The Eritrea-Ethiopia Claims Commission (EECC) is one of a pair of commissions established by the Peace Agreement of 12 December 2000 that ended a costly war between Ethiopia and Eritrea that had begun in May 1998. That war, which was sparked by disputes over the countries' common border, caused much damage and many thousands of casualties on each side. It also proved terribly expensive, as each party spent large amounts of money and incurred large debts to acquire modern weapons of war and the related munitions. Given the causes and the consequences of the war, it was, perhaps, not surprising

This panel examined the operation of International Mass Claims Commissions (IMCC), which are ad hoc international judicial institutions created to resolve specific international disputes. IMCCs generally involve a great variety and number of claims and claimants, thus providing a distinctive means to resolve international disputes. This panel seeks to evaluate the effectiveness and viability of IMCCs as international dispute resolution mechanisms. Looking in particular at the examples set by the Iran-U.S. Claims Tribunal, the UN Claims Commission, and the Eritrea-Ethiopia Claims Commission, th

AbstractThe awards on liability and damages for violations of international humanitarian law of the Eritrea-Ethiopia Claims Commission uncover both the extent of state responsibility for unlawful displacement and deportation of civilian population resulting from wrongful actions of belligerents under international law and the availability of remedies for victims of such violations. The Commission reached a number of important decisions based on government-to-government claims brought by Ethiopia and Eritrea for injuries, losses, and damage suffered by individuals and groups uprooted by the war

The aim of the article is to highlight several issues concerning the customary international law status of a number of international humanitarian law (IHL) treaty provisions that arose during the proceedings of the Eritrea-Ethiopia Claims Commission. Specifically, two key issues will be analyzed, namely the Commission's findings that the Geneva Conventions and some provisions of Additional Protocol I reflected customary international law and that international landmine conventions create only treaty obligations and do not yet reflect customary international law. This contribution discusses the Eritrean-Ethiopian War of 1998-2000. It sets out the facts and context of the crisis, the legal positions of the two countries, and the international community’s reactions. The Algiers Agreement ending the conflict established an Eritrea Ethiopia Claims Commission, which concluded that Eritrea’s large-scale, transborder military operation at the outset of the conflict constituted a violation of Article 2(4) of the U.N. Charter. Further, the commission made important findings with respect to the law on self-defense, such as that a state may not use armed force to

This chapter examines the approach used by arbitral tribunals and commissions of inquiry or fact-finding missions with respect to rules governing the use of force after the adoption of the UN Charter in 1945, with emphasis on the right to self-defence and the conditions relating to its exercise. It assesses the legal significance of arbitral awards and fact-finding reports and considers how they have interpreted and applied jus contra bellum—the prohibition of the use of force in international relations and its exceptions. The chapter focuses on two significant arbitration precedents: the Erit
