Abstract:
The effect of economic growth on environmental quality is much under dispute. A number of empirical studies have made the claim that there exists in some income ranges a positive relation between per capita income and some measure of environmental quality. According to this inverted U-shaped pattern of different pollutants relative to per capita incomes in different countries which is also called the "Environmental Kuznets Curve" (EKC), environmental pressure increases up to a point as income goes up; after the turning point environmental quality improves as income keeps rising. Possible explanations for this pattern are seen in the progression of economic development, from clean agrarian economies to polluting industrial economies to clean service economies. This trend is enhanced through the transfer of cleaner technology from high-income countries to low-income countries and the tendency of people with higher income having a higher preference for environmental quality. Since this relationship is so fundamental to questions of economic development and sustainability it has provoked a vast load of research over the last seven years supporting but also heavily criticizing the results and conclusions. This paper gives an overview of the literature published on this topic to date and the conceptual, methodological and fundamental critique put forward. (author's abstract)

The Environmental Protection Area (APA) of the Field of Dunes is the largest Conservation Unit (UC) of the City of Paracuru. Comprising for 3909.60 hectares the APA has the environmental characteristics of the dunes that make up an ecosystem of ecological balance naturally fragile and in constant state of risk in relation to human intervention, but with a great ecological value and tourism. This area has a fundamental importance for the city, it is situated near the center of the municipal office and is in the process of increasing urbanization, including in areas of permanent preservation (APP) in its interior. With the present study, we tried to analyze the relations existing between the preservation of the APA of the field of Paracuru Dunes, and the use and occupancy of this by the around communities. The guiding elements for the theoretical and empirical analysis of the issue and execution of this research were the Environment, the Public Power and Society. As research techniques were used, the research literature, documentary research, non-participant observation and structured interviews and participatory research. The results enabled the development of a real scenery and this showed that the lack of synergy between the Public Power and community entities have been disclosed as a factor in worsening environmental conditions and quality of life for residents around the Environmental Protection Area of the Field of Dunes of the City of Paracuru-CE. With the diagnosis of field and the aid of a matrix of responsibilities, built in participatory research, we guide the Public Power and the communities around of the APA on the need to discuss the ideal scenery and analyze its viability, aiming at to construct the viable scenery for the area, under the support of the Environmental and Organic Laws of the Municipality.
A Ãrea de ProteÃÃo Ambiental (APA) do Campo de Dunas à a maior Unidade de ConservaÃÃo (UC) do MunicÃpio de Paracuru. Composta por 3.909,60 hectares a APA apresenta as peculiaridades ambientais das Dunas, que compÃem um ecossistema de equilÃbrio ecolÃgico naturalmente frÃgil e em permanente estado de risco, face Ãs intervenÃÃes antrÃpicas, mas com um grande valor ecolÃgico e turÃstico. Esta Ãrea possui uma importÃncia fundamental para a cidade, pois se encontra situada prÃxima ao centro da sede municipal e està em processo crescente de urbanizaÃÃo, inclusive em Ãreas de PreservaÃÃo Permanente (APP) no seu interior. Com o presente estudo, buscou-se analisar as relaÃÃes atuais entre a preservaÃÃo da APA do Campo de Dunas de Paracuru e o uso e ocupaÃÃo desta pelas comunidades do entorno. Os elementos norteadores teÃricos e empÃricos para a anÃlise do tema e execuÃÃo desta pesquisa foram o Meio Ambiente, o Poder PÃblico e a Sociedade. Como tÃcnicas de pesquisa utilizaram-se, a pesquisa bibliogrÃfica, pesquisa documental, observaÃÃo nÃo participante e entrevista estruturada e a pesquisa participativa. Os resultados permitiram a elaboraÃÃo de um cenÃrio real e este mostrou que a falta de sinergia entre o Poder PÃblico e as entidades comunitÃrias tem se revelado como um fator de agravamento das condiÃÃes ambientais e da qualidade de vida dos moradores do entorno da Ãrea de ProteÃÃo Ambiental do Campo de Dunas do MunicÃpio de Paracuru â CE. Com o diagnÃstico de campo e o auxÃlio de uma matriz de responsabilidades, construÃdos nas pesquisas participativas, pudemos orientar o Poder PÃblico e as comunidades do entorno da APA na necessidade de discutir o cenÃrio ideal e analisar a sua viabilidade, visando construir o cenÃrio viÃvel para a Ãrea, sob o respaldo das Leis Ambientais e OrgÃnica do MunicÃpio.

Abstract:
One of the most significant issues confronting humanity as the twentieth century draws to a close is that concerning environmental degradation. This study posits the dual notion that at the centre of any movement to protect the earth from further degradation there must be a change in the predominant anthropocentric worldview, and that there is a role for poets to help bring about such change by writing ecologically-conscious poetry. The study explains what is meant by ecological consciousness as distinct from a conservation or environmental ethic. There follows a brief discussion of Deep Ecology (the philosophical perspective which, along with others, critiques human domination of nature) and a survey of relevant literature. The growth of an Australian poetic and the concomitant development of an Australian relationship with the land are also surveyed. Then, through a process of close reading, comparative analysis and discourse, the work of a number of poets (both indigenous and non-indigenous) is considered for its ecological awareness. The study highlights some pivotal ideas for the development of a new worldview: these are the development of a non-anthropocentric perspective of nature similar to that embraced by adherents of Deep Ecology; acceptance of the notion that nature is ambivalent (that the cycle of life is also a cycle of death and decay); and the possible use of indigenous people's deeply ecological relationship with the land as a basic model on which to build a new worldview. The study contends that only poetry which is grounded in ecocentrism, rather than anthropocentrism, can claim to be ecologically-conscious. It concludes by reaffirming the need for poets to encourage a change in the prevailing anthropocentric worldview by adopting a deeply-ecological focus on nature in some of their poetry.

Environmental ethics and environmental journalism are influencing the developing philosophy of environmental citizenship. This philosophy involves the ideas that people are part of the environment, that the future depends on a healthy environment, and that action on behalf of the environment is necessary. It applies to individuals, communities, large and small companies and corporations, governments, and a coalition of nations. Environmental philosophers and environmental journalists can work together, in a symbiotic way, to foster discussions among citizens and policy makers about ideas as well as events, and thus, influence attitudes and policies, and continue to influence environmental citizenship. Environmental citizenship as an extension of democracy offers the best chance for undoing the manmade problems which are degrading the quality of life on Earth. A healthier environment is the will of the people. An informed, voting public will succeed in creating a healthier environment. Pioneering work by philosophers and journalists, especially over the last forty-five years has brought the dialogue about environmental problems to an unprecedented level and continues to offer encouragement to the mindful evolution of mankind. These ecological discussions of rights and responsibilities, intrinsic and economic values, pragmatism and utilitarianism, culture and spirit, are increasingly being applied to a developing idea of sustainability, and are, thus, helping to expand ideas about what it means to be a citizen in a democracy.

Chapter one offers an introduction and a general outline of argument. Chapter two lays out the current scholarship on human rights and the environment and presents rejoinders to three prominent lines of objection to linking human rights and environmental interests: conceptual, those arising from issues of recognition, vagueness and conflicts between human rights, ecological, especially from those seeking protections for the environment regardless of its utility to humans, and those wishing to expand human rights beyond human interests, and adjudication concerns, namely from those sceptical that the polycentric nature of environmental issues create an insurmountable barrier to any significant improvements through judicially enforced human rights. Chapter three introduces and defends the environmental minimum as a normative framework for systematically conceptualizing the relationship between human rights and the environment. As such, it is chiefly concerned with ensuring a good faith regulatory engagement with environmental pollution: specific risks to recognised human rights trigger the environmental minimum, which then provides minimum standards (legal, established and emerging) that set the standard of review for determining whether a violation of human rights has occurred. Chapter four deals with the crucial empirical argument, outlining how the framework can systematically account for and consistently guide the further development of the case law under the European Convention on Human Rights. This conclusion rests on a comprehensive analysis of the environmental case law since 1950 using quantitative methods to expose doctrinal patterns previously not recognized in legal scholarship. Finally, chapter five explores and evaluates the potential benefits of the environmental minimum framework beyond human rights adjudication. Specifically, it investigates benefits to the varied fields of public law, regulatory policy, International Environmental Law, constitutionalism, and other international human rights treaties.

During development process, especially under the impact of climate change, natural disaster is one of the major challenges. In fact, the degree of devastation of natural disasters such as storms, floods and landslides are enormous, causing severe damage to people, property and environmental degradation. These natural disasters increasingly occurring more frequently in the last 20 years claimed the lives of many people. Unlike natural disasters, catastrophes are often related to human factors. Thus, the policy on response, treatment should also take into account the legal process in order to ensure that the principle of the polluter must bear responsibility after incidents and catastrophes. The catastrophe is a serious disruption of a community activity, causing loss of life, environment and material on a large scale. Normally catastrophe is beyond the capacity of affected communities to cope with, if only sources power of that community is used. The impact of economic - social development, climate change and natural disasters, environmental pollution situation, the capacity to respond to environmental incidents ... has been the pressure and challenge to Vietnam
Trong quá trình phát triển, đặc biệt dưới tác động của biến đổi khí hậu, thiên tai là một trong những thách thức lớn. Trong thực tế, mức độ tàn phá của thiên tai như bão, lũ và sạt lở đất là rất lớn, gây thiệt hại nặng nề về người, tài sản và gây suy thoái môi trường. Những thảm họa do thiên tai gây ra đang ngày càng xảy ra thường xuyên hơn trong 20 năm qua, cướp đi sinh mạng của nhiều người. Khác với thiên tai, thảm họa môi trường thường liên quan đến yếu tố con người. Do đó, chính sách ứng phó, xử lý cũng cần tính đến các quá trình pháp lý nhằm đảm bảo nguyên tắc người gây ô nhiễm phải chịu trách nhiệm sau sự cố, thảm họa. Thảm họa là sự phá vỡ nghiêm trọng hoạt động của một cộng đồng, gây ra những tổn thất về người, môi trường, vật chất trên diện rộng. Thảm họa thường vượt quá khả năng đối phó của cộng đồng bị ảnh hưởng nếu chỉ sử dụng các nguồn lực của cộng đồng đó. Nicaragua faces tremendous problems in relation to environmental and social conditions as well as continuing conflicts over access to natural and economic resources. The loss of forests and other essential eco-systems, the extinction of unique species, the degradation of soils and farmland, poverty, ill heath, exploitation and great inequalities of wealth and power remain on-going processes and essential characteristics of Nicaragua. These conditions represent an environmental crisis that threatens the country's ecological and social well-being. The thesis considers the historical causes of the environmental crisis looking at the impact of the introduction of particular political and economic structures, the development of the dictatorship of Somocisnio in Nicaragua and the impact of US hegemony in the region. It further considers why the strategies adopted by successive administrations and international organisations have failed to adequately address Nicaragua's environmental problems. The need for radical political and economic change as a means to address the underlying structural causes of environmental degradation is investigated in relation to Nicaragua. However, the examination of the effects of the Sandinista Revolution in Nicaragua is also used to reveal important insights into the impact of structural change on the environment and the necessity to include other, reformist components in any solution. Post-Revolutionary strategies and the current emphasis on NGO and community based sustainable agricultural programmes are examined in detail to evaluate the importance of this approach for environmental protection. In addition to an examination of the effectiveness of the strategies of the post-revolutionary state, a case study analysis of Programa Campesino-a-Campesfno, the most prominent and successful example of the new, community-based initiatives, is used to illustrate the generic problems and opportunities present in the new 'paradigm' of localism and sustainable agriculture. While these new initiatives may provide key components to a solution, the study considers whether by themselves, they have the capacity to address the underlying causes of degradation. The study concludes that the environmental crisis is primarily a result of the particular development model that has arisen in the region since the colonial conquest, and which has facilitated the development of a system based on the highly unequal distribution of resources and power. Consequently, the causes of the crisis are essentially structural in nature, requiring that radical changes be made to the political and economic structures of society. However, the lesson of Nicaragua's Sandinista Revolution, during which environmental degradation continued despite a series of structural and socio-political changes, indicates that structural changes do not of themselves, guarantee environmental sustainability. Equally, the limitations of programmes such as Campesino-a-Campesino reveal that a reliance on agroecological and community-based methodologies is also flawed. Therefore, progress towards social and environmental justice in Nicaragua requires a combination of radical changes to political and economic structures, alongside the use of ecologicalbased agricultural and land management practices. This means that inequalities in land and natural resource ownership are addressed in order to provide sustainable economic and ecological systems within which Nicaraguans can attempt the longterm management and protection of their environment. The introduction of these new practices must include the participation and skills of local populations in any process of change. Redistribution of wealth and resources must be accompanied by a redistribution of power so that the control and development of these changes and initiatives, develop from, and reside in, the hands of ordinary Nicaraguans.

There are always painful tradeoffs in environmental problems. In the current period, the tradeoff. has to be made between consuming environmental goods and "dirty" goods. Since many pollutants accumulate in nature and cause long time problems, the current period's decision also has important impacts on future generations. This yields another tradeoff. between control of the pollution flow and cleanup of the pollution stock in the future. For a local government, tradeoffs between strict environmental policies and local economic prosperity are also concerns.

This thesis analyzes the tradeoffs made by households, firms and government under different policy regimes. Chapter 2 considers assigning tradable permits to households that are suffering from pollution generated by firms. The households can sell a limited number of permits to polluters according to personal preferences for environmental goods and "dirty" goods. It is shown that, the market transaction between households and polluters can achieve the efficient pollution level. Chapter 3 considers a case in which the stock pollution is reversible with capital investment. In a natural resource extraction model with externalities of heavy metal pollution in the surrounding farmland, the firms tradeoff. between controlling the pollution flow and abating the pollution stock, as well as the firms extraction decisions are analyzed. Chapter 4 derives the optimal environmental bond required by a local government as a financial assurance for inducing firms to do pollution abatement. A local government needs to make tradeoffs between charging a large amount of bond and encouraging local economic prosperity. For a local government, the optimal bond amount does not necessarily cover the worst-case scenario. This thesis contributes to environmental policy design by considering the interests of different parties.

This thesis is concerned with the legal theory behind environmental rights. There are a number of different approaches that deploy rights as a mechanism to bring about environmental protection within international law, all of which can be termed ‘environmental rights’. These include a human right to a healthy environment and procedural environmental rights. But there are also theories that support a more innovative or extensive use of legal rights for protecting the natural world. Notably, many of these theories concern the introduction of nonhuman rights (animal rights or rights of nature). This thesis investigates the theory behind and the practical structure of these various approaches, as well as analysing the very concept of ‘rights’. The original contribution to knowledge is threefold. I present a case for a human right to a healthy environment to be defined broadly: measured according to human and ecosystem health, and conceived as a right of both individuals and peoples; I rigorously apply both Interest Theory and Hohfeld’s analysis of rights to human rights and thus construct a clear model for the structure of the sort of rights found in human rights (termed ‘vital rights’); and I extend the philosophical theory behind human rights (and in particular the concept of dignity) towards the growing field of rights of nature. Considered holistically, the thesis presents and suggests modes of thinking that seek to soften the divide between humanity and nature. This is done through a consideration of lived experience as always already ecologically embedded. As a result, the subject of vital rights (human rights included) should be understood as ecologically embedded living beings, opening the door to both nonhuman rights and new fields for human rights.

Abstract:
This thesis looks at the Carbon Reduction Commitment (CRC) Energy Efficiency Scheme. This is a green tax on energy consumption that targets large businesses not already covered by the EU ETS or CCAs. The CRC has been reformed on numerous occasions and will now come to an end in 2019. Importantly, the CRC has received relatively little academic attention, especially in legal scholarship. Drawing upon 31 original, semi structured interviews with regulatees, solicitors and the Environment Agency; and a quantitative analysis of emissions under the scheme, this PhD will begin to tell the story of how the CRC has been perceived by those who pay it. This is an account of how different regulatory aspects send deeper messages to regulatees. In particular, this thesis considers: stability; competence of the regulator; nudging; positive incentives; and the efficiency of the CRC. As such, this thesis draws on a wide range of literature in order to analyse the above themes in light of the original data from the empirical study. This thesis concludes that how regulation is packaged and presented to regulatees is critical and can affect how they engage with a regulatory scheme such as the CRC.
