Abstract:

There are always painful tradeoffs in environmental problems. In the current period, the tradeoff. has to be made between consuming environmental goods and "dirty" goods. Since many pollutants accumulate in nature and cause long time problems, the current period's decision also has important impacts on future generations. This yields another tradeoff. between control of the pollution flow and cleanup of the pollution stock in the future. For a local government, tradeoffs between strict environmental policies and local economic prosperity are also concerns.

This thesis analyzes the tradeoffs made by households, firms and government under different policy regimes. Chapter 2 considers assigning tradable permits to households that are suffering from pollution generated by firms. The households can sell a limited number of permits to polluters according to personal preferences for environmental goods and "dirty" goods. It is shown that, the market transaction between households and polluters can achieve the efficient pollution level. Chapter 3 considers a case in which the stock pollution is reversible with capital investment. In a natural resource extraction model with externalities of heavy metal pollution in the surrounding farmland, the firms tradeoff. between controlling the pollution flow and abating the pollution stock, as well as the firms extraction decisions are analyzed. Chapter 4 derives the optimal environmental bond required by a local government as a financial assurance for inducing firms to do pollution abatement. A local government needs to make tradeoffs between charging a large amount of bond and encouraging local economic prosperity. For a local government, the optimal bond amount does not necessarily cover the worst-case scenario. This thesis contributes to environmental policy design by considering the interests of different parties.

Abstract:
According to the Swedish Forestry Act, environmental protection is required within forest operations regardless of forest ownership. This thesis examines the extent to which regulations issued by the National Board of Forestry are implemented in clearcuttings. Different factors contributing to the outcome of environmental protection are analyzed both from a top-down and a bottom-up perspec­tive. Empirically, the study combines field investigation of clearcuts, interviews with implementing actors, and evaluation of written prescriptions and advice on environ­mental protection. The Swedish forest-environmental legislation and implementation process is also compared to that of the U.S. and, especially, to the state of Cali­fornia . Conflicting goals within the Forestry Act and vague environmental guidelines leave the implementing agency officers with great discretion. Steering attempts by the Forestry Agency are in terms of friendly advice and information. No breaches of the regulations were taken to court during 1980-1986 although this is formally possible. There is an average compliance of approximately fifty per cent of the required environmental measures. Aesthetic values are taken into account to a greater extent than pure floristic and faunistic ones. Economic considerations and harvest technology contribute to a low degree of environmental protection. Forest machines are inadequately suited for protecting single, environmentally valuable trees and they frequently cause deep tracks. Inadequate environmental knowledge and insufficient pre-harvest environmental planning also affect environ­mental performance negatively. Generally, economic considerations contribute to the low priority to environ­mental protection given by the implementing actors compared to timber production. Economic inducements counteract environmental protection. It is generally rare that environmentalists and other public interests affected by forest operations are consulted. Environmentalists however influence indirectly through political pressure to legislate, participation in the consultation process before legislation is enacted, and mass-media attention.

Environmental ethics and environmental journalism are influencing the developing philosophy of environmental citizenship. This philosophy involves the ideas that people are part of the environment, that the future depends on a healthy environment, and that action on behalf of the environment is necessary. It applies to individuals, communities, large and small companies and corporations, governments, and a coalition of nations. Environmental philosophers and environmental journalists can work together, in a symbiotic way, to foster discussions among citizens and policy makers about ideas as well as events, and thus, influence attitudes and policies, and continue to influence environmental citizenship. Environmental citizenship as an extension of democracy offers the best chance for undoing the manmade problems which are degrading the quality of life on Earth. A healthier environment is the will of the people. An informed, voting public will succeed in creating a healthier environment. Pioneering work by philosophers and journalists, especially over the last forty-five years has brought the dialogue about environmental problems to an unprecedented level and continues to offer encouragement to the mindful evolution of mankind. These ecological discussions of rights and responsibilities, intrinsic and economic values, pragmatism and utilitarianism, culture and spirit, are increasingly being applied to a developing idea of sustainability, and are, thus, helping to expand ideas about what it means to be a citizen in a democracy.

This research tests and answers the main question: Should the Environmental Protection Agency’s Policy on the Technical Impracticability Waivers be changed? This research uses public and private databases for collecting information on the Comprehensive Environmental Recovery and Liability Act sites with Technical Impracticability Waivers and examines the process the Environmental Protection Agency uses to make Technical Impracticability Waivers evaluations. Existing data demonstrates the Environmental Protection Agency has been very conservative and has granted few Technical Impracticability Waivers over the last 30 years. Several arguments for changing Environmental Protection Agency’s policy are made. A comparison of approved Technical Impracticability Waivers sites and sites that meet the criteria for approval but have not been submitted for the waiver are used in this research. The results indicate that the policy should be changed. A policy change would be beneficial to appropriate funds to the more complex and critical sites. A change in policy would also save taxpayers funds instead of being spent on experimentation on sites that are impracticable to clean up, these funds would go to more critical sites. The research also shows a need for collecting a database of sites that Environmental Protection Agency has rejected for a Technical Impracticability Waiver.

Abstract:
This dissertation addresses the impact of principles of soft law on the development of international regimes for environmental protection. It focuses on three such principles that have attracted a certain degree of consensus in international environmental law and are therefore influential in international environmental regimes: namely, the principle of common but differentiated obligations; the principle of common heritage of mankind and its corollary, the principle of common concern of humankind; and the precautionary principle. The regimes analysed are the Antarctic regime, the regime for control of trade in endangered species, the regime for protection of the stratospheric ozone layer, and the emerging regime governing conservation and management of straddling fish stocks. It is argued that these principles influence normative development in international environmental regimes through processes of discourse in which participants, both state and non-state actors, seek to determine the rules by which their mutual relations will be governed and their common interests protected. Such discourse also connects the evolution of legal rules with a broader set of concerns relating to the interest of human communities in achieving a certain level of environmental protection. In this respect, the legal rules may be contemplated within a moral framework in which members of international society seek to determine what they ought to do with respect to global environmental protection.

Abstract:

Since the inception of the U.S. Environmental Protection Agency (EPA), considerable emphasis has been placed on the use of prospective policy analysis tools that aim to inform environmental decisions, including cost-benefit analysis and risk assessment. However, compared to the prevalence of ex ante analysis at the EPA to inform decisions, relatively little evaluation of these same environmental policies is conducted after implementation, to inform future policy development or to modify existing policies.

This dissertation applied accountability, organizational learning, evaluation capacity, and institutionalism literature in consideration of processes and determinants that affect evaluation supply at the EPA. The dissertation relied on archival documents, semi-structured interviews, and three embedded case studies of EPA’s ambient air, hazardous waste, and performance partnership programs. Ten key factors were identified across the three case studies in this research that affect EPA's production of program evaluation to inform decision-making, and a new emergent model of evaluation capacity was proposed for EPA given the agency's regulatory structure. This research concludes that evaluation has much to offer EPA decision-makers, and efforts to improve evaluation capacity will present organizational learning opportunities that can further support the agency's evidence-building practices, specifically improving the application and use of program evaluation at EPA.

Abstract:
This research analyzes three contributing factors, perception, knowledge, and affordability, in order to estimate the likelihood of state cooperation on effective regulatory policies for transboundary environmental problems. The correlative hypothesis in this research postulates that states are more likely to support environmental regulatory policies when the issue is perceived by policymakers as serious, substantiated by a high level of knowledge, and affordable for the state. Regulatory policies for transboundary environmental issues require policymakers to act in foresight, employ precautionary measures, and cooperate. Cooperation implies that states will coordinate their policies and eschew their dominant strategy of independent decision making. However, this research contends that states decide to cooperate because they perceive the strategic interaction to be beneficial. Thus, the theory of cooperation in this research is consistent with realist assumptions of rational egoism.

This study focuses on identifying the conditions which encourage or discourage international cooperation with regard to environmental problem-solving. In particular, the divergence between two key international relations theories, Environmentalism and Realism, will be examined in hopes of forging a rapprochement and stimulating research for a comprehensive theoretical approach to global environmental problem-solving. It is hypothesized that a state-centric political system is both a reality and an effective structure for environmental problem-solving, therefore an examination of state participation and the motivators and inhibitors affecting state response on certain environmental issues is conducted. In particular, this study hypothesizes that uncertainty can act as an inhibitor, and without the introduction of motivators can prevent states from participating in environmental problem-solving. A conceptual model of state courses of action is utilized to illustrate the potential of state participation and the development of a state-centric approach.

Cette thèse vise à étudier les conséquences en terme de changement institutionnel pour un développement durable de l’évaluation des politiques environnementales d’un pays, meneés par une organisation intergouvernementale. Les fondements philosophiques et théoriques de l’économie institutionnelle fournissent le cadre retenu pour construire une grille de lecture permettant d’analyser l’approche théorique, l’impact et les facteurs conditionnant l’impact de l’évaluation des politiques environnementales dans l’optique de développement durable. Les examens des performances environnementales de l’OCDE sont ensuite étudiés moyennant une approche d’étude de cas qualitative. Malgré l’attention relativement faible accordée par le public à ces examens, leur intérêt réside dans une plus grande légitimité des politiques et des autorités environnementales, et dans le renforcement des politiques environnementales basées sur les principes de contrôle, suivi, évaluation et coût-efficacité. Ces impacts opèrent à travers de quatre chemins parallèles, représentant les objectifs de reddition des comptes et de l’apprentissage. La forme et l’intensité de l’influence de ces impacts dépendent de la capacité des examens à mobiliser les acteurs clés, de leur sensibilité au contexte, ainsi que de la crédibilité et le poids politique de l’OCDE auprès des acteurs des pays étudiés. Nonobstant leur conception du développement durable relativement éloignée des principes institutionnalistes, les examens contribuent au développement durable en réduisant les déséquilibres de pouvoir et en améliorant ainsi certaines des conditions pour une démocratie délibérative
This thesis examines what consequences, through which pathways, and under which circumstances, does country-level environmental policy evaluation, carried out by an intergovernmental organisation, have for institutional change towards sustainable development. The philosophical and theoretical frameworks of institutional economics are proposed as the lens through which to assess experiences from evaluation research. This is done in order to elaborate a conceptual framework for analysing the approach, the impact and the factors conditioning the influence of environmental policy evaluation in the context of sustainable development. The OECD Environmental Performance Review programme is examined through an in-depth qualitative case study approach. It is found that in spite of engendering relatively modest interest among the public, the reviews increase the legitimacy of environmental policies and authorities, and strengthen a performance-oriented environmental policy emphasising evaluation, monitoring and cost-effectiveness. These impacts operate through four parallel pathways, representing the purposes of learning and accountability. The type and intensity of influence depends on the capacity of the reviews to mobilise key change agents and to be sensitive to the context, as well as on the credibility and political weight of the OECD in the reviewed country. It is concluded that notwithstanding the distance of the prevailing OECD conception of sustainability from the institutionalist principles adopted as the benchmark for the appraisal in this thesis, the reviews contribute meaningfully to sustainable development by redressing asymmetries of power, thereby improving some of the conditions for deliberative democracy
