The explanation of their psychopathology also led us to establish that it was not omnipresent and also linked to their social and cultural environment which can actually be as sane as insane according to A. Maslow. Full textThe research aims at analyzing the influence of toys catalogs on kids and their attitude towards brand. After a review of literature (social psychology, researches concerning the consumer kid and state-of-the-art concerning the paper catalog), and thanks to a qualitative methodology for different targets (professionals, kids, and parents), a conceptual framework is then suggested dealing with the link between the characteristics of the toys guides and the attitudinal reactions of kids. A specific scale of attitude measurement toward the toys catalogs for a public of 8 to 11 years old is developed and confirmed. An experiment allows testing of the conceptual framework. Results confirm that the attitude towards the toys catalogs has a heavy influence on the attitude towards the brand after consulting the catalogs, with differences according to the characteristics of the catalogs. The role of individual variables such as gender and age is also confirmed

Full textThis dissertation compares how feminist movements from the 1970s onward were successful in establishing domestic violence as a social problem both in France and the United States. Understanding the problematization of domestic violence requires analyzing the practices and representations of women working within specialized associations as well as the institutional and professional opportunities they took advantage of in order to have their cause recognized. Ethnographic participant observation was therefore carried out primarily in the Paris region and in Los Angeles County, which allowed for an analysis of the care and support for women victims in specialized associations that emerged from the feminist movements of the 1970s. Located at the intersection of activist, institutional, and professional spaces, the actions of these associations, as well as the frameworks they develop to conceptualize domestic violence, are shaped by issues specific to each national context. By distinguishing and examining multiple analytical levels, the comparative methodology employed here sheds light on the roots of a cause’s legitimation and its changes over time, as well as on the tensions created when feminist analyses of social problems are put into practice. This analysis shows how a problem related to gender is elaborated and transformed by professional and institutional logics

Full textThis work is part of the very particular social context of better attention paid to victims, especially abuse. Beyond this development, which is reflected in the many pieces of legislation on this subject, it appears in the practice of field professionals that many resistances point to the most vulnerable. This is particularly the case for caregivers who are particularly concerned, as they are often the first to be able to spot signs of abuse (somatic, psychological). Their reluctance or even resistance to reporting has never been studied from the point of view of the right to know the arguments used by these professionals to explain their lack of reporting and the implications in terms of legal protection of the most vulnerable. For practical reasons, we targeted this study at both ends of the ages of life, namely on minors and vulnerable elderly people; the issue of abuse of persons with disabilities or victims of domestic violence is equally essential, but would have required even more complex analysis, as it involves other issues.The study was based on an analysis of the results of an internet questionnaire provided by 1157 caregivers. The main objective of this research is therefore to better understand the resistance.The main objective of this research is therefore to better understand the resistance of health professionals to reporting when they are caring for a vulnerable person for whom abuse is suspected, particularly when it is it is a child or an elderly person.The secondary objectives in such research are multiple and aim to assess the impact of individual factors (ages, seniority, level of training, place of practice) and collective factors (institutional dynamics, networking) on the positioning of professionals in the face of reporting.The organization of the results is proposed in two part: the first addresses the issue of health professionals in the face of clinical issues in the field of identification, the second that of health professionals in the face of legislation and their obligations professionals in this area.This study focuses on the analysis of the reporting practices of carers in France, but we make it clear at the outset that this problem is the lawof being exclusively national and that the issues related to itcannot be ensured state only if regulations are implemented at the international level as well
