Full textThe French Revolution of 1789 is a political phenomenon focused on upsetting the order of priority in the exercise of public powers. The actors of the Revolution and their opponents alike were quick to understand that the destiny of society and that of the Revolution were closely linked to the radical transformation of private law. Resistance to legal individualism first came from defenders of traditional order, among those members referred to by their opponents as the “aristocratic party”, before such great figures of the Counter-Revolution as Louis de Bonald and Joseph de Maistre continued the ideological combat threw major writings. Under the Consulat, the French Civil Code of 1804 was at the heart of the issues raised by the movement against legal individualism. As a Code of “Transaction”, as Portalis put it, it acceded to many anti-individualistic aspirations, under the influence of the four members of the drafting committee. Yet the fact remains that the Code allowed for concessions to revolutionary legislation, which continued to fuel opposition to the Revolution. The Restoration of the monarchy made it possible to amplify the scope of the anti-individualistic movement, as there were a lot of discussions on private law, especially on the subject of the family. Paternal power, abrogation of divorce, inheritance and primogeniture were major concerns for the ultra-royalists party, who was also planning to make religion central to society again, in an attempt to “reconnect with the chain of times”. The ultra-royalist party, initially hostile to the Charter of 1814, skillfully used the parliamentary Chambers to promote a full reaction against the Revolution’s legal individualism

Full textThe process of individualisation is studied through the reports of 30000 named witnesses at criminal proceedings in lower Normandy (nine surveys between 1660 and 1850). The study of the social backgrounds of witnesses shows that as early as the 17th century professional denominations had replaced lineage - i. E the name of the father. In the 18th century these denominations led to changes that implied higher social status. The disappearance of lineage as a means of social differentiation and its replacement by work status was preliminary to the process of individualisation. The study of the system of first names reveals the popularity of some name combinations which until 1760 made it possible to the both diverse and integrated into the neighbouring groups. After 1760 the search for originality became more radical with the widerspread use of rare first names, thus showing a truly individualistic ethic. These changes of an ideological nature point to a transformation in the way in which people envisaged the world around them

Full textThe problematics of this thesis could be summarized as from whatever is at stake. It attempts to define the historical moment where the whole corpus of social problems (the social bound as a source of the concept of community) shows itself as an question and where the question finds its answers in an (social) science and a religion. This research which has particularly studied the works of l. De bonald, de j. De maistre et de a. Comte gives an analysis of the emergence of sociology during the first half of the nineteenth century in france and shows how the corpus of social problems is an original way to deal with the problem of skepticism rised by the idea of democracy. The thesis also sketches the common course which with be taken by sociology over against what it considers to be two great figures of the modern confusion: "communism utopia" and "liberalism". It is within the framework of this context that sociology delivered the main shapes of solidarity and prepared, with e. Littre, to find an original application to democracy : the republic
