Full textThe states of the Eastern Partnership (Ukraine, Moldova, Belarus, Georgia, Armenia, Azerbaijan) and the separatist territories therein (Transnistria, Republic of Donbas, Crimea, Abkhazia, South Ossetia, Nagorno-Karabakh) have to determine their membership in a geopolitical entity to ensure their prosperity and safety. Due to the difficulties to survive as non-aligned countries and pressures fromBrussels and Moscow, all of them either have to join the European Union, the Eurasian (Economic) Union or to establish an exclusivepartnership with China in the upcoming years.Pressure from the EU and Russia is based on the desire of the EU to emerge as a global geopolitical power, particularly pushed by theUnited States to counterbalance the influence of Russia, and the will of the Kremlin to retain its influence in what is presented in theRussian media as the “legitimate sphere of influence”, even more than 25 years after the fall of the Soviet Union.The PhD dissertation analyzes the political divergences between EU member states, with the “normalizing approach” of WesternEuropean countries that seek a compromise with Russia, and those from Eastern Europe currently trying to use the European institutionsas a means to become regional powers.The Eastern Partnership launched by Poland and Sweden in 2008 embodies these two, sometimes contradictory tendencies through theimplementation of EU’s strategies of influence - the EU’s soft power - in post-Soviet space. Nonetheless, those strategies are oftenundermined by members of the EaP, which abundantly divert funds from the EU, because of the corruption of local institutions. At thesame time, Russia is also trying to regain its influence, sometimes even by using military means - the so called Russian hard power - asshown by the annexation of the Crimea and the establishment of peacekeeping missions in South Caucasus.While the European Union hardly exerts its influence in a post-2008 economic crisis context, Russia seems to have developed new waysto weaken its opponents. Hybrid warfare, weaponizing of refugees, pushed by massive bombings in Syria, and the establishment of theEurasian Economic Union are under the most efficient ways to weaken the EU and NATO so far

Full textThe objective of this dissertation is to study the Iranian factor in the context of the US-Turkish relationship. Since the beginnings of the 1990s, coupled with regional and international developments, Iran began to play an important role at the center of US-Turkish relations. Since then, both US policies and military interventions within the Middle East paved the way for Iran to arise as a challengeable actor within the region. The study aims to address how American and Turkish policymakers have responded to issues in the region with regard to Iran. A central focus of the dissertation is Iran’s nuclear question and Iran’s increasing power, which were simultaneously of particular concern to Washington, Ankara, and Tehran. Therefore, this dissertation demonstrates how these three actors handled the nuclear issue within the framework of their concerns/interests and political legitimacy and credibility. The fact that the Iranian regime has sought to increase its sphere of influence throughout the region has led the two allies to adopt common strategies from time to time. In fact, the Iranian factor has triggered important debates and developments between Washington and Ankara, in direct proportion to the positions of Turkey and Iran on different sides, particularly with the onset of the Arab Spring and Washington’s changing approach to Iran

Full textA large number of chemical representations has been proposed to model the chemical bond, but in particular Lewis structures are widely used by the experimenters community. The theoretical methods on developing the clear chemical Lewis structures are mainly used for the description of the ground states. Moreover, the majority of theoretical chemists uses molecular orbitals to describe the excited states, and thus lacks clarity. The excited states are difficult to predict, it is appropriate to use simple language to reach a common understanding of these states. We propose in this thesis two methods to access the excited states described on easily readable structures. First, a projection method developing an excited state in clear chemical structure type VB. This method is fast because it does not VB Hamiltonian diagonalizes and calculates a trust factor for a safeguard to judge the description of the excited state. Then an iterative method using a Super-CI Hamiltonian to optimize VB orbitals to an excited state. This method coupled with the projection method opens a way to a simple understanding of the excited states

Full textA growing number of newsrooms around the world have established fact-checking headings or rubrics. They are dedicated to assess the veracity of claims, especially by politicians. This practice revisits an older fact-checking practice, born in the United States in the 1920’s and based on an exhaustive and systematic checking of magazines’ contents before publishing. The ‘modern’ version of fact-checking embodies both the willingness of online newsrooms to restore verified contents —despite the structural and economic crisis of the press— and their ability to capitalize on digital tools which enhance access to information. Through some thirty semi-structured interviews with French fact-checkers and the study of a sample of 300 articles and chronicles from seven media, this PhD thesis examines the extent to which fact-checking, as a journalistic genre, certainly valorizes a credible method, but also —and indirectly— reveals shortcomings in professional practices. Finally, it discusses how the promotion of more qualitative content, as well as media literacy, could place fact-checking at the heart of editorial strategies —the latter aiming at retrieving trust from the audience

Full textThe notion of substantial denial of justice is problematic because it assumes the recognition of the international responsibility of the State in its judicial national sovereign decisions and thus the review, by an international jurisdiction, of the discretionary application of internal law by national judicial authorities. Attached to the notion of denial of justice in customary law, and historically linked to a fairly large and controversial perception of the protection that is required from States to foreigners on their territories, the notion of substantial denial of justice must still assert its influence in international conventional law, not only in the field of international investment protection but also, and foremost, in the area of human rights protection, because the stakes in that field are particularly important and the questions they raise are more relevant. Besides the study of the customary notion and its assertion as a form of denial of justice, the main point of this study is to highlight the existence of a general and subjective right to reasonable judgment, of which the definition allows to point out the limits of the normative power that the implementation of a standard provides to an international judge when he is called upon to review the internal regularity of national judgments

Full textPublic liability evolves and a lot of systems of compensation cannot be filed in the usual classification of this field. To remedy this problem, the thesis suggests creating a new legal category: liability without act. This one contains systems of public liability within which the victim is exempt from proving an act imputable to the person responsible. Twenty very different systems are presently filed there. Their analysis makes understanding of historical evolution of liability without act possible. The creation of liability without act produces three types of consequences which must be considered. First, it plays a particular part in compensation for victims. Second, it affects present categories of public liability which are fault-based liability and liability without fault. Finally, it is the beginning of a reconstruction of the structure of public liability. In fact, this field can be presented thanks to the distinction fact-based liability / liability without act

Full textIn 1991, following the end of the Second Gulf War, a de facto state has been established in Iraqi Kurdistan. This transformation of a protest actor into a de facto state has been an unprecedented gain for the « Kurdish nationalist movement ». However, despite his historic importance, this gain has failed to overtake divisions within the « Kurdish nationalist movement ». This thesis attempts to identity the reasons why the divisions have not faded away. The assumption is that the reason why these divisions have not been overtaken is because Iraqi Kurdistan has pursued a state-building project similar to those of de facto states. To test this hypothesis, this research links de facto state’s literature, Iraqi Kurdistan behaviour and the divisions of the « Kurdish nationalist movement ». This thesis first demonstrate that this project has led Iraqi Kurdistan to establish other priorities that the « Kurdish nationalist movement » unity. It then shows that to realize this state-building project, Iraqi Kurdistan has used external strategies that have affected the rest of the movement.
