Abstract:
The subject of this article is the resolution of the enlarged composition of the Supreme Court of June 5, 2018, which resolves the issue of acquiring by land easement with the content corresponding to transmission easement together with the acquisition by a state-owned company of transmission facilities developed on State Treasury properties. As a result of granting property rights to state-owned companies of state property in the early 1990s, the ownership of the transmission infrastructure and the property on which they were situated were separated.In the judicature, divergent concepts emerged regarding the solution of the issue of further use of this land by transmission companies. According to the first one, the transfer of property rights was accompanied by the creation by law of a land easement with the content corresponding to a transmission easement. On the other hand, according to the second concept, obtaining a legal title for further use of the property was possible only through contractual acquisition or prescription of transmission easement. Powstanie z mocy prawa służebności gruntowej o treści odpowiadającej służebności przesyłu w świetle uchwały Sądu Najwyższego z dnia 5 czerwca 2018 roku, sygn. akt III CZP 50/17 Tematem artykułu jest uchwała powiększonego składu Sądu Najwyższego z dnia 5 czerwca 2018 roku, która rozstrzyga kwestię nabycia z mocy prawa służebności gruntowej o treści odpowiadającej służebności przesyłu wraz z nabyciem przez przedsiębiorstwo państwowe własności urządzeń przesyłowych posadowionych na nieruchomościach Skarbu Państwa. W wyniku uwłaszczenia mienia państwowego na początku lat dziewięćdziesiątych ubiegłego wieku doszło do rozdzielenia własności infrastruktury przesyłowej oraz nieruchomości, na której były one posadowione. W judykaturze pojawiły się rozbieżne koncepcje odnośnie do rozwiązania kwestii dalszego korzystania przez przedsiębiorstwa przesyłowe z tych gruntów. Zgodnie z pierwszą z nich przeniesieniu prawa własności towarzyszyło powstanie z mocy prawa służebności gruntowej o treści odpowiadającej służebności przesyłu. Na podstawie drugiej — uzyskanie tytułu prawnego do dalszego korzystania z nieruchomości było możliwe wyłącznie w drodze umownego nabycia albo zasiedzenia służebności przesyłu.

Abstract:
The article deals with the technology of joint application of geographical information systems (GIS) MapInfo Professional and CREDO Transform for the purpose of establishing the boundaries of the easement on the land without cadastral works and without its registration in Rosreestr. According to the results of research in the field of GIS and effective regulation of land and property relations, in terms of the establishment of easement is necessary: 1) implement the use of GIS MapInfo Professional and CREDO Transform in the administrations of municipalities and public institutions competent in the provision and registration of land; 2) to Improve the skills of public sector employees, including civil servants, competent in matters of registration and provision of land plots in terms of the use of MapInfo Professional and CREDO Transform; 3) fix at the legislative level and to develop a technique of application of GIS regarding carrying out cadastral works without carrying out geodetic works on the district with the approval in the Ministry of justice of the Russian Federation and the Ministry of economic development of the Russian Federation.

The Management of a Joint Land PropertySummaryThe article is devoted to the concept of a joint land property, the origins of which go back to the enfranchisement performed on the Polish territory in the XIXth century, which consisted in granting the property right to the hitherto users. The problem of pieces of land which were used commonly by the village’s inhabitants was solved in this manner that some parts of it were the subject of a real easement and other parts were left in the inhabitants’ hands establishing so called a joint land property. The article presents the problems connected with the management of the joint land property. The postulates de lege ferenda have been also formulated. The author suggests the elimination of the partnerships, the establishment of which is obligatory, aimed at managing the joint land properties. In his opinion respective provisions of the Civil Code related to co-ownership should apply thereto.

Abstract:
The requirements of modern society for urban parks represent them as multifunctional territories. Global trends suggest that parks have a social essence and are focused on creating a healthy and aesthetic environment. But in Ukraine, parks are considered only as landscape and architectural complexes. Therefore, they are financed under urban planning programmes and at the expense of budget funds. Attracting funds from organisations in the field of landscaping requires greater integration of parks into the socio-economic system. At the same time, it is necessary to develop mechanisms for economic incentives for organisations to participate in the improvement of park areas. The purpose of this study is an economic analysis of modern financing of the green economy in Ukraine and the development of proposals for additional sources of financial support for parks. In this paper, using the analytical method, the accounting of the financial state of the green economy in the regions of Ukraine is carried out. Typical problems of modern financing, the main shortcomings of budget financing, and problems of commercial organisations in the field of urban greening are highlighted. Using the economic and mathematical modeling (index method), the analysis of changes in indicators of providing green spaces and, accordingly, indicators of their financial condition is carried out. The practical significance of the study lies in the development of recommendations on additional ways to finance park management based on the introduction of the practice of public-private partnerships, trust agreements, and easement. Requirements have been formed for legal entities that have the right to conclude such transactions. An economic mechanism for stimulating the establishment of publicprivate partnerships and concluding agreements in the field of landscaping is proposed

At the same time, in all cases, the function of determining ownership is of particular importance and it plays an important role in the formation of effective land and property relations in the urban economy and in other areas of activity. This article discusses the political and legal justification for the introduction of restrictions on the right of land ownership, including the establishment of easements, public easements, zones with special conditions for the seizure of territories, the seizure of lands for state and municipal needs.

In the United States, a significant conflict exists between overhead utility lines and inappropriately tall trees planted in or near line easements. A major goal of Virginia, U.S.’s Municipal Tree Restoration Project is the establishment of utility line arboreta in multiple state locations as a way to evaluate, showcase, and promote trees compatible with overhead utility lines. Three different utility line arboreta models have been developed that can be replicated anywhere internationally to deal with this important infrastructure conflict. A stepwise list of considerations and potential funding sources for developing utility line arboreta is provided, as well as a comparison of the advantages and disadvantages of the three described utility line arboreta models.

Abstract:
This work reveals the concept of technology in solving local issues in the provision of municipal services. On the basis of regulatory legal acts, as well as internal statistical data, an analysis of the effectiveness of the system of interdepartmental interaction between authorities was carried out, a cartographic plan of the territory was considered on the example of one of the settlements of the Kungur municipal district. Among other things, measures were proposed to improve the electronic system, digital processing of forest lands, the use of a coordination system for state and municipal employees, including compliance with the legislation deadlines.
