En 1604, le pamphlet The Black Book de Thomas Middleton a été publié en deux éditions à Londres. Middleton y répond au Pierce Penniless His Supplication to the Devil (1592) de Thomas Nashe et au The Black Booke's Messenger (1592) de Robert Greene, dans le cadre du débat concernant le Londres interlope des escrocs, des petits voleurs, et des pauvres de la ville. Il y réplique également au mythe de Faust, et contribue ainsi au débat portant sur la sorcellerie et le diable. En examinant The Black Book dans le contexte de ces deux débats apparentés, l’auteur avance que le pamphlet de Middleton met en lumière les fondements et les implications économiques de la représentation qu’avait la culture de la Renaissance des démons, sorcières, mendiants et escrocs. The Black Book propose un Lucifer qui prend la parole pour répondre à l'appel à l'aide désespéré de Pierce Penniless. En faisait endosser le rôle de la Charité à l'ennemi ultime de l'humanité, Middleton remet en question et démystifie les notions contemporaines de sorcellerie et de pauvreté urbaine. Son pamphlet offre un unique commentaire favorable sur la pauvreté et la sorcellerie dans la littérature de la Renaissance.

« Baisier » et « extorquez ». Les sorciers de Paris du XIVe au XVIIe siècle — Paris n’avait pas été étudiée jusqu’à présent en tant que territoire spécifique de sorcellerie à l’époque moderne. Le contexte urbain de la capitale du royaume montre des spécificités avec notamment l’importance des questions de sexe, d’amour et d’argent. La relative rareté des accusations de sorcellerie depuis le XIVe siècle jusqu’à la décriminalisation de la sorcellerie en 1682 peut s’expliquer par une certaine clémence affichée par la cour du Parlement de Paris, favorisée par un entrelacs de juridictions seigneuriales mais aussi par une proximité avec la cour férue de magie et avec une université qui parfois dédiabolise ces affaires. Les médecins participent du changement de perception de la sorcière, malgré l’influence du philosophe, juge et démonologue Jean Bodin qui veut au contraire convaincre de la dangerosité de l’engeance diabolique. Et les sorciers finissent par apparaître à la fin du XVIIe siècle comme des escrocs monnayant la crédulité des Parisiens. Mais cette étude toujours en cours de la sorcellerie parisienne peut encore révéler d’autres conclusions.

Abstract:
Droit réaliste dont la sanction frappe avant tout des faits juridiques, le droit pénal est toutefois loin d'ignorer la notion de contrat pour la simple raison que celui-ci constitue l'instrument juridique essentiel des échanges. Les conditions de validité du contrat entretiennent un lien particulier avec le droit pénal dans la mesure où elles ont pour fonction d'éviter l'introduction dans l'ordre juridique d'une norme contractuelle illégale. L'importance du « droit pénal de la formation du contrat » ne saurait donc surprendre. Celui-ci est-il pour autant suivi, au plan civil, par la sanction naturelle de la violation des conditions de formation du contrat, à savoir la nullité ? En appréciant l'adéquation des causes de nullité du contrat aux éléments constitutifs des infractions intervenant au stade de la formation de cet acte juridique, il est permis de dégager un principe de nullité du contrat constitutif de l'infraction. En revanche, la cohérence du système juridique n'impose pas la nullité du contrat qui entretient un lien plus ténu avec l'infraction. Cependant, même en présence d'un contrat constitutif de l'infraction, le droit positif ne reconnaît pas l'influence de droit de la loi pénale sur les causes de nullité du contrat. L'autonomie entre les conditions de validité du contrat et les éléments constitutifs de l'infraction n'empêche pas le juge civil de qualifier une infraction pénale et le juge pénal de se prononcer sur la validité d'un contrat, voire d'annuler un contrat illicite. Néanmoins, l'incompétence des tribunaux répressifs pour annuler un contrat reste le principe, ce qui en pratique conduit les juges répressifs à accorder des dommages-intérêts à la victime d'infraction, là où le juge du contrat aurait prononcé des restitutions. Il en résulte une éviction injustifiée du droit des nullités contractuelles lors du procès pénal, ce qui appelle une évolution de la compétence du juge répressif en matière contractuelle
Even though criminal law is a realistic law and mainly deals with facts, it nevertheless takes into account the notion of contract since the latter is the main legal instrument of exchanges. The conditions of validity of the contract have a special link with criminal law insofar as their main purpose is to prevent an illegal contractual norm from entering the legal order. Thus, the importance of “Criminal law of the formation of contract” should not be surprising. It remains to be seen whether “Criminal law of the formation of contract” is followed, on the civil level, by the normal sanction for the breach of the conditions of validity of the contract, known as contract nullity. By assessing to what extent the causes for contract nullity correspond to the constitutive elements of the offences, which are committed when the very contract is formed, a principle of nullity of contract, constitutive of the offence, can be drawn. Yet, when the offence does not necessarily imply a contract formation conflicting with criminal law, the legal system coherence does not require the nullity of the contract having the slightest connection with the offence. However, even when the contract is constitutive of the offence, positive law does not acknowledge any legal effect of criminal law on the causes of contract nullity. The autonomy between the nullity causes of the contract and the constitutive elements of the offence does not prevent the civil judge from qualifying an offence or the criminal judge from giving an opinion on the contract validity or even from declaring void an illicit contract. Yet, the criminal courts incompetency to annul contracts remains the rule. In practice, this leads criminal courts to award damages to the victim, while civil judge would award restitutions. The result is the eviction of contractual nullities law during the criminal trial which is difficult to understand and justifies the evolution of the competence of the criminal judge in the field of contracts law

Cette étude est basée sur l'analyse de l'information consacrée à l'actualité des déprédations, au sein de deux titres de la presse de la Vienne de l'entre-deux-guerres, l'avenir de la Vienne et le journal de l'ouest. Il s'agit ici de comprendre les mécanismes médiatiques assurant la publicité d'un acte criminel ; ainsi, en étudiant l'ensemble des techniques rhétoriques mises en oeuvre par le journaliste, il apparait que l'article criminel pouvait remplir une véritable fonction sociale. Pour la Presse locale de l'entre-deux-guerres, l'acte de vol, geste déviant et transgressif, devenait ainsi au contraire le prétexte d'un discours célébrant les normes de la communauté et les institutions de la société
This study is based on the analysis of information, as found in the depredation section of two local newspaper from the Vienne department of the interbellum period. The purpose is to understand the mechanisms applied by the media when advertizing a criminal act. In fact, after proceeding to a complete examination of the rhetorical techniques by journalists, it appears that newspaper articles could fulfill a truly social function. For the local press of the interwar years, the act of stealing, as a deviant and transgressive gesture, became the pretext for taking a line celebrating community norms and institutions in society

Abstract:
Charles Collé (1709-1783) enjoyed the reputation amongst his contemporaries of an accomplished writer of popular songs and of comédies de société. Although three of his plays were performed at the Comédie-francaise during his lifetime, the vast majority of his work was written with a view to performance at the private theatres in Paris, notably that of his main benefactor, the due d'Orleans. This thesis looks at one of the plays written for the duc's circle of friends, namely Le Galant escroc (1753), the intention being to produce a translation into English for performance purposes. As a preliminary to translation, the play is analysed in the light of four aspects of eighteenth-century society and literature: a discussion of Collé's life and career; relevant aspects of the theatre and of literary trends in the eighteenth century, with special reference to the private theatres of Paris; the social background of the characters portrayed in Le Galant escroc, with particular reference to the financiers and their relationship to the members of the nobility; and characteristic features of eighteenth-century French. The translation strategy is based both on the above considerations and on consideration of relevant translation theories. The translation retains the eighteenth-century setting, with some elements of archaism in the language and markers to remind the audience that the action is taking place in France. Emphasis is placed on theatricality and playability, but the author's intentions, in as far as they are deductible, are respected.

L’aportació artística d’Antoni Tàpies figura, des de fa varies dècades, entre les més notables de la segona meitat del segle XX. La seva influència aviat va transcendir l’entorn més inmediat i avui és una figura que gaudeix de reconeixement internacional. Nascut el 1923 en el si d’una família burgesa, culta i catalanista, immersa des de mitjan segle XIX en una tradició editorial i llibretera, ben aviat es despertà en el jove artista un amor pels llibres i la lectura. Aquestes circumstàncies familiars suposaren una extraordinària oportunitat per a què des de ben jove llegís a Nietzsche, Stendhal, Maupassant, Proust, Wilde o Sartre, entre d’altres. Probablement aquesta estima per la lectura sembrada en temps de joventut influí en què Antoni Tàpies sigui avui un dels pocs artistes de casa nostra que ha optat per l’escriptura com a mitjà d’expressió. Al llarg de la seva vida, publicà set volums, cinc dels quals constitueixen una selecció d’articles publicats en premsa i mitjans de comunicació. En aquest sentit, en tant que col·laborador habitual d’algunes de les capçaleres més importants del nostre país, Antoni Tàpies conreà l’escriptura de manera activa i periòdica, expressant les seves opinions en aquelles qüestions que considerava pertinents. L’objectiu d’aquesta investigació consisteix en realitzar una anàlisi del llegat textual de l’artista per esbossar les principals línies del pensament d’Antoni Tàpies i esbrinar, si s’escau, quines són les vinculacions entre l’obra plàstica i els seus escrits. Antoni Tàpies constitueix una raresa en el panorama historiogràfic estètic català i ens preguntem si Tàpies forma part de la tradició d’artistes occidentals que des de finals del segle XIX usaren la ploma per expressar els seus pensaments i teories artístiques. Antoni Tàpies pensà contínuament l’art i sovint en la seva obra trobem temàtiques que impregnen l’obra literària publicada al llarg dels anys. Tres d’aquestes qüestions que l’artista aborda en múltiples articles són: la pregunta sobre el sentit de l’art, un intent d’aproximació a la figura de l’artista i, finalment, les vinculacions entre art i espiritualitat. En aquest sentit, aquesta investigació s’adentra en la pregunta sobre el sentit de l’art que, en el cas particular d’Antoni Tàpies, s’haurà de respondre, entre d’altres aspectes, des de la seva funció social. Així mateix, cal situar l’artista català en diàleg amb d’altres artistes contemporanis que han reflexionat sobre qüestions semblants per poder, posteriorment, construir una visió de conjunt i valorar-ne la seva originalitat. Aquesta tesi també recorre una altra pregunta fonamental: com creu Antoni Tàpies que ha de ser el vertader artista. Aquesta és una pregunta important, ja que aludeix a aspectes personals i ens apropa als anhels més íntims de l’artista. Tàpies rebutja qualsevol intent de reduir el paper de l’artista al de mer comunicador entès com aquell qui reprodueix el discurs generat per pensadors i escriptors. L’artista ha de trobar una veu pròpia que el defineixi i cal establir les relacions entre aquesta personalitat i la funció social de l’art. Finalment, farem referència a la darrera de les temàtiques que volem estudiar: art i espiritualitat. Antoni Tàpies no s’adscriu a cap religió tot i que paraules com mística, energia, camí, Déu o meditació farceixen els seus escrits. L’artista té una visió molt personal sobre aquesta qüestió, influïda per les cultures orientals, especialment les procedents d’Índia, Xina i Japó. Ens preguntarem doncs si l’art és un mitjà de comunicació de l’experiència transcendent. En definitiva, Antoni Tàpies mai no publicà un llibre amb tota la seva estètica o filosofia de l’art però sí que optà, al llarg de tota la seva vida, per publicar articles circumstancials. L’anàlisi d’aquests textos, al costat de la seva obra plàstica, ens haurien de permetre apropar-nos al seu pensament en la que és la primera tesi doctoral sobre els escrits d’Antoni Tàpies.
The artistic contribution of Antoni Tàpies figure, for several decades, among the most notable in the second half of the twentieth century. His influence soon transcended the immediate surroundings and today is a figure who enjoys international recognition. Antoni Tàpies was born in Barcelona in 1923 into a cultured, middle-class, Catalan nationalist family who, since the 19th century, had been part of a publishing and book-selling tradition that awoke in him an early love of books and reading. These extraordinary family circumstances meant the opportunity to read Nietzsche, Stendhal, Maupassant, Proust, Sartre and Wilde, among others. Probably this love for reading explains that Antoni Tàpies is today one of the few artists in Catalonia who have chosen writing as a way of expression. Throughout his life, he published seven books and five of them are a selection of articles published in press and magazines. In this sense, as a regular contributor to some of the most important headlines of our country, Antoni Tàpies cultivated writing actively and regularly expressing his opinions on matters that he considered important. The objective of this research is to perform a textual analysis of the legacy of the artist to sketch the main lines of Antoni Tàpies thought and find out which are the links between the artistic work and his writings. Antoni Tàpies is a rarity in the historiographical aesthetic Catalan scene and we want to wonder if he is part of the Western tradition of artists that use the text to express their thoughts and artistic theories from the late nineteenth century since nowadays. Antoni Tàpies always thought the art and there are some themes that permeate the literary works published over the years. Three of these issues are: the question about the meaning of art, an attempt to approach the figure of the artist and, finally, the links between art and spirituality. In this sense, this research analises the question about the meaning of art that in Antoni Tàpies’ case should respond, among other things, from its social function. Likewise, we must place the Catalan artist in dialogue with other contemporary artists who have reflected on similar issues triyng to assess its originality. This thesis also runs another fundamental question: how Antoni Tàpies believes that a true artist must be. This is an important question because alludes to personal issues and brings us to the deepest longings of the artist. Tàpies rejects any attempt to reduce the role of the artist as a communicator understood as the one who plays the speech generated by thinkers and writers. The artist has to find their own voice and define the need to establish relationships between the personality and the social function of art. Finally, we will refer to the last issue that we want to study: art and spirituality. Antoni Tàpies not attached to any religion but words like mystical, energy, path, God or meditation stuffed his writings. The artist has a very personal view on this issue, influenced by Eastern cultures, especially from India, China and Japan. We therefore ask if art is a way of communication of the transcendental experience. In short, Antoni Tàpies never published a book with all his aesthetics or art philosophy. He choses, throughout his life, to publish circumstancial articles. The analysis of these texts, along with his artistic work, should enable us to get closer to his thinking in what is the first doctoral thesis on the writings of Antoni Tàpies.
La aportación artística de Antoni Tàpies figura, desde hace varias décadas, entre las más notables de la segunda mitad del siglo XX. Su influencia pronto trascendió el entorno más inmediato y hoy es una figura que goza de reconocimiento internacional. Nacido en 1923 en el seno de una familia burguesa, culta y catalanista, inmersa desde mediados del siglo XIX en una tradición editorial y librera, pronto se despertó en el joven artista un amor por los libros y la lectura. Estas circunstancias familiares supusieron una extraordinaria oportunidad para que desde muy joven leyera a Nietzsche, Stendhal, Maupassant, Proust, Wilde o Sartre, entre otros. Probablemente este aprecio por la lectura sembrada en tiempos de juventud influyó en que Antoni Tàpies sea hoy uno de los pocos artistas catalanes que ha optado por la escritura como medio de expresión. A lo largo de su vida, publicó siete volúmenes, cinco de los cuales constituyen una selección de artículos publicados en prensa y medios de comunicación. En este sentido, como colaborador habitual de algunas de las cabeceras más importantes de nuestro país, Antoni Tàpies cultivó la escritura de manera activa y periódica, expresando sus opiniones en aquellas cuestiones que consideraba pertinentes. El objetivo de esta investigación consiste en realizar un análisis del legado textual del artista para esbozar las principales líneas del pensamiento de Antoni Tàpies y averiguar cuáles son las vinculaciones entre obra plástica y escritos. Antoni Tàpies constituye una rareza en el panorama historiográfico estético catalán y nos preguntamos si Tàpies forma parte de la tradición de artistas occidentales que desde finales del siglo XIX usaron la pluma para expresar sus pensamientos y teorías artísticas. Antoni Tàpies pensó continuamente el arte y a menudo encontramos temáticas que impregnan toda la obra literaria publicada a lo largo de los años. Tres de estas cuestiones que el artista aborda en múltiples artículos son: la pregunta sobre el sentido del arte, un intento de aproximación a la figura del artista y las vinculaciones entre arte y espiritualidad. En este sentido, esta investigación se adentra en la pregunta sobre el sentido del arte que, en el caso particular de Antoni Tàpies, deberá responderse, entre otros aspectos, desde su función social. Asimismo, hay que situar al artista catalán en diálogo con otros artistas contemporáneos que han reflexionado sobre cuestiones similares para poder, posteriormente, construir una visión de conjunto y valorar su originalidad. Esta tesis también recorre otra pregunta fundamental: cómo cree Antoni Tàpies que debe ser el verdadero artista. Esta es una pregunta importante, ya que alude a aspectos personales y nos acerca a los anhelos más íntimos del artista. Tàpies rechaza cualquier intento de reducir el papel del artista al de mero comunicador entendido como aquel que reproduce el discurso generado por pensadores y escritores. El artista debe encontrar una voz propia que lo defina y es necesario establecer las relaciones entre esta personalidad y la función social del arte. Finalmente, haremos referencia a la última de las temáticas que queremos estudiar: arte y espiritualidad. Antoni Tàpies no se adscribe a ninguna religión aunque palabras como mística, energía, camino, Dios o meditación llenan sus escritos. El artista tiene una visión muy personal sobre esta cuestión, influida por las culturas orientales, especialmente las procedentes de India, China y Japón. Nos preguntaremos pues si el arte es un medio de comunicación de la experiencia trascendente. En definitiva, Antoni Tàpies nunca publicó un libro con toda su estética o filosofía del arte pero sí optó, a lo largo de su vida, por publicar artículos circunstanciales. El análisis de estos textos, junto a su obra plástica, debería permitirnos acercarnos a su pensamiento en la que es la primera tesis doctoral sobre los escritos de Antoni Tàpies.
